CSLB and Partners Enforce Workers’ Compensation RequirementsAll licensees are required to provide CSLB with a copy of their WC insurance policy or file an exemption from WC that is signed under pen-alty of perjury that they have no employees. If CSLB determines an exemption from WC either was filed falsely or is no longer valid because a licensee has employees, the license is suspend-ed in 30 days unless the licensee obtains a valid WC policy or provides confirmation that he/she no longer employs workers.

If you are a licensee who has previously filed an exemption from WC but now has a WC policy, do not rely on the insurance company to notify the board. Please check your license history on CSLB’s website at Instant License Check, and if board records still indicate an exemption from WC, please fax a copy of your WC certificate to 916.255.4023.

Stop Orders are proving to be an extremely ef-fective tool to enforce workers’ compensation laws. State law was enacted on January 1, 2011, giving CSLB legal authority (Business and Pro-fessions Code section 7127) to issue them. Stop Orders halt work at active job sites when unli-censed individuals and licensed contractors are found not to be carrying workers compensation (WC) insurance or have claimed to be exempt from the insurance requirement when, in fact, they have workers.

CSLB Enforcement staff and district attorney investigators work in teams and visit construc-tion sites to verify WC compliance. A CSLB in-vestigator will issue an administrative citation to an uninsured licensee for filing a false ex-emption from required WC insurance as well as a Stop Order that precludes the licensee from having employees perform any additional work until a valid WC policy has been obtained. The DA investigator will issue the licensee a Notice to Appear (NTA) in Superior Court to answer to criminal charges for failing to secure WC.

CAL/OSHA INSPECTIONS

Cal/OSHA inspectors make unannounced visits to ensure California workplaces are safe and healthy. If your business has a documented uncontrolled hazard and, as a result, receives a Cal/OSHA citation, the resulting penalties, legal issues, and lowered employee morale and publicity can have serious financial and business impacts. Managers, supervisors, and employees need to know what to expect during a Cal/OSHA inspection and how to respond appropriately.

Cal/OSHA conducts site inspections in cases of imminent danger or industrial accidents. A fatal injury to one or more employees; a serious injury or illness; a serious exposure; or the inpatient hospitalization, regardless of duration, of three (3) or more employees (a catastrophe) will trigger an accident investigation and must be reported to Cal/OSHA within 8 hours. Inspectors also focus on high-hazard work sites and industries with loss rates at or above Bureau of Labor Statistics averages.

Inspectors will also visit worksites as a response to employee complaints posing an imminent danger. At times, employee complaints may be considered low risk. These are handled with a letter reporting general information and a request to follow-up and report back within a certain time period. Conduct investigations into these complaints, gather documentation, and submit it in writing on time to the Cal/OSHA office. Note that the name of the complaining employee will be kept confidential. It is against the law to retaliate against employees for reporting safety hazards and concerns.

Cal/OSHA inspectors will present their identification and request permission from a management representative to conduct a site inspection. Instruct your receptionist and/or security personnel on which management staff should be notified of a visit. Inspectors will wait on site about one hour for management contact. They will conduct an opening conference to explain the reason for the visit. Inspection walkthroughs may include your entire facility, or a targeted work area. Inspectors have the right to walk around the building (accompanied), interview employees in private, and document hazards with photos and measurements.

When you work with an inspector, be courteous and friendly. Limit the inspection focus to only the documents and facility areas listed in the opening conference. Accompany the inspector at all times, though private employee interviews can be arranged in controlled access conference rooms. Provide neutral, fact-based answers to the inspector’s questions; don’t offer opinions or guess at answers. It is okay to offer follow-up at a later date. Don’t argue with an inspector. Also, don’t agree with comments as they may be incorrect. Don’t make jokes about health and safety, worksite, or personnel matters. Keep notes, photos, and records during the visit. If the inspector takes measurements or readings, conduct the same measurements and readings simultaneously.

After the walkthrough, the inspector should conduct a closing conference to provide inspection results, next steps, and timelines. Inspectors may request protocols, work procedures, or other documents. Deadlines for submittal range between 24 hours and 14 days. The Injury and Illness Prevention Program (IIPP) may be required immediately, since it is required to be readily accessible to employees. Conduct follow-up investigations, corrective actions, and gather requested documents and provide them to the inspector by the stated deadline. Missed deadlines can result in further site inspections or citations.

Cal/OSHA inspections are unannounced. Start planning now so you can present a competent, organized, and compliant response to a Cal/OSHA inspection. Designate and train staff to respond to Cal/OSHA inspectors. Maintain your safety programs and employee training procedures at appropriate levels. Keep safety records organized and on site and ensure key staff know how to access them.

Los inspectores de Cal/OSHA hacen visitas sin anunciarse para asegurar que los sitios de trabajo de California sean seguros y saludables. It’s ‘Bond,’ contractor’s Bond that, like fictional super-spy 007, becomes the target for our first ‘shot’ in an-swering questions this edition. Another contractor ‘assumes’ responsibility for his answer and we alert all contractors to a phone scam to beware of right now…

Q: The assets of our company were sold and your firm assisted us with obtaining new licenses in CA, NV, and AZ. Can we cancel the bonds that we have on file for the old company, or are we required to keep them active for a period of time?

A: Once the licenses are cancelled, you should contact your insurance company and request that the Bonds be cancelled as well. We’re not aware of any require-ment for them to remain on file. This being said, in CA for instance, consumers can make a claim against the Bond for up to two years after cancellation. Q: My insurance company did not renew my Con-tractor’s Bond and now my license is suspended. I contacted them and they are going to write a new Bond. This means my license will show a suspension for these past weeks and this makes me nervous. Do you know if they can backdate the Bond so there is no break?

A: I can tell you that the CSLB will accept a “back-dated” Bond if it is received within 90 days of the ex-

piration date. They will retroactively lift the suspen-sion, which means it will not show on your record. Whether your bonding company will backdate the Bond is up to them.

Q: We currently have a Joint Venture (JV) license made up of three entities and we would like to remove one. I assume that when we remove that entity we will also need to amend the name of the JV to remove that company’s business name. Is this possible and how is it done? A: Joint Ventures are treated the same as Partner-ships, which means when you remove an entity (partner) from the license the license is cancelled. So, in order to do business as the Joint Venture with just the two remaining entities, you would need to apply for a new license. Also, you are correct that when you apply for the new license you will need to amend the business name. As you may already know, an acceptable Joint Ven-ture business name must include the full business name of each entity listed, part of each entity’s busi-ness name, or a completely fictitious name.

Both California and Nevada Issue an “Industry Alert”

Nevada and California want to give contractors a heads-up on a situation they’re dealing with in both

States. This Industry Alert warns of a scam targeting existing licensees as well as new license applicants. According to CSLB Registrar Steve Sands at least one “unscrupulous company is using information from CSLB’s website to contact licensees or applicants to mislead and scam them”. According to Mr. Sands, the caller leads the licensee or applicant to believe he or she works for the Contractors Board and needs to pay money over the phone to get continuing education credit, renew a license or to schedule a licensing exam.”

There is NO law requiring continuing education in CA or NV. Further, CSLB and Nevada License Board staff will never ask for credit card information over the phone, nor do they have the authority to pro-cess any payment by phone. The CSLB has begun putting warnings in place on letters sent to applicants and with their renewal notifications. Both agencies have also prominently placed warnings on their web sites. Beware.

Currently, local permitting agen-cies maintain differing permit processes for small solar PV instal-lations. These differences have created a confusing patchwork of requirements, which has made installing solar PV more expensive and slowed the expansion of this technology in California.

OPR has convened stakehold-ers from local government, the building industry, professional associations, solar companies, utility providers, and state regu-latory agencies to tackle this problem. One result of this collec-tive effort is this solar permitting guidebook, which provides local governments and solar contrac-tors information and strategies to improve the permitting process. These improvements to local per-mitting will enable more solar en-ergy generation in California com-munities and expand the many benefits provided by this form of renewable energy.

The California Energy Commission, the Governor’s Office of Planning and Research, and others in-volved in the solar industry have compiled a free California Solar Permitting Guidebook as a blue-print to more efficiently navigate the solar con-struction permitting process. This publication aims to help contractors, building owners, and local governments improve permitting for small pho-tovoltaic systems, and promote solar energy use in their communities. The three main sections ad-dress California laws and regulations, the process for project approvals, and recommendations for improving permit processes for solar installations.

In order to expand small-scale renewable energy across California, Governor Brown instructed the Governor’s Office of Planning and Research (OPR) to help remove barriers to its development. One such barrier is the confusing variety of permitting requirements for small solar photovoltaic (PV) in-stallations throughout the state. Solar PV systems, which use solar panels to convert sunlight into electricity, have been installed in California for de-cades. The technology of solar PV systems and the methods to install and maintain these systems are well established. As a result, permitting for these small and simple solar PV projects should be as simple and standardized as possible.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
