On motion by Freeholder Cabana and seconded by Freeholder Lyon the May 14 Regular and Work Session Meeting Minutes; May 28 Work Session Meeting Minutes were approved.

COMMUNICATIONS

1. The Mendham Home School Association is asking permission to hang a banner across Route 24 (CR 510) in Mendham Borough from September 12 – 27 to advertise the Harvest Hustle 5K Race on September 27.

2. The Township of Mendham is asking on behalf of the Mendham Township Library for permission to hang a banner across County Route from September 10 to 22 to advertise the bi-annual Shredder Day event.

On motion by Freeholder Lyon and seconded by Freeholder Cabana, the requests were approved.

Freeholder DeFillippoo stated: “I would like to introduce by title an ordinance entitled, ‘CAPITAL SURPLUS ORDINANCE APPROPRIATING $162,000 FOR THE PURCHASE OF OFFICE FURNITURE FOR THE MORRIS COUNTY PROSECUTOR’S OFFICE.’”

Freeholder DeFillippo moved that the Clerk be authorized to publish the Ordinance in summary form in the local newspaper together with the notice of public hearing and consideration of final passage of this Ordinance which will take place at the Freeholder meeting to be held in the Township of Pequannock,530 Newark-Pompton Turnpike, Pompton Plains, New Jersey, on June 25 at 7:00 p.m.

Freeholder Cabana stated: “I second the motion,” which passed with six YES votes.

Freeholder DeFillippo stated: “I would like to introduce by title an ordinance entitled, ‘BOND ORDINANCE PROVIDING FOR PAVING PROJECTS AT VARIOUS LOCATIONS AT THE MORRIS COUNTY PARK COMMISSION IN AND BY THE COUNTY OF MORRIS, NEW JERSEY, APPROPRIATING $300,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $285,000 BONDS OR NOTES OF THE COUNTY TO FINANCE PART OF THE COST THEREOF.’”

Freeholder Cabana stated: “I second the motion.”

The Clerk called and recorded the following vote:

YES: Freeholders Cabana, Cesaro, DeFillippo, Krickus, Lyon, Scapicchio and Director Mastrangelo (7)

Freeholder DeFillippo moved that the Clerk be authorized to publish the Ordinance in summary form and notification of its passage in the local newspaper in accordance with the law. Freeholder Cabana seconded the motion, which passed with seven YES votes.

PUBLIC PORTION

Ken Dolsky, resident of Parsippany, asked for the status for a proposed resolution to oppose the Pilgrim Pipeline. Director Mastrangelo said the Board needs more information to understand more about it first and then decide.

Kristin Pfeffer and Kristi Conover, residents of Morris Plains, spoke to the Board about their concerns over the Central Park traffic on the residential streets. They would like to see an access road built as soon as possible. Another concern is the demolition of Greystone and the construction of the area. This has caused a lot of tractor trailers as well as dump trucks to enter through Glenbrook Road and Central Avenue. They would like to see the vehicles be directed to the Koch Road/Hanover Avenue entrance/exit. Director Mastrangelo asked that a recommendation be made to Morris Plains to place speed bumps in the necessary areas. Freeholder Lyon said that the delay with a new access route is because it is State owned at this time. He suggested that Ms. Pfeffer and Ms. Conover contact their local legislators. As it pertains to the intended access road, Administrator Bonanni indicated that currently the County does not own the specific property, but that a request for capital funding will be developed ad submitted to the Freeholder Board for 2015. He will continue to keep Ms. Pfeffer and Ms. Conover updated on this matter.

Ben, a resident of Parsippany, would like to see JC&P stopped from putting in oil pipelines in the back of his property. He would like to see an alternate route.

Barbara Eames, Whippany resident, made comments concerning Morris County Chamber of Commerce President Boudreau’s presentation at the work session today. She is concerned about businesses leaving New Jersey and specifically Mennen property, which is leaving the area shortly. She feels that incentives to get businesses here come from taxpayers. Ms. Eames asked that the Freeholders not endorse the State referendum issue.

Tom Ficociello, Morris Plains resident, asked about the GPS directions to Greystone. Administrator Bonanni said that the Park Commission will be making the changes so that the GPS directions will be more direct.

Ken Dolsky, Parsippany resident, said he has attended many meetings and attended the Township meeting in Parsippany. He asked about ordinances which fund capital projects. Treasurer Roe gave a brief explanation of the bonding process.

Joe Mastrosimone, Morris Plains resident, asked about the speed limit in Central Park. (The speed limit is set by the State but patrolled by the Park Police and Morris Plains Borough.) Mr. Mastrosimone would like to see barricades.

Freeholder Cabana presented the following resolutions:

(1)

Whereas, per Road Opening Permit #09-07 issued to Toll Bros., Inc. the original amount was $86,241.21, comprising of $44,738.24 cash and $41,492.97 Bond and

Whereas, Toll Bros., Inc. has requested that $27,500.00 be returned from Cash deposit portion of the permit.

Now Therefore Be It Resolved, by the Board of Chosen Freeholders that the Freeholder Director be authorized to sign and the Clerk shall attest to the Agreement between the County of Morris and Toll Bros., Inc. which allows the Morris County Treasurer to retain Seventeen Thousand Two Hundred Forty Eight Dollars and Twenty Four Cents ($17,248.24) of monies place on deposit for Road Opening Permit #09-07 with Toll Bros., Inc. which Agreement is on file in the Office of the County Engineer, Road Inspection and is made a part hereof by reference.

(2)NOW THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders

Of the County of Morris in the State of New Jersey as follows:

1. That the Plans and Specifications for Sussex Turnpike Improvements in Randolph Township are approved.

2. The Director is authorized to sign the plans.

3. That the County Purchasing Agent is hereby directed to advertise for bids for the project forthwith.

4. This resolution shall take effect immediately.

(3)NOW THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders

Of the County of Morris in the State of New Jersey as follows:

1. That the Plans and Specifications for Sight Distance Improvements Powerville Road (CR618) at Rockaway Valley Road in Boonton Township are approved

2. The Director is authorized to sign the plans.

3. That the County Purchasing Agent is hereby directed to advertise for bids for the project forthwith.

4. This resolution shall take effect immediately.

(4)WHEREAS, on June 24, 2009 the County of Morris entered into a New Jersey

Department of Transportation State Railroad Crossing Master Agreement which would provide funds to the County to improve rail-highway crossings or improvements of crossing surfaces on any public highway under the Federal Highway Safety Act of 1973, as amended by the Intermodal Surface Transportation Efficiency Act of 1991, and in accordance with the provisions of the U.S. Department of Transportation Federal Highway Administration Federal Policy Guide; and

WHEREAS, under the foresaid agreement, funds will be made available by the state in the form of “Change Orders” specifying the nature of the improvements and the funds provided by the State for the same; and

WHEREAS, the State of New Jersey is making available $270,000.00 under Change Order No. 2M57, Project No. STP-C00S(586) Ls5E, for improvements to the Morris Avenue crossing in Rockaway Township and $40,000.00 under Change Order No. 2Z57, Project No. STP-C00S(579)LS4E, for improvements to the Righter Road crossing in Roxbury Township; and

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Morris in the State of New Jersey as follows:

1) That the Director of Finance and County Treasurer is hereby authorized to accept the aforesaid funds, for the aforesaid purposes, crediting the appropriate accounts.

2) That Resolution No. 5, adopted by the Morris County Board of Chosen Freeholders on May 28, 2014, is hereby rescinded.

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of

Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount,

WHEREAS, the Treasurer certifies that the County of Morris has realized or is in receipt of written notification of the state or federal monies cited in this resolution, which meets all statutory requirements and will be included in the 2014 county budget,

1. The County of Morris hereby allocates $450,000 from the Park Commission’s share of the Open Space and Farmland Preservation Trust Fund toward the purchase of the King Enterprises property Located in the Borough of Kinnelon.

2. The Treasurer issue a Certificate of Availability of Funds indicating that funds are available from the Morris County Dedicated Open Space Account #13-290-56-580550-888 and process payment to the grantee as directed by the office of the Department of Planning & Development all in accordance with this resolution.

(26)WHEREAS, Amerigroup Community Care is engaged in the arranging for the

provision of prepaid health care services for its members who are enrolled or will enroll in the New Jersey Managed Medicaid Program; and,

WHEREAS, Amergroup Community Care has contracted with the Department of Human Services of the State of New Jersey known as the “Medicaid/NJ FamilyCare Contract” to arrange for the provision of comprehensive health care services known as the “Managed Medicaid Program” and “the NJ FamilyCare Program” who choose to become enrolled members of the HMO; and

WHEREAS, Amerigroup Community Care has contracted with the State of New Jersey to provide certain management and administrative services for the Managed Medicaid Program; and

WHEREAS, the provider specializes in providing Managed Long Term Support Services; and,

WHEREAS, Amerigroup Community Care wishes to retain the Provider and the Provider wishes to provide the Managed Medicaid Program and the NJ FamilyCare Program Services to its members under the terms of this Memorandum of Agreement to enable the parties to offer this service on the effective date of July 1, 2014.

NOW, THEREFORE, BE IT RESOLVED, the Board of Chosen Freeholders hereby agree to execute the referenced contract.

WHEREAS, it is in the best interest of Morris View Healthcare Center to continue to develop their referral network with qualified providers; and

WHEREAS, Zufall Health, a Federally Qualified Health Provider Of primary medical and dental care to low income and predominantly minority uninsured or under-insured residents, in the northwestern and central New Jersey areas; and

WHEREAS, the Morris View Healthcare Center, County of Morris, wishes to enter into a mutually beneficial patient referral agreement with Zufall Health; and

WHEREAS, this agreement will be effective on July 1 and may be terminated by either party should either program fail to maintain its present authority or standards.

WHEREAS, the State of New Jersey, Department of Human Services, Division of Family Development (DFD) has announced the availability of funds through a grant application for contract SH15014 in the amount of $248,469 for the period of July 1, 2014 through June 30, 2015; and

WHEREAS, emergency food assistance, emergency shelter, hotel/motel placement, case management, 24-hour response and prevention activities including rental subsidies, security deposits, rent/mortgage and utility assistance have been identified as eligible activities targeted to homeless individuals and families; and,

WHEREAS, the grant submission required a “Maintenance Agreement”, Lobbying Debarment, Suspension and Other Responsibility Matters; Drug-Free Workplace Requirements” and “Disclosure of Lobbying Activities” documents submitted with grant application; and,

WHEREAS, the County of Morris Board of Chosen Freeholders have determined it desirable to continue seeking a grant for an additional generator for the Morris View Healthcare Center through the Hazard Mitigation Grant Program.

WHEREAS, on September 12, 2012 a contract was entered into with Keller & Kirkpatrick Inc., for professional engineering services related to construction administration and inspection services for the Phase II Development of playing fields at the Central Park of Morris County; and,

WHEREAS, the aforesaid agreement was for $88,766.00; and,

WHEREAS, the aforesaid agreement was amended by increasing it by $13,000.00 to $101,176.00 and extending it to April 1, 2014 on November 25, 2013; and,

WHEREAS, it has again become necessary to amend the aforesaid agreement by increasing it by $5,000.00 to $106,176.l00 and extending the term to July 1, 2014;

WHEREAS, Keller & Kirkpatrick, Inc. has agreed to perform the service; and,

WHEREAS, the Local Public Contract Law {N.J.S.A. 40A:11-5(1)(a)(i)} requires that the resolution authorizing the award of contract for “Professional Services” without competitive bidding and the contract itself must be available for public inspection;

NOW THEREFORE BE IT RESOLVED by the Board of Chosen Freeholders of the County of Morris in the State of New Jersey as follows:

1. The amendment to the agreement between the County of Morris and Keller & Kirkpatrick Inc., 301 Gibraltar Drive, Suite 2A, Morris Plains, NJ 07950-3409, increasing the amount and extending the term as set forth above, a copy of which is on file in the Office of the County Purchasing Agent and made a part hereof by reference, is hereby approved and entered into by this Board.

2. The Director of the Board of Chosen Freeholders is hereby authorized to sign and execute this amendment, conditioned upon the contractor’s compliance with the requirements set forth in paragraph 4 below.

WHEREAS, Joint Base McGuire-Dix-Lakehurst, Picatinny Arsenal, Naval Weapons Station Earle, the 177th Air National Guard Wing in Atlantic City, and the Cape May Coast Guard Training Center are major Federal Military Assets in New Jersey; and,

WHEREAS, the Rutgers Economic Advisor Service, E/ECON recently conducted a study measuring and modeling the economic contribution to the state’s economy of our Federal Military installations; and,

WHEREAS, the Rutgers Economic Advisor Service determined that, in net, the Federal Government spent nearly $4.8 billion within the state, generating over 45,600 jobs which pay $2.6 billion in salaries and add $3.8 billion of wealth to New Jersey residents; and,

WHEREAS, the aforesaid $4.8 billion in Federal Spending in New Jersey generates $9.6 billion in net business revenues here; and,

WHEREAS, of this total, $4.5 billion is new wealth and was added in the form of gross domestic product by the State; and,

WHEREAS, of this Gross Domestic Product total, over $4.0 billion is in the form of labor income that supports an estimated 73,234 jobs; and,

WHEREAS, all New Jersey’s Military Installations make significant individual and collective contributions to the capabilities of our Armed Forces and our National Security; and,

WHEREAS, maintaining and expanding this military core is nearly as critical for New Jersey’s continued economic welfare as it is to its homeland security missions; and,

WHEREAS, in an era of federal fiscal austerity, policymakers in our Nation’s Capital will be asked to consider proposals to reduce defense spending and the size of our uniformed services;

NOW, THEREFORE, BE IT RESOLVED, by the Board of Chosen Freeholders of the County of Morris in the State of New Jersey as follows:

1) That the Governor and the New Jersey State Legislature are strongly urged to take immediate steps to protect these valuable military assets, in recognition of importance to our Nation’s and our State’s security;

2) That the County of Morris joins with other New Jersey counties and municipalities in calling on elected officials serving New Jersey at all levels of government to work in concert to promote the preservation, growth and development of our New Jersey military facilities.

3) That a copy of this resolution be forwarded to all our local state representatives, to the Morris County Chamber of Commerce, to the Honorable Governor of the State of New Jersey, Chris Christie, to the New Jersey League of Municipalities, to all the Mayors in the County of Morris and to all other Boards of Chosen Freeholders in the State of New Jersey, urging them to adopt similar resolutions.

FREEHOLDER COMMENTS

Freeholder DeFillippo commented about Bayer Pharmaceutical Company.  The mayor reported this morning that Bayer rehabilitated only a portion of the campus where they are and yet Hanover Township is receiving a ratable comparable to the previous owner on the property. There are still acres of property to build on, which she believes are 110 acres, and the township can even consider a parcel for open space. Any additional development will yield additional ratable income for the township. . . a real win!
