Important Information Regarding Holiday Closure of City Offices

Holiday Closure of City Offices Most City ADMINISTRATIVE OFFICES are closed from Friday, December 21, 2012 through Tuesday, January 1, 2013. Offices will re-open on Wednesday, January 2, 2013. This includes the Public Works and Community Development Departments located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these closure dates, and staff will not be available to accept or review plans for public works or building permits.

Zoning Information Reports (ZIR's) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during the holiday closure. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Wednesday, December 12th, prior to the holiday closure. We will make every effort to complete additional ZIR applications received during the week of December 17th, but cannot commit to this at this time, as we don't yet know the extent of our ZIR workload for that period. While we cannot accept ZIR applications in person during the holiday closure, agents may continue to mail or fax them in and we will begin working on those applications when we return on Wednesday, January 2nd, 2013. If you have any questions regarding the holiday closure and how this relates to ZIRs, please call the Planning Counter at 564-5578.

Public Works and Building & Safety Plan Check and Inspections While there will not be counter staff available to accept or review plans during the closure, the Public Works Department and Building & Safety Division will be providing inspection services on Wednesday, December 26th, Thursday, December 27th and Friday, December 28th during the holiday closure. For building permit inspections please use the normal inspection request instructions as outlined in the Inspection Request Handout provided in your building permit packet. Public Works and Building and Safety inspection staff will NOT be available for inspections on Monday, December 24th, Tuesday, December 25th, Monday, December 31st 2012 or Tuesday, January 1st, 2013 but will resume normal business hours Wednesday, January 2, 2013.

Fire Prevention Fire Prevention Staff will be on duty the following days: Monday, December 24th, Wednesday, December 26th, Thursday, December 27th, Friday, December 28th, and Monday, December 31st. Please contact them at 564-5702. Issues requiring immediate assistance from the Fire Department please contact the Combined Communications Center at 897-2410.

ESTABLISHING A HAZARD COMMUNICATION PROGRAM

Every day at workplaces throughout California, employees work with or are incidentally exposed to hazardous substances that can harm

their health or cause other safety hazards. In response to this reality, Cal/OSHA enacted the Hazard Communication standard. The

standard requires that every workplace, which has or uses hazardous substances, must have a written and effectively implemented Hazard

Communication Program that specifically addresses the potential hazards found at that particular site. The program must be accessible to

employees (or their representatives) and to Cal/OSHA.

Whatever the size of the facility or number of hazardous substances, it is essential that both employers and employees know how to identify

potentially hazardous substances, understand the health hazards associated with the chemicals, and follow safe work practices. Employers

who tailor their written program to meet the specific needs of their workplace will maximize the benefits of workplace safety.

The written hazard communication (HazCom) program must describe the persons responsible for implementing, maintaining, and

periodically reviewing the program and the procedures for meeting all the requirements of the standard, including:

A list of all hazardous substances in the workplace - The list may be compiled for the workplace as a whole or for individual work

areas and can serve as a checklist to ensure that all hazardous substances in the workplace have MSDSs and labels.

A completed MSDS for each hazardous material listed/used in the workplace - The MSDS contains useful information on the

nature of the hazards and how to use, store, and dispose of the material. It also describes what protective measures to take

while using the material and what first aid measures to follow if an exposure to the substance occurs. MSDSs must contain all

of the sections required by the standard and be readily available to employees.

Methods for employee training and awareness - Employees must receive training on the HazCom program requirements including

its location and availability; the identification and location of hazardous substances; and how to read and understand MSDSs.

Training should include how to read and understand label information including physical and health hazards of the substance;

how to detect the presence or release of the substance; and what precautionary measures are needed to protect themselves

from hazards during normal use and in emergency conditions. Training must be done at the time of initial work assignment or

when a new material is introduced. Training must be appropriate in content and vocabulary for the education, literacy, and

language comprehension level of the employee(s).

Labels and hazard warning information - Employers are required to use legible labels and other forms of warning to clearly and

quickly communicate what’s in a container, its hazards, the safety precautions, and the name and address of the manufacturer.

Labels and other forms of warning are to be conspicuously placed on containers so that the message is readily visible. Labels

should not be removed and, if torn or defaced, they must be replaced.

Todos los días en sitios de trabajo en toda California, empleados trabajan con, o resultan expuestos incidentalmente a, sustancias peligrosas que pueden ser nocivas para la salud o crear peligros a la seguridad. En respuesta a esta realidad, Cal/OSHA ha puesto en vigor una norma de comunicación de peligros (Hazard Communication). Can an old CA contractor’s license be brought back to life again when it ‘died’ a decade ago? The ‘mettle’ of a framing contractor is tested and we finish by helping readers learn what it takes to pull together to form a ‘joint venture’ effort…

Q: My husband had a CA license and failed to renew it on time. It expired back in 2000. Now he wants to renew it. He currently has an Arizona “K-11” (Electrical) license that he has held for approx 12yrs. How does he go about this in the quickest way, as we are looking to move to CA early next year?

A: Thank you for contacting Capitol Services Inc. Because his CA license has been expired for over 5 years he can no longer ‘renew’ it. He can however re-apply for the license and request that the number be re-issued. As you may know, there is a reciprocal agreement between CA and AZ so he can request to waive the trade exam based on the fact that he has been licensed for the past five years in Arizona. He’ll still be required to take the law test again. The process to obtain the license will likely take about 8 weeks, so if you be-gin soon, he will have the license before you move. Let us know if you’d like help with the process.

Q: I need assistance with determining what classification my company will need to meet the requirements to do metal stud framing in the State of California. I don’t do Structural Steel, just the metal stud framing. I also han-dle the drywall and insulation to finish off the wall, so I’m not sure if I need separate classi-fications to do that, or if it would be covered under the framing. Thank you in advance.

A: In order to do the metal stud framing you’ll need a “C-5” (Framing and Rough Carpentry) classification. Even though drywall and insu-lation are part of your projects, the CSLB will require you to have the “C-2” (Insulation) and “C-9” (Drywall) classifications to perform this work because the “C-5” doesn’t cover these trades. According to the CSLB, the “B” clas-sification would cover you for all three trades; however, in our experience we have found it is difficult to qualify for the exam without electrical, concrete, roofing and/or plumbing experience.

Q: I am inquiring about the fees and re-quirements to set up a Joint Venture with another contractor. I want to bid a project that requires both “C-20”(HVAC) and “C10-”(Electrical) licenses. My firm only holds the HVAC and would like to partner with another

contractor whom holds both. Please let me know what all is required, particularly the ap-plication process.A: A Joint Venture (JV) consists of two or more entities, each of which holds a valid CA contractor’s license in good standing. Since you hold the “C-20”, you could locate a com-pany with the “C-10” or, as indicated, “another contractor whom holds both”. A JV applica-tion signed by all Qualifiers and an Officer of record for each entity is required. You’ll also need to post a $12,500 Contractor’s Bond, which is in addition to the bond you pres-ently have on your corporate license. Further, a new Worker’s Comp policy (or certified Ex-emption) is necessary. The State fee will run $555.00.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.
