HAZARDOUS MATERIAL DISPOSAL

Many businesses generate wastes that are considered hazardous or harmful to human health or the environment because they are flammable, corrosive, reactive, or toxic. Due to the harmful potential of hazardous materials, workers must remain aware of the safety hazards and proper handling and disposal procedures in order to protect the environment, themselves, and comply with state and federal regulations.

Workers that generate or handle hazardous waste require training on the hazards and safe, proper handling of these materials. Training should cover the procedures for collection, labeling, and storage of the hazardous waste before it is transported for final disposal or treatment. In addition, workers should be trained on emergency procedures and accidental spill response for the materials that they work with.

Hazardous materials should never be disposed of down the drain or in regular trash receptacles. They should be put into proper and compatible containers that can be securely sealed. Compatible container materials ensure that wastes will not react with or corrode them. The containers should not be completely full; a “head space” allows for waste expansion. The sealed containers should be labeled with the name and hazard class of the waste along with the words ‘Hazardous Waste’ and the date it was generated.

Waste containers should be stored in a secure manner and protected from extreme environments. They should be segregated and stored in compatible hazard classes (flammable, corrosive, oxidizers, etc.) to prevent hazardous reactions if the wastes combine. The containers should remain closed during storage, except when adding or removing waste.

Proper handling and storage of waste containers can prevent ruptures, overturns, or other failures. They should not be stacked or handled in a manner that could cause them to fail. Some flammable material containers may require grounding and containers should be seismically secured, if possible, to prevent spills in an earthquake. Waste storage time limits vary depending on the facility or material; workers should be familiar with the requirements for their worksite and wastes.

Storage areas for hazardous wastes should be inspected at least weekly. Secondary containment can prevent spills, but if a leak or spill occurs, workers should follow facility spill and emergency response procedures. Spill kits should be available for such emergencies; all cleanup materials should be handled as hazardous waste.

Proper waste documentation is important to track and maintain accountability for hazardous waste prior to shipment. Workers should be familiar with the documents required for their facility and waste types including EPA Identification numbers issued by the Environmental Protection Agency and Uniform Hazardous Waste Manifests. Workers must receive training before they can sign waste manifest documentation. Transportation of hazardous wastes should be done according to regulation requirements and by dedicated hazardous waste haulers.

Proper training and knowledge can help workers ensure that hazardous wastes are safely and properly handled from “cradle to grave.”

DESECHO DE MATERIALES PELIGROSOS

Muchos negocios generan desperdicios que se consideran peligrosos o dañinos a la salud humana o la medio ambiente porque son inflamables, corrosivos, reactivos o tóxicos. Debido al potencial dañino de los materiales peligrosos, los trabajadores deben permanecer conscientes de los peligros a la seguridad, el manejo apropiado y los procedimientos de desecho con el objeto de proteger al ambiente, a sí mismos y cumplir con los reglamentos federales y estatales.

Los trabajadores que generan o manejan desperdicios peligrosos requieren capacitación sobre sus peligros y sobre el manejo seguro y apropiado de estos materiales. Esta capacitación debe cubrir los procedimientos para recolección, rotulado y almacenaje de los desperdicios peligrosos antes de que se transporten a su sitio de desecho o tratamiento final. Además, los trabajadores deben capacitarse en procedimientos de emergencia y respuesta a derrames accidentales de los materiales con los que trabajan.

Los materiales peligrosos nunca se deben desechar tirándolos por un sumidero ni en recipientes de basura comunes. Se deben poner en recipientes compatibles apropiados que se puedan sellar herméticamente. Los recipientes compatibles aseguran que los desperdicios no reaccionen con los recipientes ni los corroan. Los recipientes no se deben llenar por completo, sino que se debe dejar un espacio arriba para la expansión de los desperdicios. Los recipientes sellados se deben rotular con el nombre y la clase de sustancia peligrosa que contienen, junto con las palabras “Hazardous Waste” (Desperdicios Peligrosos) y la fecha en que se generaron.

Los recipientes de desperdicios se deben almacenar de forma segura y protegerse contra ambientes extremos. Debe segregarse y almacenarse en clases de sustancias peligrosas compatibles (inflamables, corrosivas, oxidantes, etc.) para evitar reacciones peligrosas si los desperdicios llegan a entrar en contacto. Los recipientes deben permanecer cerrados durante su almacenaje, excepto cuando sea necesario añadir o extraer desperdicios.

Con el manejo y almacenaje apropiado de los recipientes de desperdicios se pueden evitar roturas, vuelcos y otras fallas en los recipientes. No se deben apilar ni manejar de manera que pueda ocasionarse su falla. Los recipientes de algunas sustancias inflamables pueden requerir conectarse a tierra y los recipientes deben estar sujetos contra sismos, si es posible, para prevenir derrames en caso de un sismo. Los límites de tiempo para el almacenaje de desperdicios varían según el sitio o el material; los trabajadores deben familiar izarse con los requerimientos para su sitio de trabajo y sus desperdicios.

Las áreas de almacenaje para desperdicios peligrosos deben inspeccionarse al menos cada semana. Una contención secundaria puede prevenir derrames, pero si ocurre una fuga o derrame, los trabajadores deben seguir los procedimientos de respuesta de emergencia de su sitio de trabajo contra derrames. Debe haber kits de respuesta a derrames disponibles para dichas emergencias y todos los materiales resultantes de la limpieza se deben tratar como desechos peligrosos también.

La documentación correcta de los desperdicios es importante para poder hacer seguimiento y mantener la responsabilidad de los desperdicios peligrosos antes de su transporte. The CA Contractor’s Board is making decisions that will have ramifications for all who ‘qualify’. More than one Registrar is also ‘aiming’ high in defeating some low-down activity…

At it’s September meeting in Sacramento the CSLB took action on a number of issues, including setting up a Task Force to look at the duties and responsi-bilities of qualifying individuals. The discussion cen-tered around a perceived lack of “understanding by license applicants, licensees and the public on the minimum requirements of the individual qualifying on behalf of a firm (Responsible Managing Officer (RMO) or Qualifying Partner (QP)”.

The CSLB has determined that some “retiring” li-censees are serving as an RMO on a corporate li-cense for a monthly fee but have “no direct involve-ment in the construction and business activities”. To address this problem, the Board has recommended that: 1) information be distributed clarifying the du-ties and responsibilities of the qualifying individual; 2) pursue legislation to amend B&P Code 7068.1(d) to provide for disciplinary action “when a licensee or qualifier fails to comply with the duties and re-sponsibilities the qualifying individual certified he/she would perform”; and 3) “establish a task force to further identify the scope of the problem; investi-gate suspected individuals who attempt to qualify multiple licenses; and explore administrative and

legislative remedies.”

We would also like to see the Task Force look at a fourth area to make clear that a Responsible Man-aging Officer is in compliance with the Board’s rules and regulations where, for instance, there are mul-tiple ongoing projects some of which are overseen by his or her director of operations, project man-ager, superintendent, etc.

The task force may want to look at what we perceive as a disturbing trend where attorney’s go to court to challenge a contractor’s legitimate compliance with Code Section 7068.1 in order to make a case for using what might be described as ‘draconian’ penalties in B&P Code 7031 (the section of law that deals with recovering compensation and/or forcing a contractor to pay back all monies received on a contract if they’re determined to be “unlicensed”).

Also, according to a recent Press Release, for the second time in three months, the California Con-tractors Board (CSLB) and Arizona Registrar of Con-tractors (ROC) joined with several other state licens-ing boards, including Nevada, Utah, and Oregon in a sting of unlicensed contractors advertising on Craigslist. The combined effort led to over 150 unlicensed contractor investigations. In CA alone, 36 individuals were arrested and now face misde-meanor charges of contracting without a license,

illegal advertising and/or requesting an excessive down payment. According to the Board, “eight of the phony contractors were issued Stop Orders”.

Additionally, the participating Contracting Boards along with the National Association of State Con-tractors Licensing Agencies (NASCLA) again issued a nationwide consumer alert regarding irregulari-ties on the Internet. According to CSLB Registrar Steve Sands, “While Craigslist serves as a valuable free tool for legitimately licensed and insured con-tractors, the number of illegal and deceptive ads is growing like wildfire”.

The Arizona sting led to 9 unlicensed contractor investigations. The ROC routinely refers unlicensed contracting cases to the Maricopa County Attor-ney’s office for prosecution.

Not only are these State agencies trying to protect consumers by deterring illegal construction activi-ties, but they also aim to level the playing field for legitimate contractors in the industry.

Be Aware of Fines or PenaltiesThe civil penalty for licensees who violate adver-tising laws can range from $100 to $5,000, with multiple penalties for multiple violations.

Unlicensed Operators Can AdvertiseUnlicensed operators can legally advertise for construction work or improvements if the cost of the work (combined labor and materials) is under $500. However, they must state in the ad that they are “unlicensed.” Unlicensed operators face fines or criminal prosecution if they adver-tise as a contractor in a telephone directory or any other advertising forum.

Setting Up a Tailgate/Toolbox Safety Meeting Tailgate or Toolbox safety meetings are 10-15 minute on-the-job meetings held to keep employees alert to work-related accidents and illnesses. Tailgate/toolbox safety meetings have proved their worth by alerting employees to workplace hazards, and by preventing accidents, illnesses and on-the-job injuries. Why Have Them?

In both the tunneling and construction industries, tailgate safety meetings are required by Title 8, Sections 8406 and 1509 of the California Code of Regulations.

While tunneling and construction are the only industries that specifically require tailgate safety meetings, all California employers must have a safety program that includes employee training in safe work practices.

Tailgate/toolbox safety meetings can be used to address actual problems on the job or in the shop. The supervisor leading the meeting can draw on the experience of workers, and use that experience to remind all employees –especially newer ones – of the dangers of working with particular kinds of machinery, tools, equipment and materials. What to Talk About?

Talk about work practices, machinery, tools, equipment materials, attitudes, and anything else that may cause or contribute to a work-related accident or illness. Keep the topic relevant to the job or tasks at hand.

An excellent source for construction related topics is the publication Cal/OSHA Pocket Guide for the Construction Industry. Supervisors can choose individual sections or topics and relate them to their specific site requirements. Copies can be ordered from the Division of Occupational Safety and Health.

Choose a topic you think needs safety review. If you notice that spills aren’t being cleaned up promptly, discuss it. If there has been an accident or a near-accident on the job, talk about it. What happened? Where did it happen? How can it be prevented from happening again? Encourage employees to suggest topics. They often know best - what and where the dangers are. How to Run a Good Meeting 1. Hold the meeting on the job, preferably where everyone

can sit and relax. 2. Hold meetings at the beginning of shift or after a break. 3. Choose the topic carefully. Topics should be about health

and safety problems on the job. Research the problem before the meeting. For machinery, consult the manufacturer’s operations manual. For handling toxic substances, get a copy of the material safety data sheet. Your company’s insurance carrier is another good source

of information. Cal/OSHA also supplies a wide range of printed material on worksite safety and health.

4. Don’t choose too broad a topic. 5. Encourage employee participation - keep your meeting

short. Sample Topic for Tailgate/Toolbox Safety Meetings:

Why are guards left off machines? Guards are placed on machines to prevent workers from

contacting moving parts. They are required by Cal/OSHA regulations.

Many California workers are killed or injured every year because guards are removed and not replaced.

Why are guards left off? Ask the group to give reasons. Some common ones are:

♦ I didn’t have time to replace the guard. ♦ I wanted to make sure the machine was working okay. I

just never got around to replacing the guard. ♦ I put on a new drive and the old guard didn’t fit. ♦ I had to remove the guard to adjust the machine. ♦ I couldn’t work with the guard on. It slowed me down. ♦ Listen I’ve run these machines for years without guards

and I’ve never been hurt. These excuses have been given countless times. After the

accident has happened, the guard is replaced and strict rules are enforced. Of course, it’s too late for the victim. The purpose of meeting on this topic is to make sure rules are enforced before an accident can happen.

Project Description: Notice is hereby given that the City of Paso Robles (“Owner”) has determined that all Contractors and Electrical Subcontractors bidding on the Wastewater Treatment Plant Upgrade Project (“Project”) must be pre-qualified prior to submitting a Bid on the Project. It is mandatory that all Electrical Subcontractors who intend to submit a Bid for this project (“Prospective Sub-Bidders”), fully complete the Statements of Pre-Qualifications (“SOPQ”) package, provide all materials requested herein, and be pre-qualified by the Owner to be on the final qualified Sub-Bidder’s list. The final list of pre-qualified Electrical Subcontractors will be issued following evaluation of the SOPQ packages.

The City owns, maintains, and operates a 4.9 million gallons per day (mgd) secondary wastewater treatment plant (WWTP) located at 3200 Sulphur Springs Road in Paso Robles. Currently, the annual average flow is 3 mgd (60% of its capacity). The WWTP was built in 1954 and was upgraded or expanded in 1972, 1987, 2002, and 2008 but has not been comprehensively upgraded since 1954. The WWTP upgrade is intended to bring the plant into compliance with current and anticipated discharge regulations, as well as local regulatory requirements and City goals and policies. The upgrade work is to be completed on the site of the existing treatment plant and the existing treatment plant is to remain in operation while the upgrades are constructed.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
