    amasezerano yo guhererekanya ibintu:inyandiko zikoreshwa mu guhererekanya

    CHAPTER ONE: GENERAL PROVISIONS

    Article One: Purpose of this Law

    This Law determines modalities for managementand conservation of biological diversity within

    Rwanda.

    Article 2: Definitions of terms

    In this Law, the following terms shall have the

    following meanings:

    1

    protected area: a geographically defined

    area which is designated and managed for itsconservation;

    2

    bioregion: a natural area with flora and faunaas well as specific environmental conditions;

    3

    material transfer agreement: contractualdocuments used for the acquisition of various

    biological and research materials;

    4

    bioprospecting: research, collection andutilization of biological and genetic

    resources;

    5

    vulnerable species: any indigenous species

    facing a high risk of extinction in the wild in

    ADOPTE :

    CHAPITRE PREMIER: DISPOSITIONS

    GENERALES

    Article premier: Objet de la prsente loi

    La prsente loi dtermine les modalits de gestion etde conservation la diversit biologique au Rwanda.

    Article 2: Dfinitions des termes

    Aux fins de la prsente loi, les termes repris ci-aprs

    ont les significations suivantes:

    1

    zone protge: zone gographiquement

    dlimite dsigne et gre en vue de saconservation ;

    2

    biorgion: espace naturel caractris par uneflore et une faune et des conditions

    environnementales spcifiques;

    3

    accord de transfert de matriel: documentscontractuels utiliss pour acqurir diffrents

    matriels biologiques et de recherche ;

    4

    bioprospection: recherche, collecte etutilisation des ressources biologique et

    gntiques;

    5

    espces vulnrables: toutes les espces

    confrontes un risque dextinction ltat

    the medium-term future although they are notpart of endangered or critically endangered

    organisms;

    protected species: any species which are of

    such high conservation value or nationalimportance that they require national

    protection;

    endangered species: indigenous speciesfacing a high risk of extinction in the wild in

    the immediate future, although they are notcritically endangered species;

    8

    critically endangered species: indigenousspecies facing an extremely high risk of

    extinction in the wild in the immediate future;

    9

    alien species: species occurring in an area

    outside of its historically known natural range

    as a result of intentional or accidentaldispersal by human activities;

    10

    invasive species: species whose introduction

    or spread does or is likely to cause economicor environmental harm or harm to human

    health;

    sauvage extrmement lev et moyen termebien quelles ne soient pas des organismes

    grande valeur de conservation ou dune grandeimportance nationale ncessitant une protection

    nationale ;

    menaces dextinction;

    espces svrement menaces dextinction:espces exotiques confrontes un risque

    extrmement lev dextinctiondans un proche

    avenir ;

    espces exotiques:espces prsentes en dehors

    de leur aire connue de rpartition naturelle ou

    de leur aire de dispersion potentielle du faitdune introduction accidentelle ou dlibre

    rsultant de lactivit humaine;

    10

    espces envahissantes: espces dont

    lintroduction ou la propagation cause ou peutcauser des dommages conomiques ou

    cologiques, ou nuire la sant humaine;

    CHAPTER II: BIODIVERSITY PLANNINGAND MONITORING

    Article 3: Biodiversity planning and

    monitoring

    The Minister shall monitor the conservation statusof various components of Rwandas biodiversity

    and promote biodiversity research.

    Article 4: Content of national biodiversitystrategies

    The national biodiversity strategies mustespecially:

    1

    provide for all possible actions to put in

    place an integrated, co-ordinated and

    uniform approach to biodiversitymanagement by organs of state, national

    and international non-governmental

    organisations, the private sector and local

    communities;

    2

    identify priority areas for conservationactions and the establishment of protected

    areas;

    3

    reflect regional co-operation on issues

    concerning biodiversity management;

    CHAPITRE II: PLANIFICATION ETSURVEILLANCE DE LA BIODIVERSITE

    Article 3: Planification et surveillance de la

    biodiversit

    Le Ministre assure la surveillance de ltat deconservation de diffrentes composantes de la

    biodiversit au Rwanda et la promotion des

    identify national biodiversity strategieswhich determine norms and standards for

    biodiversity conservation plans at local

    level.

    Article 5: Determining and managing a

    bioregion

    The Minister shall, on his/her own initiative or at

    the request of interested persons put in place an

    Order determining a geographic region as abioregion if that region contains whole or several

    nested ecosystems and is characterised by itslandforms, vegetation cover, human culture or

    history;

    The Order shall also set out a plan for themanagement of biodiversity and its components in

    such a region.

    Article 6: Transboundary bioregional plan

    The Government shall enter into an agreementwith neighbouring countries of Rwanda to ensure

    effective implementation of a transboundary bio-

    regional plan.

    Article 7: Content of a bioregional plan

    The bioregional plan must contain measures forthe effective management of biodiversity and its

    components in the bioregion and provide for

    Le plan biorgional doit contenir des mesures degestion effective de la biodiversit et ses

    Article 8: Review of a bioregional plan

    The bioregional plan shall be reviewed at leastevery five (5) years and whenever necessary to

    assess compliance with the plan and the extent towhich its objectives are being met.

    Article 9: Biodiversity management plan

    Any person, organization or organ of State which

    intends to contribute on biodiversity managementshall submit to the competent authority a draft

    biodiversity management plan for approval.

    The plan plan shall be related to the management

    of the following:

    1

    an ecosystem;

    2

    indigenous species;

    3

    alien and migratory species.

    An Order of the Minister shall determine allapproved biodiversity management plans.

    Article 10: Review and amendment ofbiodiversity management plans

    Biodiversity management plan shall be reviewed

    at least every five (5) years.

    If considered necessary, a biodiversitymanagement plan may be amended as required by

    the competent authority by taking into account

    views expressed by stakeholders.

    Article 11: Monitoring

    The competent authority shall establishmonitoring mechanisms and set indicators to

    determine:

    1

    the conservation status of various

    components of Rwandas biodiversity;

    2

    any positive or negative trends affecting

    the conservation status of the variouscomponents of biodiversity.

    Article 12: Research promotion

    In order to promote biodiversity, the competent

    authority shall conduct research on the protection

    and conservation of biodiversity and itssustainable use.

    Article 10: Rvision et modification des plans degestion de la biodiversit

    Le plan de gestion de la biodiversit doit tre rvis

    au moins tous les cinq (5) ans.

    En cas de ncessit, un plan de gestion de labiodiversit peut tre amend sur demande de

    Lautorit comptente doit tablir les mcanismes desurveillance et fixer les indicateurs permettant de

    composantes de la biodiversit du Rwanda ;

    2

    toutes tendances positives ou ngatives qui

    affectent ltat de conservation dediffrentes composantes de la biodiversit.

    Article 12: Promotion de la recherche

    Pour promouvoir la biodiversit, lautorit

    comptente doit promouvoir la recherche sur la

    protection et la conservation de la biodiversit ainsique son utilisation durable.

    on biodiversity conservation;

    the assessment of strategies and

    techniques for biodiversity conservation;

    3

    the determination of biodiversity

    conservation needs and priorities;

    4

    the sustainable use, protection and

    conservation of indigenous biologicalresources.

    Article 13: Biodiversity status report

    The national organ in charge of environment shall

    produce a biodiversity status report every two (2)

    years and submit it to the Minister.

    CHAPTER III: ECOSYSTEMS ANDENDANGERED AND INVASIVE SPECIES

    Article 14: Ecosystems in need of protection

    An Order of the Minister shall set out a nationallist of ecosystems that are threatened and in need

    of protection and their location.

    The list referred to under Paragraph One of thisArticle shall include the following:

    1

    critically endangered ecosystems;

    2

    endangered ecosystems;

    3

    vulnerable ecosystems;

    4

    other ecosystems with high conservationvalue or of high national importance.

    Article 15: Prohibited activities in ecosystems

    included on the list

    An Order of the Minister shall set out a list of

    activities prohibited in an ecosystem included onthe list referred to under Article 14 of this Law.

    CHAPITRE III : ECOSYSTEMES ETESPECES MENACEES DEXTINCTION ET

    ESPECES ENVAHISSANTES

    Article 14: Ecosystmes ncessitant la protection

    Article 16: Species in need of protection

    Every five (5) years and whenever necessary, anOrder of the Minister shall set out a list of the

    following species in need of protection:

    1

    critically endangered species ;

    2

    endangered species;

    3

    vulnerable species;

    4

    other species of such high conservation

    value or national importance that require

    protection, although they are not includedon the list of species under items 1, 2

    and 3 of this Paragraph.

    Article 17: Activities prohibited with respect to

    national organ in charge of environment and otherorgans provided for by relevant laws shall put in

    place mechanisms designed to:

    1

    prevent unauthorized introduction andspread of alien species and invasive

    species to ecosystems where they do notnaturally occur;

    2

    manage and control alien species and

    invasive species to prevent or minimizeharm to environment and to biodiversity

    in particular;

    3

    eradicate alien species and invasive

    species from ecosystems where they may

    harm biodiversity and such ecosystems.

    Article 19: Activities involving alien species

    It is prohibited to introduce a specimen of an alienspecies into the country whithout a permit.

    The permit referred to under Paragraph One of

    this Article shall only be issued after anassessment of impact on biodiversity is

    conducted.

    Article 20: List of invasive species

    An Order of the Minister shall set out a list ofinvasive species.

    Such a list shall be subject to review every two (2)

    years and whenever necessary.

    Article 21: Activities involving invasive species

    included on the list

    Activities involving invasive species or specimens

    included on the list are prohibited unless they areauthorized.

    The permit referred to under Paragraph One of

    this Article can only be issued after an assessmentof impact on biodiversity is conducted.

    Article 22: Obligation to control invasive

    species

    A person granted the permit provided for in

    Article 21 of this Law shall take all required stepsto minimize harm to biodiversity.

    Any owner the land on which an invasive species

    occurs must, without delay, inform the competentauthority in writing or by any other possible

    means immediately after noticing the occurrence

    Article 23: Modalities for controlling,

    containing and eradicating invasive species

    The control, containing and eradication of aninvasive species shall be carried out by means of

    methods that are appropriate for the species

    concerned and the environment in which it occurs.

    Any action taken to control, contain and eradicate

    an invasive species shall be executed with caution

    and in a manner that may cause the least possibleharm to biodiversity and damage to the

    environment.

    The methods employed to control, contain anderadicate the listed invasive species shall also

    cater for sprouts or offsprings, propagating

    material, reproduction and re-growth of suchinvasive species in order to prevent such species

    from producing offspring, forming seed,regenerating or re-establishing itself in any

    manner.

    envahissantes afin dempcher ces espces deproduire une descendance, des semences, se

    rgnrer ou se rtablir sous toute autre forme.

    Article 24: Invasive species control, containingand eradication plan

    Any person who prepares a plan for intervention

    in the area of operation shall incorporate into the

    plan an invasive species control, containing anderadication strategy and monitoring plan.

    All State agencies shall prepare an invasive

    species prevention, control, containing anderadication plan for land under their control and

    all of their intervention zones, as part of theirenvironmental plan.

    Local authorities with legal personality shall

    prepare invasive species control, containing anderadication plans as part of their integrated

    development plans.

    Article 25: Content of the plan

    An invasive species control, containing anderadication plan must include at least the

    following:

    1

    a detailed list and description of any

    invasive species occurring on the relevantland;

    2

    a description of the parts of that land thatare infested with such invasive species;

    Article 25 : Contenu du plan

    Un plan permettant de contrler, de contenir etdradiquer des espces envahissantes doit

    comporter au moins ce qui suit:

    une liste dtaille et une description de toute

    espce envahissante apparaissant sur uneterre donne ;

    2

    une description des parties de cette terre quisont infectes par de telles espces

    envahissantes;

    Article 26: Genetically modified organisms

    No person shall introduce and use in the countrygenetically modified organisms without a permit.

    CHAPTER IV: BIOPROSPECTING,

    ACCESS AND BENEFIT SHARING

    Article 27: Bioprospecting in and export of

    indigenous biological resources

    Activities in terms of bioprospecting in and export

    of indigenous biological resources shall be subjectto a permit.

    The application for the permit referred to inParagraph One of this Article shall provide

    reasons justify it.

    Article 28: Preconditions for issuance of a

    permit

    Before a permit provided for in Article 27 of thisLaw is granted, consideration shall be given to theinterests of a person, of the community and the

    State giving access to:

    1

    the indigenous biological resources to

    which the application relates;2

    traditional uses of the indigenous

    biological resources;

    3

    knowledge of or discoveries about the

    indigenous biological resources.

    Article 29: Right to biological resources andsharing of benefits

    If a stakeholder has interests under Article 28 of

    this Law, the issuing authority shall grant a permitin accordance with the provisions of the Order of

    the Minister.

    CHAPTER V:PERMITS

    Article 30: Permit issuing authority

    The permits referred to in this Law shall be issuedby the competent authority.

    rwibinyabuzima, Minisitiri ashobora guhagarikaitangwa ryuruhushya no kuvanaho urwatanzwe.

    Ingingo ya 32: Ikiguzi cyuruhushya

    Impushya zivugwa muri iri tegeko, zishyurwa

    amafaranga agenwa nIteka rya Minisitiri.

    Amafaranga yishyuwe ku ruhushya ashyirwa mu

    Kigega cyIgihugu cyIbidukikije (FONERWA).

    Ingingo ya 33: Ibikubiye mu ruhushya

    Uruhushya rutangwa, rugomba gusobanura:

    1

    impamvu ituma rutangwa;

    2

    igihe ruzamara;

    3

    ikindi kintu cyasabwa nubuyobozi

    butanga uruhushya.

    Before the applicant is issued with the permit,he/she shall submit to the competent authority an

    environmental impact assessment.

    An Order of the Minister shall determine the time-

    limits within which the person applying for a

    permit must be notified of the issuance,

    suspension and cancellation of the permit.

    Article 31: Discontinuation of the permit

    issuance procedure

    For the purposes of protecting biodiversity, the

    Minister may decide the discontinuation of theissuance of the permit and the cancellation of the

    permit issued.

    Article 32: Permit fees

    Permit fees refereed to in this Law shall be

    determined by an Order of the Minister.

    Permit fees shall be deposited in the National

    Fund for Climate and Environment (FONERWA).

    Article 33: Permit content

    The permit issued shall specify:

    1

    the purpose for which it is issued;

    2

    the period of validity;

    3

    any other matters that may be prescribed

    by the issuing authority.

    La personne qui demande le permis doit, avantdobtenir le permis, soumettre lautorit

    comptente une tude dimpact environnemental.

    Un arrt du Ministre dtermine les dlais dans

    lesquels la personne qui prsente sa demande de

    permis doit tre notifie de la dcision doctroi, de

    suspension et dannulation du permis.

    Article 31: Arrt de la procdure doctroi dun

    permis

    Pour protger la biodiversit, le Ministre peut

    dcider linterruption de laprocdure doctroi dunpermis et lannulation du permis octroy.

    Article 32: Frais payer pour le permis

    Les frais payer pour les permis prvus par la

    prsente loi sont dtermins par arrt du Ministre.

    Les frais perus sur les permis sont verss au Fonds

    National de lEnvironnement au Rwanda

    (FONERWA).

    Article 33: Contenu du permis

    Le permis octroy doit spcifier:

    1

    le but de son octroi;

    2

    la priode de sa validit ;

    3

    toute autre information pouvant tre

    prescrite par lautorit dlivrantle permis.

    Ingingo ya 35: Gukuraho uruhushya

    Ubuyobozi bwatanze uruhushya bushoborakurwambura uwaruhawe iyo:

    1

    uwahawe uruhushya cyangwaumuhagarariye yabeshye;

    2

    uwahawe uruhushya yarenze cyangwa

    yananiwe kubahiriza ibyo yategetswe muruhushya cyangwa ibikubiye muri iri

    tegeko no mu yandi mategeko agenga

    igikorwa cyasabiwe uruhushya.

    Ingingo ya 36:Kujuririra icyemezo

    Umuntu wese utishimiye icyemezo yafatiwe kubijyanye nuruhushya atakambira Minisitiri.

    Iyo atanyuzwe nicyemezo cya Minisitiri, aregera

    urukiko rubifitiye ububasha.

    The permit shall be issued on the basis of thecontent of the application.

    Article 34: Impact assessment and expert

    evidence

    Before issuing a permit, the issuing authority

    shall, in writing, require the applicant to submit anindependent environmental impact assessment orexpert evidence.

    Article 35: Cancellation of a permit

    The issuing authority may cancel the permit if:

    1

    the applicant or the person acting onhis/her behalf provided misleading

    information;

    2

    the permit holder has failed to comply

    with any condition of the permit or anyprovision of this Law or other laws

    governing activity subject to the permit.

    Article 36: Appeal against a decision

    Any person who is not satisfied with the decisionmade with respect to his/her permit shall appeal to

    the Minister.

    If he/she is not satisfied with the decision of the

    Minister, he/she shall file the case to thecompetent court.

    Le permis est dlivr sur base du contenu de lademande.

    Article 34: Etude dimpact et preuve dexpert

    Avant doctroyer le permis, lautorit qui le dlivre

    demande, par crit, le requrant de lui soumettre unetude indpendante dimpact environnemental ou la

    preuve dun expert.

    Article 35: Annulation dun permis

    Lautorit dlivrant le permis peut lannuler si:

    1

    le requrant ou la personne agissant en sonnom a fourni des informations

    mensongres ;

    2

    le titulaire du permis a enfreint lune des

    conditions du permis, une disposition de laprsente loi ou dautres lois rgissant

    lactivit concerne par le permis.

    Article 36:Recours contre une dcision

    Toute personne qui nest pas satisfaite de la dcisionprise son gard en ce qui concerne le permis fait

    recours au Ministre.

    Si elle nest pas satisfaite de la dcision prise par le

    Ministre, elle saisit la juridiction comptente.

    CHAPTER VI: ADMINISTRATIVESANCTIONS

    Article 37: Administrative sanctions

    Subject to the provisions of the Organic Law

    instituting the Penal Code, any person whoviolates the provisions of this Law shall be givenany of the following administrative sanctions:

    1

    temporary suspension of his/her permit;

    2

    cancellation of his/her permit;

    3

    administrative fine provided for by anOrder of the Minister.

    The fine under item 3 of Paragragph One of this

    Article shall be deposited into the National Fundfor Climate and Environment (FONERWA).

    CHAPTER VII: FINAL PROVISIONS

    Article 38: Drafting, consideration andadoption of this Law

    This Law was drafted in English, considered andadopted in Kinyarwanda.

    CHAPITRE VI : SANCTIONSADMINISTRATIVES

    Article 37: Sanctions administratives

    Sous rserve des dispositions de la loi organique

    portant code pnal, toutepersonne qui enfreint lesdispositions de la prsente loi est punie de lune oulautre des sanctions administratives suivantes:

    1

    suspension temporaire de son permis ;

    2

    annulation de son permis ;

    3

    amende administrative prvue par un arrt

    du Ministre.

    Lamende vise au point 3 de lalina premier du

    prsent article est verse au Fonds National delEnvironnement au Rwanda (FONERWA).
