CSLB Issues Industry Alerts Regarding Scam Targeting Licensees and Applicants

At least one unscrupulous company using public information to rip off dozens of businesses

Business and Professions Code section 7080.5 requires CSLB to make public the name and address of every accepted appli-cation for a license, on the day following acceptance, at CSLB’s office in Sacramento. Since technology now permits the elec-tronic posting of these lists, CSLB makes them available on its website. These lists are used by many legitimate companies, including bond companies and license as-sistance companies.

At this point CSLB will continue to post the applicant lists on its website, but the pro-cess could change if applicants continue to be preyed upon by unscrupulous com-panies.

SACRAMENTO – The Contractors State Li-cense Board (CSLB) is issuing an Industry Alert to all licensees about to renew cur-rent licenses or anyone who has either ap-plied for a CSLB license, or plans to apply.Be careful if anyone contacts you claiming to be from CSLB, or asks for credit card in-formation over the phone for you to renew your license, get continuing education credit, or take a licensing exam. This is a scam!

“We’ve discovered at least one unscru-pulous company that’s using information from CSLB’s website to contact licensees or applicants to mislead and scam them,” said CSLB Registrar Steve Sands. “The caller leads the licensee or applicant to believe he or she needs to pay money over the phone to get continuing education credit, renew a license or to schedule a licensing exam.”

CSLB staff will never ask for credit card information over the phone, nor will they process any payment over the phone. CSLB fees are only payable through the mail via check or at CSLB headquarters via cash, check, or credit card. There are no con-tinuing education requirements to renew a CSLB license. A list of all license fees are available on CSLB’s website: http://www.

BE AN EXTRA-SAFE DRIVER

Those who drive for a living would be the first to agree it can be mighty dangerous out there on California’s crowded roads. Although the

common factors of inexperience, recklessness, and aggressive driving contribute to many vehicle accidents, it doesn’t explain why so many

professional drivers get into accidents. A driver may be trained, experienced, and competent behind the wheel, but the very f lood of vehicles

competing for space on the roads today presents added danger to all drivers. Even the very best drivers must learn to operate their vehicles

with life-saving EXTRAS.

Drivers should take extra care of their vehicles’ maintenance by keeping them in good operating condition. Before getting beh ind the wheel,

do a simple walk around the vehicle to insure that tires are properly inflated and have good tread, check that lights are clear and working,

and see that windshields are clean and wipers blades are sharp.

Once inside the vehicle, drivers should take the extra time to check the gas gage, adjust the mirrors, seat, and seatbelt to a comfortable

position and, if it’s an unfamiliar vehicle, locate the lights, brakes, and wipers. Horns, flasher lights, and other warning devices are not just

accessories but vital parts of the extra safety built into any vehicle, so make sure they operate properly.

On the roadways, be extra careful by driving defensively. Following the rules of the road can help you concentrate on what your should be

doing…driving. Stay out of the other vehicle’s blind spot and avoid tailgating. Instead, keep a safe distance from other drivers by maintaining

that extra safety cushion of driving space between your vehicle and those around you. As an extra precaution, know the condit ion of the

weather and road and drive only as fast as those conditions allow.

Be extra cautious by staying alert and expecting the unexpected. Watch out for and anticipate other drivers, pedestrians or children on or

near the road. Safe drivers scan constantly for hazards, predicting how they may be affected by a hazard and pre-determining how to avoid

or reduce them.

The ever-changing variable of the road and other vehicles can make drivers instantly vulnerable to accidents. If drivers don’t practice these

life-saving extras on the road, they might personally discover why vehicle deaths and serious injuries now total more than all the wartime

wounded and fatalities since 1776.

Aquellas personas que se ganan la vida conduciendo serán los primeros en estar de acuerdo en que puede ser sumamente peligroso

conducir en las congestionadas autopistas de California. No obstante que los factores comunes de inexperiencia, imprudencia y

conducción agresiva contribuyen a muchos accidentes automovilísticos, no explican por qué tantos conductores profesionales se

involucran en accidentes. Quizá un conductor esté capacitado, tenga experiencia y sea competente al frente del volante, pero el flujo de

vehículos compitiendo por espacio en las carreteras hoy día representa un peligro adicional para todos los conductores. Incluso los

mejores conductores deben aprender a operar sus vehículos con algunas PRECAUCIONES que podrían incluso salvar vidas.

Do you know you can’t use the same ‘fingerprints’ in two different states? We ‘qualify’ an answer for an out-of-state contractor, share tips on Nevada licensing and learn why your ‘fingerprints’ can’t cross state borderlines…

Q: I noticed that Nevada doesn’t use the terms RMO/RME like California. Does that mean that the Qualifying Individual must be contracted as an executive and be given a title (Vice President for example) in the State of Nevada? If this is the case, could you please tell me what are the dif-ferent titles that may apply?

A: For the State of Nevada, your “Qualified Indi-vidual” may either be an employee or an Officer. The Qualifier does not need to be given an Of-ficer title in order to act in that capacity; how-ever, if he/she is an Officer, the titles to choose from are President, Vice President, Secretary, or Treasurer.

Q: We are in the process of updating our Offi-cers on our CA and NV licenses. I am discovering that the new Officers are required to get finger-printed for CA. Will they also be required to get fingerprinted for NV? If so, can the fingerprints they get here in CA be used for NV purposes as well?

A: Yes, the Nevada State Contractors Board does require that all personnel you list on the applica-tion get fingerprinted. The fingerprints are not transferable from one State to another. For CA, the Officers cannot get fingerprinted until the application is submitted and they receive the re-quest from the CSLB. For Nevada, they can get fingerprinted ahead of time and submit these with the application.

Q: My company is going to need a CA license for a project we have coming up and we were won-dering if the Qualifying individual has to be an employee of the entity obtaining the license, or can he be an employee of a subsidiary company or parent company? I’m not sure if it matters, but neither the subsidiary company nor parent com-pany has a license in CA.

A: A Responsible Managing Employee (RME) must be a bona fide employee of the applying entity. This means that the RME must be em-ployed by the firm and actively involved in the operation of the business at least 32 hours per week or 80 percent of the total business operat-ing hours per week, whichever is less.

Q: We just received our renewal for our CA Li-cense, but our RME left the company a few

months ago (unbeknownst to the CSLB) so he is not available to sign. We have designated a new RME but he is not on record yet. He has some projects to finish with his own license before he wants to be added to our license. Can we request an extension? Or can we have the new qualifier sign and attach an explanation of our future plan?

A: The CSLB will not accept a renewal unless it is signed by the Qualifying individual, as well as an Officer, listed on the license. The CSLB will not give you an extension, nor will they accept the new Qualifier’s signature until he is officially added to the license, even with an explanation. In order for them to process the renewal, we sug-gest simultaneously submitting a Replacement of Qualifier application with the Renewal Appli-cation signed by the new Qualifier so that they can (hopefully) be processed together.

Project Description: The preposed improvements consist of recoating the interior of one water storage tank, plus some additional structural modifications and improvements. The Marr Ranch No. 1 tank is an above ground welded steel tank that is approxximately 74 feet in diameter by 32 feet high and has a capacity of 1 million gallons. The tank was constructed in the 1980s and has a bitumastic lining system. All of the interior steel surfaces above the upper shell are lined with a coal tar cut-back solution (e.g. Supertank), whereas the shell and the tank bottom are lined with a coal tar eneamel hot mopping applied lining. These coatings contain lead, chromium, and cadmium, which must be handled and disposed of in accordance with California Code of Regulations, Title 8, Construction Safety Order No. 1532.1 (CFR 1926.61), and California Administrative and Health Code, Title 22. Test results can be found in Appendix B.

Sealed proposals for Bid No. 5106 for the Wastewater Main Rehabilitation Project FY13 will be received in the Purchasing Office, 310 E. Ortega Street, Santa Barbara, California 93101, until 3:00 p.m., Tuesday, December 4, 2012 to be publicly opened and read at that time. Any bidder who wishes its bid proposal to be considered is responsible for making certain that its bid proposal is actually delivered to said Purchasing Office. Bids shall be addressed to the General Services Manager, Purchasing Office, 310 E. Ortega Street, Santa Barbara, California, and shall be labeled, “Wastewater Main Rehabilitation Project FY13, Bid No. 5106".

The work generally includes all labor, material, supervision, plant and equipment necessary to repair damaged sanitary sewer main pipelines utilizing traditional open trench excavation methods (point repairs), rehabilitate 6 and 8-inch sanitary sewer main pipelines utilizing cured-in-place pipe liner (CIPP), folded and formed PVC pipe liner, and/or spiral-wound pipe liner methods, perform pre-rehabilitation sewer main cleaning, and perform pre and post rehabilitation CCTV inspections per PACP standards, as outlined in the project contract documents, complete and in place. The Engineer’s estimate is $514,000. Each bidder must have a Class A license to complete this work in accordance with the California Business and Professions Code.

Project Addendum notifications will be issued through Ebidboard.com. Per California Civil Code Section 3247, a payment bond in the amount of 100% of the bid total will be required from the successful bidder for bids exceeding $25,000. The bond must be provided within 10 calendar days from notice of award and prior to the performance of any work.

The proposal shall be accompanied by a proposal guaranty bond in the sum of at least 10% of the total amount of the proposal, or alternatively by a certified or cashier’s check payable to the Owner in the sum of at least 10% of the total amount of the proposal.

A separate performance bond in the amount of 100% of the bid total will be required from the successful bidder. Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.

Include your license number in

anything that might be considered

advertising.

Don’t use false or misleading

advertising, or advertise a price

you don’t intend to honor.

Don’t advertise to do work you’re

not licensed to perform.

Don’t advertise about bonding.

When advertising asbestos

removal services, be sure to include

your asbestos certification and

registration numbers along with

your business name.

Notify CSLB whenever you see

advertising for an unlicensed

contractor.
