Tidbits looks at a few frivolous lawsuits for a laugh, but don’t try them yourself! Frivolous lawsuits rare-ly make it through the courts and usually end up costing the plaintiff. Richard Overton took the advertising message of Anheuser-Busch a bit too literally. In 1991, he sued the company for $10,000 claiming to have suffered emotional distress, mental injury and financial loss because drinking Anheus- er-Busch beer did not bring to life the beautiful women in tropical settings as was advertised. The supposed false ad- vertising led him to buy and drink more Bud Light. The case was dismissed. An episode of “Fear Factor” prompted Austin Aitken to sue NBC for $2.5 mil- lion in 2005. Aitken claimed to have suf- fered injury and great pain after watch- ing contestants on the television eat rats. This caused him to become light- headed and dizzy, which resulted in him vomiting and running into a doorway. The judge threw out the lawsuit. In 2006, Allen Heckard sued Michael Jordan and Nike founder Phil Knight for $832 million. In the suit he claimed to suffer defamation, permanent injury and emotional pain and suffering because he was often mistaken for Michael Jordan. He said that continual public harassment because of the alleged resemblance “has troubled his nerves.” Heckard dropped the lawsuit later that year. A woman had just bought her morn-ing coffee when she noticed a most unusual funeral procession approach-ing the nearby cemetery. A long black hearse was followed by a second long black hearse about 50 feet behind. Be-hind the second hearse was a solitary woman walking a pit bull on a leash. Behind her were 200 women walking single file. The woman couldn’t stand her curiosity. She respectfully ap-proached the woman walking the dog and said, “I am so sorry for your loss and I know now is a bad time to dis-turb you, but I’ve never seen a funeral like this. Whose funeral is it?” The woman replied, “Well, that first hearse is for my husband.” “What happened to him?” The woman replied, “My dog attacked and killed him.” She inquired further, “Well, who is in the second hearse?” The woman answered, “My mother-in-law. She was trying to help my husband when the dog turned on her.” A poignant and thoughtful mo-ment of silence passes between the two women. “Could I borrow that dog?” “Get in line.”

Sincerely, Frank.” The case was dismissed and so was the wedding.

• Andrea Pizzo, a former student of the University of Maine, sued her alma mater for failing to protect her from a cow with a “dangerous disposition.” While tak-ing a class in livestock management, a 400-plus-pound Bovine head-butted her into the wall of its pen. Pizzo suffered knee and wrist injuries, so she sued the collegeforanunspecifiedamount.Inhersuit she claims the school “should have known that the heifer had a personality problem.” Verdict unknown.

• Cynthia Economou was sued by Karl Lambert in Florida court; he claimed that Economou stole his foot. Lambert’s foot was severed in a car accident, and Economu, the paramedic on site, took his mangled limb to help in the training of her body recovery dog. In her defense, Economu said, “It was an unrecognizable massofflesh...Itwasn’tacleancut.Youcouldn’t even recognize it as a foot ... If I had thought it was somehow re-attach-able and usable, I would have gone to my commander.” She was charged with second-degree petty theft and received six months of probation.

• After eating Cap’n Crunch with Crunch Berries over a period of four years, Ja-nine Sugawara realized that the “Crunch Berries” in the cereal were not real fruit. Shefiledaclass-actionsuitagainstQuaker’s parent company PepsiCo in 2009 for fraud and breech of war-ranty, seeking full restitution of all money gained through misleading labeling and a court order forcing Quaker to disclose to the public the true composition of Crunch Berries. The case was dismissed.

• In 1910, Olaf Olverson was desperate for cash, so he sold his body to the Karo-linska Institute in Stockholm, Sweden, for medical research after his death. A year later, he inherited a fortune. He tried to “buy himself back” from the institute, but they wouldn’t cooperate. When Olverson refused to donate his body, the institute sued him for breach of contract. Olverson lost the case. The judge ruled that he not only owed his body to the Institute, he owed them money for the two teeth he had removed without the Institute’s permission, saying Olverson had illegally tampered with their property.

• Bobby Mackey’s Music World in Wilder, Kentucky, was sued by J.R. Costigan in 1993. He claimed a ghost “punched and kicked him” while he was using the bar’s restroom one night. He sued the bar for $1,000 in damages and demanded that a warning sign of the ghost’s presence be put up in the restroom. The club’s lawyer filedamotiontodismissthecase,cit-ingthedifficultyofgettingtheghostintocourt to testify for the defense. The case was dismissed.

• In 1976, at the University of California Los Angeles Medical Center, doctors removed John Moore’s spleen in a suc-cessful effort to cure his cancer. Doctors later found that the spleen possessed uniquecancer-fightingcells.Experimentswith the cells led to a new discovery worth an estimated $3 billion. Moore tried to sue the University of California, claim-ing his spleen was pirated. The spleen had belonged to him so he should share in the commercial value. He sued for part oftheprofits,butin1990,14yearsafterthe operation, Moore lost the case.

• Computer designers at Apple code-named a new computer model Sagan in 1993. Traditionally, this is an honor. “You pick a name of someone you respect,” an employee explained, “and the code is only used while the computer is be-ing developed. It never makes it out of the company.” This didn’t matter to Carl Sagan; his lawyers complained that the code was “an illegal usurpation of his name for commercial purposes” and demanded that it be changed. The de-signers changed it to BHA, which stood for “Butt-Head Astronomer.” Sagan sued again, contending “Butt-Head” is “defam-atory on its face.” Apple won.

• Chicago lawyer Frank Zaffere sued his ex-fiancéMariaDillonwhenshebrokeoff their engagement in 1992. Zaffere filedasuitfor$40,310.48tocoverhis“lost courting expenses.” He did send a letter along with court papers to his ex

Your Defense?Make sure you: 1. Update your internet safeguards (on your web browser).2. Make sure you have up to date anti-virus program (your local computer store can guide you here). 3. DO NOT open emails that you don’t know who or where they are from! Turn up the sensitivity on your anti-spam settings on your computer. 4. Do not give out any information about yourself in an email that has solicited something from you. Often they use a ‘squeeze page’ to get this from you.5. Teach your children to NOT open emails they don’t recognize (nor to give out their information).

USE the internet but just be smart about it!

Lastly, make sure you have an identity theft service watching your back. The FTC recommends this. Be safe!

Fixing a Slamming DoorQ: My front door swings open and shut way too quickly. This means when my son pushes the door open, it bangs against the doorstop on the wall so hard I’m afraid it will crack the drywall behind it. A: There are a couple of things you can try. To slow down the swinging, remove the pin from the top hinge of the door. Your son can be your helper by holding the door in place while you stand on a safe stepladder to take out the pin.Wrap the pin in clear tape -- just one thin layer. Reinsert into the top hinge, and test the door. If this doesn’t slow down the swing, wrap one more layer around the pin. This should create enough friction to stop the super-fast, free swing. You may need to reap-ply tape after several months, however.If the door banging shut is too loud, try using foam weather stripping to cushion the frame. Adhesive-backed foam stripping is avail-able at home improvement stores in different widths. Try the thinnest width available.Pre-test the stripping before gluing it down. With the paper backing still on, unroll the strip along the inside of the door frame where the door closes against it. Put a little clear tape at the top and bottom to hold it, and test the door. Does it shut easily, or do you have dif-ficultygettingittolatchwiththestripinplace?Ifit’sdifficult,andyouhavethethinnestweather stripping available, try placing a small half-inch long piece at the top and bottom of the door frame and test the door again. This small amount of stripping should mufflethenoisesomewhat.

HOME TIP: Does your door stick or lightly scrapethefloorwhenyouopenit?Tapeapiece of sandpaper to the area and push the door back and forth over it to try and sand down the bottom of the door a bit.

Don’t Let Downgrade Deter You from Investing

Just when you thought you could take a break from financial drama, following the resolution of the debt ceiling issue, here comes Act 2: the downgrade of the U.S. long-term credit rating. As a citizen, you may be feeling frustrated. And as an investor, you might be getting worried. But is this concern really justified?

Certainly, it was news when

Standard and Poors (S&P) lowered the U.S. long-term credit rating from AAA to AA+. This was, after all, the first time that the U.S. has lost its AAA status since its initial publication 70 years ago. Further-more, S&P put a negative outlook on the rating, which means that further downgrades are possible. But despite these developments, there’s no reason to think that the sky is falling in on the investment world. Consider the following:

“Downgrade” doesn’t mean default. Rating agencies such as S&P assign ratings to bonds to help investors measure credit risk — the chance that they won’t receive timely payments. The downgrade to AA+ just means that investors would be slightly less likely to receive future payments than if the bond had an AAA rating. This is far different from a default, which would result in investors not receiving current payments.U.S. credit rating is still high quality. S&P didn’t change the U.S. government’s short-term credit rat-ing, which applies to debt maturing in less than one year. Furthermore, even the long-term rating of AA+ is still considered high quality. Also, keep in mind that two other major rating agencies, Moody’s and Fitch, both affirmed their AAA rating on the U.S., al-though Moody’s has a negative outlook on its rating.Downgrade was not a surprise. Because the down-grade had been rumored for weeks, the financial markets may have already “priced in” some of the impact. While it’s possible that interest rates may rise, it’s also important to note that similar down-grades of other countries’ debt in the past have not resulted in significant rate jumps. As for the stock market — which was already volatile, partially due to the debt ceiling issue — the negative reaction we’ve seen to the downgrade will likely be short-term. This downgrade should not be as calamitous as we’ve been led to believe. Corporate profits, always a key driver of stock prices, are still strong, and with the market correction we’ve seen in the past couple of weeks, many quality stocks now appear to be more attractively priced — which means it may actu-ally be a good time to look for investment opportuni-ties that make sense for you, rather than head to the “sidelines.”

In any case, you never want to overreact to any one piece of news. If you were to make big changes to your investment strategy, you’d likely incur fees and expenses — and, even more importantly, your portfolio might no longer be positioned to meet your long-term goals. You’re much better off by stick-ing with a strategy that’s based on your individual needs, risk tolerance and time horizon. This can be challenging, especially in light of the screaming headlines. But remember, although past performance isn’t indicative of future results, the U.S. financial markets have seen plenty of traumas in the past, and have always survived — and, usually, eventually prospered. Know Your Pet’s ‘Safe Area’DEAR READERS: I recently received a report from the University of Missouri about a dog named “Sugar,” a Cocker Spaniel who was badly injured in the tornado that ravaged Joplin, Mo. When her owners grabbed her and ran for the safety of their basement shel-ter, “Sugar, sensing the increased fear of her owners, became panicky and bolted back upstairs to her own ‘safe area,” a spot under one of the beds.’ With the tornado almost atop their house, the owners could not leave the shelter to retrieve her.Sugar survived the tornado, although she was badly injured and had lost use of her hind legs. Veterinarians at the University of Missouri performed emergency surgery to correct the injury to her spine. After many days of physical rehabilitation and therapy, Sugar is recovering with her owners.In addition to this encouraging story of recovery, what caught my interest was that Sug-ar’s owners knew exactly where she preferred to hide when something scary was hap-pening. This doesn’t seem like much, but knowing your pet’s favorite hiding places can be a lifesaving advantage in an emergency. With Sugar, unfortunately, this was not the case, as she was found several blocks away. There was nothing more her owners could do without putting themselves in mortal danger (something else that is important to keep in mind in an emergency). But in a less extreme emergency, when there’s time to gather the family and pets, or whenyourpetishavingahealthemergency,you’llbeabletofindyourpetfaster,ordirect emergency personnel to where your pet normally hides, if you know where that hiding place is.

Broken Heart Not Just Figure of SpeechDEAR DR. DONOHUE: Last December, my husband called the paramedics when I did not respond to him. They rushed me to the hospital when I began convulsing. I have no recollection of any of this. When I woke one week later, I was in the ICU. I was told that I had broken-heart syndrome. I also was told it has to do with blood pressure. Can you confirm that there is such a thing? -- A.

ANSWER: Broken-heart syndrome is for real. It’s a recent addition to the catalog of illnesses. Japanese doc-tors first described it, and called it Tako-tsubo cardiomyopathy. Cardiomyopathy is a heart illness that affects the heart muscle, not the heart arteries or heart valves. The classical case is one where a person develops severe chest discomfort preceded by physical or emotional stress. The emotional stress could be the unexpected death of a loved one. An EKG shows a pattern that replicates the pattern of a heart attack. The heart’s function is greatly compromised. It doesn’t pump blood like it should, and that can lower blood pressure. Seizures are not included in the list of symptoms. However, a drop in blood pressure also drops the flow of blood to the brain. That can trigger seizures. The explanation for this is a surge in the body’s stress chemicals that affect heart function. Damage to the heart muscle isn’t permanent. The heart returns to good health in a matter of weeks. You didn’t mention any prior stress. Do you recollect any? On the plus side, your heart arteries are in good shape, and you ought not to suffer a recurrence. The booklet on congestive heart failure does not address broken-heart syndrome specifically, but it does detail a more common condition, its treatment and its prognosis. ANSWER: Many times, when the kidneys aren’t working up to par (weak kidneys), doctors put their patients on a reduced-protein diet. It slows the decline of kidney function. That’s why your doctor limited your meat (protein) intake.

ANSWER: If you chew too much sugar-containing gum, you promote cavities. Too much sugarless gum can cause diarrhea. 4 chicken breastsSalt to taste/Pepper to taste1/2 purple onion, chopped3 cups purple and green grapes cut in half (add less if you want)3 to 4 stalks celery chopped2-3 cans mandarin oranges (drained) (you can add a little juice to dressing)1 pkg. slivered almonds (or toasted is good too)1 pkg. ranch dressing mix1 pt. sour cream2 cups mayonnaise2 cups buttermilk 1-2 Tbsp. sugar1 pkg. oriental noodles

Salt and boil chicken breasts until well cooked(Itismoreflavorfulifyoucookthechicken in chicken stock), then refrigerate until cooled and break into pieces.Mix onion, grapes, celery and oranges. In separate bowl mix ranch dressing package, sour cream, mayonnaise, and buttermilk. You can add 1-2 Tbsp. sugar. Stir together veggie/fruit mixture and chicken with dress-ing. Add a little pepper. Just before serving add the oriental noodles.

Great on lettuce, rolls, croissants or even cream puffs. It makes a lot, but never goes to waste!!!! YUM!!

¥ You can whiten chopping boards with lemon juice. Just use the cut side of a lemon to scrub the board, let it sit for up to 10 minutes, and rinse clean.

¥ If you’re stuffing pillows or a child’s toy with foam-rubber chips, rub a bit of fabric softener over your hands first. The tiny pieces won’t get stuck to your hands with static, and it will smell nice to boot!

¥ Here’s a fun activity for the kids: Let them “paint” cookies. Using clean craft brushes or wa-tercolor brushes, the kids can use food coloring to paint designs on cookies. They can even paint the dough before it’s been cooked, and then see how the design spreads and settles.
