There is a specific IIPP required for the construction industry, the Con- struction IIPP. What should you expect to see in an IIPP? It is a written plan that has the following elements: Management commitment/assignment of responsibilities Safety communications system with em- ployees System for assuring employee compliance with safe work practices Scheduled inspections/evaluation system Accident investigation Procedures for correcting unsafe/unhealthy conditions Safety and health training and instruction Recordkeeping and documentation The IIPP includes procedures that your employer puts into practice. Part of the employer’s respon- sibility is to control potential workplace hazards and correct hazardous conditions or practices as they occur or are recognized. The program includes a system for your employer to com- municate with you on matters relating to occu- pational safety and health, including provisions designed to encourage employees to inform the employer of hazards at the worksite without fear of reprisal. The safety communications system, one of the elements of the IIPP, should be in a form readily understandable by all affected employees. The safety communication system may include: meetings training programs postings written communications a system for anonymous notification by employees about hazards labor/management safety and health com- mittees other means of ensuring communication with employees. In addition to the above, the Construction IIPP requires that supervisors conduct “toolbox” or “tailgate” safety meetings with their crews at least every ten working days to emphasize safety. Supervisors also need to hold periodic meetings to discuss safety problems and accidents that have occurred. In California, every employer is required by law to provide a safe and healthful workplace for his/ her employees. If your employer has ten or more employees, you should expect them to have a written IIPP in place. You should never undertake a job that appears to be unsafe, and you should not perform a job until you have received instruc- tions on how to do it properly and safely. The goal of the IIPP is to ensure that worker safety and health are not compromised. Injury and Illness Prevention ProgramIn California, every employer is required by law to provide a safe and healthful workplace to his/her employees. In accordance with the California Code of Regulations, your employer needs to have an effective Injury and Illness Prevention Program (IIPP) in writing. Urgent RequestSBCA & AIA Members Continue Dialog with the

City of Santa Barbara Community Development Dept.By Peter Novak

In an effort to improve the planning and permitting process we are having ongoing meetings with staff at the City of Santa Barbara. Community Development Department. The Community Development Department is responsible for planning & zoning, building and safety, and hous-ing and redevelopment for the City of Santa Barbara.

We need examples/stories from our membership of experiences in the City plan check/permit-ting process that can help illustrate the problems and frustrations that we have experienced. The City is open to dialog and review of the process in order to better serve the community, and is adopting procedural improvements to that end. Please send plan check submittals that illustrate issuescosting time and money to rectify, or examples that tell the story to the SBCA at [email protected]. Along with AIASB, we are continuing our dialog with the City Building Department to collec-tively find ways to improve the plan check/permit process. We are talking to them about:

Creating a more interactive communication through the city’s departmental routing pro-•cedure, allowing a more timely resolution to plan check corrections and requests for more information;Expediting the entire process through the use of email;•Offering a checklist for plan check applicants;•Creating a tiered permit system with a simpler process for small projects;•Offering a pre-application meeting with the Planning Department; assign a designated •planner for each project application;Setting up a digital drawing review process; •

SITE SAFETY INSPECTIONS

Regular site safety inspections using site-specific checklists keep the workplace safe by identifying and correcting hazards in the workplace. Inspection frequency depends on the hazard level of the workplace; sites may need checks at every shift, daily, quarterly or annually. Document the inspection observations, identified hazards, and the corrective actions taken.

Focus on the administrative records and postings at the workplace. MSDS binders, safety programs, procedures, trainings, and records need to be up to date and accurate. Critical procedures (e.g. spill cleanup, evacuation) should be posted in prominent locations. Required employer postings (e.g. Cal OSHA, Workers Compensation, and labor law) must be “likely to be seen” by employees.

Floor surfaces should be clean and free of slip hazards such as dirt, granular substances, equipment parts, water, or oil. Wet surfaces should be covered with non-slip materials. Holes in the floor, sidewalk, carpet, or other walking surface should be repaired properly, covered, or made safe.

For good housekeeping, items and debris should be kept up off floors and out of walkways. Stored items need to be stacked properly on shelving units firmly attached to the wall; heavier items should be on the bottom, lighter items stored on top shelves. Items stored on tops shelves require 18” clearance from fire sprinkler systems. Unsecured stacks on floors should not exceed 72” in height. Ensure areas under desks and tables are accessible to allow proper ergonomic seating and access in case of an earthquake.

Electric panels should have 36” clearance in front. Power cords to equipment should be intact; repair or replace frayed cords . Check that extension cords do not cross walkways and are used only temporarily. Additional power outlets should be installed if extension cords are necessary on a permanent basis or there are “daisy chained” power strips. Ground Fault Circuit Interrupter (GFCI) outlets should be installed around wet areas.

Aisles and walkways need 36” clearance in an office and 44” in a shipping area. Clearly mark emergency exits so they can be seen from any point in the facility. Keep exits clear of stacked material and other impediments. Label doors that are not exits to avoid confusion. Fire doors should not be propped open.

Ensure equipment and tools are in good working order; place defective equipment out of service. Check that equipment guards and protective coverings are in place. Store chemicals within their compatible classes; flammables should be kept in a secured flammable cabinet. Personal protective equipment should be clean and accessible with available areas and materials for decontamination and storage.

Test fire alarms and sprinkler systems annually. Fire extinguishers should be checked for charge monthly and recharged annually. Inspect first aid kits periodically and replenish or replace supplies when needed.

Site safety inspections keep the workplace safe; a hazard left uncorrected can lead to accidents and injuries.

INSPECCIONES DE SEGURIDAD EN EL SITIO DE TRABAJO

Las inspecciones de seguridad periódicas usando listas de verificación específicas para cada sitio de trabajo ayudan a mantener seguro el sitio al identificar y corregir peligros. La frecuencia de las inspecciones depende del nivel de peligrosidad del sitio de trabajo; algunos sitios pueden necesitar inspección cada turno, cada día, trimestralmente o anualmente. Kalb’s Q & A for ContractorsBy David Kalb, Capitol Services, Inc.

While one of my missions in life is to assist con-tractors, I often hear from attorneys and others with questions about construction industry is-sues. First, I field a question and ‘kickback’ new guidance on getting paid for ‘referrals.’ We also catch up on the latest CSLB discussions…

I have responded to questions about Referral Fees in the past and have read related articles written by attorneys and the CSLB. These ques-tions have generally originated with contractors; however, realtors or others who regularly deal with the construction industry have also been curious about what is acceptable.

While B&P Code Section 7157(d) clearly states that it is not legal for one contractor to pay any type of inducement (i.e. kickback) to another contractor, the law apparently does not include non-contractors. The CSLB recently clarified this in their newsletter and I wanted to make sure my readers had the most accurate and up-to-date information.

At a recent CSLB Enforcement Committee meet-ing in Sacramento, one of the agenda items dealt with this very issue. According to the Board, the practice of paying “inducements” or what are often called, ‘finder’s fees’ is apparently prevalent in several industries including water damage/restoration, plumbing, pool builders, and re-modelers. The Board’s Enforcement staff held a sting operation in Riverside in March and

all 9 contractors (licensed and unlicensed) who showed up to bid clearly stated that referral fees would be paid once the “homeowner” signed a contract. These offers of “inducements” cost these contractors up to $2000 in fines. Call it what you will, but if you are a contractor beware any offer to ‘kickback’, pay for referrals, provide finder fees or ‘inducements’ for a contract be-cause they are all illegal in California.

Other topics discussed at the August 23rd CSLB Committee meetings included: Enforcement partnerships with 2 dozen cities and counties as well as a number of other state agencies; licens-ing requirements for solar and other alternative energy projects; and the latest on licensing for a Limited Liability Company (LLC).

Q: This really is not as much a question as it is a statement. I regularly read your column in my Exchange newsletter and find your information very helpful. I’ve learned a great deal from your answers and appreciate your providing this ser-vice. The construction industry can use all the help it can get.

I know you often write about the CSLB doing stings and their Enforcement efforts but it’s not enough. There are too many unlicensed guys running around taking jobs from the legitimate contractor. What can you suggest that we can do to help the Board and help ourselves at the same time?

A: Thank you very much for the kind words and reaching out to help combat unlicensed activi-ties. In our present economy, it’s tough enough staying busy without having to battle unlicensed individuals who are undercutting the legitimate contractor. The CSLB is doing what they can with their present resources; however for one thing they have 29 vacant Enforcement positions that are subject to the current State hiring freeze.

In January of this year, the Board’s Statewide In-vestigative Fraud Team (SWIFT) launched a new task force to battle the underground economy. There are a number of areas where contractors can help themselves and the entire construction industry including identifying unlicensed indi-viduals and reporting them to one of the SWIFT representatives throughout the state.

Because this is such a huge issue, I am going to devote an entire upcoming column to what we, as an industry, can do to win the battle against unlicensed activities. Please send your thoughts on this issue to share and be on the lookout for this important information.
