The King responded by challenging the matter in court, demanding that President Zuma should reverse his action and publicly apologise. The King’s legal representative, Adv. Dali Mpofu, argued that President Zuma had no power to remove the King and lashed out at those who claimed to be members of the Royal family wanting the King to be removed. “They don’t even know who they are,” said Adv. Mpofu. This utterance had those present in court, in stitches. Adv. Mpofu said the President should not deal with this matter, until it could be proved that those people were not real mem- bers of the Royal family. He described the accusations against the King as defama- tion of character and malicious damage. With regard to the allegation that the King assaulted his late mother Nomos- cow, Adv. Mpofu said the court should stop this to avoid up- rising and violence. A representative of the President, Nceba Dukada, said the President was not on a mission to dethrone the King, but that instead he (Zuma) was just a spectator in a dispute be- tween the two groups of the Royal family. Thanduxolo Mtirara, chairperson of the group that wants the King to be ousted, was represented by Phillip Zilwa. Judge Justin Laing presided and reserved judgement for a further date. Members of the Democratic Alliance, the Economic Free- dom Fighters (EFF) and the United Democratic Movement and its leadership were also in court during the proceedings. TWO murder accused in a shooting at a tav-ern in Ngqeleni on August 2, appeared in theNgqeleni Magistrate Court last Tuesday and

were remanded in custody for their bail appli-cation.

Mkhulekeni Phakathi and Earnest Ngemawere arrested last month in connection with

the shooting in the Mdumazulu locationwhere six people were shot and one died.

The suspects were working at a construc-tion company that was doing work on theHluleka access road and scores of community

members protested outside Ngqeleni court tooppose their bail.

The man who died from the shooting isLindikhayaSokhanyile (28) and is a sonof oneof the Marikana victims, the late PumzileSokhanyile.

Tavern owner, Mlamli Mnakaniso (44),who was also shot in the arm during theshooting, said he was thankful to God that hesurvived the ordeal.

“I was shot in the arm while I was aboutto start the car on my way home as I wasabout to close the tavern,” said Mnakaniso.

He said when they heard gun shots, peoplefrom the tavern came out to look and the gun-men continued shooting at them, which gavehim a chance to roll-over and hide under hisvehicle.

“I heard several gunshots in the yard andinside the tavern. Two men came to the carto look for me but because I was under thevehicle, they did not see me and they left,”he said.

According to Nokwethisa Mlindwa (34),who was the cashier at the tavern on thatnight, one of the suspects came into the tav-ern before the shooting and bought a beerthat he drank.

“When it was time to close, my boss tookthe cash and went out and the suspect fol-lowed him to his car.”

She said when she heard the gun shots out-side, she turned off the lights.

“That did not help much because the sus-pect came and pointed at me with a gun de-manding money.

“I told him that there was no money andI begged him not to shoot me, then he startedto search me and found R40,” she said.

A GRADE 12 learner (18) of the Ntabanku-lu Senior Secondary School was acciden-tally shot dead in a shoot-out described asa botched armed robbery at a shop in Nta-bankulu on September 1.

Xolisa Diko from the Bhakubha locationin Ntabankulu was shot dead while he wasbuying paraffin from the shop. Police be-lieve he was shot after being mistaken fora robber. He was found dead with the 5-li-tre paraffin container next to him.

It is alleged that five armedmen stormedthe shop while Diko was already inside theshop. The men were wielding shot gunsand were demanding money, forcing eve-rybody to lie down.

But the Pakistani owners of the shop,

didn’t surrender.An eyewitness said the owners came

from the other side of the shop and whenthe robbers realised this, they startedshooting at the owners and an exchange ofgunfire ensued between the robbers andowners.

Two robbers died on the scene while twoshop owners were rushed to hospitalwhere one of them died later.

Police spokesperson Captain MlungisiMatidane said three of the robbers had-managed to escape from the scene.

“A total of four people died in this inci-dent and we will work tirelessly to ensurethat we arrest those responsible,” he said.

Matidane confirmed that no money wastaken from the shop. He said they hadfound three 9mm pistols on the scene andsome ammunition.

THE South African Human Rights Commis-sion (SAHRC) have found that the EasternCape departments of Education and Trans-port haveviolated learners’ right to basic edu-cation by failing to provide them with trans-port to school.

This was found after an investigation intothe problems with scholar transport in theEastern Cape was conducted.Isaac Mangena, Spokesperson for the SA-

HRC, said the departments have been orderedto provide urgent time-bound remedies todeal with this problem.“The Commission received a complaint in

May 2013 from former Democratic AllianceParliamentarian Lindiwe Mazibuko allegingthat learners fromZweledingaSenior Second-ary School in Queenstown had to walk longdistances to school in order to access educa-tion.“These learners were provided with schol-

ar transport in the previous year, and thescholar transport was suspended without no-

tice being given to the school,” said Mange-na. He added that owing to recognizing thesystemic challenge of lack of transport oflearners to schools in the province, the Com-mission elected to investigate more schoolsin the province and visited schools such asLovemore Park Farm Primary School inPort Elizabeth, and Ntabankulu, Dalibaso,Luthubeli and Upper Mpako SecondarySchools inMqanduli area to gathermore evi-dence relating to the scholar transport prob-lems. The investigation revealed that theavailability of transport to learners at theseschools was not adequate and in some in-stances, non-existent.The Commission found that the failure by

the Department of Education and the De-partment of Transport to provide transport,violated learners’ right to education as en-shrined in Section 29 of the Constitution.“In addition, the departments’ failure to

provide subsidized transport amounts to aninfringement of its duty to consider the bestinterest of the learner as per section 28 of theConstitution.As a result, the Commission recommend-

ed that these departments should review theirmemorandum of agreement regarding the pro-vision of scholar transport to ensure that it’sconsistent and does not prevent learners fromgoing to school, thus violating their right to ed-ucation.”The statement from SAHRC stated that the

departments must provide the commissionwith monthly written reports on the progressmade towards the delivery of transport to thelearners of the schools as listed above.The Democratic Alliance Member of Parlia-

ment in the Eastern Cape, Edmund van Vu-uren, said his party would closely monitor thesituation until it is resolved.“The DAwill now request that this report be

tabled in the Eastern Cape Provincial Legisla-ture in order to ensure the recommendations

made by the SAHRC are enforced immediate-ly,” said van Vuuren.He added that his colleague, theDAShadow

Minister of Basic Education, Annette Love-more,will also have the report brought beforethe Portfolio Committee on Basic Education,so that the national policy can be improved.Department of Education Spokesperson in

the Eastern Cape, Loyiso Pulumani, said theDepartment had received the report from theSAHRC and that they are currently in theprocess of studying it.“All the recommendationswill be fully con-

sidered. The SAHRC is an important Chapter9 institution in our country’s constitutionallandscape and the department will treat it assuch, with the full deference they deserve,”said Pulumani.

Wednesday, August 20. She was raped andkilled at the beginning of Women’s Month,and her body was found dumped in bushes.According to police spokesperson, Za-

mukulungisa Jozana, no arrest has yet beenmade but police are working tirelessly tobring the perpetrators to book. Other GoodSamaritans who assisted with the arrange-ment of the funeral, included City Funeralsthat assistedwitharrangingother funeral ne-cessities such as the tent and coffin.

Rev. Thembeka Izzy Maxambela (46) is a fe-male pastor of note who has made a name forherself throughout the Eastern Cape province.Reverend Maxambela serves on the spiritual

desk at the King Sabata Dalindyebo Local Mu-nicipality under the Department of Public Safe-ty.She had been invited to several government

activities to offer spiritual upliftment and anopening devotion with her moving prayers andsermons.As a young girl growing up in Ngangelizwe

township in Mthatha, Maxambela said evenwhen she was out with girls of her age, shewould just sing out loud in gospel songs.“Even at school Iwas the leading voice during

assemblies and at church. I would occasionallypreach during youth conventions,” she said.Maxambela, at the age of 24 in 1994, started

to pursue her calling, but said it was not an easydecision.“Therewere a lot of challenges butmymother

was always on my side. I was very young andsome people did not believe inme, especially be-cause I was a girl,” said Maxambela.

She latermarried into the Bobe fami-ly inGatyana and has a 21-year-old son.“My husband is also a pastor and aprophet, so he understands my callingand that sometimes I need my time

alone to connect with my God.”She has compiled her sermons in a CD ti-

THE police have declared Bizana as the hotspot for stock theft in the former Transkei re-gion owing to the number of livestock recov-ered in the town recently.

This follows an operation led by the Com-mander of stock theft in the Mt Ayliff cluster,LieutenantSilulamiDlembula.A total of four-teen cattle were recovered in different loca-tions of Bizana during this operation.InMbileni location 2 cattle were recovered,

and 8 sheep in both Nyanisweni and Nyaka.One man was arrested.In Mpetsheni 10 cattle were found and two

men arrested. According to the police spokes-person, Captain Mlungisi Matidana, the cat-tle were stolen in Flagstaff, Harding and Kok-stad. Matidana said that meant there wasacross-the-border theft which could make itdifficult to recover the stock if it is stolen.“It might happen that they take the stock

from Bizana and exchange it in KwaZulu-Na-tal towns like Harding and Kokstad which iswhywe’ve recovered stolen stock there,” saidMatidana. Someof the stockhadalreadybeenidentified by the rightful owners but thosethat have not yet been identified are at a com-pound. He urged people to come forward ifthey had lost their livestock.

Bizana ishot spotfor stock theft

THE Ntabankulu High Court in the East-ern Cape has sentenced a man (30) to lifeimprisonment and an additional 15 yearsbehind bars for murder and robbery.

Phathisizwe Ngwaqa was sentenced onSeptember 1 following the murder of Mn-inawa Gewu (48) with a hammer in hishome in Mbodleni location, Mount Frereon November 02, 2011.According to court papers Ngwaqa

kicked the door open and attacked Gewuwho was alone in the house.He allegedly hit him with the hammer

on his head until he died before taking thedeceased’s money, vehicle and cell phone.Following a thorough investigation led

by Warrant Officer Thandile Vezi the

“hammer-man,” ashebecameknownafterthis incident, was arrested.

. In a separate incident Elliotdale po-lice arrested a man (31) and a woman (22)in connection with the murder of a man(50) in the Thafalehashe AdministrativeAuthority in Elliotdale on August 28.It is alleged that three men armed with

firearms entered the shop and demandedmoney from the deceased and then shothim to death.Police spokesperson Major Zamuku-

lungisa Jozana said they then took aR2 000, airtime amounting to R300, ciga-rettes amounting to R300 and his firearmbefore fleeing from the scene.He said the man and a woman were ar-

rested in Thafalehashe and could appearin the Elliotdale Magistrate Court oncharges of business robbery and murder.

GROUND-BREAKING research that looks atthe use of steroids and the impact thereof onpatients with TB pericarditis-associated HIVcases in which theWalter Sisulu University’s(WSU) health sciences faculty participated, isyet more proof of how the institution contin-ues to championand contribute tomedical researchthat changes theface of healthcare.

The universitytook part in an Afri-can-led multi-coun-try study, led byProfessor BonganiMayosi of the De-partment of Medi-cine at UCT. Thestudy is envisagedto change the clini-cal management ofpatients with TBpericarditis, an in-flammation of thepericardium (the fi-brous sac surround-ing the heart).“The NelsonMan-

dela Academic Hos-pital (NMAH) to-gether with WSU medical staff were pivotalin the recruitment and management of pa-tients enrolled in most of the studies on peri-carditis. This present study in which a totalof 1 400 participants were enrolled, saw theNMAHC (whereWSU doesmost of its clinicalwork) contributing the highest number of pa-tients – 25%,” said WSU’s Professor Abolade

Awotedu of the faculty’s Department of Inter-nal Medicine.The study was conducted in 19 hospitals

across Africa in countries such as Kenya,Ma-lawi, Mozambique, Nigeria, Sierra Leone,South Africa, Uganda and Zimbabwe.The great work carried out by the Universi-

reasonable to addsteroids to regulartreatment in TB peri-carditis patientswhoaren’t infected withHIV to prevent con-striction of the heart.However, this strate-gy should be avoidedin HIV-positive peo-ple because of the in-creased risk ofmalig-nancy,” said Mayosi.Patients were sup-

plied with pred-nisolone and a place-bo as identical tab-lets, and participatedfor 600 days.“While previous

studies were toosmall to provide a de-finitive answer tothis question, ourstudy was designedspecifically to ad-dress it, and providea reliable answer be-cause of its large sizeand relatively longfollow-up period,”added Mayosi.Mayosi showered

praise on all thosewhose commitment to the body of work hadmade it such a great success.“This is an African-led study with little

funding initially. Yet in its context, it sets newstandards for data quality and completeness

of follow up in large African clinical trials. Itchallenged the perception that ‘Africans can’tdo it’,” said Mayosi.

THEMayor of King Sabatha Dalindyebo Mu-nicipality (KSD) announced that the munici-pality is on a mission to upgrade the streetsof Mthatha and its surrounding areas.

The KSD Executive Mayor, CouncillorNonkoliso Ngqongwa, said ever since the in-ception of theKSDPresidential Intervention,the lives of KSD residents were drasticallychanging.“Yes we are not done yet with the develop-

ment of our streets and we are planning toroll out phase two of street revamping at Ik-wezi township,” she said.Ngqongwa also revealed that the munici-

pality was not finished with the developmentof Hillcrest, as the revamping of Gerald

Hawks and Msimbiti Streets was in the ten-dering process.Recently the municipality had spent a sum

ofR15 million toupgrade seven streets inHill-crest as part of a project which was led byKSD’s Human settlements department.

These streets included Yellowwood, Mtati,Rosewood, Stinkwood, Msintsi, Mbongisaand West Street.The streets of Ikwezi Township that will be

refurbished areDikweni, Gobodo,Mpako andFiniza.Hillcrest residents are pleased with the de-

velopment of their area, as most of the streetswere in a state of disrepair.“We are pleased with this revamping of our

streets, because previously we used to havegravel roads.We thank the KSDMunicipalityfor coming to our rescue,” said aHillcrest res-ident, Devin Fleshman.Meanwhile, KSD spokesperson, Sonwabo

THE Nyandeni Local Municipality, whichcomprises Libode and Ngqeleni, has signeda Memorandum Of Understanding withthreehigher education institutions inanen-deavour to build capacitywithin themunic-ipality.

The institutions include Walter SisuluUniversity (WSU), the University of FortHare and the Tsolo Agricultural and RuralDevelopment Institute.The signing of this agreement took place

at the Savoy Hotel, in Mthatha, last Thurs-day in the presence of Nyandeni council-lors, officials and representatives from allthree institutions.Speaking at the event, Professor Nomfun-

do Luswazi of WSU said good leadership isof vital importance for municipalities, andthat is why they, as the institution of higherlearning in the area, had taken the initiativeto come on board and be part of the MOU.Professor Larry Obi of the University of

FortHare, said through this agreement theyhoped to achieve exemplary leadership thatwill enhance the living standard of the peo-ple. Obi said this was a good step towardsthe right direction.“Nyandeniwill be one of our key strategic

partners,” said Obi. He stressed that thegreatest weapon to defeat poverty was edu-cation, promising that they would imple-ment that in Nyandeni.He revealed that the university had also

adopted other municipalities.

HILLCREST TOWNSHIPGETS NEW FACELIFT

Report by Zibele Limani & Amanda NgquzuIn a bid to improve the lives of our communities, KSD municipality has splashedR15 millions to upgrade seven (7) streets of Hillcrest which are Yellow wood, MtatiStreet, Rose wood, Stink wood, Msintsi Street, Mbongisa and a parallel streetknown as West Street. 30 locals got employment in the refurbishment and oneEngineering Student got a training opportunity.The refurbishment of the above-mentioned streets started on May 2013 and it wascompleted on April 2014. Three (3) sub-contractors got a piece of slice in thedevelopment. But the Municipality is not done yet with the development ofHillcrest, right now, it is in the process of tenderising the revamping of GeraldHawks andMsimbiti streets.KSD Municipality's Human settlements department started the project with theimplementing agent known as Stedone and it spent R6 million revamping theabove-mentioned streets of Hillcrest and KSD's department of Technical servicestook over and run the project to completion.One of the residents of Hillcrest, the 18 year old Devin Fleshman had this to sayabout the Hillcrest development: “We are pleasedwith this revamping of our streetsbecause we use to have gravel road but now we can walk freely on a tar road. RIVAL schools of the Ngangelizwe Townshipoutside Mthatha battled it out in the Council-lor’s Cup Tournament that took place at theRotary stadium this past Friday.

The annual, one-day tournament is solelymeant for the schools of Ward 2 in Ngange-lizwe under Councillor Notyatyambo Gcing-ca.This year’s tournament featured six local

schools from the area, namely NgangelizweSenior Secondary School (SSS), Nozuko SSS,Jonguhlanga Junior Secondary School (JSS),Ikwezi Skill Centre High School, Mzimvubu

JSS and Zimele SSS.The schools braved the chilly weather to

battle it out in an array of sporting codes likenetball, soccer, rugby, and for the first timesince the inception of the tournament, volley-ball. Jonguhlanga JSS and Mzimvubu JSSwere the only Junior Secondary schools toparticipate in the Ward 2 derby.Defending champions, Ngangelizwe High

School’s soccer team couldn’t handle the jun-ior secondary players as they were sent off tothe dressing room by Mzimvubu JSS duringthe semi-finals of the tournament losing 2-0.Despite Mzimvubu’s 2-0 triumph over

Ngangelizwe, Nozuko SSS proved to be thebetter team as they avenged Ngangelizwe’s

THE Thembu Royals were crowned the 2014Mthatha champs at the Rotary stadium inMthatha this past Sunday, following theirhard-earned victory over Mthatha Bucs.

The tournament is an annual event spon-sored by Build It in association with SAFA’sLocal Football Association (LFA) acrossSouth Africa.Before the kick off, spectatorswere kept on

the edges of the grandstand seats by the flam-boyant parade of the Zimele Drummies asthey walked the players to the pitch.Despite the Royals’ sloppy defence, they

managed to hang on till the penalty shootoutwhen they defeated Mthatha Bucs by 2-1 onpenalties.Thembu Royals’ coach, Thando Maseti

confirmed that his team was not ready forthe game as they didn’t have enough time toprepare after having lost their director.“I am surprised myself that the boys man-

aged to go this far. Really, we were not fit forsuch games, but the boys have proven thattheyhave the fighting spirit regardless of thephysical fitness,” said the coach.Both the teams were hungry for goals as

they attacked constantly but failed to con-vert their chances to goals.Bucs’ defence that took no prisoners at the

back almost cost them in the early minutesof the game.Bucs gave away a free kick too close to the

box as they couldn’t handle the Thembu’sgoal-hungry strikers. And a few minutes af-ter that they again conceded an early goalwhich was ruled out as being offside by the

match official.The game ended in a goalless draw and

since it was the final, a decider was neededand they went on penalties.Confident Bucs’ were the first that took the

first penalty but their confidencewas calmeddown after they missed. Thembu’s goalkeep-er slaughtered in the first goal for his teamand saved three more and consequently puthis side ahead. Mthatha Bucs’ nerves grewas they missed more.Royals’ captain sealed his team’s win by a

marvellous strike that left the Bucs’ goal-keeper shocked and the arena roaring withjoy. Bucs’ didn’t go home empty handed, asthey were consoled with Build It sportingbags, balls, soccer kit and miniature tro-phies.Build It representative,WalterChakufuna,

along with the SAFA LFA chairperson,Sandile Nowalaza, of the KSD, congratulatedthe victors, and said they guaranteed thatnext year’s tournament would be bigger andbetter.
