However, regulators made several changes that will provide flexibility for contractors working on pre-1978 buildings, strengthen the rule’s health protections, and clarify confusion in the previous version of the rule. Changes to the rule that must be followed by all contractors working in buildings constructed pri- or to 1978 include: Requiring renovators to build a containment wall—a barrier consisting of plastic sheeting or other impermeable material over scaffold- ing or a rigid frame—to enclose an exterior work space and prevent the spread of lead dust outside of the area under certain cir- cumstances; Clarification that uncertified workers should be trained by certified renovators in lead- safe work practices; Clarification that certified renovators should ensure their workers maintain containment and do not spread dust or debris; Allowing states to charge higher penalties for non-compliance with the rule; Clarification that the rule covers other sur- face coatings (such as varnishes and stains) besides paint; More explicit minimum standards for HEPA vacuums; Allowing certified renovators to collect paint chips for lab analysis as an alternative to us- ing test kits (except in California where the State has a more restrictive requirement that only inspector/risk assessors can take paint samples to identify lead-based paint haz- ards). Contractors face minimum fines of $5,000 and a maximum of $37,500 per violation per day for not complying with these federal regulations aimed at protecting them, their workers, and consumers from exposure to dust from lead-based surface coatings. Failure to obtain the legally-required certification puts compliant contractors at a com- petitive disadvantage and puts non-compliant workers and the public at risk for lead exposure. Federal Regulators Adjust Lead Paint RulesFurther Cleaning Verification Not Required

The US EPAdeclined to add dust testing (or clear-ance) requirements to the Renovation, Repair and Painting (RRP) Rule that took effect in April 2010. However, regulators made several changes that will provide flexibility for contractors working on pre-1978 buildings, strengthen the rule’s health protections, and clarify confusion in the previous version of the rule.

Changes to the rule that must be followed by all contractors working in buildings constructed pri-or to 1978 include:

Urgent RequestSBCA & AIA Members Continue Dialog with the

City of Santa Barbara Community Development Dept.By Peter Novak

In an effort to improve the planning and permitting process we are having ongoing meetings with staff at the City of Santa Barbara. Community Development Department. The Community Development Department is responsible for planning & zoning, building and safety, and hous-ing and redevelopment for the City of Santa Barbara.

We need examples/stories from our membership of experiences in the City plan check/permit-ting process that can help illustrate the problems and frustrations that we have experienced. The City is open to dialog and review of the process in order to better serve the community, and is adopting procedural improvements to that end. Please send plan check submittals that illustrate issuescosting time and money to rectify, or examples that tell the story to the SBCA at [email protected]. Along with AIASB, we are continuing our dialog with the City Building Department to collec-tively find ways to improve the plan check/permit process. We are talking to them about:

Creating a more interactive communication through the city’s departmental routing pro-•cedure, allowing a more timely resolution to plan check corrections and requests for more information;Expediting the entire process through the use of email;•Offering a checklist for plan check applicants;•Creating a tiered permit system with a simpler process for small projects;•Offering a pre-application meeting with the Planning Department; assign a designated •planner for each project application;Setting up a digital drawing review process; •

SCAFFOLDING SAFETY

Scaffolding allows workers to do their jobs at elevated heights. Scaffolding includes suspended systems from buildings, supported systems from the ground, and aerial systems on mobile equipment. If not properly trained, those who work on scaffolding systems are at risk for falls or falling objects which could cause serious or even fatal injuries.

To prevent falls, scaffolding equipment should be properly installed and operated. A Cal/OSHA-defined “qualified person” should study the load, bracing, and safety code requirements for each job site. Properly designed scaffolding systems have work levels that are decked with regulation-sized planks and have appropriate worker access. Depending on the height of the scaffold, fall protection can include safety harnesses, guardrails or toe boards.

A “competent person” as described by Cal/OSHA, should inspect the scaffolding before each use to see that it is in good condi tion and operable. Scaffolding should be plumb and level and in firm contact with a stable surface. The scaffolding should be sturdy with all nuts and bolts tightened. Damaged or improperly constructed equipment should not be used. To avoid electrocution hazards, power lines should be at least 12 feet away the scaffold.

Before a scaffold job begins, all workers should receive training on that particular scaffolding system. Training should cover all required personal fall protection equipment. Workers should be trained in how to correctly wear the protection device, how to inspect it before each use, and how to recognize when the equipment should be removed from service. Workers should know to keep their body belt or harness system drop lines away from sharp surfaces and corrosive materials that may weaken the protection device and cause it to fail. They should also be instructed to secure drop lines to separate, sturdy anchor points on structural members of the scaffolding.

Workers should only climb the scaffolding from designated areas on the structure or on properly installed ladders. Workers should practice good climbing techniques including facing the rungs when climbing up or down; using tool belts or approved hoists to carry materials up to the jobsite and thus allow the use of both hands; and establishing solid footing and balance before climbing the structure.

Workers must practice safe behaviors on scaffolding at all times. Only one person should stand on an individual plank at a time. Materials should not be hoisted or placed on cantilevered platforms unless they are designed for it. Bridges between scaffold towers should not be constructed unless a “qualified person” designed them. Workers should also be aware of activities taking place overhead and try to keep tools away from the edges of the scaffold and platform openings so they don’t drop on workers below.

If workers have received proper training and education in scaffold systems, fall protection equipment, and proper scaffold work practices, they can work safely and feel safe at elevated heights.

LA SEGURIDAD EN LOS ANDAMIOS

Los andamios les permiten a los trabajadores desempeñar su trabajo a grandes alturas. Se clasifican como andamios los sistemas suspendidos de los edificios, sistemas soportados desde el suelo y sistemas aéreos con base en equipos móviles. Si las personas que trabajan en sistemas de andamios no están debidamente capacitadas, corren el riesgo de caerse o de ser golpeadas por objetos que caen, lo que puede ocasionar lesiones serias o aun fatales.

Para prevenir las caídas, los equipos de andamio deberán estar correctamente instalados y operarse debidamente. Una persona definida por Cal/OSHA como “persona calificada” (qualified person) debe estudiar las cargas, los tirantes y los requisitos de l código de seguridad para cada sitio de trabajo. Los sistemas de andamio bien diseñados tienen niveles de trabajo con pisos de planchas de tamaño reglamentado y cuentan con un acceso apropiado para los trabajadores. Kalb’s Q & A for ContractorsBy David Kalb, Capitol Services, Inc.

While not a lawyer, I am often asked to provide expert interpretation regarding contractor’s license law. With nearly 30 years assisting con-tractors in Sacramento this is often enough ex-perience to settle a ‘bet’. These two contractor questions demonstrate why it’s important to know the answer before you play your ‘cards’…

Q: Dear Mr. Kalb: I am a member of the Santa Barbara Contractor’s Association and represent a number of General contractors. A friendly dis-pute has arisen over the interpretation of Busi-ness & Professions Code 7057. Half of the con-tractors believe that a GC may only self-perform (either by himself or with his crew) a maximum of 2 specialty trades on a project and the other half believe that a GC can self-perform all of the work under their license. The statute seems to be pretty vague as to whether or not a contractor can do all of the specialty trade work on a single project and there is no case law interpreting this specific issue that any lawyer I know can find.

Subsection (a) seems to say that a GC can do the whole of the project and Subsection (b) seems to say that if the GC does do more than 2 trades they need to be licensed for that additional spe-cialty work. I believe that a GC can do all the trades (except fire sprinkler & well drilling). There is a cup of coffee riding on your interpretation of the statute. If you could let me know or publish the response it would be greatly appreciated.

A: I am happy to provide you with this interpre-tation of 7057 and break the 50/50 tie. The half that “believe that a GC can self-perform all of the work under their license” can collect that ‘cup of java’.

B&P 7057 states that a “B” contractor must per-form “at least two unrelated building trades or crafts other than framing or carpentry”. In other words, two trades are the base, or minimum. There is nothing in the law that limits the “B” to self-performing as many trades as he or she wants (except, as you noted, “C-16” fire protec-tion and “C-57” well drilling). Alternatively, as many GC’s know, they can take a General build-ing contract and sub-contract 100% of the job as long as they use properly licensed sub-contrac-tors for EACH trade or craft.

Granted, the law can appear to be contradic-tory. It does not allow a GC to handle carpentry or framing and ONLY one other trade; yet they can legally self-perform framing or carpentry ONLY even though this is only one trade. Con-fusing? Yes but this is what the law states. These seeming contradictions are also the reason why I regularly receive questions on Section 7057 so please tell the other half who thought 2 trades was the maximum that they are not alone.

I hope this resolves the dispute and the victors enjoy their ‘win’. If you have further questions,

Q: I am the Responsible Managing Officer (RMO) on an existing license (“A” and “B”) and have an offer to become the Responsible Managing Em-ployee (RME) for a new contractor (“B” only). Can I split the licenses and stay on as the “A” only so I can be their new “B” qualifier?

A: Sorry, you would need to disassociate totally from the existing license in order to become the RME for the new company. It is not the number of classifications you hold that determines who can qualify a given contractor’s license. In other words, in your case you cannot split the license classifications.

However, like all rules exceptions exist, and there are several circumstances where an individual can be both the RME and RMO at the same time. Any reader in this situation should contact me personally to discuss your specific situation on a case-by-case basis.

One of our larger home improvement contrac-tors recently informed us that they are hav-ing trouble getting their permits approved for final inspection on a project in one room, where the home did not have updated carbon monoxide protectors (which are now recently required in many jurisdictions), smoke detec-tors, and GFI outlets, even in other rooms.

I know many contracts have provisions that provide that the contractor is not required to perform work required by existing code vio-lations. It may be a good idea to negotiate up-front the price for you to perform this ad-ditional work, so that if you have to perform

the work, you do not get into an argument with the homeowner.

Obviously, whether you have to install an elec-tric or battery operated detector, or the num-ber of detectors or outlets, vary from home to home, or based upon the requirements of the city. Thus, you might include in your descrip-tion of the work, a per unit price for each item that could come up in your business, installed, and then you would only need to prove how many were installed, and the owner would be obligated to pay you for that work.
