Operation Underground Takes Aim at “Off the Books” Activity CSLB and partners to take action against contractors operating in California’s underground economy

SACRAMENTO – Investigators from the Contrac-tors State License Board (CSLB) and their coun-terparts from the state Department of Insurance (CDI), Employment Development Department (EDD), and county district attorneys’ offices part-nered for a series of sweeps at suspected ille-gal construction sites on June 20 and 21, 2012. Sweeps were conducted in 11 counties, where 104 enforcement actions were issued for failure to carry workers’ compensation insurance, under-re-porting the number of workers to obtain cheaper insurance premiums and to pay less payroll with-holding tax, and cash payment to hide unregu-lated practices. Uninsured, untaxed, unlicensed, and unregulated activity is referred to as the un-derground economy.

Sweeps took place in cities within Alameda, Butte, El Dorado, Kern, Los Angeles, Monterey, Orange, Riverside, San Bernardino, Santa Clara, and Yolo Counties. CSLB and its partners targeted 133 con-tractors, suspected of violating the state’s labor, employment, tax, and licensure laws. Some re-ceived stop orders for the workers’ compensation insurance violations, which means they are not allowed to use employee labor until they obtain a policy for their workers and submit proof to CSLB.

LADDER SAFETY 2

Ladders are handy, simple tools to use, but if they are not maintained properly, they can be unsafe. Falls are the third leading cause of

worker deaths, with 609 workers killed and 272,000 injured in 2002. Half of these injuries and deaths involved a ladder. Ladder accidents

can occur if they are faulty, if they have been set up improperly, and if they are used improperly.

While workers are familiar with the rules for safe ladder setup and use, it is important to know how to inspect, maintain, and store ladders

used in the workplace. The materials that go into ladders are designed and engineered to last indefinitely if they are cared for and not

abused. Proper maintenance, care, and an inspection checklist can guard workers against using a faulty ladder.

Neglected ladders can become unsafe ladders, so workers should maintain them frequently. Before using a ladder, it should be inspected to

make sure it is in good working condition. If an inspection shows defects in a ladder, it should be immediately tagged out of service. Broken

or damaged ladders should be properly repaired by a qualified worker or they should be discarded and replaced.

A ladder inspection begins from the top down. Workers should look for loose steps and rungs. The rungs should be sturdy, clean, and not

slippery from grease or oil. The upright ladder legs should be strong and free of cracks, splits, and bent edges. The ladders braces should

be solid. Nails, screws, bolts or other fasteners should be tight. Finally, the ladder feet should be examined and the non-slip base should be

in good repair.

Different ladder types and materials have specific inspection points. Wood ladders should never be painted and should not have cracks or

splits. Metal and fiberglass ladders should be checked for bends and breaks. Metal ladders should be inspected for signs of corrosion. Step

ladders should not be wobbly, a possible indication of side strain, and the hinges should be firm and straight. Extension ladders should have

working extension locks that seat properly. The extension rope should not be rotted or frayed.

Workers should try to prevent ladder damage during transport and use because this can weaken the ladder. When hauling a ladder,

workers should tie it securely to the vehicle to prevent nicks, gouges, or chafing. Damaged bolts and joints can work loose and eventually

cause the ladder to twist and become unstable. Straight ladders should be stored flat or on wall brackets to prevent sagging or warping.

Step ladders should be stored upright and in the closed position. All ladders should be stored in covered, protected areas away from

moisture sources.

Las escaleras de mano son herramientas prácticas y simples de usar, pero si no reciben mantenimiento apropiado pueden ser peligrosas.

Las caídas son la tercera causa más importante de muerte de trabajadores, con 609 trabajadores muertos y 272,000 lesionados en 2002.

La mitad de esas lesiones y muertes involucraron una escalera de mano. Los accidentes con escaleras de mano ocurren si éstas tienen

defectos, si están mal colocadas o si se usan incorrectamente.

Aunque los trabajadores conozcan las reglas de seguridad para la colocación y uso seguro de las escaleras de mano, es importante que

sepan cómo inspeccionarlas, hacerles el mantenimiento y cómo guardar las escaleras que usan en su sitio de trabajo. Los materiales que

Requirements for Contractors Include Certification & Training

Firms must have one or more “Certified Renovator” assigned to jobs where lead-based paint is disturbed. To • become certified, a person must successfully complete an EPA training course conducted by an EPA-accredited training provider.

All renovation workers must be trained. They can be trained to • use lead safe work practices on-the-job by a Certified Renovator if the work is not HUD regulated, or they can become Certified Renovators themselves.

Firms performing renovation, repair or painting work must also • become certified. This can be accomplished by applying to EPA and paying a fee.

The RRP rule affects contractors, property managers and others who disturb known or presumed lead-based paint during renovation activities done for compensation. The includes most repair, remodeling and maintenance jobs, such as window replacement, weatherization and demolition. The rule applies to any work that disturbs painted surfaces in residential houses, apartments and child-occupies facilities such as schools and day-care centers built before 1978. Fines for violating RRP Rule requirements can be up to $37,500 per incident.

Limited Specialty Licensing, DAS Electrical Cer-tification & Worker’s Comp Exemptions

Changes in ‘limited’ specialty licensing in CA has created ‘unlimited’ numbers of relevant ques-tions for contractors. In sharing his disturbing story another contractor will discover there are still a few good options open to him…

Q: I was checking the CSLB website for informa-tion on the “C-61/D-51”, classification. It’s show-ing: “D-51” – Waterproofing and weatherproof-ing — under relevant class. Do you know what the “relevant class” is?

A: The “D-51” (waterproofing and weatherproof-ing) was a “C-61” (limited specialty) category eliminated by the CSLB a number of years ago. This work now falls under any of several clas-sifications, depending on the specific project you’re doing. The “relevant” classifications are “C-39 (roofing), “C-33” (painting), “C-29” (mason-ry), or “C-54” (tile). Therefore, if the waterproof-ing/weatherproofing you’re doing relates to roofing, you’ll need a “C-39”; if painting is your specialty, you’d need the “C-33”, and so on.

Q: Do you have any experience dealing with the CSLB relating to certification of electricians? I was trying to get some idea on what kind of enforcement action is typically taken and what penalties might be expected for non-compli-ance.

A: According to the 2012 License Law and refer-ence book, “Upon referral by the Chief of the Di-vision of Apprenticeship Standards (DAS) alleg-ing a violation under this section, the Registrar of Contractors shall open an investigation”. The Registrar may also initiate an investigation and disciplinary action on his own.

We’re knowledgeable about the history of these certifications through the DAS but have not directly handled any. The CSLB only gets involved as it relates to enforcement actions for “C-10” contractors that do not comply. En-forcement of this certification is relatively new for the CSLB and we’re not aware of any stats regarding how often the CSLB has taken action for non-compliance and what penalties, if any, have been levied.

Q: Thanks for what you do with the industry! I have three questions.

1. We recently had to downsize and lay off all our employees. If I’m the only employee, can I hold a license, be incorporated and not have Worker’s Compensation Insurance? 2. Can I switch my Responsible Managing Officer (RMO) status to a new and different corporation and still keep all my classifications? The new cor-poration would be an “S” or a “C”, if that made any difference. And again the same insurance question if I’m the only employee on this new company. Finally, is there a form to file if I have

no employees?

A: Thank you for the kind words. We’re sorry to hear you’ve had to lay off your employees.

If you’re the only Officer (and employee) on a corporate license as well as the Qualifier, you can hold the license without needing Worker’s Compensation. This would be true for your ex-isting company or “new and different” corpora-tion (“S” or “C”). The form you’ll want to file with the Board is the “Exemption from Workers’ Com-pensation”.

• Investigators in Chico opened one insurance investigation, and two contracting citations are pending in Paradise (Butte County). • Six citations were issued for workers’ comp vio-lations, and three investigations and audits were opened in South Lake Tahoe (El Dorado County). • In Bakersfield, two insurance fraud and two EDD investigations were opened (Kern County). • One contractor caught in Inglewood and anoth-er in Santa Clarita will face tax audits (Los Angeles County). • One insurance investigation was opened in Sali-nas; three were cited for workers’ comp violations in Pebble Beach; one was cited in Carmel for con-tracting without a license and illegal advertising; and two were cited for workers’ comp violations and received stop orders (Monterey County). • Two contractors caught in Riverside face EDD audits, along with one in Temecula (Riverside County). • One contractor caught in Ontario received a citation for workers’ comp violations and faces an EDD audit; one caught in Chino Hills faces an EDD audit; one contractor at a Fontana jobsite

received a citation for aiding and abetting a non-licensee who was cited for contracting without a license and failure to carry workers’ comp; and one EDD audit was opened in Upland (San Ber-nardino County). • Sixteen EDD audits were opened and one per-son was cited for workers’ comp violations in San Jose; and one EDD audit was opened in Campbell (Santa Clara County). • In Woodland, investigators issued six stop or-ders for workers’ comp violations and opened six investigations for insurance and tax fraud (Yolo County).

CSLB urges consumers to follow these tips when hiring a contractor:

• Hire only licensed contractors and ask to see their license and a photo ID to verify their iden-tity. Make sure that all subcontractors also have the appropriate licenses and that the contractor has a good payment history with those supplying project materials. • Always check the license numbers on CSLB’s In-

stant License Check to make sure the licenses are in good standing, and that employees are cov-ered by workers’ compensation insurance. • Don’t pay more than 10 percent or $1,000, whichever is less, as a down payment. There is an exception for about two dozen licensees who carry special bonds to protect consumers. These exceptions are noted on CSLB’s website.• Don’t pay in cash, and don’t let payments get ahead of the work.

The Contractors State License Board operates un-der the umbrella of the California Department of Consumer Affairs. More information and publica-tions about hiring contractors are available on the CSLB website or by calling 800-321-CSLB (2752). You can also sign up for CSLB email alerts. CSLB li-censes and regulates California’s 300,000 contrac-tors, and is regarded as one of the leading con-sumer protection agencies in the United States. In fiscal year 2010-11, CSLB helped recover nearly $45 million in ordered restitution for consumers.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
