Foster is offering Roof Framing (CT 113), Mea-suring and Calculating (CT 118, trade math), and 2 new “green-collar” classes (Weatheriza-tion and Sustainability Audit).

Let me put in a word about the weatheriza-tion and auditing classes. It is becoming ob-vious that the first step toward energy and water efficiency is weatherization rather than alternative energy. We will need non-fossil-fuel energy in order to stop contributing to global warming and negative climate change, but the easiest and cheapest way to conserve energy (and water) is to tighten up our homes and businesses. The Weatherization class (CT 124) covers both diagnostic and remediation phases of using less energy and water. It cov-ers blower-door testing, infrared scanning, and duct-blasting and teaches about sealing the building shell, installing insulation and flashing properly, sealing HVAC ductwork, etc.

Now students, carpen-ters, contractors, realtors, and architects can continue to take “drop-in” classes in a variety of building topics, but can also now earn a City College Certificate (8 construction tech classes only) and an Associate of Science de-gree in Construction Technology (with some additional general ed. classes).

This Spring semester (beginning in late Janu-ary), the Construction Academy is offering 7 16-week classes in the construction field. Rodney Utt is teaching his yearly cabinet mak-ing course (CT 115), and Jim Cunningham is teaching Intro to Construction Trades (CT 111) and Contractors License Prep (CT 130). Patrick

New, Revised Laws Affect State Contracting PracticesLegislation Strengthens CSLB Consumer Protection Measures

Force (which includes CSLB) to aid in prose-cuting tax withholding and workers’ compen-sation insurance violations.

AB 2219 indefinitely extends the requirement that all C-39 Roofing contractors obtain work-ers’ compensation insurance coverage, even if they certify that they have no employees. The bill also extends, indefinitely, the require-ment that insurers conduct annual audits, and requires that these audits be conducted in person to verify the accuracy of the reported number of employees.

SB 691 adds CSLB to the list of agencies ap-proved to receive workers’ compensation in-surance information from EDD.

Regulations/PermitsAB 2114 enacts new construction permit re-quirements for swimming pools, spas, or pub-lic wading pools.

SB 1099 changes the effective date of regu-lations to four times annually, versus the cur-rent 30 days following Office of Administra-tive Law (OAL) approval, and requires OAL to provide a link on its website to all regulations filed with the Secretary of State.

SB 1520 makes minor changes to the state’s regulatory adoption processes.

CalRecycle’s Paint Stewardship Program is now in effect. These regulations outline the steps for recycling unused architectural paint.

Public Works ContractingAB 2440 makes changes impacting those con-tracting for public works projects with the Los Angeles County Metropolitan Transportation Authority.

SB 1370 requires the Department of Industrial Relations to post on its website prevailing wage requirements on public works projects.

SB 1549 changes public works contract bid-ding in the San Diego region.

Boards and LicenseesAB 1588 waives fees or continuing education requirements for a licensee whose license ex-pires while on active duty in the Armed Forces or California National Guard.

AB 1904 allows for the issuance of temporary professional licenses (including those issued by CSLB) to spouses of those serving in the

SACRAMENTO – The broadly used term “con-sultant” as it relates to building and construc-tion work becomes more clearly defined once Assembly Bill 2237 takes effect on January 1, 2013. The new law, sponsored by the Con-tractors State License Board (CSLB), states that anyone who provides or oversees bids for construction, arranges for subcontractor work and schedules, and/or has oversight for a project is, in fact, acting in the capacity of a contractor and must be state-licensed. In Cali-fornia, a state contractor license is required for any project that is more than $500 in com-bined labor and material costs.

“AB 2237 is a valuable consumer protection measure and will place project responsibility where it belongs,” said CSLB Registrar Steve Sands. “All too often, people who don’t have a state contractor license call themselves con-struction consultants and encourage prop-erty owners to take on a home improvement project as the owner-builder. The so-called consultant collects a fee and many times leaves the homeowners with all of the project responsibility and liability.”

Owner-builders that employ workers must be registered as an employer with the Employ-ment Development Department and must have protective measures in place for work-ers, including workers’ compensation insur-ance in the event of an onsite injury. The ho-meowner becomes responsible for all phases of a project and its integrity, including pulling project permits, requesting inspections, and making sure local and state building codes are met. The new law will clearly define when someone is a contractor and discourage un-scrupulous individuals from working under a fraudulently obtained owner-builder permit.

Another CSLB-sponsored bill strengthens enforcement authority over contractors who violate state contracting laws. AB 2554 amends Business and Professions Code sec-tions 7011.4 and 7106.5 to enable the CSLB Enforcement division and its representatives to issue notices to appear in court related to disciplinary actions against a license.

Several other laws affecting consumers, con-tractors, and the construction industry take effect January 1, 2013:

Workers’ Compensation InsuranceAB 1794 authorizes the Employment Devel-opment Department (EDD) to provide new employee information filed by employers with members of the Joint Enforcement Strike

military.

AB 2570 prohibits a licensee from including provisions in settlements of a civil dispute that prohibit the consumer from contacting, filing a complaint, or withdrawing a complaint with CSLB (or any other consumer protection program overseen by the Department of Con-sumer Affairs).

SB 1576 enables CSLB to take administra-tive action if a licensee files a false complaint against another licensee.

The California Air Resources Board issued a regulatory advisory regarding labeling re-quirements for off-road diesel-fueled con-struction vehicles.

The Occupational Safety and Health Stan-dards Board introduced regulations pertain-ing to safety orders for forklifts, excavators, and woodworking equipment and machines, but will not proceed with those related to lad-derway openings.

Additional Construction LawsAB 1750 specifies that a C-27 Landscaping contractor can enter into a prime contract for a rainwater capture project.

AB 2339 requires state regulators and those involved in the heat pump and geothermal heating and cooling industries to evaluate policies and develop infrastructure for wider use of these technologies.

SB 1092 requires brokers of construction trucking services to demonstrate evidence annually of a valid surety bond.

The Contractors State License Board operates under the umbrella of the California Depart-ment of Consumer Affairs. More information and publications about hiring contractors are available on the CSLB website or by calling 800-321-CSLB (2752). You can also sign up for CSLB email alerts. CSLB licenses and regulates Cali-fornia’s 300,000 contractors, and is regarded as one of the leading consumer protection agen-cies in the United States. In fiscal year 2010-11, CSLB helped recover nearly $45 million in or-dered restitution for consumers.

Important Information Regarding Holiday Closure of City Offices

Holiday Closure of City Offices Most City ADMINISTRATIVE OFFICES are closed from Friday, December 21, 2012 through Tuesday, January 1, 2013. Offices will re-open on Wednesday, January 2, 2013. This includes the Public Works and Community Development Departments located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these closure dates, and staff will not be available to accept or review plans for public works or building permits.

Zoning Information Reports (ZIR's) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during the holiday closure. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Wednesday, December 12th, prior to the holiday closure. We will make every effort to complete additional ZIR applications received during the week of December 17th, but cannot commit to this at this time, as we don't yet know the extent of our ZIR workload for that period. While we cannot accept ZIR applications in person during the holiday closure, agents may continue to mail or fax them in and we will begin working on those applications when we return on Wednesday, January 2nd, 2013. If you have any questions regarding the holiday closure and how this relates to ZIRs, please call the Planning Counter at 564-5578.

Public Works and Building & Safety Plan Check and Inspections While there will not be counter staff available to accept or review plans during the closure, the Public Works Department and Building & Safety Division will be providing inspection services on Wednesday, December 26th, Thursday, December 27th and Friday, December 28th during the holiday closure. For building permit inspections please use the normal inspection request instructions as outlined in the Inspection Request Handout provided in your building permit packet. Public Works and Building and Safety inspection staff will NOT be available for inspections on Monday, December 24th, Tuesday, December 25th, Monday, December 31st 2012 or Tuesday, January 1st, 2013 but will resume normal business hours Wednesday, January 2, 2013.

Fire Prevention Fire Prevention Staff will be on duty the following days: Monday, December 24th, Wednesday, December 26th, Thursday, December 27th, Friday, December 28th, and Monday, December 31st. GROUND FAULT CIRCUIT INTERRUPTERS

Ground Fault Circuit Interrupters (GFCI) are devices designed to prevent accidental electric shock and electrocution by preventing ground

faults. They also protect against electrical fires, tool/appliance overheating, and destruction of wire insulation. GFCI’s are required by

building code in “wet” locations like kitchens and bathrooms and by CalOSHA at construction sites.

The most common electric shock hazard, ground faults can cause severe electrical shock or electrocution. In normal conditions, electricity

runs in a closed circuit; electricity flows out on the "hot" wire and returns on the "neutral" wire, completing the circuit. A ground fault occurs

when the electrical current does not complete its circuit and unintentionally flows to the ground. Ground faults can cause fires and are

dangerous when they flow through a person to the ground.

Ground fault shocks can happen when a person comes into contact with the "hot" side of an electrical circuit with wet hands or while

standing in water or on a wet floor. GFCI’s protect against ground faults by measuring the current on the electrical circuit; current in the hot

and neutral wires should be equal or close to equal. If a ground fault occurs, the GFCI outlet or GFCI circuit breaker senses the change in

current and trips, breaking the circuit and stopping the flow of electricity. The GFCI does not protect workers from line contact hazards (i.e.

a person holding two "hot" wires, a hot and a neutral wire in each hand, or contacting an overhead power line).

Different GFCI types are available for a variety of situations. GFCI circuit breakers snap into the main electrical panel and provide ground

fault protection on all outlets on that branch circuit. GFCI wall receptacle outlets provide ground fault protection at that outlet and

downstream. Portable GFCI units such as receptacles, extension cords, and cord-connected devices contain GFCI circuitry. Portable GFCI

devices should only be used on a temporary basis and should be tested prior to every use.

GFCI’s have test and reset buttons for a reason; they must be tested regularly. For general use, GFCI’s should be tested and inspected

monthly. For construction site GFCI’s, a written inspection plan should be in place and a competent person should conduct per iodic tests

and visual inspections before each day’s use. Records of the testing must be kept.

GFCI Inspections should look for external defects such as deformed or missing pins, insulation damage, and indications of internal damage.

Damaged or defective equipment should not be used until repaired. Additional inspections are required if an outlet is returned to service

following repairs and after any incident which can be reasonably suspected to have caused damage (for example, when a cord set is run

over).

INTERRUPTORES CON DETECCIÓN DE FALLA A TIERRA

Los interruptores con detección de falla a tierra (GFCI, por sus siglas en inglés de Ground Fault Circuit Interrupters) son dispositivos diseñados para evitar choques eléctricos accidentales o electrocución evitando el paso de la corriente a tierra. También protegen contra incendios ocasionados por fallas eléctricas, sobrecalentamiento de herramientas o electrodomésticos y daños al aislamiento de los cables. Los códigos de la construcción exigen el uso de los GFCI en lugares “húmedos”, tales como cocinas y baños, y Cal/OSHA los exige en los sitios de construcción.

La causa más común de riesgo de choque eléctrico son las fallas a tierra, y pueden causar choques eléctricos graves o electrocución. Bajo condiciones normales, la electricidad pasa por un circuito cerrado, pasando por el conductor “vivo” y regresando por el “neutro”,completando así el circuito. Una falla a tierra ocurre cuando la corriente eléctrica no completa su circuito, sino que pasa a tierra en un lugar inesperado. Las fallas a tierra pueden ocasionar incendios y son peligrosas cuando pasan a través de una persona en su trayecto a tierra.

Los choques por falla a tierra pueden ocurrir cuando una persona entra en contacto con un conductor “vivo” teniendo las manos mojadas o estando parada en agua o sobre un piso mojado. Los GFCI protegen contra fallas a tierra midiendo la corriente en el circuito eléctrico. La corriente en el conductor “vivo” y en el “neutro”deben ser iguales o casi iguales. Can an old CA contractor’s license be brought back to life again when it ‘died’ a decade ago? The ‘mettle’ of a framing contractor is tested and we finish by helping readers learn what it takes to pull together to form a ‘joint venture’ effort…

Q: My husband had a CA license and failed to renew it on time. It expired back in 2000. Now he wants to renew it. He currently has an Arizona “K-11” (Electrical) license that he has held for approx 12yrs. How does he go about this in the quickest way, as we are looking to move to CA early next year?

A: Thank you for contacting Capitol Services Inc. Because his CA license has been expired for over 5 years he can no longer ‘renew’ it. He can however re-apply for the license and request that the number be re-issued. As you may know, there is a reciprocal agreement between CA and AZ so he can request to waive the trade exam based on the fact that he has been licensed for the past five years in Arizona. He’ll still be required to take the law test again. The process to obtain the license will likely take about 8 weeks, so if you be-gin soon, he will have the license before you move. Let us know if you’d like help with the process.

Q: I need assistance with determining what classification my company will need to meet the requirements to do metal stud framing in the State of California. I don’t do Structural Steel, just the metal stud framing. I also han-dle the drywall and insulation to finish off the wall, so I’m not sure if I need separate classi-fications to do that, or if it would be covered under the framing. Thank you in advance.

A: In order to do the metal stud framing you’ll need a “C-5” (Framing and Rough Carpentry) classification. Even though drywall and insu-lation are part of your projects, the CSLB will require you to have the “C-2” (Insulation) and “C-9” (Drywall) classifications to perform this work because the “C-5” doesn’t cover these trades. According to the CSLB, the “B” classi-fication would cover you for all three trades; however, in our experience we have found it is difficult to qualify for the exam without electrical, concrete, roofing and/or plumbing experience.

Q: I am inquiring about the fees and re-quirements to set up a Joint Venture with another contractor. I want to bid a project that requires both “C-20”(HVAC) and “C10-”(Electrical) licenses. My firm only holds the HVAC and would like to partner with another

contractor whom holds both. Please let me know what all is required, particularly the ap-plication process.

A: A Joint Venture (JV) consists of two or more entities, each of which holds a valid CA con-tractor’s license in good standing. Since you hold the “C-20”, you could locate a company with the “C-10” or, as indicated, “another con-tractor whom holds both”. A JV application signed by all Qualifiers and an Officer of re-cord for each entity is required. You’ll also need to post a $12,500 Contractor’s Bond, which is in addition to the bond you pres-ently have on your corporate license. Further, a new Worker’s Comp policy (or certified Ex-emption) is necessary. The State fee will run $555.00.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
