(3') Knowingly approving or granting any license, per-mit, privilege or benefit in favor of any person not qua-lified for or not legally entitled to such license, permit,privilege or advantage, or of a mere representative ordummy of one who is not so quilified or entitled.

(k) Divulging valuable information of a eirnfidentialcharacter, acquired by his office or by him on aecount ofhis official position to unauthorized persons, or releasingsuch information in advance of its authorized release date.

The person giving the gift, present, share, percentage orbeneflt referred to in subparagraphs (b) and (c)'; or offer-ing or giving to the public officer the employment men-tioned in subparagraph (d); or urging the divulging oruntimely release of' the confidential information referredto in subparagraph (k) of this seclion shall, together withthe offending public ofticer, be punished under Section nineof this Act and shall be permanently or temporarily dis-qualified in the discretion of the Court, from transactingbnsiness in any form with the Government.

Snc. 4. Prolnbition on pri,oate i,nili'aiduals.-(o) It shallbe unlawful for any person having family or close personalrelation with any public official to capitalize or exploit ortake advantage of such family or close personal relationby directly or indirectly requesting or receiving any presentgift or material or pecuniary advantage from any otherperson having some business, transaction, applicationr,re-quest or contract with the government, in which such publicofficial has to intervene. Family relation shall include thespouse or relatives by consanguinity or affinity in the thirdcivil degree. The word "close personal relation" shall in-clude close personal friendship, social and fraternal con-nections, and professional employment all giving rise tointimacy which assures free access to such public officer.

(b) It shall be unlawful for any person knowingly toinduce or cause any public official to commit any of theoffenses defined in Section 3 hereof.

Spc. 5, Prohibi,tion on certuin rel,ati'aes,*It shall be un-lawful for the spouse or for any relative, by consanguinityor affinity, within the third civil degree, of the Presidentof the Philippines, the Vice-President of the Philippines, thePresident of the Senate, or the Speaker of the House ofRepresentatives, to intervene, directly or indirectly, in anybusiness, transaction,-contract or application with the Gov-ernment: Proaided, That this section shall not apply toany person who, prior to the assumption of offlee of anyof the above officials to whorn he is related, has been alreadydealing with the Government along the same line of busi-ness, nor to any transaction, contract or application alreadyexisting or pending at the time of such assumption of publicoffi.ce, nor to any application filed by him the approval ofwhich is not discretionary on the part of the official orofficials concerned but depends upon compliance with re-quisites provided by law, or rules or regulations issuedpursuant to law, nor to any act lawfully performed in anofficial capacity or in the exercise of a profession.

the accused, be entitled to recover in the criminal actionwith priority over the forfeiture in favor of the Govern-ment, the amount of money or the thing he may havegiven to the accused, or the fair value of such thing.

(b) Any public officer violating any of the provisionsof Section 7 of this Act shall be punished by a fine of notless than one hundred pesos nor more than one thousandpesos, or by imprisonment not exceeding one year, or byboth such fine and imprisonment, at the discretion of theCourt.

The violation of said section proven in a proper adminis-trative proceeding shall be sufficient cause for removal ordismissal of a publie officer, even if no criminal prosecutionis instituted against him.

Suc. 10. Com.petent court.-4ntil otherwise provided bylaw, all prosecutions under this Act shall be within theoriginal jurisdiction of the proper Court of First Instance.

Snc. 11. Prescripti,on of offenses.-All offenses punish-able under this Act shall prescribe in ten years.

Snc. 12. Terrruination of office.-No public officer shallbe allowed to resign or retire pending an investigation,criminal or administrative, or pending a prosecution againsthim, for any offense under this Act or under the provisionsof the Revised Penal Code on bribery.

Snc. 13. Suspension and, loss of benefi,ts.*Any publicofficer against whom any criminal prosecution under avalid information under this Act or under the provisionsof the Revised Penal Code on bribery is pending in court,shall be suspended from office. Should he be convictedby final judgment, he shall lose all retirement or gratuitybenefits under any law, but if he is acquitted, he shall beentitled to reinstatement and to the salaries and benefitswhich he failed to receive during suspension, unless inthe meantime administrative proceedings have been filedagainst him.

Snc. L4. Erceptiozr,.-Unsolicited gifts or presents ofsmall or insignificant value offered or given as a mereordinary token of gratitude or friendship according to localcustoms or usage, shall be excepted from the provisionsrf this Act.

Nothing in this Act shall be interpreted to prejudice orprohibit the practice of any profession, lawful trade oroccupation by any private person or by any public officerwho under the law may legitimately practice his profession,trade or occupatiorr, during his incumbency, except wherethe practice of such profession, trade or occupation involvesconspiracy with any other person or public official to com-mit any of the violations penalized in this Act.

Snc. L5. Separabi,Lity clause.-If any provision of thisAct or the application of such provision to any person orcircumstances is declared invalid, the remainder of theAct or the applicatirf of. such provision to other personsor circumstances shall not be affected by such declaration.

Snc. 16. Effecti,ai,tg.-This Act shall take effect on itsapproval, but for the purpose of determining unexplainedwealth, all property acquired by a public officer silrce heassumed office shall be taken into consideration.
