Play to Save Redevelopment Funds On December 29, 2011, the California Supreme Court ruled in the redevelopment litigation -- CRA v. Play to Save Redevelopment FundsOn December 29, 2011, the California Supreme Court ruled in the redevelopment litigation -- CRA v. Matosantos – upholding ABX1 26 which abolished redevelopment agencies, but striking down companion legislation that would have allowed agencies to survive if they contribute money to the State. As part of the Supreme Court’s ruling, agencies are to be dissolved on February 1, 2012. A coalition of labor, business, local government, public safety and affordable housing advocates is working with members of the Legislature to pass SB 659 and temporarily postpone the February 1, 2012 dissolution dead-line in order to preserve the ability to develop a new program.

If agen-cies are dissolved on February 1, 2012, succes-sor agencies are responsible for winding down all assets, properties, contracts, leases, records, buildings, and equipment of the former redevel-opment agencies, and laying off workers – ac-tions that are difficult to do in short time frame.

WORKING AGAINST VIOLENCE

Perhaps workplace violence can’t be totally eliminated, but there are things that can be done to minimize it. Awareness and preparation are key factors.

Evaluate the security of all work sites, establish a security plan for each location, and update the plan on a regular basis. The chance of violence is greater for certain jobs including jobs of contact with the public, working in late or early hours, exchanging money, delivering goods or services, high stress jobs, high crime areas, and if working alone or in small numbers.

Initiate safety measures. Increase security with alarms, closed-circuit cameras or guards. Lock doors to limit public access. Increase visibility with lighted entrances and exists. Shields workers with windows, partitions or high and wide counters. Alter cash handling policies or install drop safes. Arrange furniture so workers cant be trapped by an attacker. Remove potential weapons from desktops (scissors, staplers, and paperweights).

Hire responsibly. No one should be hired without a reference check.

Clearly communicate company policy about violence and reprisals. Employee manuals should clearly explain what behavior is acceptable, what is not, and what will be done by whom, if violence occurs. It should contain written criteria for reporting incidents and repercussions if an incident occurs. Employer response should be predictable and consistent.

Create clear levels of authority and procedures for dealing with the risk of and response to violence in advance. If a threat of violence is identified, potential victims or targets should be alerted along with others who may be affected, such as supervisors or front office personnel.

Train workers to recognize early signs of potential violence. The most commonly mentioned warning signs are: a history of violent behavior, an obsession with weapons, carrying a concealed weapon, verbal threats of harm, being paranoid, being a loner, obsessive involvement with the job, holding a grudge, workplace physical actions, bizarre comments or expressing extreme desperation over recent family, financial or personal problems. Employees should take all threats seriously and report any bizarre or suspicious behavior.

Give workers training in nonviolent response techniques and conflict resolution, to reduce the risk of volatile situations leading to physical violence. Training should also be given in how to respond to a violent situation.

Workplace violence takes a toll on both employers and employees. It affects not only those assaulted, but also those who are witnesses. It can negatively affect the future reputation of a business.

Quizás la violencia en el trabajo no pueda eliminarse por completo, pero hay cosas que pueden hacerse para minimizarla. Los factores claves son estar conscientes y preparados.

Evalúe la seguridad en todos los sitios de trabajo, establezca un plan de seguridad para cada uno de ellos, y actualice dicho plan periódicamente. La probabilidad de que surja la violencia es mayor en ciertos trabajos que incluyen contacto con el público, trabajo de noche o en horas tempranas de la mañana, intercambio de dinero, entrega de mercancías o servicios, empleos de alto estrés, áreas de alto índice de crimen y trabajos solitarios o en grupos pequeños.

The waiting is over after more than a decade of demand contractors can form a new ‘structure’ for licensing their business. For many years in CA the State refused to allow Limited Liability Com-panies (LLC) to be licensed as contractors. With this pent-up demand now released the rush is on at Capitol Services…

Q: Now that a LLC can be licensed, we would like to transfer our corporation number to the new LLC. Can this be done?

I have received many questions during the past few weeks related to the new LLC license. I am familiar with several corporations that were formed for the express purpose of doing busi-ness in CA until such a time as the state allowed LLC construction companies to become licensed. The new law amended Section 7075.1 to allow the transfer of a corporate license “to a limited liability company that is formed by a corpora-tion to continue the business of the corporation subsequent to the cancellation of the corporate entity’s license, provided the personnel listed for each entity are the same.”

A potential for problems with this transfer is the corporation will cease to exist and this may call into question ongoing contracts.

Q: We are looking into the dissolution of our present corporation, and would like to know if we can transfer our contractor’s license to the

new corporation.

A: According to B&P Code Section 7075.1, if forming a new corporation you’re only allowed to transfer the current license number to the new entity under the following conditions: “...when the parent corporation has merged or created a subsidiary, the subsidiary has merged into the parent corporation, or the corporation has changed its filing status with the Secretary of State from a domestic corporation to a for-eign corporation or from a foreign corporation to a domestic corporation.” For any of these sce-narios the formation of the new entity must be to continue the business of the formerly licensed corporation.

Q: We’re considering offering a gift card to any homeowner who signs up for new flooring dur-ing the month of February (amount to be deter-mined). Do you think this would be acceptable under CSLB rules?

A: According to B&P Code 7157(b), A contrac-tor or his or her agent or salesperson may give tangible items to prospective customers for advertising or sales promotion purposes if the gift is not conditioned upon obtaining a home improvement contract and does not exceed five dollars ($5).

Unless the offer involves a very minimal gift card, you may instead want to offer a rebate or reduc-

tion in contract price because it is not consid-ered “tangible”.

This is based on an Attorney General opinion from 1985. In response to a question from an Assembly member, the AG concluded, “as an inducement to contract, a home improvement contractor may offer a homeowner cash rebates or discounts on the purchase of products or ser-vices”. This “non-tangible” rebate could include carpeting, painting, cabinetry, or any of several other ‘home improvement’ trades.

Enforcement Bill Passes CommitteeSB 691 (Lieu), which adds the Contractors State License Board (CSLB) to the list of authorized governmental entities that EDD may share infor-mation with for the purposes of aiding any spe-cific workers’ compensation fraud investigation, passed the Senate Labor Committee this week. Sponsored by the CSLB, SB 691 seeks to permit the Employment Development Department to share employment data and information with the CSLB for the purposes of investigating any specific workers’ compensation fraud investiga-tion. Contractors such as roofers and electricians face some of the highest workers’ compensation premiums due to injuries, but also suffer from some of the most significant rate distortion due to misreporting and underreporting. While the CSLB must ensure that licensed contractors ap-propriately maintain workers’ compensation

coverage, they do not currently have statutorily guaranteed access to EDD’s databases to investi-gate possible workers’ compensation fraud.

The committee also defeated two bills authored by Senator Tom Berryhill and sponsored by As-sociated Builders and Contractors (ABC) that would have made change to prevailing wage laws. SB 725 and SB 727 would have made nu-merous and major changes to current prevailing wage law as it relates to determining rates and dollar thresholds.

AB 890 (Olsen) was passed by an Assembly Com-mittee and exempts from the California Environ-mental Quality Act (CEQA) a project or activity undertaken by a city or county to improve public safety within an existing road bed, provid-ed the project or activity is not for the purpose of increasing traffic capacity.

AB 249 (Bill Berryhill) was held in an Assembly

committee and will be reintroduced as a new bill to give additional time to resolve numerous outstanding issues. The bill sought to address a complex provision of law that would eliminate a person’s ability to sue to recover all compensa-tion for construction work performed by an “un-licensed contractor” whose license has lapsed, unless the lapse is due to the license being sus-pended or revoked. Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
