Real world problems can sometimes be easy to solve. At other times, the complex nature of the problem seems to require a ‘by the numbers’ approach if you expect to reach your goal suc-cessfully. A contractor looking at a new ‘venture’ shows everyone the route to ‘jointly’ profiting…

Q: I’m the president of our company and we’ve had a “C-39” (Roofing) License for four years. It will expire at the end of this month and my Re-sponsible Managing Officer (RMO) is leaving the company. We don’t have another RMO. What will happen to the corporation?

A: Once the RMO disassociates, your company will have 90 days to replace him. Normally, dur-ing this time, the license would remain in good standing. However, you may have problems re-newing the license until the new Qualifier is of-ficially on board since the current RMO cannot sign the renewal application. Nevertheless, for a number of reasons I would suggest sending in the renewal prior to the end of the month.

Unless you have someone who already holds the “C-39” classification an Officer or supervising employee will need to sit for the exam. Upon passing the law and trade test, and meeting the Board’s other licensing requirements, this person would become the new Responsible Managing Officer or Employee (RMO/RME).

FIRE EXTINGUISHERS

Even though your company may be equipped with automatic sprinklers or other means of fire protection, the portable fire extinguisher is the first line of defense in the control of fires at their start.

Most fires, in the beginning stage, can be extinguished easily with portable equipment, but only if the equipment is readily accessible and the employee knows how to use it. The reaction time, from when the fire is first realized, is extremely important. If time is wasted in a search for the proper fire extinguisher and a review of the operating instructions, a small, easily controlled fire will spread in size and intensity. The fire will get out of control and both lives and equipment will be endangered.

A knowledge of the various types of extinguishers and their location in relation to the company layout or equipment, is necessary for quick and effective employee action. This means that extinguishers should reflect the character of the fire anticipated for the company and its operations. Fire extinguisher locations should be clearly marked and readily accessible.

An inspection and recharging program should be in place to insure that when an extinguisher is needed, it is fully charged and operational. The program will run more effectively if the fire extinguishers are well-positioned and clearly marked.

Too many fires have spread because the wrong extinguisher was used, the extinguisher was empty, the employee did not know how to operate the extinguisher, or the employee could not find an extinguisher in time to be of any help. Knowing where the fire extinguishers are and how to use them should be basic to any effective injury and illness prevention program (IIPP).

Anque su empresa pueda estar equipada con rociadores automáticos u otros medios de protección contra incendios, el extintor de incendios portátil es la primera línea de defensa para el control de incendios, cuando comienzan.

La mayoría de los incendios, en su etapa inicial, pueden extinguirse fácilmente con equipo portátil; pero sólo si se puede tomar el equipo fácilmente y si el empleado sabe cómo usarlo. El tiempo de reacción, desde el momento que se observa el incendio por primera vez, es extremadamente importante. Si se pierde tiempo en buscar el extintor de incendios adecuado y en revisar las instrucciones de operación, un incendio pequeño y fácilmente controlable puede extenderse en tamaño e intensidad. El incendio se volverá incontrolable y se pondrá en peligro tanto las vidas como el equipo.

Es necesario conocer los diversos tipos de extintores y su ubicación en relación con la distribución o equipo de la compañía para que los empleados puedan actuar con rapidez y eficacia. Esto significa que los extintores deben reflejar el tipo de incendio que se prevea en la compañía y sus operaciones. IMPORTANT NOTICES REGARDING CITY OFFICE CLOSURE DUE TO MANDATORY FURLOUGH

WelcomeThe LDT Bulletin is one way we are increasing communication between the City and our customers. These bulletins will also be located in our lobby area at 630 Garden Street. We hope you’ll find the contents of this issue useful. To subscribe to the City LDT Bulletin please send an email to: [email protected]________________________________________CITY OFFICES CLOSED DUE TO MANDATORY FURLOUGHMost City ADMINISTRATIVE OFFICES are closed due to an unpaid mandatory furlough for City employees on Wednesday, November 23rd. Offices will also be closed on Thursday, November 24th and Friday, November 25th due to the Thanksgiving Holiday.

Most City ADMINISTRATIVE OFFICES are also closed due to an unpaid mandatory furlough from December 19 through January 2, 2012. Offices will re-open on Tuesday, January 3, 2012. This includes the Community Development Department located at 630 Garden Street. As such, Zoning & Enforcement staff will not be able to prepare Zoning Information Reports during these furlough dates, and Building and Safety staff will not be available to accept or review plans for building permits.

ZONING INFORMATION REPORTS (ZIR’s) The Municipal Code requirement to obtain a ZIR prior to the close of escrow (SBMC Section 28.87.220) will remain in effect during this furlough. In order to accommodate the needs of the real estate community as best we can, we are committed to completing all ZIRs received by Thursday, December 8th, prior to the furlough. We will make every effort to complete additional ZIR applications received during the week of December 12th, but cannot commit to this at this time, as we don’t yet know the extent of our ZIR workload for that period.

While we cannot accept ZIR applications in person during the two-week furlough, agents may continue to mail them in and we will begin working on those applications when we return on Tuesday, January 3rd. If an escrow opens and closes during our two-week furlough, agents are still required to submit an application as soon as possible, either in the mail or in person once our office re-opens. We will waive the double “After the Fact” ZIR fee if valid escrow instructions are provided to verify the escrow opening and closing dates occurred during our furlough.

If you have any questions regarding the furlough period and how this relates to ZIRs, please call the Planning Counter at 564-5578.

BUILDING AND SAFETY PLAN CHECK AND INSPECTIONS While there will not be Building and Safety counter staff available to accept or review plans during the furlough, there will be limited Building and Safety inspection staff available Monday through Thursday, the week of December 19th and Tuesday through Friday, the week of December 26th. Building and Safety inspection staff will NOT be available for inspections Monday, January 2, 2012 but will resume normal business hours Tuesday, January 3, 2012. Use the inspection request line as you normally would, by calling 564-5492.

We ask that, if an inspection can be postponed until after the first of the year, please do so.

FIRE PREVENTION Fire Prevention Staff will be on duty Monday through Thursday the week of December 19th and Tuesday through Friday, the week of December 26th. Staff will NOT be available Monday, January 2, 2012 but will resume normal busi-ness hours Tuesday, January 3, 2012. Please contact them at 564-5702.

Setting Up a Tailgate/Toolbox Safety Meeting Tailgate or Toolbox safety meetings are 10-15 minute on-the-job meetings held to keep employees alert to work-related accidents and illnesses. Tailgate/toolbox safety meetings have proved their worth by alerting employees to workplace hazards, and by preventing accidents, illnesses and on-the-job injuries. Why Have Them?

In both the tunneling and construction industries, tailgate safety meetings are required by Title 8, Sections 8406 and 1509 of the California Code of Regulations.

While tunneling and construction are the only industries that specifically require tailgate safety meetings, all California employers must have a safety program that includes employee training in safe work practices.

Tailgate/toolbox safety meetings can be used to address actual problems on the job or in the shop. The supervisor leading the meeting can draw on the experience of workers, and use that experience to remind all employees –especially newer ones – of the dangers of working with particular kinds of machinery, tools, equipment and materials. What to Talk About?

Talk about work practices, machinery, tools, equipment materials, attitudes, and anything else that may cause or contribute to a work-related accident or illness. Keep the topic relevant to the job or tasks at hand.

An excellent source for construction related topics is the publication Cal/OSHA Pocket Guide for the Construction Industry. Supervisors can choose individual sections or topics and relate them to their specific site requirements. Copies can be ordered from the Division of Occupational Safety and Health.

Choose a topic you think needs safety review. If you notice that spills aren’t being cleaned up promptly, discuss it. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from happening again? Encourage employees to suggest topics. They often know best - what and where the dangers are. How to Run a Good Meeting 1. Hold the meeting on the job, preferably where everyone

can sit and relax. 2. Hold meetings at the beginning of shift or after a break. 3. Choose the topic carefully. Topics should be about health

and safety problems on the job. Research the problem before the meeting. For machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the material safety data sheet. Your company’s insurance carrier is another good source

of information. Cal/OSHA also supplies a wide range of printed material on worksite safety and health.

4. Don’t choose too broad a topic. 5. Encourage employee participation - keep your meeting

short. Sample Topic for Tailgate/Toolbox Safety Meetings:

Why are guards left off machines? Guards are placed on machines to prevent workers from

contacting moving parts. They are required by Cal/OSHA regulations.

Many California workers are killed or injured every year because guards are removed and not replaced.

Why are guards left off? Ask the group to give reasons. Some common ones are:

♦ I didn’t have time to replace the guard. ♦ I wanted to make sure the machine was working okay. I

just never got around to replacing the guard. ♦ I put on a new drive and the old guard didn’t fit. ♦ I had to remove the guard to adjust the machine. ♦ I couldn’t work with the guard on. It slowed me down. ♦ Listen I’ve run these machines for years without guards

and I’ve never been hurt. These excuses have been given countless times. After the

accident has happened, the guard is replaced and strict rules are enforced. Of course, it’s too late for the victim. The purpose of meeting on this topic is to make sure rules are enforced before an accident can happen.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
