Understand Prevailing Wage LawsBefore You Bid On Public Works Projects

Complicating matters further, the DOL and state agencies may restrict the types of work that can be performed by workers in certain classifica-tions.

For example, a worker classified as a laborer may not be permitted to perform tasks traditionally associated with members of a particular trade or craft, such as plumbers or electricians.

Cash or fringe benefits?Generally, prevailing wage rates consist of a base rate paid in cash and a fringe benefit amount. Contractors have the option of pay¬ing fringe benefits in cash or applying fringe benefit cred-its for contributions to “bona fide” benefit plans, such as health and life insurance, long-term dis-ability plans, retirement plans, and vacation days or other paid time off.

As the economy continues to struggle, many contractors are adding public works projects to their repertoires just to stay profitable. Public projects can be a lucrative source of new work, but they’re also subject to complex federal and state requirements fraught with traps for the uninitiated. Prevailing wage laws are among the most treacherous.

What’s required?Most federal projects are subject to the Davis-Bacon Act, which requires federal contractors to pay a “prevailing wage.” That is, Davis-Bacon — along with its state counterparts — requires you to pay wages on a public project that are com-parable to wages for similar work in the same geographic area.

What’s more, a majority of states impose similar requirements on state-funded projects. If a proj-ect is financed by both federal and state funds, the higher wage usually applies.

ASBESTOS IN CONSTRUCTION

What is Asbestos? Asbestos is the name given to a group of naturally occurring minerals. Asbestos differs from other minerals, in that it forms long thin fibers instead of crystals. There are six different minerals, divided into two groups, included in the asbestos family. The two groups are Serpentine and Amphibole, and are based on the differences of their crystalline structure. Serpentine forms a sheet or layered structure. Amphiboles form a chain-like structure. Asbestos fibers are naturally occurring and stay airborne very well.

Where do you find asbestos? Asbestos is used in many products because of their high tensile strength, flexibility, and resistance to chemical and thermal breakdown. Asbestos is used in insulation, fireproofing materials, automotive brakes, cement and wallboard materials, floor tiles and roofing materials.

Chrysotile (a member of the Serpentine group) is the most common type of asbestos found in buildings. Chrysotile makes up 90-95% of all the asbestos in the United States. The federal government declared a moratorium on asbestos production in the early 1970’s. Installation of these products continued into the early 1980’s.

Who is at risk of asbestos exposure? The construction trades most at risk from asbestos are insulators, plumbers, pipefitters, electricians, sheet metal workers, roofers, bricklayers, painters, and steel workers. Any construction worker may be exposed occur during maintenance, remodeling, renovation or demolition of older buildings.

How can you become exposed? Disturbing asbestos materials may generate airborne asbestos fibers. Asbestos is only dangerous if it becomes airborne. To be a significant health concern, asbestos fibers must be inhaled over an extended period of time. Asbestos fibers then accumulate in the lungs. As exposure increases, the risk of asbestos related diseases also increase. As long as asbestos containing materials are not damaged, the asbestos fibers do not become airborne and do not pose a health threat.

Asbestos related diseases. Asbestosis– is a scarring of the lung tissue. The scarring impacts the elasticity of the lungs and lowers its ability to transfer oxygen and carbon dioxide. Asbestosis is a slowly progressive disease, taking 15 to 30 years to fully develop.

Mesothelioma– is a type of cancer. This disease attacks the lining of the space holding the lungs, called the pleura. Mesothelioma is considered to be exclusively related to asbestos exposure. Mesothelioma may take 30 to 40 years to develop.

Lung Cancer– is a malignant tumor in the lungs. The tumor grows through the surrounding tissues, invading and blocking the air passages of the lungs. The time between exposure to asbestos and the occurrence of lung cancer may take 20 to 30 years. It should be noted that there is a multiplying effect between smoking and asbestos exposure, which creates a high susceptibility to lung cancer.

How to protect yourself? Before you disturb asbestos (loosen the fibers) you must have special training. OSHA requires a “competent person” to be designated for all worksites that will involve asbestos work. The competent person should inspect the jobsite regularly, be knowledgeable of personal protective equipment, and supervise the work to be done to ensure all safety measures are being taken to prevent exposure to asbestos.

¿Qué es Asbesto? Asbesto es el nombre dado a un grupo de materiales que ocurren en la naturaleza. El asbesto difiere de otros materiales en que forma fibras largas y delgadas en vez de cristales. Incluidos en la familia del asbesto existen seis diferentes minerales, divididos en dos grupos. Los dos grupos son Serpentinos y Anfíbolos, y su división se basa en las diferencias de su estructura cristalina. Los Anfíbolos forman una estructura en forma de cadena. Las fibras de asbesto ocurren naturalmente y se mantienen muy bien en suspensión en el aire. ¿Dónde se encuentra el asbesto? El asbesto se usa en muchos productos por su alta resistencia a la tensión, flexibilidad y resistencia a las sustancias químicas y a la descomposición térmica. El asbesto se usa en aislamiento, materiales a prueba de fuego, frenos para automóviles, cemento y materiales para tablas de pared para construcción, materiales para pisos y para techos. Crisótilo (un integrante del grupo Serpentino) es el tipo más común de asbesto que se encuentra en edificios. El Crisótilo constituye el 90 al 95% de todo el asbesto en los Estados Unidos. El gobierno federal declaró una moratoria en la producción de asbesto en la década de los setenta. La instalación de productos que contienen este material continuó hasta principios de la década de los ochenta. ¿Quiénes corren riesgos por exposición al asbesto? Los trabajadores manuales que corren el mayor riesgo de exposición al asbesto son los que instalan aislamiento térmico, los plomeros, los instaladores de tuberías, los electricistas, trabajadores de láminas metálicas, instaladores de techos, albañiles, pintores y trabajadores en la industria del acero. Cualquier trabajador de la industria de la construcción puede resultar expuesto durante trabajos de mantenimiento, remodelado, renovación o demolición de edificios viejos. ¿Cómo puede usted resultar expuesto? Cualquier disturbio a los materiales que contienen asbesto puede generar fibras de asbesto en suspensión en el aire. Para que éstas se conviertan en un peligro significativo a la salud, es necesario que se inhalen durante un período largo de tiempo. Al hacerlo, las fibras de asbesto se acumulan en los pulmones. Según aumenta la exposición del individuo, el riesgo de contraer enfermedades relacionadas con el asbesto también aumenta. Mientras que no se dañen los materiales que contienen asbesto, las fibras de asbesto no quedan en suspensión en el aire y no presentan peligros a la salud. Enfermedades relacionadas con el asbesto. Asbestosis – es la producción de cicatrices en el tejido de los pulmones. Las cicatrices afectan la elasticidad de los pulmones y disminuyen su habilidad de transferir oxígeno y dióxido de carbono. La asbestosis es una enfermedad de avance lento, que toma unos 15 a 30 años en desarrollarse por completo. Mesotelioma – es un tipo de cáncer. Esta enfermedad ataca el recubrimiento del espacio en que residen los pulmones, conocido como la pleura. El Mesotelioma se considera una enfermedad relacionada exclusivamente con la exposición al asbesto. El Mesotelioma puede tomar de 30 a 40 años en desarrollarse. Cáncer del pulmón – es un tumor canceroso en el pulmón. El tumor crece por todo el tejido que lo rodea, invadiendo y bloqueando el paso del aire a lo pulmones. El tiempo transcurrido entre la exposición y la ocurrencia del cáncer del pulmón puede ser de 20 a 30 años. Cabe notar que existe un efecto multiplicador entre la exposición al asbesto y fumar, lo cual genera una alta susceptibilidad al cáncer del pulmón. ¿Cómo puede usted protegerse? Antes de crear cualquier disturbio en materiales que contengan asbesto (soltar las fibras) es necesario contar con entrenamiento especial. La OSHA exige que se designe a una “persona competente” para todos los sitios de trabajo en que se hagan trabajos en asbesto. Dicha persona competente deberá inspeccionar el sitio de trabajo periódicamente, ser conocedor de los equipos para protección personal y supervisar el trabajo a ejecutar para asegurar que se tomen todas las medidas de seguridad para evitar la exposición al asbesto. We begin with a ‘suspense’ story offered by a contractor who is becoming ‘unqualified’. You need a license to work, but can you participate in bids without one? We ‘demolish’ a miscon-ception for a contractor who learns that ‘break-ing up’ is hard to do…

Q: I’m an out-of-state contractor and we cur-rently have a license in CA for our corporation but haven’t been getting much work lately. Our qualifying individual has informed us that he is disassociating from the license and we have 90 days to replace him. Can we just go without a Qualifier since we aren’t really using the license at the present time? A: You do in fact have 90 days to replace your Qualifier once he/she disassociates from your license. After the 90 days your license will be-come suspended. If you don’t intend on using the license, we recommend that instead of let-ting it go suspended, you file to inactivate it. In this way you don’t need to have a qualifying individual, bond, or Worker’s Compensation in-surance.

Q: I am hoping you may be able to provide some information in regard to one of our Builder’s Exchange members. Their contractor’s license

is listed under one name (that is not incorpo-rated) and they are conducting business under another name. Ultimately, they would like their membership to be reflected under this name, however, our policy is to list members by the name that appears on the CSLB records. Do you have any recommendations on what they need to do with the License Board? Any insight you can provide is greatly appreciated.

A: It appears this contractor is a Sole Proprietor. My recommendation is to file an Application to Change Business Name with the CSLB. This is a one-page form and the Board does not require any fee. On the other hand, if he wants to con-tinue operating under BOTH business names at the same time, he’ll need to apply for a second contractor’s license. He should not conduct business under two different names using once license number. Thanks for the question.

Q: For a public works project, does a sub-con-tractor need a license at the time of bid? The paperwork states that a license is needed at the time the work is to be performed, but doesn’t specify whether you need a license to bid the project. A: I am assuming this subcontractor is bidding to a licensed general contractor? While local

governments may have some latitude regard-ing when a license is required, for the most part, the general and all subs should be licensed at the time of bid. There are several exceptions in Code Section 7028.15, plus if the project in-cludes federal funds, a proper license would be required at the time the contract is awarded. Our suggestion; get the license sooner, rather than later!

Q: I am currently at a project site and we’re having a sub-contractor (who does not have a contractor’s license) come out and crush some concrete. Does he need a license to perform this work and place it in a pile? A: I’m guessing this is not the answer you want to hear, but yes, a contractor’s license is re-quired to break concrete. The appropriate clas-sification to perform this type of work would either be the “C-8” (concrete) or “C-61”/”D-06” Concrete Related Services.

So it’s important to gather records from these sub-contractors to ensure they’re in compliance. What are the penalties for noncom-pliance?The penalties for prevailing wage violations can be severe. Under the Davis-Bacon Act, for example, they may include fines, contract termi¬nation or even “debarment” from future federal contracts for up to three years. And that’s not all — contract payments may be withheld to cover the violator’s liabilities for unpaid wages and certain other damages.

Contractors or subcontractors that falsify pay-roll records or demand kickbacks of wages are sub¬ject to civil and even criminal prosecution.

WATER • Is there plenty of fresh, cool drinking water located as close as possible to the workers?

• Is there a plan for refilling water coolers throughout the day?

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
