CSLB Reminds Contractors to Get Permits Before ExcavatingFailing to contact 811 regional notification centers risks safety, big fines, license
vation will be considered unauthorized dig-ging and you may be subject to a fine of up to $50,000, held responsible for any repair costs, and potentially lose your contractor license (Government Code sections 4216-4216.9).
The regional notification center websites pro-vide information about permit exemptions and other state laws and requirements. Both Northern and Southern California centers also offer an online procedure to start the approval
SACRAMENTO – The Con-tractors State License Board reminds contrac-tors who plan to disturb a ground surface—wheth-er by digging, drilling, boring, etc.—that they must call 811 before be-ginning a project. You must contact either the Northern or Southern California regional notifi-cation center at least two working days (but not more than 14 calendar days) before beginning your excavation project.
The center will issue an inquiry identification number to the excavator as confirmation of the call, and an Underground Service Alert (USA) excavation ticket number, which is only valid for 28 days. Every contrac-tor excavating at a job site must have his or her own USA identification (ticket) number for the excavation work he or she is performing. An excavation permit is not valid without the identification number.

Sexual Harassment TrainingApril 1, 2013

Harassment training for supervisors has always been a good idea; now it is required by law. AB 1825 (Now Government Code Section 12950.1) requires that all California employers with 50 or more employees provide at least two hours of harassment avoidance training to all supervisors once every two years. Moreover, new supervisors or newly promoted supervisors must receive the required training within six months of hire or promotion. For smaller employers, providing harassment training for employees can also help protect you against harassment claims and lawsuits. This training is mandatory for any supervisor who hires, fires, disciplines, and/or directs the work of one or more other employee.
The seminar will cover the following topics:Discrimination • The laws against illegal sexual harassment• The costs and remedies of harassment• Identifying unlawful sexual harassment• Preventing and stopping sexual harassment• Retaliation• Hypothetical situations•

Is there a license for that? You may be sur-prised at what work actually requires a CA contractor’s license. Always better to check first rather than get surprised without it. You can always call us at any time to discuss your issue, we may later share it to help oth-ers learn from your lesson, but don’t hesitate to ‘drop the dime’ to Capitol Services. First, a quick answer for a guy in a real hurry…
Q: I never imagined I’d do more than follow your column when I could, but I do have an issue. I am trying to sell my business and plan to remain as the Responsible Managing Offi-cer (RMO). The buyer is under the impression that I must own 20% of the stock to make the RMO position legitimate. I am maintaining that a separate bond would suffice without stock ownership. I would be grateful if you would respond to this issue since escrow is to close in two days and this just became an is-sue today.
A: You are correct! There is no requirement that you own any percentage of the corpora-tion. If the new owner posts a $12,500 Bond of Qualified Individual, you would not need to own any stock. The bond is required for all RMO’s that own less than 10%. Good luck

A: It all depends on the total scope of the project. For example, a General Engineering contractor cannot just pour concrete for the foundation of a home. However, they can if in addition to that they are also doing the curbs, gutters, sidewalks, etc. Basically, an “A” con-tractor can do cement and concrete work if it’s in connection with a General Engineering project.
Q: Is there a contractor’s license for water-proofing? And will I be required to take an exam for it?
A: Yes, there is a license for that. The specific type of license can be a little tricky as that work can fall under several different classifi-cations depending on exactly what you’re do-ing. It can be covered under a “C-39” (Roof-ing), “C-33” (Painting), “C-29” (Masonry), or “C-54” (Tile). Each of these classifications has a trade exam. There is also the “D-65” which is “weatherization and energy conservation” that includes weather stripping, caulking,
water heater pipe wrap, etc. The “D-65” does not have a trade exam. Contact our office and we can nail down the proper classification for you.
Contractor Alert: March 2013 – The CSLB re-minds contractors that they must call 811 before beginning a project that will disturb the ground surface – whether by digging, drilling, boring, etc. You must contact either the Northern or Southern California regional notification center at least two working days (but not more than 14 calendar days) before beginning your excavation project. Accord-ing to the bulletin, “the regional notification center call is free by dialing 811. If you fail to register, your excavation will be considered unauthorized digging and you may be subject to a fine of up to $50,000, held responsible for any repair costs, and potentially lose your contractor license.”

appealed the trial court’s decision to no avail. Bardos argued that the license that was issued to BCI made him a licensed contractor because he was an officer. However, in that BCI is a corporation, it is considered a separate legal entity from its officers and shareholders and as Busi-ness and Professions Code section 7059.1 (b) states, “A licensee shall not conduct business under more than one name for each license. Nothing in this section shall prevent a licensee from obtaining a busi-ness name change as otherwise provided by this chapter.” Cadmus would have been another name. Bardos also argued that Cadmus substan-tially complied with licensure require-ments. In order for substantial compli-ance to be found, four factors must be met. First, the contractor must be duly licensed prior to the act or contract. Second, the contractor must have acted reasonably and in good faith to main-tain proper licensure. Third, the con-tractor did not know that it was not duly licensed. Fourth, the contractor acted promptly and in good faith to reinstate licensure. As stated previously, the appli-cation for licensure did not happen until the job was actually completed, thereby leaving Cadmus unlicensed for the entire duration of the job. This definitely does not support substantial compliance. Looking at Business and Professions Code
section 7031(b) which states in part “...a person who utilizes the services of an un-licensed contrac-tor may bring an action in any court of competent ju-risdiction in this state to recover all compensation paid to the unli-censed contractor for performance of any act or con-tract.” caused the appellate court to uphold the trial court’s decision of having the funds disgorged.
As a side note, Bar-dos argued that Business and Professions Code section 7031 was inapplicable be-cause of Palms status as a tribal entity. However, the appellate court held that the sovereign immunity defense is only available to the tribe and the tribal en-tities, not to parties attempting to avoid liability to tribal entities. As said in the past, make sure that every-thing is properly done. If all of your I’s are dotted and T’s are crossed, then you have a higher chance of avoiding trouble at all times!

The case of Twen-ty-Nine Palms Enterprises v. Paul Bardos once again shows con-tractors how im-portant it is to make sure that they are properly licensed and all paperwork is in order. February 2007 saw the start of construction improvements to the Spotlight 29 Casino. Twenty-Nine Palms Enter-prises (“Palms”), a tribal corporation, hired a construc-tion manager by the name of Paul Bardos (“Bardos”) who was the RMO of Bardos Construction, Inc. (“BCI”). They also hired Worth Group (“Worth”) as the general contractor. There was one portion of the project which dealt with a new parking structure that Worth submitted a bid for in excess of $1.7 million. Palms apparently asked Bardos to bid as well. The bid from Bar-dos came in around $750,000 so Palms wanted Bardos to do the work. Palms ap-parently asked Bardos to do the work un-der a different name and Bardos agreed which lead to the creation of Cadmus Construction Co. (“Cadmus”). Outside of the fact that the construction contract should not have been entered into until Cadmus was properly licensed, Bardos should have at least filed the ap-propriate paperwork with the county for the fictitious business name as well as with the Contractors’ State License Board at that time. However, the paperwork was not filed with the CSLB until June 25, 2007, with the license being issued in Oc-tober 2007, months after the work was ac-tually completed. Palms discovered that Cadmus was not licensed and sued to re-cover all funds paid for the construction work completed. The trial court ruled in their favor and ordered full disgorgement for $751,995. With over $750,000 on the line, Bardos
