REBAR / IMPALEMENT PROTECTION

Steel reinforcing bars, or rebar, are a common hazard on construction sites. The thin steel bars can stick out from construction projects and

pose a hazard to workers who can cut or scratch themselves on the sharp ends. Workers that stumble or fall onto the exposed steel bars

can be pierced or impaled on them, resulting in serious internal injuries and death.

To protect workers from this hazard, CalOSHA requires that rebar and other projections on the worksite "be guarded to eliminate the hazard

of impalement." Guarding from rebar impalement hazards must be done when workers will be working around or at any height above

exposed rebar. This also includes work situations where rebar is below grade or in a basement.

Fall prevention methods such as guardrails and personal fall protection systems are the first level of protection for workers. These should be

used any time workers are exposed to potential falls of ten feet or greater; a fall from any height can seriously injure a worker.

The next level of impalement protection is to use protective guard systems to cover the protruding ends. Steel reinforced rebar caps provide

the strongest and best impalement protection for workers. Proper protective rebar caps should be at least 4” square or, if they are round,

they should have a 4.5 inch diameter.

Some rebar caps are too narrow or not steel-reinforced. If a worker falls on a standard plastic cap, the impact pressure can push the rebar

through the cap and impale the worker, or impale the worker cap and all. Standard mushroom rebar caps and/or covers are only appropriate

to prevent cuts, abrasions or other minor injuries when workers are working at grade with rebar and when there is no impalement hazard.

Long 2 x 4 wood caps or other manufactured troughs can be used to effectively protect exposed rebar. Protective rebar caps and troughs

must have passed a drop test of 250 pounds from 10 feet above to prove that they can protect against impalement. If you construct

protective wood troughs on the job site, they should be built according to a registered engineer’s drawings (keep the plans on site), or to the

Workers should be vigilant around exposed rebar ends. Fall prevention is the first defense and covered rebar ends are extra insurance

against impalement in case of a fall. With the focus on safety and protected rebar ends, this is one safety point workers will be glad to miss.

PROTECCIÓN CONTRA QUEDAR ATRAVESADO POR UNA VARILLA DE ACERO

Las varillas, o barras de acero de refuerzo, son un peligro común en los sitios de construcción. Estas barras delgadas de acero pueden

sobresalir de los proyectos de construcción y presentar un peligro a los trabajadores quienes pueden cortarse o rasguñarse en los bordes

filosos. Los trabajadores que se tropiecen o caigan sobre las varillas pueden quedar atravesados en ellas, resultando en heridas internas

graves o la muerte.

Para proteger a los trabajadores contra este peligro, Cal/OSHA requiere que las varillas y otros objetos que se proyecten en el sitio de

trabajo “estén resguardados para eliminar el peligro de que un trabajador quede atravesado”. Es necesario tener resguardos contra quedar

atravesado en las varillas siempre que los trabajadores estén trabajando cerca de varillas expuestas o a cualquier altura sobre ellas. Esto

también incluye situaciones de trabajo en las que las varillas están debajo del nivel del suelo o en un sótano.

Los métodos de prevención de caídas, tales como pasamanos y sistemas de protección personal contra caídas son el primer nivel de

protección para los trabajadores. Estos métodos deben usarse siempre que los trabajadores estén expuestos a un peligro de caída de diez

pies o más; una caída de cualquier altura puede lesionar gravemente a un trabajador.

El próximo nivel de protección contra quedar atravesado en una varilla es usar sistemas de resguardo para cubrir los extremos expuestos.

Hay tapas con refuerzo de acero para las varillas que proporcionan la mejor protección para los trabajadores. Una tapa de protección para

varillas de acero de refuerzo debe ser cuadrada, de al menos 4” por lado, o si es redonda, debe tener al menos 4.5” de diámetro.

Algunas tapas para varillas son demasiado angostas o no tienen refuerzo de acero. Si un trabajador se cae sobre una tapa plástica, la

presión del impacto puede hacer que la varilla sobresalga por la tapa y el trabajador quede atravesado; o que el trabajador quede

atravesado con todo y tapa. Las tapas estándar para varilla en forma de hongo y/o las cubiertas son sólo apropiadas para prevenir

cortaduras, rasguños u otras lesiones menores cuando los trabajadores están trabajando al mismo nivel de las varillas y cuando no exista

peligro de que queden atravesados.

Tapas largas de madera de 2 x 4 u otros protectores manufacturados pueden usarse para proteger eficazmente los extremos expuestos de

la varillas. Las tapas y protectores para las varillas deben haber pasado una prueba de caída de 250 libras de una altura de 10 pies para

garantizar que pueden proteger a los trabajadores. Si usted construye canaletas de madera para protección en el sitio de trabajo, éstas

Kalb’s Capitol Connection Q & A for ContractorsBy David Kalb & Shauna Krause, Capitol Services, Inc.

With more than 30 years assisting contractors you might think we have heard it all, but that’s not likely to happen. Our first question is a good example of why we never rest on our reputation but always look for changes in practice or interpretation of contractor’s regulation. Like France has a different word for everything, each state has it’s own rules for contracting…

Q: I’ve recently read an article at your cutredtape.com website which stated in part: “…According to the Board, the practice of paying “inducements” or what are often called, ‘finder’s fees’ is apparently prevalent in several industries…The Board’s En-forcement staff held a sting operation in Riverside in March and all 9 contractors (licensed and unli-censed) who showed up to bid clearly stated that referral fees would be paid once the “homeowner” signed a contract…”

I was interested in finding out more about this as I have couple friends who are interested in having me help them find leads for construction. They have licenses but I don’t know if the above applies, as I would only be handling the leads sort of like what a national Service company does. Any infor-mation or direction that I can take to find out more would really be appreciated.

A: We cannot tell you how this national “service”

company handles referrals or “leads”; however, our guess is that their business model has been reviewed by the CSLB and deemed to be proper (i.e. not involving “inducements”). That said, if you enter into a home improvement contract with a ho-meowner that involves kickbacks or inducements with other contractors, you might be subject to a fine. If you have not already done so, I would sug-gest checking out the CSLB web site link on this subject (http://www.cslb.ca.gov/Newsletter/2010-Fall/page3.htm).

You also want to be careful that you’re not operat-ing as a “home improvement salesperson” for these contractors. If “finding these leads” involves visiting a person’s home and or negotiating the work to be performed, this could trigger the HIS rules and require you to be registered with one or more of these licensed contractors. If you have any further questions, I would suggest contacting the CSLB and asking them for a second opinion. You’ll want to tell the Board exactly what you intend on doing to gather these leads and how you will be compensat-ed for locating them. Good luck in your endeavor.

Q: You helped me get my Nevada license about a year ago. I’m not sure if you remember but I had some difficulty with the application process specifi-cally because I was a new start-up company with lit-tle financial strength and as you know, Nevada has

very strict financial requirements. I was able to get the license with a minimal bid limit, but I have had a difficult first year financially. My problem is that the Nevada Contractors Board sent me a request to review my financial information again even though I’m not up for renewal until next year. Is this nor-mal? Will they pull my license if my financials aren’t as strong as they were a year ago when I originally applied?

A: You are not alone in having difficulty with the financial requirement in Nevada, we hear from contractors every day in the same predicament! Nevada requires that all residential contractors in which the qualifying party has been a qualifier for less than two years in Nevada provide financial in-formation on an annual basis. If your financial state-ment and bank forms do not support the bid limit you currently have, you have the option to lower your bid limit or possibly have a financial review hearing. The financial review hearing officer will give you some other options such as indemnifica-tion, or he/she may even just accept your informa-tion as it stands. Good luck!

Your plan should create a management struc-ture that will survive your departure and keep the business on sound financial footing while ensur¬ing adequate liquidity to fund your retire-ment or a buyout. Include a buy-sell agreement in the succession plan. It allows you to restrict transfers of ownership interests and can help minimize income and estate taxes.

Just do itWhile everyone talks about the need for a succes¬sion plan, too few actually follow through with developing one. Because the per-son (or people) who’ll eventually take over your construction business needs to be groomed into a leader, it’s critical that you start the process at least several years before you plan to retire, and ideally a decade or more in advance of that tar-get date.

ring ownership without creating harsh tax obli-gations. One option is a grantor retained annuity trust (GRAT), which will provide you with income for a term of years and then distribute the re-maining assets to your beneficiaries.

The transfer of assets into the GRAT is a taxable gift, but the annuity you receive reduces the val-ue of the gift. Interest rates also affect the value of the gift. The current high-gift-tax-exemption / low-interest-rate environment may make a GRAT especially attractive this year. But keep in mind that, if you die before the end of the annuity pe-riod, the trust assets will be included in your es-tate and the tax advantages will be negated.

Get your advisors involvedNo matter whom you choose as your successor, get your CPA, lawyer, insurance advisor and a family business consultant involved to help you assess your circumstances and create a workable succession plan.

Along with selecting a vehicle to transfer your as-sets, the plan should state to what extent you’ll stay involved with the company after you leave. If you stay too involved, you may inadvertently

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
