Contractors State License Board Warns Licensees to BeAware of Misleading Business Solicitations
Appeals often look like official government correspondence
SACRAMENTO, CA – The Contractors State License Board (CSLB) wants its licensees to be aware of a warning issued this week by the California State Board of Equalization (BOE).
Licensees are urged to be wary of misleading business solicitations from companies that mimic official correspondence from a government agency.
BOE says businesses have informed the board of notices they have received from the “California Labor Compliance Bureau,” requesting immediate payment of a “processing fee” of $275. The “California Labor
Compliance Bureau” is not a government agency. The notices use public information, such as BOE account numbers and in-dustry codes, which give them the appearance of official correspondence.
The “processing fee” is purportedly for labor-related notices that California employers are required to post at their business premises informing employees of their legal rights under the National Labor Relations Act. The notices in question are avail-able free of charge on the National Labor Relations Board’s (NLRB) website. BOE is not affiliated with the California Labor Compliance Bureau. BOE Correspondence always features the BOE’s title and/or logo and contains contact information. If you receive a notice and question whether it is official BOE correspondence, you should contact your local BOE office or contact the BOE’s Information Call Center at 800-400-7115.

Requirements for Contractors Include Certification & Training
Firms must have one or more “Certified Renovator” assigned to jobs where lead-based paint is disturbed. To • become certified, a person must successfully complete an EPA training course conducted by an EPA-accredited training provider.
All renovation workers must be trained. They can be trained to • use lead safe work practices on-the-job by a Certified Renovator if the work is not HUD regulated, or they can become Certified Renovators themselves.
Firms performing renovation, repair or painting work must also • become certified. This can be accomplished by applying to EPA and paying a fee.

Beginning on April 22, 2010 renovation, repair and painting contractors must:be “RRP certified”• use lead safe work practices when working in homes built before 1978.•
The RRP rule affects contractors, property managers and others who disturb known or presumed lead-based paint during renovation activities done for compensation. The includes most repair, remodeling and maintenance jobs, such as window replacement, weatherization and demolition. The rule applies to any work that disturbs painted surfaces in residential houses, apartments and child-occupies facilities such as schools and day-care centers built before 1978. Fines for violating RRP Rule requirements can be up to $37,500 per incident.

8 Core Elements Working Together to Prevent Injuries and Illness in Construction
The Cal/OSHA 8 course focuses on implementing an effective accident prevention program, with its primary audience being construction foreman/supervisors. This course is designed to educate and train foremen/supervisors on their daily roles and responsibilities of accident prevention on the site. This course is not a typical course on how to develop an accident pre-vention program, or an Injury and Illness Prevention Program as required in California. The Cal/OSHA 8 course is aimed at the importance of workplace safety and health, everyone’s responsibilities for safety on the job, and what the foreman/supervisor can do to prevent accidents and illnesses on the job. The course links these responsibilities and actions to the requirements of California’s Injury and Illness Prevention Program and to the California Title 8 Construction Safety Orders.
The course provides participants with a packet of safety resource material to be kept in the work vehicle. Examples include tailgate training information, IIPP requirements, and the Cal/OSHA Pocket Guide for the Construction Industry.
This course discusses:Safety responsibilities on the job.Examples and discussion of systems that ensure workers follow safety rules and regula-tions, including discussion on how to recognize individual safety performance.Methods for creating effective safety communications.Construction hazard recognition with reference to Title 8 California Code of Regula-tions sections.Investigation of accidents and exposures and near misses to prevent recurrence, includ-ing exercises on how to determine if the hazard is created by an unsafe action and/or unsafe equipment conditions.Procedures for ensuring timely correction of unsafe and unhealthy conditions and/or work practices.Methods of conducting safety and tailgate training.Documentation for use in improving the safety program and preventing recurrence of incidents.Attendees will receive a certificate of completion plus an official wallet card certifying course completion

GUARD AGAINST MACHINE INJURIES
Cleaning a jammed conveyor, reaching for a wrench, or retrieving a dropped glove are common tasks. Yet, each of these acts can lead to a serious injury. Many injuries occur during equipment maintenance. Sometimes workers try to reach past the guards while trying to service equipment or get caught in power transmissions such as belts, pulleys, running rolls, chains or sprockets. Other injuries occur when equipment is unguarded or when machinery starts unexpectedly.
If some basic precautions are taken, protecting workers from these injuries can be simple, and inexpensive. Inexpensive physical controls such as machine guards can prevent many injuries. The important thing is that the guards remain in place. Bright, contrasting colors painted on machine guards and points of operation give workers a visual warning and can make it easy to spot missing guards. Good lighting also helps spot dangerous conditions or unguarded machinery.
Regular maintenance by experienced workers can make a big difference in preventing equipment jams and in reducing the risk of injury from being caught by or falling into machinery. Employers should establish and train workers to follow safe work practices around machinery and other electrical equipment. The law requires equipment to be turned off and locked out during any maintenance to prevent someone from turning it on unexpectedly. Workers should recognize and understand the following when working around machinery:
The location of machine guards and points of operation The purpose of color-coded machinery alerting workers to hazards and to help pinpoint missing guards The danger of pinch points and importance of guards on in-running rolls, belts, pulleys, chains, and sprockets Know and follow established lockout/tagout procedures Know when machines have been shut down for maintenance or to clear jams Assure that machines remain off while they are shut down for maintenance Know and observe electrical safety work practices developed by the company Understand the importance of keeping machinery clean to prevent equipment jams
The surest way to safeguard worker hands and fingers is for everyone to stay alert when working around machinery or moving equipment and to follow established company safety practices and use common sense.

CÓMO EVITAR LESIONES EN LAS MAQUINARIAS
Limpiar una correa transportadora atascada, alcanzar una herramienta, o recuperar un guante caído son tareas comunes. Sin embargo, cada uno de estos actos puede conducir a una lesión grave. Muchas lesiones ocurren durante el mantenimiento de los equipos. Algunas veces los trabajadores tratan de alcanzar algo dentro de un resguardo mientras le dan mantenimiento a un equipo, o los atrapa un dispositivo transmisor de potencia, tal como correas, poleas, rodillo en movimiento, cadenas o ruedas dentadas. Otras lesiones pueden ocurrir cuando el equipo no tiene resguardos o cuando arranca inesperadamente.
Si se toman algunas precauciones básicas, la protección de los trabajadores contra estos peligros puede ser sencilla y de bajo costo. Some contractor licensing ‘arrangements’ are subject to change, others not so much. Learn more about how ‘limited’ some partnerships aren’t. We start with another contractor’s con-cern about RME’s with a ‘sole’. We also add more ‘fuel’ to the firestorm of controversy about how public agencies can structure their bids…
Q: I was hoping to get an opinion on the follow-ing scenario. A contracting company is formed as Sole Ownership, however the company has a Responsible Managing Employee (RME) who is the qualifying individual, not the listed owner. Would it be fair to say that this company is at least 51% owned AND controlled by the listed owner?
A: Yes, by definition, a sole proprietorship is 100% owned and controlled by the listed owner, even with a RME. The CSLB, as matter of policy, will not recognize a Responsible Managing EMPLOYEE as owning any of the company.
Q: If someone is applying for a Limited Partner-ship (LP) license and they are listing a corporation as the General Partner (GP) and a Limited Liabil-ity Company (LLC) as the LP on the application, can they add more General Partners later (after the license is issued)? If so, are they required to inform the CSLB? The original GP and LP won’t change; they will just add additional GP’s.
A: Yes, they are required to notify the CSLB. The reason is that by adding a General Partner after the license is issued, this changes the partnership
entity thereby requiring the company to apply for a NEW license (and new license number). The CSLB will however, allow an LP to change Lim-ited Partners. Also, for my reader’s information, beginning January 1st the CSLB should begin al-lowing a LLC to act as a General Partner (some-thing they are now prohibited from doing).
Q: We protested a bid on the basis that our com-petitor did not list a “C-36” (Plumbing) subcon-tractor to run a new gas line to some furnaces that are being replaced. Their contention is that their “C-4” (Boiler Hot Water Heating & Steam Fit-ting) license allows them to install the new line as incidental to the installation of the furnaces and they can therefore self-perform this work. I contend that they are allowed to make the con-nections to gas service, but aren’t allowed to install completely new gas lines. The school is agreeing with them and has responded to our protest accordingly. What does someone in the know think? A: My opinion is that the school district was within their rights to take the action they did. Of course, I am not familiar with all the details of this bid, but on its face, a “C-4” can perform the work you describe.
In part, “a boiler, hot-water heating and steam fitting contractor installs, services and repairs power boiler installations, hot-water heating systems and steam fitting, including ... steam fit-ting and piping, ... fuel oil tanks, fuel oil lines ... and all other equipment ... associated with these
systems”.
Therefore, it could be argued that since the pri-mary project was installation of a furnace, this related piping would be “incidental and supple-mental” to the job.
Second, a public agency can determine which classification is proper as allowed by Code Sec-tion 7059(b): “In public works contracts... the awarding authority shall determine the license classification necessary to bid and perform the project (this is the same section that references “incidental and supplemental” language). This being said, I have seen where public agencies, like a school district, get it wrong and therefore should be challenged – just not in this case.
