Protect Your Lien Rights, Stay on Top ofRevised Mechanics Lien Laws

The new law gives homeowners 15 days instead of 10 to file a Notice of Completion with the Coun-ty Recorder. Also, instead of the previous 90-day window to record a lien, a prime contractor must record a claim of lien within 90 days after com-pletion of the work of improvement or 60 days after the owner records a notice of completion or cessation, whichever is earlier. WORKPLACE DISTRACTIONS

Some workplace distractions and interruptions are unavoidable but others – if not properly controlled or regulated -- could lead to injuries,

lost productivity, and a decrease in worker morale.

Work interruptions are a distraction that can result in work errors or accidents. Before addressing or responding to another person, workers

should shut down or disengage any work tool, equipment, or processes. Job training should include instructions not to interrupt others

during a critical job phase or process. Instruction manuals and procedural guidebooks should be kept on site to answer frequently asked

questions and thereby eliminate the need to interrupt or distract other workers.

External noise from tools, mobile equipment, and processes can be distracting in industrial and construction work environments. In work

situations where loud or constant noise is unavoidable, hearing protection devices can eliminate or decrease unwanted and distracting

noise. In other work environments even not-so-loud sounds can be a distracting annoyance. Constantly ringing phones, conversations, and

loud faxes, copiers, and printers can distract workers from their job tasks or -- depending on the level or duration of the noise -- can

contribute to workplace stress.

Electronic devices such as cell phones, IPODS, and PDAs can be the source of serious distractions in some work environments. Check with

your supervisor to find out if these electronics are allowed where you work. If these devices are approved in your workplace, as a courtesy

to your co-workers, make sure you keep your cell phone on a low volume or silent when you work. To maximize work safety and

performance, turn email notifications off and disable instant messaging. Don’t answer the phone or emails when you’re in the middle of a

task – let it ring to voicemail then check messages later -- preferably on your break time.

In some work environments wearing a headset with low volume music can be relaxing to workers and help them to safely focus on their

work. However, wearing headphones on a construction or industrial site can be dangerous if it prevents workers from hearing warning

signals, mobile equipment backup alarms, and safety instructions.Walking around while talking on the phone or wearing a headset distracts

your attention from safety and could result in a slip or fall or cause you to run into or be struck by something or someone.

Workplace distractions and interruptions are common, but training can help you remember to keep your mind on the task at hand. Speak up

about repeated and/or unsafe distractions and think and take responsibility for not interrupting or distracting others.

DISTRACCIONES EN EL SITIO DE TRABAJO

Algunas distracciones e interrupciones en el sitio de trabajo son inevitables, pero otras – si no están debidamente controladas o reguladas

– pueden conducir a lesiones, pérdida de productividad y disminución de la moral de los trabajadores.

Las interrupciones en sus tareas son una distracción que puede resultar en errores o accidentes en el trabajo. Antes de hablarle o

contestar a otra persona, el trabajador debe apagar o desconectar cualquier herramienta, equipo o proceso que esté en funcionamiento. La

capacitación para el trabajo debe incluir instrucciones de no interrumpir a otros trabajadores durante una fase crítica de la tarea o del

proceso. Los manuales de instrucciones y las guías de procedimientos deben tenerse en el sitio de trabajo para contestar preguntas

frecuentes y eliminar así la necesidad de interrumpir o distraer a otros trabajadores.

Los ruidos externos, provenientes de herramientas, equipos móviles y procesos, pueden ser una distracción en ambientes de trabajo

Duplication of effort is always frustrating, especially when your license is at risk as a result, as our first contractor demonstrates. While a college degree is great preparation, if you want a ‘general’ engi-neering license in California you are going to have to spend some time in the trenches, so to speak. Sparks may fly when we plug in a couple answers every electrical contractor should know…

Q: We are a large company with a General Build-ing license in CA. We keep running into the same issue where our Responsible Managing Employee (RME) leaves the company and then we are stuck rushing to replace him so that our license doesn’t lapse. Can I, as an Officer of the company, take a class to pass the exams so that we can avoid hav-ing to go through this every time someone leaves? I have been in the business for many years but have never framed or built a house.

A: We understand your frustration; it can certainly be a hassle when your Qualifying individual termi-nates his/her employment unexpectedly. While you don’t have the “hands-on” work background, if you can show at least four years of experience supervising/managing your company’s General Building projects, then you can apply to become the Responsible Managing Officer (RMO) for your company. If you can show that you’ve been acting

in a supervisory capacity for the company for the past 5 of 7 years, then you may be able request a Waiver of the examination. Please contact us if you have further questions or would like assistance with this process.

Q: I have a degree in Engineering. Will that suffice for qualification to obtain a General Engineering contractor’s license in CA?

A: In order to qualify for a General Engineering con-tractor’s license, you’re required to show at least 4 years of experience. The CSLB will give you up to three years of work experience credit for your En-gineering degree, so you would need to show an-other year of Journeyman level or above work ex-perience to sit for the exam.

Q: We currently have a “C-10” license with an RME. He also has an electrical certification with the De-partment of Industrial Relations, Division of Appren-ticeship Standards (DAS). Of course we are waiting until the last minute, but his electrical certification expires very soon. Is that going to cause our “C-10” contractor’s license to go suspended?

A: If it weren’t for the last minute many of us wouldn’t get anything done, right? Lucky for you, the “C-10” contractor or Qualifier does not need to

hold an Electrical certification. If you have employ-ees that work under your license then they need to get certified, but your RME is not required to keep his DAS registration.

Q: As you know, you are helping us get our “C-7” (low voltage) contractor’s license in CA. When we get the CA license squared away we plan to apply for a Waiver in Nevada and take the Business and Law exam only. Any reason this wouldn’t work that way?

A: Unfortunately, there are two reasons why it won’t work that way. First of all, the reciprocal agreement between CA and NV allows you to waive the trade exam and experience requirements only if you have been licensed for 5 out of the last 7 years in CA, AZ, or UT. Since you will be newly licensed in CA, you won’t meet the 5-year requirement. Secondly, Ne-vada doesn’t reciprocate for electrical. Since the “C-7” is part of the electrical classification, even after five years you still won’t qualify for a Waiver of the trade test. Sorry if this has ‘shorted out’ your plan!

Setting Up a Tailgate/Toolbox Safety Meeting Tailgate or Toolbox safety meetings are 10-15 minute on-the-job meetings held to keep employees alert to work-related accidents and illnesses. Tailgate/toolbox safety meetings have proved their worth by alerting employees to workplace hazards, and by preventing accidents, illnesses and on-the-job injuries. Why Have Them?

In both the tunneling and construction industries, tailgate safety meetings are required by Title 8, Sections 8406 and 1509 of the California Code of Regulations.

While tunneling and construction are the only industries that specifically require tailgate safety meetings, all California employers must have a safety program that includes employee training in safe work practices.

Tailgate/toolbox safety meetings can be used to address actual problems on the job or in the shop. The supervisor leading the meeting can draw on the experience of workers, and use that experience to remind all employees –especially newer ones – of the dangers of working with particular kinds of machinery, tools, equipment and materials. What to Talk About?

Talk about work practices, machinery, tools, equipment materials, attitudes, and anything else that may cause or contribute to a work-related accident or illness. Keep the topic relevant to the job or tasks at hand.

An excellent source for construction related topics is the publication Cal/OSHA Pocket Guide for the Construction Industry. Supervisors can choose individual sections or topics and relate them to their specific site requirements. Copies can be ordered from the Division of Occupational Safety and Health.

Choose a topic you think needs safety review. If you notice that spills aren’t being cleaned up promptly, discuss it. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from happening again? Encourage employees to suggest topics. They often know best - what and where the dangers are. How to Run a Good Meeting 1. Hold the meeting on the job, preferably where everyone

can sit and relax. 2. Hold meetings at the beginning of shift or after a break. 3. Choose the topic carefully. Topics should be about health

and safety problems on the job. Research the problem before the meeting. For machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the material safety data sheet. Your company’s insurance carrier is another good source

of information. Cal/OSHA also supplies a wide range of printed material on worksite safety and health.

4. Don’t choose too broad a topic. 5. Encourage employee participation - keep your meeting

short. Sample Topic for Tailgate/Toolbox Safety Meetings:

Why are guards left off machines? Guards are placed on machines to prevent workers from

contacting moving parts. They are required by Cal/OSHA regulations.

Many California workers are killed or injured every year because guards are removed and not replaced.

Why are guards left off? Ask the group to give reasons. Some common ones are:

♦ I didn’t have time to replace the guard. ♦ I wanted to make sure the machine was working okay. I

just never got around to replacing the guard. ♦ I put on a new drive and the old guard didn’t fit. ♦ I had to remove the guard to adjust the machine. ♦ I couldn’t work with the guard on. It slowed me down. ♦ Listen I’ve run these machines for years without guards

and I’ve never been hurt. These excuses have been given countless times. After the

accident has happened, the guard is replaced and strict rules are enforced. Of course, it’s too late for the victim. The purpose of meeting on this topic is to make sure rules are enforced before an accident can happen.

Project Description: Notice is hereby given that the City of Paso Robles (“Owner”) has determined that all Contractors and Electrical Subcontractors bidding on the Wastewater Treatment Plant Upgrade Project (“Project”) must be pre-qualified prior to submitting a Bid on the Project. It is mandatory that all Electrical Subcontractors who intend to submit a Bid for this project (“Prospective Sub-Bidders”), fully complete the Statements of Pre-Qualifications (“SOPQ”) package, provide all materials requested herein, and be pre-qualified by the Owner to be on the final qualified Sub-Bidder’s list. The final list of pre-qualified Electrical Subcontractors will be issued following evaluation of the SOPQ packages.

The City owns, maintains, and operates a 4.9 million gallons per day (mgd) secondary wastewater treatment plant (WWTP) located at 3200 Sulphur Springs Road in Paso Robles. Currently, the annual average flow is 3 mgd (60% of its capacity). The WWTP was built in 1954 and was upgraded or expanded in 1972, 1987, 2002, and 2008 but has not been comprehensively upgraded since 1954. The WWTP upgrade is intended to bring the plant into compliance with current and anticipated discharge regulations, as well as local regulatory requirements and City goals and policies. The upgrade work is to be completed on the site of the existing treatment plant and the existing treatment plant is to remain in operation while the upgrades are constructed.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
