Legal revisions mainly change the wording and format of the mechanics lien no- tice. Because of the changes, CSLB has updated release forms to reflect the new language. New Mechanics Lien Release Forms Available on CSLB WebsiteUpdated forms reflect legal changes that took effect July 1, 2012

SACRAMENTO – The Contractors State License Board (CSLB) is reminding licensees of revisions that were made to the state’s mechanics lien laws on July 1, 2012. Legal revisions mainly change the wording and format of the mechanics lien no-tice. Because of the changes, CSLB has updated release forms to reflect the new language. Con-tractors can use these documents to protect their lien rights on construction projects. The forms are available on the CSLB website (www.cslb.ca.gov).

The 20-Day Preliminary Notice is now simply called Preliminary Notice. In addition, the word-ing of the Notice to Property Owner statement, required as part of the Preliminary Notice, has changed. Subcontractors and suppliers should use the newly worded Notice for private home improvement projects. The Preliminary Notice should be delivered to the homeowner in per-son or by certified, registered, or express mail, or overnight delivery, with a receipt of the mailing as proof. You may give notice any time before work starts or products are delivered, and up to 20 days after. If you give notice more than 20 days after work or delivery, your lien rights only apply to the work or products provided 20 days before the no-tice was given, and anytime thereafter.

AERIAL PLATFORM SAFETY

Jobsites are not always at ground level. Sometimes, workers need to use aerial platforms, aerial ladders, articulating boom platforms,

vertical towers, or ladder trucks to reach their work. All work has hazards and risks involved in it, but when you work at an elevated height,

extra training and attention to safety procedures is a necessity.

In order to work safely with aerial platforms, get training on the operating procedures for your job site and task. Get specialized training on

each aerial lift model you will use. Know the risks and hazards involved with aerial work, including your own risk of falling and the hazard of

dropping objects on to coworkers below. Learn to tether your tools and equipment and ensure that coworkers underneath the platform are

wearing hard hats.

Formal inspections and maintenance of aerial platforms should be scheduled based on the environment and how often the machine is used.

Before performing maintenance on an aerial platform, lower it to the full down position. Switch all of the controls to the off position. Apply the

brakes and/or use chock blocks. Lock out the power and bleed the hydraulic lines. Never modify or alter your aerial platform without written

permission from the manufacturer because changes could alter the structure and stability. Never operate the aerial platform from a scaffold,

trailer, or boat without written permission from the manufacturer.

In addition to regular inspections and maintenance, inspect the platform each time before you use it. Look for proper function of the controls.

Make sure that the emergency lowering mechanism works. Watch for wear and tear. Check for proper fluid levels and no leaks. Never use

equipment if it is not working properly. Tag it out of service until it can be repaired.

When you are planning your work, first ensure that the platform is appropriate to the task. Make sure that loads are within the capacity limit

and are stowed properly for stability. Always use the outriggers and stabilizers required for the aerial platform and check for uneven

surfaces and debris in the work area. Look for overhead obstructions and electrical lines. Avoid using aerial platforms outside in bad

weather and high winds. Don’t use an aerial platform if it has to be stabilized against another building or object. Never use your aerial

platform as a crane.

Before working on an aerial platform, put on the appropriate fall protection gear. Consider a fall limiter so that you do not fall too far off of the

platform. Make sure that guardrails are installed and access gates are closed before you raise the platform. Keep both feet on the platform

at all times and do not reach too far out. Do not use lumber or ladders to get additional height on the platform. Do not step on guardrails or

gate rungs and do not climb out of the platform for any reason. If you will travel with the aerial platform, go slowly in order to watch for

overhead hazards and people down below.

Las obras no siempre se llevan a cabo en lugares nivelados. A veces los trabajadores tienen que usar plataformas aéreas, escaleras aéreas, plataformas con brazos articulados, torres verticales o camiones escalera para alcanzar su sitio de trabajo. Todas las tareas tienen sus peligros y riesgos, pero cuando se trabaja a alturas elevadas, se necesita una capacitación adicional y prestar particular atención a los procedimientos de seguridad.

We ‘heat’ up the discussion with contractors as a warning reminder to stay cool on the job this summer. Another contractor is concerned about what happens if his Qualifier gets thrown ‘under the bus’. A general gets advice on ‘cover-ing’ his base, and more on the statewide crack-down on the economic ‘underground’…

Q: I am President of this company and as we discussed, we intend on using “Bob” to be our qualifying person for our CA contractor’s li-cense. That being said, what happens if “Bob” gets hit by a bus or leaves the company for any reason? What is the typical protocol for compa-nies in dealing with this issue? Look forward to your response.

A: The State of CA has a procedure in place should your qualifying individual (in this case “Bob”) leave or be unable to continue as your Qualifier for any reason. The Contractors Board will give a company 90 days to replace this in-dividual, during which time the license remains in good standing as if the Qualifier were still there.

Q: We are bidding a public works project for new construction. The question came up: Can an “A” License contractor install exterior fire service items or does it require a “C-16” license? What research I found, I don’t see where the “C-16” li-cense is necessary because I hold an “A” general license, but I want to make sure I’m covered.

A: Your covered! General Engineering (“A”) contractors can self-perform the installation of exterior fire service items like water mains, fire hydrants, and other related fixed works requir-ing specialized engineering knowledge and skill.

WARNING! It’s the time of year when tempera-tures can rise to over 100 degrees. The sum-mer sun is more direct and radiant heat from the sun and ground (concrete, asphalt, etc.) can take its toll on construction workers. MOST IM-PORTANTLY, know the symptoms of heat stress, heat exhaustion and heat stroke.

As most readers know, it’s recommended that you try to perform the heaviest work first thing in the morning when heat exposure is less. Use mechanical equipment whenever possible to eliminate or reduce manual labor in the heat. Schedule frequent rest breaks in a cool spot or shade; have plenty of drinking water available (i.e. stay hydrated), and stay away from caf-feinated drinks and alcohol. Finally, take pre-cautions to protect your skin (hat, long sleeve clothing, etc.), eyes (sunglasses), and use sun-screen.

Dubbed, “Operation Underground”, investiga-tors from the Contractors State License Board (CSLB), Department of Insurance (CDI), Employ-ment Development Department (EDD) and county District Attorneys’ offices partnered for

a series of sweeps at suspected illegal construc-tion sites on June 20 and 21, 2012. Sweeps were conducted in 11 counties, where over 100 enforcement actions were issued for, among other things: failure to carry Worker’s Compen-sation insurance; under-reporting the number of workers to obtain cheaper insurance premi-ums; and cash payments to avoid payroll with-holding taxes.

“Participants in the state’s underground econ-omy are harmful to everyone,” said CSLB Reg-istrar Steve Sands. “Anyone who neglects their responsibility to comply with state contract-ing, insurance, and payroll requirements drives up premiums. At the same time, legitimate li-censed contractors struggle because illegal op-erators underbid them.”

According to Insurance Commissioner Dave Jones, “Operation Underground is a result of the partnership under the Joint Enforcement Strike Force to aggressively combat the underground economy”. Jones stated, “Legitimate businesses that play by the rules are often forced to close their doors because illegal businesses are cheat-ing the system.”

Accidents that happen around cranes, booms, and buckets are serious and can result in inju-ries and fatalities. Following proper safety pro-cedures is important. Make sure lifting equip-ment is in safe operating condition to perform the job. The area covered by the boom should also be taken into consideration. It is important to remember that only employees known to be qualified in the safe operation of cranes or hoist-ing apparatus are permitted to operate such equipment.

A “qualified person” as defined by Cal/OSHA is a person designated by the employer; and by reason of training, experience, or instruction has demonstrated the ability to perform safely all assigned duties; and, is properly licensed in accordance with federal, state, or local laws and regulations when required.

Take the following guidelines into mind when working with or around cranes to help promote a safer jobsite:

• A qualified person must visually inspect the crane’s controls, rigging, and operating mecha-nism prior to the first operation on any work shift.• Know the safe working load of the equipment being used and never increase the load beyond the manufacturer’s rating or original design limi-tations.• Determine the load weight and rig it properly to prevent shifting and release of any parts.• Keep the crane on a firm and level surface. If the ground is muddy or uneven, stabilize the crane by approved means.• All travelling cranes should have proper clear-ance between the crane and any stationary structures or material.• Conduct several test lifts before working the lift.• The load must be kept under control at all times.• Safely land and properly block the load before unhooking or unslinging.• Keep cranes and booms away from overhead lines and from the edge of excavations.

• Cranes must not be operated with wheels or tracks off the ground unless properly bearing on outriggers.• Cranes should be positioned so that the boom or bucket can’t be swung over workers.• On a crowded or busy job site, the swing area should be roped off or barricaded and signs posted to keep unauthorized persons out of the hazard zones.• No one should be allowed to ride on a load that is being lifted. • The operator should respond to signals only from the appointed signal person, but must obey a stop signal at any time.• An audible warning device should be mounted on each crane, within easy reach of the opera-tor.

By being aware and alert to the dangers and tak-ing the necessary precautions, workers can pre-vent crane-related accidents and injuries.

WATER • Is there plenty of fresh, cool drinking water located as close as possible to the workers?

• Is there a plan for refilling water coolers throughout the day?

SHADE AND REST • Is a shade structure available at all times (regardless of the weather) for workers to

rest and cool down?

• Is the shade structure up and ready when the weather forecast is 85ºF or higher?

• Do you have a plan in place for checking the weather forecast?

TRAINING • Have workers been trained to recognize and prevent heat illness BEFORE they start

working outdoors?

• Can workers identify symptoms of heat illness?

• Is there a special plan in place to allow workers to get used to the heat?

EMERGENCY PLAN • Does everyone know who to notify if there is an emergency?

• Can workers explain their location if they need to call an ambulance?

• Does everyone know who will provide first aid?

WORKER REMINDERS Have workers been reminded to:

• Drink water frequently?

• Rest in the shade for at least 5 minutes as needed?

• Look out for one another and immediately report any symptoms?

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
