For some time, there has been a controversy in the Home Improvement industry whether salespersons can be independent contrac- tors. The Contractors’ Board has declared that a salesperson almost never can be an independent contractor, and requires work- ers’ compensation insurance to be used by the contractor as a salesperson. The Em- ployment Development Department and IRS each have factors that they use in determin- ing whether a person may be deemed an independent contractor or an employee. It does seem to be possible that a pure sales- person, who only negotiates that sale, and nothing more, could possibly fall within the definition provided by the taxing authorities of an independent contractor notwithstand- ing the opinion of the Contractors’ Board. However, when that person who is not an employee of the contractor does anything that would require a contractor’s license, we herein described of any material or article of merchandise. “Contractor” includes subcontractor and specialty contractor. “Roadway” includes, but is not limited to, public or city streets, highways, or any public conveyance.” (emphasis added) Recently, the Legislature passed AB 2237 which amended Business and Professions Code section 7026.1, which adds to the defi- nition of a contractor on Home Improvement Contracts to include the term “consultant” as a person who: (1) provides or oversees a bid for a construction project, or (2) arranges for and sets up work schedules for contrac- tors and subcontractors and maintains over- sight of a construction project. A number of our clients utilize registered salespersons on Home Improvement Proj-ects for more than just sales. Indeed, it is becoming more common in the industry that these persons, who are the first interac-tion between the customer and the contrac-tor, continue on the project by acting in the manner of a construction manager. Many of these salespersons coordinate the subcon-tracts, supervise or inspect the work, and negotiate change orders and payments with the customer. Important Information Regarding Holiday Closure of City Offices

Holiday Closure of City Offices Most City ADMINISTRATIVE OFFICES are closed from Friday, December 21, 2012 through Tuesday, January 1, 2013. Offices will re-open on Wednesday, January 2, 2013. This includes the Public Works and Community Development Departments located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these closure dates, and staff will not be available to accept or review plans for public works or building permits.

Zoning Information Reports (ZIR's) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during the holiday closure. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Wednesday, December 12th, prior to the holiday closure. We will make every effort to complete additional ZIR applications received during the week of December 17th, but cannot commit to this at this time, as we don't yet know the extent of our ZIR workload for that period. While we cannot accept ZIR applications in person during the holiday closure, agents may continue to mail or fax them in and we will begin working on those applications when we return on Wednesday, January 2nd, 2013. If you have any questions regarding the holiday closure and how this relates to ZIRs, please call the Planning Counter at 564-5578.

Public Works and Building & Safety Plan Check and Inspections While there will not be counter staff available to accept or review plans during the closure, the Public Works Department and Building & Safety Division will be providing inspection services on Wednesday, December 26th, Thursday, December 27th and Friday, December 28th during the holiday closure. For building permit inspections please use the normal inspection request instructions as outlined in the Inspection Request Handout provided in your building permit packet. Public Works and Building and Safety inspection staff will NOT be available for inspections on Monday, December 24th, Tuesday, December 25th, Monday, December 31st 2012 or Tuesday, January 1st, 2013 but will resume normal business hours Wednesday, January 2, 2013.

Fire Prevention Fire Prevention Staff will be on duty the following days: Monday, December 24th, Wednesday, December 26th, Thursday, December 27th, Friday, December 28th, and Monday, December 31st. Please contact them at 564-5702. Issues requiring immediate assistance from the Fire Department please contact the Combined Communications Center at 897-2410.

DRIVE SAFELY

Motor vehicle accidents are the leading cause of workplace deaths. According to the California Highway Patrol (CHP), 10 people die on

California roads every day. The CHP reports the most frequent accident causes on California roads include unsafe speed, unsafe following,

improper turns, and inattention to the road. Proper driver education, seatbelts, following speed laws, obeying the rules of the road, and

paying attention to the road and fellow drivers can help reduce the risk of being injured or killed in a motor vehicle accident.

The California Vehicle Code requires you to follow posted speed limits on roads and highways. Excessive speed reduces your ability to

respond to unexpected road hazards. The higher the speed, the greater the risk of serious injury or death in a crash.

Posted speed limits are maximums. Always maintain a speed that is reasonable for the road and the conditions at the time. Take into

account the weather, visibility, traffic, and the surface conditions of the road when you determine your speed of travel. Never use a speed

that endangers your safety, other persons, or property.

The CHP recommends you leave a 3-second cushion between your car and any vehicle you are following. This applies if the pavement is

dry, theres no heavy traffic, and your brakes are in top condition. In poor conditions, add one more second for each weather condition or

hazard encountered.

Avoid unsafe turns, never pull out in front of a car that has not committed to a stop or a turn.

Be a defensive driver and prevent accidents by scanning the road and other drivers. Watch the road ahead and behind you. Keep your eyes

moving and stay alert to be prepared to react to the unexpected.

Pay attention to what you and other drivers are doing on the road. Adjust your seat and mirrors and preset your favorite radio stations and

climate controls before you start the car. Don’t eat, drink, smoke, or read while driving. The best and safest situation is to be stopped when

using a cell phone. Never text or use a personal digital assistant while driving. And, do your personal grooming at home, not in the car.

Get driver’s education training for California roads and know how to operate vehicles that you are assigned to take on the road.

Always wear your seat belt when driving or riding in a vehicle. According to the National Highway Traffic Safety Administration (NHTSA),

seat belts reduce the risk of fatal injury by 45 percent in a car and by 60 percent in a light truck. A lap and shoulder belt is best, but use a lap

belt if it is present. Only transport people in a car or truck if you have enough seatbelts for everyone.

When you get behind the wheel of a vehicle, follow the rules of the road. Do not drive if you have been drinking, are on medication, or are

very tired. Be a courteous and safe driver and yield the right of way when necessary.

Los accidentes automovilísticos son la principal causa de muerte en el trabajo. Según la Patrulla de Caminos de California (California Highway Patrol – CHP), 10 personas mueren diariamente en las carreteras de California. La CHP informa que las causas más frecuentes de esos accidentes son el exceso de velocidad, el seguir demasiado cerca al vehículo que le precede, dar vueltas incorrectas, y la falta de atención al camino. La educación correcta de los automovilistas, el uso de cinturones de seguridad, obedecer los límites de velocidad y los reglamentos de tránsito, prestar atención al conducir y a las acciones de otros conductores pueden ayudar a reducir el riesgo de resultar lesionado o perecer en un accidente vehicular.

Las leyes de tránsito de California (California Vehicle Code) exigen que los conductores obedezcan las señales de límites de velocidad en todos los caminos y carreteras. La CHP recomienda dejar un espacio equivalente a 3 segundos entre su vehículo y el que le precede. Esto se aplica si el pavimento está seco, no hay congestión de tráfico y los frenos de su vehículo están en óptimas condiciones. Bajo malas condiciones, sume un segundo por cada condición del tiempo o peligro que se encare.

Evite vueltas peligrosas, nunca salga al camino delante de un vehículo que no haya comenzado a dar vuelta o a detenerse. Sea un conductor defensivo y evite accidentes observando todo el camino y a otros conductores. Preste atención al camino adelante y detrás de su vehículo. Continúe moviendo la vista y manténgase alerta para estar preparado a reaccionar si ocurre algo inesperado.

Preste atención a lo que usted y otros conductores hacen en el camino. Ajuste el asiento y los espejos retrovisores, seleccione su estación de radio preferida y ajuste los controles del clima antes de poner en marcha su vehículo. No se debe comer, beber, fumar ni leer mientras se conduce un vehículo. La mejor y más segura situación es tener el vehículo detenido cuando usa su teléfono celular. Nunca envíe mensajes de texto ni use su asistente personal digital mientras conduce. Y arréglese el pelo, maquillaje, etc. en su casa, no en su coche.

Answering questions, solving problems and alerting contractors to potential trouble is all in a day’s work. As we do here, when you see a veteran let them know you appreciate their service, and help them if you can. Does military construction work qualify for a civilian license? We ‘double down’ on a contractor’s inquiry on RME’s…

We recently included an Industry Alert in the col-umn regarding a SCAM that is being perpetrated against existing contractors and applicants hop-ing to become contractors. At their December 11th CSLB meeting held in Norwalk, the Board asked that this warning be reiterated as much as possible. We aim to please!

The current SCAM involves at least one unscru-pulous company that is contacting existing con-tractors whose licenses are up for renewal. Ac-cording to CSLB Registrar Steve Sands, “The caller leads the licensee to believe he or she needs to pay money over the phone to get continuing ed-ucation credit or renew a license.” CSLB staff will never ask for a credit card over the phone and there are no continuing education requirements to renew a CSLB license.

Since the CSLB discontinued posting applicant lists on its website last month, there appears to be a decrease in these type of calls. Neverthe-less, someone pretending to be a Contractors Board employee recently contacted one of our clients. The RMO was told his test was going to

be scheduled on a date in January when in fact the company’s application had not even been reviewed or accepted. Again, beware!

Q: I was discharged from active military duty about 18 months ago and want to apply for a CA contractor license. All my related experience was in the military including work in Iraq handling various types of construction. Do you know how the Contractors Board will evaluate this ex-perience?

A: First off, thank you for your service. As we dis-cussed, in many cases, veterans possess trans-ferable skills to meet the minimum experience and training requirements for a state contractor license. The CSLB offers a Veterans Application Assistance Program for those who are transition-ing from military service to civilian employment. This program offers priority services to veteran applicants by evaluating transferable military experience and training, as well as education. From our years of experience helping veterans with their contractor’s licensing, it appears you have the required 4 years to qualify for the li-cense exam.

Q: We are currently licensed in Arizona and we would like to obtain a similar license in California. Arizona didn’t have a classification that closely fit with the type of work we do, but they had deter-mined that we needed a sheet metal license. We install material handling systems, manufacturing process systems, and other industrial machinery.

What California license would we need?

A: There is a “C-43” Sheet Metal license here in California that would be equivalent to the li-cense you hold in Arizona; however, based on what you described we believe the “C-61”/”D-21” (Machinery and Pumps) would suit you bet-ter. The machinery and pumps classification will cover you for basic industrial machinery installa-tions such as the material handling and manu-facturing process systems that you mentioned. If you’re doing heavier industrial work then you may want to consider the “A” General Engineer-ing license.

Q: Is it possible to have two RME’s on a license?

A: It’s possible to have two, Responsible Manag-ing Employees (RME), if each one holds a differ-ent classification. For example, if you hold the “B” General Building class and the other qualifier has a “C10” Electrical classification, both of you can be on the license simultaneously. You can-not however have two individual RME’s for one classification.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.
