What Can and What Can’t General Building Contractors Do?By CSLB

Under California law “B” General Building contrac-tors have spe-cific guidelines to follow when it comes to trades they can per-form.

Business and Professions Code section 7057

states that a general building contractor only can take a prime contract that requires two or more unrelated building trades, and that framing and carpentry cannot count as one of the two trades. However, a general contractor may take a prime contract that is only for fram-ing and carpentry, and no separate unrelated trade. If a B licensee takes a subcontract, it, too, must involve two unrelated trades (not includ-ing framing and carpentry toward the two) or a B can subcontract to only do the framing and carpentry.

There is no limit to the number of unrelated trades a “B” licensee can perform on a given contract, provided that there are two or more, and that framing and carpentry don’t count as one of the two that must be performed at a minimum.

Two trades that a “B” license holder may not

Requirements for Contractors Include Certification & Training

Firms must have one or more “Certified Renovator” assigned to jobs where lead-based paint is disturbed. To • become certified, a person must successfully complete an EPA training course conducted by an EPA-accredited training provider.

All renovation workers must be trained. They can be trained to • use lead safe work practices on-the-job by a Certified Renovator if the work is not HUD regulated, or they can become Certified Renovators themselves.

Firms performing renovation, repair or painting work must also • become certified. This can be accomplished by applying to EPA and paying a fee.

Beginning on April 22, 2010 renovation, repair and painting contractors must:be “RRP certified”• use lead safe work practices when working in homes built before 1978.•

The RRP rule affects contractors, property managers and others who disturb known or presumed lead-based paint during renovation activities done for compensation. The includes most repair, remodeling and maintenance jobs, such as window replacement, weatherization and demolition. The rule applies to any work that disturbs painted surfaces in residential houses, apartments and child-occupies facilities such as schools and day-care centers built before 1978. Fines for violating RRP Rule requirements can be up to $37,500 per incident.

PUT SAFETY IN GEAR WHEN BACKING

There are probably several reasons for the frequency of accidents when backing up vehicles. One may be that the driver fails to exercise

the usual precautions, think that a backing accident is unlikely to result in personal injury. Then too, the driver may think that little damage is

done, because the vehicle is being operated at low speed.

Many backing accidents occur because operators rely too heavily on their vehicle mirrors. Even with the best of mirrors and mirror

arrangements, there still are blind spots to the sides of the vehicle and b behind it.

To reduce the number of backing accidents, we have to know and observe e necessary preventive measures. Here are some guidelines:

1. Make every effort to avoid backing. Park so that you can move forward when starting. Avoid making "Y" turns in driveways or

roads.

2. Park in a location away from traveling or parked vehicles, thus avoiding setting yourself up for a collision.

3. If parked in one spot for any period of time, walk around your vehicle and check for any children, other vehicles or obstacles.

(Did you ever wonder why some companies require a cone to e placed at the rear of any parked service vehicle? Thats one

reason.)

4. Whenever you cant see through a rear window, the law requires that a signal person be stationed where they can view the rear

of the vehicle and be seen by the operator.

5. Before backing, sound your horn with two quick beeps, check rear and side view mirrors, watch side clearances and then back

slowly.

Backing a vehicle is often said to be a true test of a drivers ability. Backing accidents can be prevented.

Probablemente existan varias razones que expliquen la frecuencia de los accidentes al retroceder vehículos. Una razón puede ser que el

conductor no tome las precauciones usuales, pensando que un accidente en retroceso probablemente no resulte en lesiones personales.

También es posible que el conductor piense que el vehículo recibiría pocos daños por estar moviéndose lentamente.

Muchos accidentes al retroceder ocurren porque los conductores se confían demasiado de los espejos retrovisores. Aun con los mejores

espejos o juegos de espejos existen puntos ciegos (los cuales el conductor no puede ver) ya sea detrás o a los lados del vehículo.

Para reducir el número de accidentes al retroceder, es necesario saber y poner en práctica las medidas preventivas necesarias. Considere

las siguientes reglas:

Haga todo lo posible por no tener que retroceder. Estacione de manera que pueda transitar hacia adelante cuando arranque de

nuevo. Evite dar vuelta en forma de "Y" en las calles y entradas a garajes.

Estacione en un lugar alejado de otros vehículos estacionados o que estén transitando, y de esa manera evitar el peligro de un

choque.

Si el vehículo ha estado estacionado durante algún tiempo, dé una vuelta a su alrededor para verificar que no haya niños, otros

vehículos u obstáculos presentes. (¿Ha pensado alguna vez por qué algunas empresas exigen que se coloque un cono detrás

de los vehículos de servicio estacionados? Ésta es una de las razones.)

WATER • Is there plenty of fresh, cool drinking water located as close as possible to the workers?

Can a legal judgment ‘ricochet’ from its intended target? Our first contractor is hoping to get out of harm’s way before the legal battle is joined. We share the steps another contractor must ‘dance’ in a corporate shuffle. We will help an-other questioner ‘plug in’ to the reason he may, or may not, need to file a CA contractor’s license application…

Q: Okay, say a contractor disassociates from a company while there is a lawsuit pending but before a judgment is obtained, and then asso-ciates with another company. If a judgment is later obtained against the first company will it follow the license holder to the new company?

A: In my opinion, the judgment should not fol-low the contractor under your suggested sce-nario. However, he or she will likely be required to divulge a suit is pending when associating with the second company. Generally, the Board’s policy is that judgments apply to personnel who are still listed on the license. Personnel who have previously disassociated should not be held re-sponsible. The date of disassociation is critical and this is not a ‘get out of jail’ free card.

Q: Our Company recently converted from a “C” Corp to an “S” Corp. Ownership has remained the same. Do we need to do anything with our License? One of your recent Q&A articles in our local contractor’s builder exchange newsletter

spoke about a Sole Owner who converted to an “S”, therefore needing a new license. Are we in the same boat?

A: When converting from a “C” corporation to an “S” corporation (or vice versa), you do not need to do anything with your license. The CSLB is not concerned with what type of corporation you are. If you kept the same corporate number (which according to our research looks to be the case) then a new license is not required. A Sole Owner is an entirely different type of business entity than a corporation, hence the need for fil-ing new license application.

Q: If my corporate license were to be suspended, would I be able to use my personal contractor’s license as a back up and continue to work?

A: First, it depends on why the license was ‘Sus-pended’ by the Board. If the Board action is sim-ply related to a Bond or Worker’s Compensation cancellation then that’s one thing. If the Suspen-sion is caused by a judgment or disciplinary ac-tion this is something totally different. We’ll as-sume it’s the former reason.

You can use your personal license as long as it is current and Active. You should consider transfer-ring the contracts that are currently under your corporate license over to your personal license in order to continue work in progress, plus you

would need to sign new contracts under your Sole Owner business name. You should not do business under your corporate license number and name while it is suspended.

Q: We provide a patient safety monitoring sys-tem that utilizes the existing CATV coax system in hospitals and other medical facilities. We place a Server at the CATV demarcation point in the hospital communication room; a Room Con-trol unit (similar to a cable TV set top box) in each patient room; and a computer at each nurse sta-tion using the existing hospital computer net-work. All we do is install and plug in our equip-ment. All new cable/coax installations are the responsibility of the facility using their in-house staff or contractors. Are we required to apply/obtain a contractor’s license to install our own equipment?

A: According to the CSLB, a license would not be required for this type of work. However, if the medical facility you’re doing the installations for requests that you have a contractor’s license, then a “C-7” (Low Voltage Communications) would be the proper classification to apply for.

Enforcement officials with the United States En-vironmental Protection Agency (US EPA) indicate they are relying on tips from the public and indus-try to step up enforcement of the lead paint Reno-vation, Repair, and Painting (RRP) rule. To fully and effectively investigate these tips, complainants should provide as much information as possible, including the company or contractor’s name and address, and a description of the project or activ-ity that is not compliant.

The RRP rule went into effect in 2010. The rule requires that at least one person in any firm that is engaged in construction activities that disturb paint in or on any building constructed in 1978 or before receive training and register with US EPA to be certified. Information on training providers and certification firms are available online. Certi-fication is $300 and is valid for five years. Those who do not complete the training and certifica-tion face fines up to $37,500 for each day of viola-tion.

In 2011, US EPA conducted more than 1,000 com-pliance inspections. An even higher number of these record-keeping audits and on-site inspec-

tions are planned for 2012.

As a contractor, you play an important role in helping to prevent lead exposure. Ordinary reno-vation and maintenance activities can create dust that contains lead. By following the lead-safe work practices, you can prevent lead hazards.

Contractors who perform renovation, repairs, and painting jobs in pre-1978 housing and child-occupied facilities must, before beginning work, provide owners, tenants, and child-care facilities with a copy of EPA’s lead hazard information pam-phlet Renovate Right: Important Lead Hazard In-formation for Families, Child Care Providers, and Schools. Contractors must document compliance with this requirement; EPA’s pre-renovation dis-closure form may be used for this purpose.

Federal law requires renovation firms (including sole proprietorships) to be certified and requires individuals to be trained in the use of lead-safe work practices. To become certified, renovation contractors must submit an application and fee payment to EPA or to the state if you work in one of the states authorized to run their own RRP

programs. Individuals wishing to become certi-fied renovators must take training from an EPA-accredited training provider.

Please note that if you previously completed cer-tain lead-safe work practice training prior to Oc-tober 4, 2011, you may be eligible to take a four-hour refresher course instead of an eight-hour initial course from an accredited training provider to become certified. See a list of eligible courses. Contractors who perform renovation, repairs, and painting jobs should also:Provide a copy of your EPA or state lead training certificate to your client; Tell your client what lead-safe methods you will use to perform the job; Learn the lead laws that apply to you regard-ing certification and lead-safe work practices; Ask your client to share the results of any previ-ously conducted lead tests; Keep records to dem-onstrate that you and your workers have been trained in lead-safe work practices and that you follow lead-safe work practices on the job.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
