Here are the facts of the case: The plaintiff, Ted Jacob Engineering Group (TJEG), entered into a contract with the defendant, Ratcliff Architects, that contained an agree-to-agree clause. The scope of the work increased substantially and TJEG performed the work as requested, present-ing Ratcliff with timely claims for additional fees. Ultimately, Ratcliff terminated its contracts with the county and TJEG, the parties never having agreed on adjusted fees. The plaintiff sued the architect to obtain a judicial determination of its claims.

TJEG’s total claim was nearly $1.2 million. The jury awarded TJEG $1.1 million, and the trial

court awarded some $1.3 million in prejudgment interest and more than $2.2 million in attorneys’ fees.

Important Information Regarding Holiday Closure of City Offices

Holiday Closure of City Offices Most City ADMINISTRATIVE OFFICES are closed from Friday, December 21, 2012 through Tuesday, January 1, 2013. Offices will re-open on Wednesday, January 2, 2013. This includes the Public Works and Community Development Departments located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these closure dates, and staff will not be available to accept or review plans for public works or building permits.

Zoning Information Reports (ZIR's) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during the holiday closure. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Wednesday, December 12th, prior to the holiday closure. We will make every effort to complete additional ZIR applications received during the week of December 17th, but cannot commit to this at this time, as we don't yet know the extent of our ZIR workload for that period. While we cannot accept ZIR applications in person during the holiday closure, agents may continue to mail or fax them in and we will begin working on those applications when we return on Wednesday, January 2nd, 2013. If you have any questions regarding the holiday closure and how this relates to ZIRs, please call the Planning Counter at 564-5578.

Public Works and Building & Safety Plan Check and Inspections While there will not be counter staff available to accept or review plans during the closure, the Public Works Department and Building & Safety Division will be providing inspection services on Wednesday, December 26th, Thursday, December 27th and Friday, December 28th during the holiday closure. For building permit inspections please use the normal inspection request instructions as outlined in the Inspection Request Handout provided in your building permit packet. Public Works and Building and Safety inspection staff will NOT be available for inspections on Monday, December 24th, Tuesday, December 25th, Monday, December 31st 2012 or Tuesday, January 1st, 2013 but will resume normal business hours Wednesday, January 2, 2013.

Fire Prevention Fire Prevention Staff will be on duty the following days: Monday, December 24th, Wednesday, December 26th, Thursday, December 27th, Friday, December 28th, and Monday, December 31st. Please contact them at 564-5702. Issues requiring immediate assistance from the Fire Department please contact the Combined Communications Center at 897-2410.

COLD WATER TREATMENT OF THERMAL BURNS

When you burn yourself not all the damage happens at once. Because the body holds heat, the burning process can last for several

minutes on up to several days or even longer in the case of serious burns. Immediate application of cold water or a cold compress is a

treatment that has been found to decrease the degree and depth of a burn.

Speed is the most important single factor in burn treatment. The more quickly you cool down the burn the better your chances are of

reducing its effects. Use water from a drinking fountain, sink, hose, shower or whatever water source is closest. Hold the burn under cool

running water, submerge the burn in a sink full of water or place a water-soaked cloth over the burn. Add more cool water to the cloth as it

absorbs the heat from the burn.

It’s also important for you to continue the water treatment for a long enough period of time. This may take 30 minutes or 3 days, depending

on the burn. The first appearance of the burn can be misleading. Sometimes it doesn’t look as bad as it really is until the third or fourth day.

What the burn looks like then depends on what you did right after the burn and how quickly you did it. If the burn was cooled down

immediately there might be almost no pain or swelling and very little change in the skin’s appearance.

If the pain is still there when the injured area returns to normal body temperature, it means further cold water treatment is necessary. As

long as the burned area feels warmer to the touch than the surrounding skin area, treatment should be continued.

Most of us have experienced at least one painful burn in our lives, and chances are that we will experience it again. Remembering this

simple, effective first aid treatment is an easy way to relieve the discomfort of a burn and prevent lasting burn damage.

TRATAMIENTO DE AGUA FRÍA PARA QUEMADURAS POR CALOR

Cuando uno se quema no se sufre todo el daño de inmediato. Debido a que el cuerpo retiene el calor, el efecto de una quemadura puede

tardar en notarse desde varios minutos hasta varios días, o hasta más tiempo en el caso de las quemaduras graves. La aplicación

inmediata de agua fría o de una compresa fría es un tratamiento que se ha descubierto que reduce el grado y la profundidad de una

quemadura.

Actuar con rapidez es el factor individual más importante en el tratamiento de las quemaduras. Cuando más rápido usted enfríe la

quemadura, mayores son las probabilidades de reducir sus efectos. Use agua de un bebedero, fregadero, manguera, regadera o la fuente

de agua más cercana. Ponga la quemadura debajo del agua fría del grifo, sumérjala en un fregadero lleno de agua o póngale encima una

tela empapada de agua. Agregue más agua fría a la tela a medida que ésta absorba el calor de la quemadura.

También es importante que usted siga con el tratamiento de agua durante un período que sea lo suficientemente largo, que puede variar

de 30 minutos a 3 días, según el tipo de quemadura. La primera apariencia de la quemadura puede ser engañosa. A veces no se ve tan

mal como realmente es sino hasta el tercer o cuarto día. La manera en que se vea entonces la quemadura dependerá de lo que usted haya

hecho inmediatamente después de sufrirla y la rapidez con que lo haya hecho. Si se enfrió inmediatamente la quemadura, quizá no haya

casi dolor ni inflamación y haya un cambio mínimo en la apariencia de la piel.

Si el dolor continúa cuando el área lesionada vuelva a la temperatura corporal normal, eso significa que se necesita un tratamiento

adicional con agua fría. Se debe seguir el tratamiento todo el tiempo que el área quemada se sienta más caliente al tacto que la piel a su

alrededor.

Whether in Nevada or California a solar contrac-tor can’t light up your life, without the proper license, but which one is right for the job? We offer clarification on the rules for selling home improvements in California. Another contrac-tor gives us the ‘key’ to a slim chance on ‘locking down’ an exam waiver…

Q: We’re solar contractors in NV and have a ques-tion on the best classification to apply for in CA. We called the Contractors Board in Sacramento and they told us your state has a “C-46” (Solar) license. We called back a second time and the new person who answered said we could get the “C-46” or an electrical license “C-10.” We found you on the Internet and you look to have a lot of experience in these issues. In your opinion, which license would be best?

A: In order to shed some light on this topic, I am sending you an “Industry Bulletin” from 2010. The CSLB published this a few years ago to re-spond to questions regarding which classifica-tions are authorized to perform solar projects. This “Fact Sheet” lists 7 different classifications that can properly perform some or all aspects of solar energy projects.

The “C-46” is a broad classification, which allows contractors to “install, modify, maintain, and re-pair thermal and photovoltaic solar systems”. “C-10” contractors are “authorized to perform any solar projects which generate, transmit, transform or utilize electrical energy in any form

for any purpose”. “A” (General Engineering) and “B” (General Building) contractors are also autho-rized to install solar energy systems.

The real question is what classification you can qualify for. In addition, depending on the license classification you hold in NV, you may be eligible to secure a waiver of the trade test. I hope this information helps. Call us if you have any further questions.

Q: I have a question and my business partner re-ferred me to your company. What is California’s rule for home improvement salesman? Some places I’ve worked treat them as independent contractors and others treat them as employ-ees.

A: In CA, a Home Improvement Salesperson (HIS) is a person employed by a licensed contrac-tor to solicit, sell, negotiate, or execute home improvement contracts. A Home Improvement Salesperson can work for a number of contrac-tors and sell a variety of goods and services, but must be registered with the CSLB separately for each contractor for which he/she is employed.

Q: I got a solicitation in the mail (not from your company) stating that the CSLB allows individu-als to request a waiver of the exams if they have been an Officer of the corporation or a “key em-ployee” for at least five years. Do you know if this is true and what is a “key” employee?

A: That is true under certain circumstances. The CSLB only allows this waiver request for individ-uals seeking to replace the Qualifying individual on an existing license, not for the purposes of obtaining a new license. According to B&P code 7065.1(c), in order to qualify for this waiver the following conditions must exist:

For five of the seven years immediately 1. preceding the application for replacing the Qualifier, the corporation or LLC must have continually employed the new Qualifying individual in a supervisory capacity in the same classification(s) being applied for.For five of seven years immediately preced-2. ing the application, the corporation or LLC has held an active license in good standing in the same classification(s) being applied for.The corporation or LLC has not requested 3. a waiver under this subdivision within the past five years.

As far as what it meant by “key employee”, I be-lieve the company that you received the solicita-tion from is referring to item 1.

the event the parties can’t agree on a price for additional services, they leave little choice but to seek a judicial determination of the value of the work.

If you’re subject to an agree-to-agree clause, protect yourself by thoroughly documenting any changes and communicating this informa-tion to the owner or GC early and often. Also, to avoid the expense and time commitment of litigation, consider discontinuing performance until an agreement on price can be reached.

Options availableA caveat: The TJEG case involved California law. If you find yourself in this situation, it’s a good idea to consult an attorney in your jurisdiction to dis-cuss the options available under applicable law.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
