Cal/OSHA has agreed to make early referrals to CSLB in cases where a construction indus-try employer has acted willfully or with gross negligence, violating occupational safety and health standards, as well as state contracting law and trade standards. This proactive step strengthens the collaboration between the two agencies that was formally established in a 2005 memorandum of understanding.

Cal/OSHA currently refers fatalities or serious accidents to CSLB when a citation for serious, willful or repeated action by a construction in-dustry employer has become a final order of the Occupational Safety and Health Appeals Board. Between July 2011 and May 2012, 91 such referrals were made to CSLB.

The two agencies agreed at a recent meeting to aggressively work to ensure that CSLB is

FIRST AID FOR BURNS

A burn can be painful or painless, according to the degree. The degree of a burn is determined by its location on the body and the number

of skin layers affected. A burn can be caused by heat, electricity, chemicals or radiation. The first response in a burn situation is to stop the

heat source or break contact between the heat source and the skin. The body holds in the heat and continues to burn until the skin cools. In

many cases you can cool the burn with water. Unless told to by a medical professional, never use butter or ointments; they seal in heat and

may cause infection. If blisters form, they should not be broken because they protect the burn from infection.

For heat or thermal burns, rinse the burn (without scrubbing) or immerse the affected area in cool water until the pain is gone. With a sterile

cloth pat the burn area dry then cover. For accidents involving drenching by a hot liquid, remove the liquid-soaked clothing or place clothed

victim in water bath or shower. Smother any burning clothing by dropping the victim to the ground and rolling them. Never peal stuck

clothing from a burn.

In cases of electrical burns, turn off the electric power at the source. Do not touch the victim until all wires are clear. Avoid contact with the

electric current while removing the victim. Make sure the victim’s breathing and heartbeat are regular. Treat the victim for shock and make

sure they get medical attention. Check places where the electricity entered and exited the victim’s body. Treat minor burns w ith cool water

and have the victim seek medical attention.

With chemical burns, locate the chemical container and follow the label directions for emergencies. Consult the chemical’s Material Safety

Data Sheet (MSDS) or call the Poison Control Center. Remove any contaminated clothing. If the eyes have been affected, flush them for 30

minutes. For acid chemicals, immediately flush the affected area for 15-20 minutes. For dry chemicals, brush the chemical off the skin then

flush the area for 15-20 minutes. Make sure the victim seeks medical attention.

The severity of a burn may not be obvious for up to 24 hours and infection may occur if improperly treated. Always seek medical help if the

victim:

shows symptoms of shock

has head or neck burns or has trouble breathing

has burns on the hands, feet or groin (making muscle and ligament damage more likely)

if second or third degree burns are present

if victim is over age 60 or under 5 years of age

Before an accident happens, know the location of the first aid kit, the nearest telephone, and medical facility. Burns can be painful and

cause irreparable damage in seconds. You must be able to respond appropriately and get medical help as quickly as possible.

PRIMEROS AUXILIOS PARA QUEMADURAS

Una quemadura puede ser dolorosa o no, dependiendo de su grado. El grado de una quemadura está determinado por su ubicación en el cuerpo y el número de capas de la piel afectadas. Las quemaduras pueden ser ocasionadas por el calor, la electricidad, productos químicos o radiación. La primera reacción a una quemadura debe ser detener la fuente de calor o romper el contacto entre la fuente de calor y la piel. El cuerpo retiene el calor y continúa quemándose hasta que se enfríe la piel. En muchos casos puede enfriarse la quemadura con agua. A no ser que lo recomiende un profesional médico, nunca use mantequilla ni otros ungüentos, ya que éstos sellan la quemadura en el calor y pueden ocasionar infecciones. Si se forman ampollas, éstas no deben romperse porque protegen la quemadura contra las infecciones.

Para quemaduras ocasionadas por el calor, enjuague la quemadura (sin frotarla) o sumerja el área afectada en agua fresca hasta que desaparezca el dolor. Con un paño estéril, dé palmaditas al área quemada para secarla y después cúbrala. Para accidentes que involucren quemaduras con líquidos calientes, quite la ropa mojada o coloque a la víctima en un baño de agua o bajo una regadera. Si se incendia la ropa, apáguela tirando a la víctima al suelo y haciéndola rodar. Nunca tire de la ropa si está pegada a la quemadura.

En casos de quemaduras eléctricas, apague la energía eléctrica en la fuente. No toque a la víctima hasta que se haya apagado la corriente. Evite entrar en contacto con la electricidad mientras saca del sitio a la víctima. Asegúrese de que la víctima esté respirando y tenga un pulso regular. Atienda a la víctima contra el shock y asegúrese de que reciba atención médica. Revise los lugares en que el cuerpo de la víctima hizo contacto con la electricidad. Trate las quemaduras ligeras con agua fresca y lleve a la víctima a que reciba atención médica.

Con las quemaduras por productos químicos, ubique el recipiente del producto y observe las instrucciones de la etiqueta del mismo para casos de emergencia. Consulte las Hojas de Datos de Seguridad de Materiales (MSDS, por sus siglas en inglés) o llame a un centro de control de envenenamiento. Elimine cualquier ropa contaminada. Si los ojos han sido afectados, enjuáguelos durante 30 minutos. En el caso de ácidos, lave inmediatamente el área afectada durante 15 a 20 minutos. Para productos químicos secos, quite el producto de la piel con una brocha o cepillo y luego lave el área afectada durante 15 a 20 minutos. Asegúrese de que la víctima reciba atención médica.

La severidad de la quemadura puede no ser obvia hasta que hayan transcurrido 24 horas, y puede infectarse si no se ha tratado correctamente. Siempre haga que la víctima reciba atención médica en los siguiente casos:

Antes de que suceda un accidente se debe conocer la ubicación del botiquín de primeros auxilios, el teléfono y el centro médico más cercanos. Las quemaduras pueden ser dolorosas y ocasionar daños irreparables en sólo segundos. Es imprescindible que usted responda correctamente y obtenga auxilio médico lo más rápido posible.

Our first contractor is 99% sure he knows the answer. We’re here to give him the assurance he needs in providing our answer as we do 100% of the time! New business poses new problems for an aspiring California entrepreneur…

Q: I think I know the answer to this question, but I thought I’d better check with the expert! Contractor’s licenses in AZ, NV, and CA are not transferable, correct? We are in the process of selling the assets of a business and I’m trying to determine if the licenses would transfer. This is not a stock transaction where the license holder would be the same and just the owners would change. We will retain the entity that holds the license (but essentially there would be no assets so it wouldn’t be operating) and the purchasers would be forming their own company to con-duct business. I’m assuming the new entities would have to file for their own licenses? And as always, thank you for your help!

A: As always, thank you for your question! You are correct, in an asset sale since a new entity is being formed, the new company would need to apply for a new contractor’s license and they would be issued a new license number in all those states. Let us know if you’d like our assis-tance with that process in CA, NV or AZ.

Q: We are starting a new business in CA and we want to provide contracting services to hom-eowners such as HVAC, plumbing, pool and spa repair, handyman work, electrical, etc. We won’t be self-performing any of the work, we are just acting as a “one-stop shop” for homeowners to call for their home improvement needs. Will the General Building (“B”) classification be sufficient for our company, or will we be required to have an employee sit each “C” specialty classification?

A: As long as you won’t be self-performing the work, the General Building classification appears to be sufficient. According to the Business and Professions Code 7057(b) “a general building contractor shall not take a prime contract for any project involving trades other than framing or carpentry unless the prime contract requires at least two unrelated building trades or crafts other than framing or carpentry, or unless the general building contractor holds the appropri-ate license classification or subcontracts with an appropriately licensed contractor to perform the work.”

Q: I am an out-of-state contractor and we cur-rently have a license in CA for our corporation but haven’t been getting much work lately. Our qualifying individual has informed us that he is

disassociating from the license and we have 90 days to replace him. Can we just go without a Qualifier since we aren’t really using the license? A: You do in fact have 90 days to replace your Qualifier once he/she disassociates from your li-cense. After the 90 days your license will be Sus-pended. If your intent is not to use the license, we recommend you file as Inactive. In this way you don’t need to have a Qualifying individual, bond, or Worker’s Comp Insurance (as long as there are no employees).

Members of President Obama’s Cabinet and federal prosecutors opposed the change, saying it would make it harder to recoup money needed to recover from wildfires.

Timber companies have countered by saying federal prosecutors routinely sue for much more than the land is worth in an effort to boost the government’s bottom line.

MANDATORY JOB CONFRERENCE: There will be a MANDATORY job conference on September 10, 2012 at 10 A.M. Only those prime contractors attending the job walk shall be qualified to bid the work. It is the sole responsibility of each Prime Contractor to insure that they have signed the meeting attendance sheet prior to the conclusion of the meeting.

EXAMINATION OF SITE: Each bidder shall examine the site of work before bidding and shall be responsible for having acquired full knowledge of the job and of all problems affecting it. No variations or allowances from the contract sum will be made because of lack of such examination.

PROJECT DESCRIPTION: This project is the second of two phases. As part of the second phase, the roofing, windows, and interior and exterior lighting will be replaced with higher efficiency products. Also as part of the second phase, the suspended ceiling will be demoed and the existing barrel roof framing will be exposed and refinished. As part of the first phase of work, per code requirements, electrical panels and wiring was replaced, and interior and exterior doors were replaced. Also as part of the first phase, the Kitchen was renovated and the building was expanded in order to meet the ADA requirements for the renovated restrooms.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
