It is also proposed to construct a new bridge on the Eastern side of the existing bridge (km 0,2) to accommodate both North/Southbound traffic. 2. Alternative 3 (Preferred Alternative): Construct a new double lane bridge to acceptable geometric standards on the eastern side of the existing bridge to accommodate both North/Southbound traffic.     1. Introduction and Project Proposal:

    Doug Jeffery Environmental Consultants have been appointed by the Provincial Government Western Cape: Department of Transport and Public Works to carry out the Environmental Impact Assessment (EIA) Process required by law. The EIA process is undertaken in terms of the National Environmental Management Act, (NEMA) 1998 (Act 107 of 1998), as amended.

    It is proposed that Main Road 191 (R45) between Paarl and Franschhoek be upgraded between km 0.0 and km 9.57 (Helshoogte Road). The proposed upgrading includes the widening of the road, strengthening of the existing pavement layers and the upgrading of culverts. On average, the widening of the road will be less than 4m, but this may be exceeded where additional turning lanes are needed.

    Please refer to Figure 1: Locality Map attached.

    It is also proposed to construct a new bridge on the Eastern side of the existing bridge (km 0,2) to accommodate both North/Southbound traffic.

    Where such construction occurs within a watercourse or within 32 metres of a watercourse, measured from the edge of a watercourse, excluding where such construction will occur behind the development setback line. 18 The infilling or depositing of any material of more than 5 cubic metres into, or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock from a a watercourse;

    (i) the sea; (ii) the seashore; (iii) the littoral active zone, an estuary or a distance

    of 100 meters inland of the high-water mark of the sea or an estuary, whichever distance is greater –

    but excluding where such infilling, depositing, dredging, excavation, removal or moving

    (i) is for maintenance purposes undertaken in accordance with a management plan agreed to by the relevant environmental authority; or

    (ii) occurs behind the development setback line. 39 The expansion of

    (i) Canals; (ii) Channels; (iii) Bridges; (iv) Weirs; (v) Bulk storm water outlet structures; (vi) Marinas;

    Within a watercourse or within 32 meters of a watercourse, measured from the edge of a watercourse, where such expansion will result in an increased development footprint but excluding where such expansion will occur behind the development setback line. 40 The expansion of

    (i) Jetties by more than 50 square meters; (ii) Slipways by more than 50 square meters; (iii) Buildings by more than 50 square meters; or (iv) Infrastructure by more than 50 square metres

    Within a watercourse or within 32 meters of a watercourse, measured from the edge of a watercourse, but excluding where such expansion will occur behind the development setback line.

    47 The widening of a road by more than 6 meters, or the lengthening of a road by more than 1 kilometer –

    (i) Where the existing reserve is wider than 13.5 meters; or

    (ii) Where no reserve exists, where the existing road is wider than 8 meters –

    Excluding widening or lengthening occurring inside urban areas.

    R545: Listing Notice 2 (18 June 2010) Scoping and EIA:

    18 The route determination of roads and design of associated physical infrastructure, including roads that have not yet been built for which routes have been determined before 03 July 2006 and which have not been authorized by a competent authority in terms of the Environmental Impact Assessment Regulation, 2006 or 2009, made under section 24(5) of the Act and published in Government Notice No. R. 385 of 2006, -

    (i) It is a national road as defined in section 40 of the South African National Roads Agency Limited and National Roads Act, 1998 (Act No. 7 of 1998);

    (ii) It is a road administered by a provincial authority; (iii) The road reserve is wider than 30 meters; or

    The road will cater for more than one lane of traffic in both directions. Before any of the listed activities mentioned above can be undertaken authorisation must be obtained from the relevant authority, in this case DEA&DP. 5. What process will be undertaken?

    The aim of the environmental assessment is to: • Establish the current environmental sensitivity of the

    site. • Determine environmental issues related to the project. • Identify any alternatives to the current concept. • Inform Interested and Affected Parties (I&APs), such

    as neighbours and community groups, about the project and provide opportunity to identify alternatives and issues.

    • Assess the proposals and the issues raised. • Involve relevant specialists to undertake baseline and

    detailed impact assessments. • Assess the proposals and the issues raised. • Recommend the optimal concept, with least significant

    impacts, to the decision-making authority. The environmental process for this project will involve the following steps (Figure 4: Process flow-diagram):

    • Identifying key Interested and Affected Parties (I&APs). Scoping Process

    • Distribute the Background Information Document (BID) (this document).

    • Advertising the project in the Paarl Post, Eikestadnuus and Die Burger with a registration period of 21-days starting Thursday 13 June 2013 to Monday 8 July 2013.

    • Place site notices on site to inform the general public of the process and invite them to register and participate.

    • Open and maintain a registered I&AP database. • Appointment of specialists to determine the current

    environmental status of the site and the constraints for development.

    • Compilation of a Draft Scoping Report (DSR) and Plan of Study for the EIA, identifying what specialist studies are to be undertaken, their site constraints, as well as highlighting all issues and comments raised by I&AP’s and alternatives being considered.

    • Lodge the DSR at the local library and/or another appropriate venue, for public review and comment for a period of 40 days. The DSR and all future documentation will also be available on our company website: www.dougjeff.co.za

    • All comments received will be recorded and responded to by the project team in the form of a Comments and Response Report.

    • The DSR will be updated to a Final Scoping Report (FSR) which is to include the Comments and Response Report. The FSR will be advertised to registered I&APs for a further 21-days.

    • Specialist studies will determine the significance of the potential impacts associated with the proposed development.

    Assessment Process

    • The specialist findings will form the basis of the DRAFT Environmental Impact Report (EIR), as well as the DRAFT Environmental Management Programme (EMP), which will be circulated for public comment for 40 days.

    • Depending on the level of participation, nature of the comments received and findings of the specialists, a Public Open House session may be held during the 40-day comment period.

    • Compilation of the FINAL EIR and Provisional EMP, incorporating all comments received and the project team’s responses to these comments

    • Should any significant changes be made to the Draft EIR, the Final EIR will be made available for an additional 21-day commenting period.

    • The FINAL EIR and Provisional EMP will then be submitted to DEA, with any additional comments, who will make a decision on whether the project will be authorised with conditions or refused.

    • Registered I&APs will be informed of DEA’s decision.

    6 How and why should you get involved?

    You are invited to register as an I&AP in the environmental process for the proposed project. The most important part of the EIA process is public consultation and it provides you with the opportunity to get a better understanding of what is being proposed and to raise any issues or concerns you may have. Please note that in order to be registered as an IAP, you must provide written comments or request that your name be added to the list. Correspondence will only be distributed to registered I&APs. I&APs who are unable to read or write or who otherwise need special assistance to state their views on the proposal, may by appointment (during office hours) request a member of Doug Jeffery Environmental Consultants to assist them to record their comments or objections. In order to register or submit comment, I&APs must refer to the DEA&DP reference number above; must provide their name and contact details (postal address as well as preferred method of communication, e.g. email, fax, registered post, normal post, etc); and must give an indication of any direct business, financial, personal or other interest which they have in the application to:

    1. Inleiding en Projek Voorstel:

    Doug Jeffery Environmental Consultants (Pty) Ltd is deur “the Provincial Government Western Cape: Department of Transport and Public Works“ aangestel om ‘n Omgewingsinvloedbepaling (OIB) Proses soos deur die wet vereis, te onderneem. Die OIB proses word ingevolge die Wet op Nasionale Omgewingsbestuur, (WNOB) 1998 (Wet 107 van 1998), soos gewysig, onderneem.

    Daar word voorgestel dat Hoofstraat 191 (R45) tussen die Paarl en Franschhoek tussen 0,0 km en 9.57 km (Helshoogte Pad), opgradeer word. Die voorgestelde opgradering sluit die verbreding van die pad, die versterking van die bestaande plaveisel en die opgradering van die duikers in. Die verbreding van die pad sal gemiddeld minder as 4m wees, maar kan oorskry word indien daar addisionele draai bane benodig word.

    Verwys na Figuur 1: Liggingsplan aangeheg.

    Dit is ook voorgestel dat ‘n nuwe brug aan die Oostekant van die bestaande brug (km 0,2) gebou word om beide Noord / Suidwaartse verkeer te akkomodeer.

    2. Wat word Voorgestel: Alternatiewe

    Die voorgestelde opgradering sluit in die verbreding van die pad, die versterking van die bestaande plaveisel en die opgradering van die duikers. Daar sal egter drie ontwikkeling voorstelle ondersoek word vir die brug onder die spoorlyn, naamlik: Alternatief 1: Bou ‘n nuwe enkelbaan brug aan westelike kant van die bestaande brug om die Noordwaartse verkeer te akkommodeer. Die bestaande brug bly om die suidewaartse verkeer te akkommodeer, maar die 3.8 m vertikale speling op die bestaande brug is substandaard en kan in die toekoms vereis dat swaar voertuie na die Noordwaartse ryvlak herlei word. Alternatief 2: Bou ‘n nuwe dubbel baan brug op aanvaarbare geometriese standaard, aan die westekant van die bestaande brug om beide Noord / Suidwaartse verkeer te akkommodeer. Die bestaande brug, wat ‘n Nasionale Monument en Erfenisgebied is sal behoue bly om voetgangerverkeer te akkommodeer. Hierdie brug is beplan om onder die spoorlyn oor die rivier te gaan wat verskeie kwessies voordoen, insluitend potensiële oorstromings op die pad. Alternatief 3 (Voorkeur Alternatief): Bou ‘n nuwe dubbel baan brug tot aanvaarbare geometriese standaard aan die oostekant van die bestaande brug om beide Noord /

    Suidwaartse verkeer te akkommodeer. Die bestaande brug, wat ‘n Nasionale Monument en Erfenisgebied is sal behoue bly om voetgangerverkeer te akkommodeer. Die voorgestelde brug sal oor die bestaande Spoorlyn gaan om die brug hoog genoeg te kan maak, asook op veilige hoogte, vry van potensiële vloede. Figuur 2&3: Voorkeur uitleg aangeheg. Geen-Opsie Alternatief: Die bestaande brug behoue bly en slegs die padtekens word aangepas. As gevolg van die swak vertikale speling (3.8 m) sal die pad steeds onveilig vir padgebruikers bly. 3. Wat is die doel van die dokument?

    Die hoofdoel van die Agtergrondinligtingsdokument (AID) is om:

    • Belanghebbende en Geaffekteerde Partye (B&GPe) met inligting aangaande die voorgestelde ontwikkeling te voorsien.

    • Die omgewingsproses wat uitgevoer word, te beskryf. • Om die B&GPe genoegsame tyd te bied om te

    registreer en/om omgewingskwessies en vertoë wat hulle mag hê te opper.

    4. Watter wetgewing is van toepassing?

    Die omgewingsproses word onderneem volgens: • Die Wet op Nasionale Omgewingsbestuur (WNOB),

    1998 (Wet nr. 107 van 1998), soos gewysig. • Die Wet op Nasionale Erfenisbronne, 1999 (Wet Nr. 25

    van 1999) • Nasionale Waterwet, 1998 (Wet 36 van 1998) –

    Watergebruiklisensie

    Die voorgestelde ontwikkeling sal die volgende gelyste aktiwiteite ingevolge die WNOB behels:

    11 Die konstruksie van:

    (i) kanale; (ii) brûe; (iii) damme; (iv) stuwalle; (v) grootmaatstormwateruitlaatstrukture; (vi) marinas; (vii) waterhoofde groter as 50 vierkante meter; (viii) skeepshellings groter as 50 vierkant meter; (ix) geboue groter as 50 vierkante meter; of

    (x) infrastruktuur of strukture wat 50 vierkante meter of meer dek,

    waar sodanige konstruksie plaasvind binne ‘n waterloop, of binne 32 meter van ‘n waterloop, gemeet van die rand van die waterloop, uitgesonderd waar sodanige konstruksie agter die ontwikkelingsterugsetlyn sal plaasvind. 18 Die opvulling of storting van enige materiaal van meer as 5 kubieke meter in, of die baggering, uitgrawing, verwydering of verskuiwing van grond, sand, skulpe, skulpgruis, spoelklippe of rotse uit –

    (i) ‘n waterloop; (ii) die see; (iii) die seestrand; (iv) die kus- aktiewe sone, ‘n riviermonding of ‘n

    afstand van 100 meter landwaarts van die hoogwatermerk van die see of ‘n riviermonding, wat ook al die grootste afstand is,

    maar uitgesonderd waar sodanige opvulling, storting, baggering, uitgrawing, verwydering of verskuiwing –

    (i) is vir instandhouding wat gedoen word ooreenkomstig ‘n betuursplan waartoe die betrokke omgewingsowerheid ingestem het; of

    (ii) agter die ontwikkelingsterugsetlyn plaasvind. 39 Die uitbreiding van:

    (i) kanale; (ii) brûe; (iii) stuwalle; (iv) grootmaatstormwateruitlaatstrukture; en (v) marinas;

    binne ‘n waterloop of binne 32 meter van ‘n waterloop, gemeet van die rand van die waterloop, waar sodanige uitbreiding sal lei tot ‘n groter ontwikkelingsvoetspoor, maar uitgesonderd waar sodanige uitbreiding agter die ontwikkelingsterugsetlyn sal plaasvind. 40 Die uitbreiding van:

    (i) hawehoofde met meer as 50 vierkante meter; (ii) skeepshellings met meer as 50 vierkante meter;

    of (iii) geboue met meer as 50 vierkante meter

    binne ‘n waterloop of binne 32 meter van ‘n waterloop, gemeet van die rand van die waterloop, maar uitgesonderd waar sodanige uitbreiding agter die ontwikkelingsterugsetlyn sal plaasvind.

    47 Die verbreding van ‘n pad met meer as 6 meter, of die verlenging van ‘n pad met meer as 1 kilometer –

    (i) waar die bestaande reserwe breër as 13,5 meter is, of

    (ii) waar daar nie ‘n reserwe is nie, waar die pad breër as 8 meter is,

    uitgesonderd waar die verbreding of verlenging in stedelike gebiede plaasvind.

    R546: Gelyste Kennisgewing 3 (18 Junie 2010)

    19 Die verbreding van ‘n pad met meer as vier meter, of die verlenging van ‘n pad met meer as een kilometer. – Alle gebiede buite stedelike gebiede.

    R545: Gelyste Kennisgewing 2 (18 Junie 2010) Omvang en OIB:

    18 Die roetebepaling van paaie en die ontwerp van geassosieerde fisiese infrastruktuur, insluitende paaie wat nog nie gebou is nie waarvoor roetes voor 3 Julie 2006 bepaal is en wat nog nie deur ‘n bevoegde owerheid gemagtig is nie ingevolge die Omgewingsinvloedbepalingsregulasies, 2006 of 2009, uitgevaardig ingevolge artikel 24(5) van die Wet en afgekondig in Goewermentskennisgewing No. R. 358 van 2006, tensy -

    (i) dit ‘n nasionale pad is soos omskryf in artikel 40 van die Wet op die Suid-Afrikaanse Nasionale

    Padagentskap Beperk en op Nasionale Paaie, 1998 (Wet No. 7 van 1998); );

    (ii) dit ‘n pad is wat deur ‘n provinsiale owerheid geadministreer word;

    (iii) die padreserwe breër as 30 meter is; of (iv) die pad vir meer as een baan verkeer in albei

    rigtings voorsiening sal maak. Voordat enige van die gelyste aktiwiteite hierbo genoem uitgevoer kan word moet magtiging van die relevante owerheid verkry word, in hierdie geval die DOS&OB. 6 Watter proses sal onderneem word?

    Die doel van die omgewingsassessering is om: • Die huidige omgewingsensitiwiteit van die perseel te

    bepaal. • Enige omgewingskwessies verwant aan die projek vas

    te stel. • Enige alternatiewe as die huidige konsep te

    identifiseer. • Belanghebbende en Geaffekteerde Partye (B&GPe),

    soos bure en gemeenskapsgroepe, aangaande die projek in te lig en om geleetheid te bied en om alternatiewe opsies en kwessies te identifiseer.

    • Om die voorstelle en kwessies geopper te ondersoek. • Relevante spesialiste betrokke te kry om basiese en

    meer omvangryke impakstudies te onderneem. • Voorstelle en vertoë wat geopper is aan te spreek. • Die optimale konsep, wat die minste impak het, aan

    die besluitnemende owerheid voor te lê. Die omgewingsproses (Figuur 4: Proses Vloeidiagram) vir hierdie projek sal die volgende stappe bevat:

    • Identifisering van sleutel Belanghebbende en Geffekteerde Partye (B&GPe).

    Omvang Proses

    • Versprei die Agtergrondinligtingsdokument (AID) (hierdie dokument).

    • Adverteer die projek in die Paarl Post, Eikestadnuus en Die Burger met ‘n registrasieperiode van 21 dae beginnende Donderdag 13 Junie 2013 tot Maandag 8 Julie 2013.

    • Plaas perseelkennisgewings en kennisgewings by relevante plaaslike plekke om die algemene publiek van die proses in te lig en om hulle uit te nooi om te registreer en deel te neem.

    • Die begin en instandhouding van ‘n geregistreerde B&GP databasis.

    • Aanstelling van spesialiste om die huidige omgewingstatus en die beperkings vir ontwikkeling vas te stel.

    • Samestelling van ‘n Konsep Omvangsverslag (KOV) en Plan van Studie vir OIB, identifisering van watter spesialisstudies onderneem moet word, die perseelbeperkings, asook die uitlig van vertoë en kommentaar wat deur die B&GPe genoem is en alternatiewe om oorweeg te word.

    • KOV word by plaaslik biblioteek en/of ander gepaste plek gelos vir publieke nagaan en kommentaar vir ‘n 40 dae periode. Die KOV en alle verdere dokumentasie sal ook op ons maatskappy se webtuiste: www.dougjeff.co.za beskikbaar wees.

    • Alle kommentaar ontvang sal genoteer en deur die projekspan in die vorm van ‘n Kommentaar en Antwoordverslag aangespreek word.

    • Die KOV sal opdateer word tot ‘n Finale Omvangsverslag (FOV), wat die Kommentaar en Antwoordverslag sal insluit. Die FOV sal geadverteer word vir geregistreerde B&GPe vir ‘n verdere 21-dae periode.

    • Spesialisstudies sal die beduidenheid van die potensiële impakte verwant aan die voorgestelde ontwikkeling vasstel.

    Assessering Proses

    • Die spesialisstudies sal die basis van die KONSEP Omgewingsimpakverslag (OIV) vorm, asook die KONSEP Omgewingsbestuursprogram (OBP), wat versprei sal word vir publieke kommentaar vir 40 dae.

    • Afhangende van die vlak van deelname, aard van die kommentaar wat ontvang word en die bevindings van die spesialiste, mag ‘n Ope Huis Vergadering gedurende die 40-dae kommentaar periode gehou word.

    • Samestelling van die FINALE OIV en Voorlopige OBP, wat al die Kommentaar wat ontvang is, bevat asook die projekspan se terugvoering op hierdie kommentaar.

    • Indien daar enige beduidende veranderings aan die KONSEP OIV gemaak word, sal die FINALE OIV beskikbaar gestel word vir ‘n bykomende 21-dae kommentaarperiode.

    • Die FINALE OIV en Voorlopige OBP sal dan met enige bykomende kommentaar aan die DOS voorgelê word, waarvolgens daar dan ‘n belsuit geneem sal word of die projek met bepalings gemagtig of afgekeur gaan word.

    • Geregistreerde B&GPe sal dan van die DOS se besluit in kennis gestel word.

    7 Hoe en waarom om betrokke te raak?

    U word uitgenooi om as B&GP te registreer en/of om geskrewe kommentaar te lewer. Die mees belangrike deel van die OIB is openbare konsultasie en dit voorsien u met die geleentheid om beter insae te kry in wat voorgestel word en om enige vertoë wat u mag hê, te opper. Neem asseblief kennis dat om as B&GP te registreer, moet u geskrewe kommentaar lewer of versoek dat u naam by die lys gevoeg word. Korrespondensie sal slegs aan geregistreerde B&GPe versprei word. B&GPe wat nie kan lees of skryf nie of wat andersins spesiale bystand benodig om hulle mening uit te druk, mag per afspaak (gedurende kantoorure) ‘n lid van Doug Jeffery Omgewingskonsultante vra om hul kommentaar en vertoë op skrif te stel. Om te registreer of kommentaar te lewer, moet B&GPe na die DOS&OB verwysingsnommer hierbo verwys; hul name en kontakbesonderhede (posadres sowel as kommunikasiemetode wat verkies word, bv. gewone pos, geregisreerde pos, e-pos, faks ens.) verskaf; en moet ‘n aanduiding gee van enige direkte besigheid-, finansiële-, persoonlike- of ander belang wat hulle by die aansoek mag hê stuur na:
