Hiring a Fellow Contractor?Be Careful of License Status Before Hiring

Before hiring another contractor, be sure to check their contractor license status with CSLB. Con-tracting with a licensee who has been disciplined might result in disciplinary action against your license.

State contracting law (Business and Professions Code section 7121) allows you legally hire a sus-pended or revoked licensee, but only as a non-supervisory employee. Plus, you must obtain

workers’ compensation coverage and pay the proper payroll taxes for that employee.

Investigation of a recent consumer complaint revealed that a revoked licensee convinced a li-censee in good standing to change his business name and address of record so that the revoked licensee could contract under that license. The licensee in good standing informed the inves-tigator that he was unaware that it is illegal to employ a revoked licensee, other than in a non-supervisory capacity. The revoked licensee had hired and trained employees, prepared con-tracts, and had full control of the business op-erations.

Upon learning of B&P Code section 7121 and related violations, the licensee sev-ered his relationship with the revoked licensee. The licensee’s actions have been referred for citation, and the revoked licensee is fac-ing criminal prosecution for numerous B&P Code viola-tions.

HOUSEKEEPING ON CONSTRUCTION SITES

Picture your construction site in your mind. Construction sites can be busy and hectic with many workers and multiple contractors carrying

on different yet simultaneous operations. What would happen if these groups never cleaned up after themselves? Trash and debris would

pile up to become one large hazardous obstacle course. Imagine how difficult it would be to maneuver around such a site. How would you

dodge the falling materials thrown or accidentally pushed over the sides of the building? How you would find your tools and supplies if they

were covered by debris from other workers? A construction site with poor housekeeping is not productive nor is it a safe working

environment.

Although, the overall safety of a construction site is the ultimate responsibility of the general contractor who maintains the site safety plan

and communicates its information to all of the subcontractors on site, every worker on the site is responsible for safety. It ’s every worker’s

responsibility to know and following the site safety plan, practice good housekeeping, follow recommended work practices, and promptly

report and/or correct hazards at the worksite.

If you’re a construction site worker, you must do your part to keep the worksite free of unnecessary clutter and debris that could cause an

injury or accident. Try to limit the amount of materials and chemicals onsite to the quantities that you will need. As you go about your daily

work, place trash and debris in the proper receptacles located conveniently throughout the job site. Remove combustible materials such as

wood and paper from the site promptly. Keep form and scrap lumber with protruding nails cleared away from work areas, passageways, and

stairs. Remove or bend over protruding nails prior to disposal and storage.

Keep storage, staging, and work areas, along with all stairs and walkways on the construction site, free of obstructions, and debris. Store

tools and materials neatly and out of the way in storage bins or lockers and keep flammable or hazardous wastes in covered, segregated

waste containers. Ensure that materials stored on roofs or at heights are secured. Never throw waste, materials, or tools from a building or

structure. Debris chutes are a safe means of removing this material from an elevated work site. Guard the area where the material could fall

and post signs around the workplace to wear hard hats and watch for falling debris. Place protective guards across areas where workers

may could fall or could face an impalement hazard. And, control muddy areas using fill, gravel, boards and plywood, or other means.

You can do your part to keep the worksite a safer place for yourself and your coworkers, if you just remember to clean up as you go and at

the end of each shift.

Las obras de construcción pueden ser muy concurridas y frenéticas, con muchos trabajadores y diversos contratistas llevando a cabo

diferentes actividades pero simultáneas. ¿Qué pasaría si ninguno de esos grupos hiciera sus tareas de limpieza? La suciedad y los

desperdicios se acumularían hasta convertirse en una peligrosa carrera de obstáculos. Imagínese lo difícil que sería desplazarse por un

sitio como ese. ¿Cómo esquivaría usted los materiales que caen o que accidentalmente se tiran por los lados del edificio? ¿Cómo

encontraría usted sus herramientas y suministros si estuvieran cubiertos por desperdicios de los otros trabajadores? Una obra de

construcción en desorden y sin limpiar no es un ambiente de trabajo productivo ni seguro.

Aunque la seguridad general de una obra de construcción es, en última instancia, la responsabilidad del contratista general, quien debe

mantener el plan de seguridad del sitio y comunicarle la información contenida en él a todos los subcontratistas presentes, cada trabajador

en la obra es responsable de la seguridad. Cada trabajador es responsable de conocer y obedecer el plan de seguridad, practicar el buen

orden y limpieza, cumplir con las prácticas recomendadas de trabajo, y reportar y/o corregir de inmediato los peligros en el sitio de trabajo.

Si usted es un trabajador en una obra de construcción, debe hacer su parte para mantener dicho sitio libre de desorden y desperdicios que

puedan causar una lesión o accidente. Trate de limitar la cantidad de materiales y sustancias químicas presentes en el sitio a sólo lo que

necesitará. Según hace sus tareas diarias, coloque la basura y los desperdicios en los recipientes apropiados ubicados por todo el sitio de

trabajo. Saque rápidamente del sitio los materiales combustibles, tales como madera y papel. Mantenga los encofrados y pedazos de

madera con clavos salientes alejados del sitio de trabajo, pasillos y escaleras. Saque o doble los clavos salientes antes de desechar o

almacenar las tablas.

Mantenga libres de obstrucciones y desperdicios todas las áreas de almacenaje, recopilación de materiales y áreas de trabajo, así como

todas las escaleras y pasillos en la obra. Guarde las herramientas y materiales en forma ordenada, apartados de las áreas de tráfico, en

cajones o armarios, y mantenga los desperdicios inflamables o peligrosos en recipientes separados y cubiertos. Asegúrese de que todos

We often hear from people looking for a ‘short cut’ in obtaining a contractor’s license. Some-times our expertise finds a quicker route, but of-ten just doing the right thing is the contractor’s best choice. In the current economy people are looking for alternatives to get back to work and contracting is sometimes a choice for that new vocation…

Q: We’re an out-of-state full service contractor. One of our clients has asked us to handle con-struction management for the site prep on a new project in Nevada. We will subcontract all work to local contractors who of course will be properly licensed in the area of the project. What licensing will the state require of us? A: Even as a Construction Manager sub-con-tracting all the work to licensed contractors, you will be required to have a Contractor’s License in Nevada. Bidding on work and signing con-tracts for construction work requires a license. It sounds as if the A-7 (Excavating and Grading) classification is what you will need if you’re do-ing site work. There is no trade test for the “A-7” in Nevada, so only the Business/Management exam will be necessary.

Q: I hope you can help me. I was laid off from a

telephone company last year and want to restart my cabinet shop. Prior to working for the phone company I spent approx. 10 years in construc-tion as a finish carpenter handling residential and commercial cabinetry. Basically I have a ton of experience, but my verifiable experience is more than a decade old. Will that qualify me for a “C-6” license? A: The CSLB will only consider work experience that occurred within the last ten years, so unfor-tunately it doesn’t appear that you will qualify at this time. Note if you have a 4-year college de-gree, the State may credit you 2 years in lieu of experience depending on your field of study.

Q: I’ve seen on the CSLB website where a ho-meowner can qualify for a Contractor’s License, but I’m not sure how that process works (the site is a bit confusing). Any words of wisdom will be truly appreciated. A: The CSLB will give partial work experience credit to individuals who have done work on their own property as owner/builder. How-ever, it is difficult to qualify for a Contractor’s Li-cense solely based on this basis. For example, it may have taken you a year and a half to build your home, but the CSLB may only grant you 6

months for that work. Even if you have worked on or built several properties, the Board is very tough in granting this type of experience credit. You’ll likely need to show other work or educa-tional background.

Q: We are going to need to replace the Respon-sible Managing Employee (RME) on our license once again. You helped us with the application process originally, but this will be our third time in the last year. Is the Contractors Board going to hold this against us?

A: This is not an issue. The Board will not hold it against a company if they replace their Qualifier several times in a year. There is however, a “rule of three” for individual Qualifiers. You can only personally qualify up to three licenses in any one year.

New research shows that workers are not only getting less sleep than they should, they’re get-ting less than they used to. In 2005, the National Sleep Foundation (NSF) estimated that overall U.S. adults are sleeping an average of 6.9 hours a night.

Sleep deprivation is becoming more prevalent due to the ever-increasing demands of personal and professional work life. People work all day and in the evening, they take more time to enjoy television, watch movies, or participate in other social activities.

The downside is that many people try to pack in too many activities, and end up feeling fatigued or sleep-deprived at work. And depending on the workplace, a lack of sleep can be dangerous - af-fecting judgment, health, and safety.

Some short term effects of sleep deprivation in-clude:

a decrease in daytime alertness by 32 per-•cent due to a reduction of 1.5 hours of sleep for one night.a twofold risk of sustaining an occupational •injury.

decreased alertness, and impaired memory •and cognitive ability.drowsy drivers responsible for at least •100,000 crashes, 71,000 injuries, and 1500 fatalities annually according to the National Highway Traffic Safety Administration (NHT-SA).

Some of the long term effects of sleep depriva-tion are:

high blood pressure•heart attack•heart failure•stroke•obesity•psychiatric problems.•

Workers must assess how much sleep they need to perform optimally. If they haven’t gotten enough sleep to function well at work, they should prob-ably take the needed time to recuperate. Workers should pay attention for signs of lost concentra-tion, and nodding off. A quick fix is to get up and stretch or walk around, or get a drink of water or grab a light snack.

Although workers’ sleep habits are largely out of

an employer’s control, employers should educate workers on the effects of inadequate sleep and the resulting fatigue. Also, having an employee who is tired and works beyond a regular shift may increase the risk for injury.

The (NSF) suggests that individuals establish a regular sleep schedule, exercise during the day, and relax before bedtime. And for several hours before bedtime adhere to the following tips:

Avoid heavy meals and caffeine.•Consume less or avoid alcohol and nicotine.•Drink fewer fluids that may disrupt sleep.•Use caution with certain drugs or sleep aids •as they can sometimes interfere with natural sleep.

Remember that worker fatigue due to inadequate rest is everyone’s problem because it can affect more than the individual involved. Worker fatigue can have catastrophic safety or financial effects on families, businesses and even, depending on the job, the general public.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
