AfriForum’s application for an order that could lead to the Vhembe municipal manager’s being held in contempt of court centres around the fact that Vhembe District Municipali-ty (VDM) neglected to comply with the court order of 2 October last year regarding potable water to Makhado (Louis Trichardt).

A motion notice was handed to the North Gauteng High Court in Pretoria of an ap plication on 14 May. After 17:00 the previous day, AfriForum heard that Vhembe had decided to settle. The parties met at court the following day to discuss Vhembe’s proposed settlement. AfriForum’s advocate, Jan Saunders, informed Vhembe’s lawyer, however, that they declined the settlement offer and wanted to go to court. At the time of going to press, the parties still had to be called into court.

The application requests that the Vhembe municipal manager, Mr Ma-sala Makumule, be ordered to see to it that the VDM complies with the court

manager’s being found guilty of contempt of court, the applica-tion states that he is ordered to pay the costs. That means that he could be responsible for the pay-ment in his personal capacity.

AfriForum’s local chairper-son, Mr Wally Schultz, as well as businesswoman Annette Coetzee and AfriForum attorney Werner Human, supplied sup-porting affi davits to Anne Marie Kuhne’s founding affi davit.

“The connection of the infra-structure of the new boreholes occurred on 8 February, where-as the court order of 2 October specifi ed 30 November, a time frame chosen by Vhembe,” said Schultz.

Coetzee said that the town’s water delivery problems had a devastating effect on businesses that rely on water to earn a living. Concerning the giving of notice of water supply inter-ruptions, Coetzee found that radio stations received no such

notifi cations. “From June last year up to

March this year (in nine months) we have been without water for more than 123 full days. The position has not improved since last year’s court order,” said Kuhne, who keeps a daily record of the water supply in her area.

“I believe we are doing the right thing to go to court, since we have a strong case. We hope that fairness will prevail,” Schultz said on Tuesday.

AfriForum says no to settlement offer

afriForum’s local branch gathered at an attorney’s fi rm in Makhado (Louis trichardt) on 26 april to have their affi davits signed before a Commissioner of oaths. afriForum’s application for an order that could lead to the Vhembe municipal manager’s being held in contempt of Court centres around the fact that Vhembe Municipality neglected to comply with the court order of 2 october last year regarding potable water to Makhado (Louis trichardt). In the meantime, Vhembe proposed a settlement, which was declined by afriForum, who want to go to court. Toe ek Thohoyandou wou skakel, kon ek geen besonderhede kry nie,” het Human gesê.

Die Suid-Afrikaanse Raad vir Balju’s kon ook nie akkurate inligting verskaf nie, maar het Human verseker dat Thohoyandou die regte liggaam is om die betekening deur te voer. Uiteindelik het BZ Luthuli van die Suid-Afrikaanse Raad vir Balju’s ‘n brief onderteken waarin die Raad vir Balju’s die nominasie van die balju in Makhado (Louis Trichardt) ondersteun om die betekening te doen.

“Dit was nogals ‘n storie om die spesiale magtig-ing te bekom,” het Human gesê.

Intussen kon plaaslike AfriForum voorsitter Wally Schultz nie sy ore glo dat Thohoyandou se balju net nie gekontak kan word nie. “Dit stel ons saak met ‘n week uit, maar ons is voluit aan die gang met die lang regsproses om uiteindelik water vir die dorp te verkry,” het Schultz verlede week gesê.

The accident happened near the Baobab Toll Plaza along the N1 near Musina last Thursday morning. Rescue workers had to use the jaws of life to cut away the wrecked taxi and get to the victims trapped underneath the truck.

Col Ronél Otto, spokesperson for the police in Limpopo, told Zoutpansberger that the taxi had been overloaded, with 20 Zimbabwean nationals, including the driver. She said the group were on their way back to their country when the horror accident took place. According to her, 12 people died at the scene, while one passed away in the Musina Hospital.

Otto added that a culpable homicide case had been opened and that the police were still investi-gating the cause of the accident. She also mentioned that the police were looking into the possibility that the driver of the taxi might have been tired.

The spokesperson for the Department of Roads and Transport, Mr Joshua Kwapa, confi rmed that the taxi was overloaded when the accident hap-pened. He said the taxi crashed into the rear of the truck that was in the middle of the road.

In 2005, 19 Zimbabweans died when the taxi in which they were travelling plunged over a cliff on the same road, near the Hendrik Verwoerd Tunnels. Last year, 10 people died when a taxi collided with a truck near Bandelierkop.

One of the survivors, Ms Mutera Mungwesu, was visibly upset and struggled to hold back her tears when the Zoutpansberger visited her in the Musina Hospital on Thursday morning. She said the 19 boarded the taxi, “longing to see our families at home. I felt tired and decided to sleep. Like a clap of thunder, I heard a loud bang. Within seconds, there were bodies scattered all over the road”.

She said she cannot remember what happened after the accident, “until I found myself in this hospital bed. I strongly believe that we were saved by the grace of God.”

‘n bekende en ‘n besonderse landboukenner van die sout-pansberg-streek, mnr. Johan van der goot (70), is verlede Vrydag te ruste gelê, nadat hy op 6 Mei oorlede is.

Johan sal veral onthou word vir sy onuitputbare kennis van die beesboerdery en landbou-sa ke, nostalgiese herinne-ringe asook sy merkwaardige mensekennis. As ‘n boorling van die streek is Johan gebore op 12 November 1942 en het hy grootgeword op die Van der Goot-familieplaas, Schiermon-nikoog, naby Vivo.

Nadat hy in 1962 aan die Hoërskool Piet Potgieter matri-ku leer, loop hy klas by die destydse Onderwyskollege in Pretoria. Ná hy sy onderwys-dip loma verwerf, besluit hy om

sy pa, Japie, te kom bystaan met die beesboerdery. ‘n Paar jaar later, in 1976, trou hy met sy eggenote, Rina Louw. Vier kinders, Marleen, Japie, Cobus en Yssel, is uit die huwelik gebore.

In 1997 verhuis Johan en sy tweede vrou, Janet, na hul hu welik en kom vestig hulle permanent op Makhado (Louis Trichardt).

Ná afl oop van Johan se afster-we en begrafnis het die familie hul waardering uitgespreek teenoor drs. Anton Stroebel en Pierre Burger, asook die Zoutpansberg Privaathospitaal en Limpopo MediClinic vir hulp en bystand. Verder het die familie ook vir ds. Hans Grobler van die Gereformeerde Kerk bedank, wat die begrafnisdiens

waar geneem het, en die susters vir die verskaf van die verver-sings. Die familie het ook almal bedank vir hul boodskappe, besoeke, oproepe en hulp.

“Dit word opreg waardeer,” het Johan se familie gesê.

Accused a SIU offi cer,not an NPA offi cialthe national prosecuting authority (npa) responded last week to a report about an of-fi cer that was allegedly caught poaching in the Kruger national park.

The Zoutpansberger reported on 19 April on the 28-year-old Rabelani Rodney Ndou who was arrested on 14 April after he had allegedly killed a buffalo in the Mabalingwe area of the national park.

Following this report, the NPA said that their records did not refl ect Ndou as one of their em-ployees. The Zoutpansberger dug a bit deeper and was able to confi rm that Ndou is in actual fact a forensic investigator of the country’s prime corruption-busting force, the Special Investigating Unit (SIU).

The SIU is a public entity with powers of in-vestigation and litigation to take civil action to correct any wrongdoing it uncovers – courtesy of a presidential proclamation.

According to the SIU’s website, where criminal matters are concerned, they will bring the matter to the attention of their close partners, the Hawks, in the South African Police Service (SAPS), as well as the National Prosecuting Authority (NPA). The SIU also works closely with the Asset Forfeiture Unit (AFU) in the NPA for the effective recovering of the proceeds of crime.

Mr Boy Ndala, a spokesperson for SIU, con-fi rmed on Tuesday that Ndou was an employee of the SIU.

Ndou was arrested after park rangers found the carcass of a buffalo. While investigating the car-cass, Ndou and three other suspects approached the scene. When they noticed the rangers, they alleg-edly tried to run away. Ndou was arrested while the other three suspects managed to get away.

A hunting rifl e was found in Ndou’s possession. He was charged in the Louis Trichardt District

Court with performing a restricted activity involv-ing alien species without a permit and illegal access to a national park. After a brief appearance, he was released on R3 000 bail.

The police suspect that Ndou’s rifl e might have also been used to kill a rhino in the national park, and have requested ballistic tests to be done on the weapon. Ndou will appear in court again on 4 June.

Police constable charged with murderthe police constable involved in the fatal shooting of a man in Makhado (Louis trichardt) last year has been charged with murder.

Const Ndivhuwo Caroline Mu shi ane (32) of the Makhado SAPS appeared in the Louis Tri chardt Regional Court on Monday. The murder case was opened, following the fatal shoot-ing of the 33-year-old Mr Justice Mulaudzi in August last year. Mulaudzi was shot in the head during an altercation with the constable near the railway cross-ing in Grobler Street.

At the time, police said that Mu shiane was on a routine patrol with another constable when they spotted Mulaudzi. They noticed that he seemed to be under the infl uence of alcohol. Mushiane and the second constable tried to question Mulaudzi, but he alleg-edly refused to give his coopera-tion. When the police constables ordered him to get into the back of their patrol vehicle, he lost his temper and became aggres-sive, allegedly snatching one of their service pistols. A struggle for the weapon ensued in which Mulaudzi was shot.

At fi rst, the Makhado SAPS opened an inquest docket re-garding Mulaudzi’s death. Soon afterwards, however, the charge was changed to murder when the Independent Police Investigative Directorate (IPID) got involved in the investigation. They ordered ballistic reports on both consta-bles’ pistols.

Based on these reports and other witnesses’ statements the State decided to put Mushiane on trial for Mulaudzi’s death. After a brief court appearance, Mushiane’s case was postponed until 12 June for trial.

For many people today, it seems that no news is not good news anymore.

All they see or read about ap-pear to hold some kind of bad form. Crime statistics keep on rising as the economy weakens. The rich get richer, while the poor perish from poverty, and the world outside looks like a scary place for many.

Surveys conducted among South Africans show that more and more people switch their televisions to a different chan-nel as soon as the evening news comes on, and fewer readers are as eager to buy the newspaper as they were only three years ago (2010), because the strain of constant bad news in an already stressful environment becomes too much for most.

People are desperate for good news to lighten the glumness that has befallen the world. Depres-sion is fast becoming an epidemic during these hard times.

Experts and psychologists reckon that, given all these nega-tive factors to deal with in this day and age, it is crucial to keep

a positive attitude alive, and that, they say, is not as easy as just saying “I’m going to be posi-tive and have a great attitude”, or reading motivational quotes. Staying positive requires hard work, every day.

According to international therapists on the subject of posi-tive thinking, creativity arises out of a relaxed state, and it’s creativity we need to come up with solutions to the situations we are in.

In order for us to achieve a positive-thinking mind, they say, we must practise to direct our minds and steer it away from judgment and toward compas-sion — for ourselves and others. Speak positive thoughts out loud to yourself, over and over, so that it becomes a habit and the negative thoughts will dissolve in time, is the advice.

Many experts mean that it is essential to surround yourself with positive people. All of us affect, and are affected by, the people we meet, in one way or another. This happens in-stinctively, they say, and on a

subconscious level; through our words, thoughts, feelings and through body language. This is why we (instinctively) prefer to be around positive people and avoid the negative ones. “Negative thoughts, words and attitude bring up negative and unhappy moods and actions,” say psychologists. “When the mind is negative, poisons are released into the blood, which cause more unhappiness and negativity,” says a psychologist from Cape Town.

Robin Sharma, writer of The Monk who sold his Ferrari and other inspirational books, says: “Spend time with your kids, fam-ily and friends, instead of spend-ing hours slouched on the couch in front of the television because you’re tired. Pick your kids up, carry them, twirl them around or whatever you feel like. Just do it. There were times when all I really wanted to do was just sit on the sofa, but my kids wouldn’t let me. What about some good news for a change

For the time being, there will be no load shedding of elec-tricity in the Makhado (Louis trichardt) area.

For the past two weeks, ru-mours have started doing the rounds about an Eskom 2013 load-shedding schedule for Ma-khado (Louis Trichardt). This schedule, according to informa-tion, would contain the dates and times for when power cuts in the town’s electricity supply will take place.

With the winter season here, concerned residents started phon-ing the offi ces of the Zoutpans-berger in an attempt to get more details on this report.

Resident’s minds, for the time being, were put at ease by the electricity department of the Ma khado Municipality who indicated that they had received no load-shedding notice from

Eskom.But Eskom’s ability to keep

the country’s lights on this winter remains a big worry.

Shortly before the winter sea-son, Eskom urged South Africans to try and save 10% of their elec-tricity usage, especially during peak periods. Peak periods are from 06:00 until 09:00 and from 16:00 until 21:00.

“Higher levels of planned maintenance are urgently re-quired in order to ensure that our ageing fleet of power stations can perform more reliably, on a sustained basis,” said the energy supplier. According to Eskom, almost two thirds of their power stations are already past their mid-point of expected operating lives and require higher levels of planned maintenance work.

That is why, said Eskom Chief Executive Brian Dames, they

will continue to do extensive maintenance work, no matter how challenging it might be in the cold months ahead.

“We have kept the lights on in recent years, in a situation of constrained supply, in part by deferring non-essential mainte-nance,” said Eskom. They have now implemented a fi ve-year-plan that will enable them to do the required maintenance.

Peak demand is expected to reach approximately 36 700MW nationwide this winter, similar to last winter.

Eskom have therefore urged households, in particular, to help Beat the Peak by reducing demand during peak hours. Gey-sers, pool pumps, non-essential lighting and all other non-es-sential appliances should be switched off during those hours.

During the south african air Force’s (saaF) air-capability demonstration at the roodewal bombing range last week, it became clear that the saaF is going through some tough times.

The SAAF showcased its military capabilities last Thursday at the bombing range, which falls under the command of Air Force Base (AFB) Makhado. The SAAF is, just like the other three arms of the country’s defence service, under severe budgetary pressure, which meant that the demonstration was downscaled greatly this year. The most noticeable display of air power that was missing was the Gripens from 2 Squadron.

Speaking at the event, the SAAF’s deputy chief, Major General Gerald Ma-linga, acknowledged that the downsizing of the event was due to severe budgetary

constraints. Malinga said that the SAAF command had a difficult time in taking the decision not to take part in any air shows, SAAF exercises or flybys until there was more funding.

He added, however, that the SAAF would continue to deliver, whatever the task. “But it will be extremely challenging, especially in terms of funding.” The SAAF already announced in March this year that 12 of South Africa’s 26 Gripens had been placed in long-term storage. In the place of the Gripens, 85 Combat Flying School’s Hawk fighter training planes were used to fill in with bomb drops and cannon fire to support troops on the ground who were engaged in a simulated battle with the enemy “Charlie”.

Pathfinders, jumping 10 000 feet from an Oryx helicopter, had VIPs from the

various South African and visiting defence forces, as well as the media, look on in wonder as they sailed over them, landing in the “war zone.”

The Oryx helicopters, from 17 and 19 Squadrons, showed their ability to insert and extract troops, land a Gecko ground vehicle, as well as an 81mm mortar team. The 120mm mortars were not demon-strated either, also due to budgetary constraints.

A pair of Rooivalk combat support heli-copters from 16 Squadron also showcased their firepower. In addition to a number of rocket volleys, the nose cannons provided effective air support for the troops moving towards the enemy hiding in the bush and keeping them at bay.

“breaker” Morant and other war criminals are not heroes. the true heroes were the austral-ian soldiers who exposed their despicable war crimes…”

This was one of the opinions concerned South Africans voiced at an interview that was fi lmed for possible screening in the documentary Breaker Morant - The Re-trial by an Australian production team, co-directed by Nic Bleszinsky. The two-part documentary is fi lmed in Australia, South Africa and the UK, where Bleszinsky and military lawyer James Unkles were to lodge their third attempt to obtain a pardon for Morant and Peter Handcock. The two were executed by a British fi ring squad after murdering prisoners of war and civilians, including children, towards the end of the Anglo-Boer War (1899-1902).

Following the fi lming of the re-enactment of murder scenes for the documentary in the Sout-pansberg area, the team fi lmed an interview with Adv Peter Latta (legal researcher and advocate for Zoutpansberg Skirmishes) in Johannesburg on 24 April. At the interview, Latta was assisted by Mn-cedi Vakalisa, attorney and African human rights and generalist lawyer, and Adv André Jooste in his capacity as concerned member of the descendants of the Grobler family. The Grobler children were killed mercilessly by the Bushveldt Carbineers (BVC) on 5 September 1901.

Latta paid a visit to Makhado (Louis Trichardt) on 8 May and gave feedback on the interview. He also received a copy of the book, The legend of Breaker Morant is dead and buried, by Charles Leach, local historian and founder of the Zout-pansberg Skirmishes Foundation, to present to the British government.

Latta was asked in the interview to present the South African view of the James Unkles appeal to the British Appeal Court to set aside the rejec-tion of the pardon for Morant. Latta set forth a few strong points on behalf of the descendants of those massacred by the BVC and the Zoutpansberg Skirmishes Foundation.

“Concerned South Africans … believe that the Unkles appeal amounts to the glorifi cation of war criminals and the promotion of war crimes. This glorifi cation of war criminals is totally inappropri-

ate and unwelcome since the universal declaration of human rights and modern humanitarian laws. The appeal once again opens up old wounds for descendants and traumatises descendants and amounts to a gross violation of their rights,” Latta said and added that the Unkles appeal was similar to neo-Nazis who believe convicted Nazi war criminals were heroes.

Latta brought an interesting perspective by say-ing that the true Australian heroes were Robert Cochrane (Special Justice of the Peace for Western Australia) and the 15 “other largely Australian soldiers who had the courage to expose these rep-rehensible war crimes and their perpetrators”.

“Concerned South Africans respect and admire the decisions of the Australian attorney general and the British defence ministry’s permanent secretary, who have denied these pardon applications. This is in line with the modern human rights ethos,” Latta said.

An important development is that the Zoutpans-berg Skirmishes Foundation will continue to engage with the British High Commission and Australian Government to ensure that the true facts are presented regarding “these despicable war crimes”.

“I’m not speculating, but showing the facts,” Latta said, following intensive research of the facts of the Court Martial of Morant, Peter Handcock and George Witton from the most dependable available resources. “Latta found that Morant and Handcock were guilty since 15 soldiers gave an affi davit which confi rmed that they had witnessed the murders, and the accused admitted to the mur-ders. The argument is often used that Morant and the BVC only followed orders. “It was proved in the Court Martial that no orders existed to kill sur-rendered prisoners of war and wounded soldiers,” Latta said.

Unkles said: “The series [Breaker Morant- The Re-trial] will examine the controversial trial and sentencing in detail and the refusal of the current Australian government and attorney general to support the case for review … It is my contention that serious legal and procedural fl aws denied these men due process … and that will be a focus of the documentary.”

Meissenheimer verduidelik dat Makhado (Louis Trichardt) in vier sektore ingedeel is, elk met ‘n sektorleier.

“Daar word drie georganiseerde twee-uur skofte per sektor per nag gedoen. Elke patrolievoertuig is in besit van ‘n radio wat verbind is met die dorpswag se beheerkamer (Delta Wiskey). Ons is ook in radio verbinding met die polisie,” sê Meis-senheimer.

Meissenheimer sê die dorpswag reageer op enige klagte, dag of nag, en verleen ook bystand en ondersteuning aan die polisie. “Soos u weet is die dorpswag altyd daar met bystand as daar ‘n pro bleem ontstaan. Lede stel soms hul lewens in gevaar om u, die publiek, te help. Lede is vrywil-ligers en word nie vergoed nie. Hulle gee nie alleen hul kosbare tyd nie, maar gebruik ook hul eie petrol en eie voertuig,” sê Meissenheimer.

Wat laasgenoemde betref, is die dorpswag op-soek na nog inwoners (veral die jonger geslag) wat kan help om die las te verlig op die lede wat reeds gereeld patrollies ry. Indien daar meer mense is wat ry, ry almal minder skofte.

“Kom wys wat in jou steek en bied jou diens aan vir die gemeenskap. Kom ons wys dat ons omgee vir ons vrouens en kinders en oumense, deur hulle te beskerm en ‘n veilige, misdaadvrye omgewing daar te stel. Mens weet nooit - môre is dit dalk jy wat kan deurloop onder die misdaad,” sê Meissenheimer. Hy voeg by dat hulle tans sowat

106 lede is wat duisende inwoners help beskerm. “Ons kort omtrent nog 200 lede om meer skofte te kan ry,” sê Meissenheimer.

the escalating number of rhinos that are being poached in the province prompted the provincial police commis-sioner, Lt gen simon Mpembe, to assign the stock theft unit to crack down on rhino-poaching syndicates, and his decision seems to be paying di vidends.

Barely three months into their new role of targeting poachers and preserving the world’s most vulnerable beast of late, the Stock Theft unit has recorded a substantial amount of success.

From January up to date, the unit has arrested a total of 31

suspects, recovered 11 rifles (including two AK 47s), 128 live rounds of ammunition, four rhino horns, two elephant tusks, eight knives and sixes axes.

The provincial commander of the Stock Theft Unit, Lt Col Madimetja Mokale, said his colleagues had been cracking stock-related crimes for quite some time and was not fazed when the responsibility of tack-ling rhino poaching came along. He said the dedication and deter-mi nation which his colleagues within the unit showed towards their responsibilities was the driving force behind all the

successes.Mpembe said fi ghting crime

was everybody’s responsibility and he would shuffl e personnel around if needs be. Mpembe added that he could not ignore the good work which the unit had been doing over the years and it was time to entrust them with more responsibilities; he was happy with the return. “The war against rhino poaching in the province is tough, but we will fi ght it ... We will do our best to empower the unit with resources and also bolster their manpower if the tasks at hand demand this,” said Mpembe.

Successes for police’s stock theft unit

the ward councillor for tshi-ko ta in the Makhado munici-pality, Cllr brian du plooy of the Democratic alliance, wel-comed the proposed redevelop-ment of the infamous tshikota Lodge site last week.

He referred to an announce-ment by Human Settlements MEC Clifford Motsepe that the old Tshikota Hostel devel-opment will be rectified and re-developed in the present fi nancial year. The MEC made this announcement during his 2013/14 departmental budget vote speech.

The multi-million rand effort made in 2001 to redevelop the hostel premises into quality beginners’ rental units ended in

disaster when, on completion 12 years ago, the newly erected residential units were declared unfi t for human occupation, due to the usage of sub-standard material and building methods. Residents have struggled since then to get the government to ad-dress the crisis. The derelict site, however, remained uninhabit-able. Residents expressed fears that it could deteriorate into a massive crime zone and hideout for criminal elements.

In a media release last week, Du Plooy said residents who were in line to take up units in the development were still living in shacks. They were unable to apply for RDP houses, due to the municipality’s mistakenly re-

cording them as having received those Tshikota homes a long time ago. They are registered as RDP occupants on the system.

Du Plooy said the DA had in-ves ti gated the housing develop-ment after receiving complaints from the community. The MEC indicated in his speech that more than 100 benefi ciaries will ben-efi t from this re-development. The department will now em-bark on phase one of a two-phase re-development project in this fi nancial year.

Du Plooy said the DA would be monitoring MEC Motsepe’s progress with this develop-ment, given the empty prom-ises Tshikota residents had been given for the past decade.

Verkope begin om 07:30 met ‘n verskeiden-heid vleis, biltong en droëwors wat te koop aangebied word. Daar is ook heerlike tuisgebakte koeke, terte, beskuit en koeksisters, asook kerrie-en-rys, hamburgers, vetkoeke met maalvleis, warmbrakke, sosaties, nagereg en natuurlik pannekoek.

“Kom geniet ‘n koppie tee of koffi e en ‘n snytjie koek in die teetuin, of drink ‘n yskoue koeldrank,” nooi die gemeente.

• MONSTER ROCK FESTIVAL Residents of Makhado (Louis Trichardt) can start getting ready for the next Monster Music Festival to be held at the Rugby Lapa on 1 June.

The fi rst band will perform at 12:00, with fétes opening at 11:00. In total, 13 bands will be performing, showcasing the best bands in Limpopo along with bands from Gauteng. The music showcased covers a wide spectrum of genres - from Afrikaans and oldies to classic rock and rock.

Bands playing include Van Smith, Flatlander, Die Vynils, Comet D Strings, Borderline, Mo-ments in Oblivion, Dezgheta, *9#, Lizzie, Rein-hardt gone solo, MeeM and Sold out.

There will be cash prizes for the tyre-throw and bungee-pull competition, as well as lucky draws and give-aways. Other attractions include food and merchandise stalls, a tattoo artist and a jumping castle for the kids.

Tickets are available at the Rugby Lapa Louis Trichardt or at Light World at R100 per adult and R50 for children between the ages of 12 and 18. Entry for children under 12 is free.

police in Limpopo are searching for a suspect who overpowered a five-year-old girl while she was walking on her way home from school, severely assaulted and possibly raped her and then left her lying in the veld.

The incident allegedly took place on Thursday, 11 May, in the Capricorn RDP settlement at Morebeng (Soekmekaar) when the girl left school to walk to her residence. She never returned home and was reported missing the same day. A search was launched, but she was not found until police received a call on Sunday evening at approximately 21:00 about the body of a girl that was found lying in a dense, bushy area. Police went to the scene and discovered the missing girl. She was still alive, but had been severely assaulted all over her body.

“The possibility that she might have been raped

is also being investigated,” said provincial police spokesperson Col Ronel Otto.

The girl was taken for treatment to a local hos-pital at Botlokwa (Matoks), from where she was transferred to the Polokwane Provincial Hospital. At the time of going to press, the police reported that she is still in a serious condition. No arrests have been made yet in connection with this inci-dent.

Provincial police commissioner Lt Gen Simon Mpembe expressed his utter shock and outrage over the incident and vowed that the police would use all their resources to track down the suspect. He also appealed to members of the community who might have witnessed something or anybody who might have information which might assist with the investigation to come forward.

Friends of ours love to feed the birds and pigeons in their back yard. Sometimes

a wild bird or dove would fl y into a window and break its neck. One moment it was fl ying, a happy bird, and within seconds it was dead.

These sort of incidents don’t just hap-pen in the world of birds, but again and again we hear of healthy people dying in an instant. Accidents are very common. None of us can be sure what the next mo-ment holds for us.

David’s words in our text are very true: “There is but a step between me and death”.

Remember that you must be prepared to meet God at any moment, for today may be the day when you are called into His presence. There is only a heartbeat between being alive on earth and stand-ing before the Lord Jesus Christ, who is the King of kings and the Lord of lords.

Ek wil graag kommentaar lewer op mnr. Jaap Kelder, voorsitter

van die Nasionale Belastingbetalers-vereniging, se brief in die Beeld van 9 Mei 2013.

Hierdie is ‘n klassieke geval waar die boodskapper geskiet word as die ontvanger nie van die boodskap hou nie. Jaap Kelder bevraagteken my bona fi des en integriteit, maar weereens versuim hy om die spesi-fi eke punt wat ek aangeraak het, te bespreek.

Ek is tog sekerlik geregtig om in my persoonlike hoedanigheid in die openbare diskoers deel te neem en my opinie by wyse van briewe uit te spreek. Noudat Jaap Kelder egter my bona fi des en integriteit bevraagteken, kan ek dit op rekord plaas dat my fi rma deurgaans ge-poog het om ‘n skikking met die Soutpansberg Belastingbetalers-vereniging se regsadviseur te bereik.

Tans het die Soutpansberg Belas-tingbetalersvereniging 372 lede met rekeninge wat agterstallig by die Makhado Munisipaliteit is. Indien daar wel dagvaardings teen die lede uitgereik word, kan hulle aanspreek-lik gehou word vir prokureurs- en kliëntkostes wat behels die party- en party kostes plus 100% toeslag, soos vervat in die Verbruikersooreenkom-ste wat hulle met die Makhado Munisipaliteit aangegaan het. In so ‘n geval sal die aanvangsregskostes om ‘n aanmaning en dagvaarding uit te reik en te beteken nagenoeg R1 418 per aangeleentheid beloop, wat ‘n totale bedrag regskostes van R527 496 kan verteenwoordig.

As die aangeleentheid deur lede van die Soutpansberg Be-lastingbetalersvereniging geop-poneer word, kan die getakseerde prokureur- en kliënt kostes R20 000 of meer per aangeleentheid beloop, wat ‘n totale fooi van R7,4 miljoen sal verteenwoordig.

Tans is daar slegs die aangeleent-heid hangende in die Noord-Gau-tengse Hooggeregshof waarna Jaap Kelder foutiewelik verwys asof die Munisipaliteit die aangeleentheid verloor het. Die ware feite is dat die Makhado Munisipaliteit, om regs-kostes te beperk, toegestem het tot die voorlopige bevel in afwagting vir die Hof om die aangeleentheid te beredder. Geen kostebevel is tans gemaak nie. Indien die aange-leentheid gefi naliseer word of ‘n skikking bereik word, sal ons totale fooie waarskynlik nie meer as R50 000 tot R60 000 beloop nie, teenoor fooie van meer as R7 miljoen as die dispuut by wyse van dagvaarding beslis moet word.

Die feite en syfers spreek vanself. Aangesien die fi nansiële implika-sie nou bespreek word, versoek ek Jaap Kelder ook graag om sy fi nansiële belang by die Belasting-betalersvereniging te verklaar, en watter inkomste hy die afgelope jaar daaruit ontvang het. As my interpre-

tasie van die Rademansaak korrek is, bedreig dit die voortbestaan van die Belastingbetalersverenigings, aangesien daar geen sin is om met dié verenigings voort te gaan indien hulle wetlik verplig is om die volle rekening te betaal nie.

Ter wille van lesers wat nie my eerste brief gelees het nie, herhaal ek kortliks my argument dat die Grondwetlike Hof basies beslis het dat ‘n verbruiker se Munisipale rekening, wat uit verskeie items bestaan soos kragtoevoer, vullisver-wydering en basiese koste, in terme van Artikel 102 van die Munisipale Stelses Wet en Bywette gekon-solideer kan word. Daarna word daar slegs na een rekening verwys en die verbruiker kan nie dikteer watter items hy wil betaal en watter items nie. Indien die verbruiker nalaat om die rekening ten volle te betaal, is hy basies in versuim en is die munisipaliteit geregtig om die verbruiker se krag af te sny en/of ander toepaslike regstappe te neem. Ek verwys spesifi ek na paragraaf 30–34 en paragraaf 39 van die Rademan vs. Moqhaka Munisipali-teit-uitspraak, waarin die Grondwet-like Hof dit duidelik stel dat die verbruikers hulle totale rekeninge moet betaal.

Jaap Kelder poog om paragraaf 42 en 43 tot die essensie van die uit-spraak te verhef terwyl dit geensins die geval is nie en die essensie van die hofsaak wel in paragraaf 30-34 bespreek word. Ek versoek die lesers graag om self die aangehaalde gedeelte te lees en self te beoordeel wat die effek van die Grondwetlike Hof se beslissing is.

Wat Jaap Kelder ook nalaat om te verduidelik, is dat die belastings wat gehef word, nie vir ‘n spesifi eke diens is wat gelewer word nie, maar basies die munisipaliteit in staat moet stel om sy ander funksies te verrig waarvoor daar geensins voorsiening gemaak word in die verbruikersooreenkoms met die verbruiker nie, soos verkeersdienste, verkeersligte, straatligte, instand-houding van openbare ruimtes en parke en vele meer. Kan Jaap Kelder asseblief verduidelik hoe hulle gaan bepaal watter van die algemene dienste onbevredigend verrig is en watter persentasie van belastingbetalersgelde hulle geregtig is om terug te hou? Tans hou die Belastingbetalersverenig-ing al die belastingbetalings asook basiese heffi ngs terug en verwag dat die munisipaliteite wel bevredi-gende dienste moet lewer sonder ‘n voldoende inkomste.

Ek vertrou dat hierdie skrywe wel my bona fi des en integriteit bo verdenking plaas, maar totdat Jaap Kelder sy belange verklaar het, bevraagteken ek sy bona fi des.

Who is a debt collector?A debt collector is any person or company other than an at-torney or his employee who for reward collects debts owed to another on the latter’s behalf. Property Managers who collect arrear rent or levies are also debt collectors.Must a debt collector be registered?All debt collectors must register with the Council for Debt Collectors in order to operate. Failure to register before collecting a debt is a criminal offence.How do I know if the person contacting me is a debt collector?All debt collectors must produce proof of registration, on request.What do debt collectors do?They collect debts owed to another, by mail, phone or in person. They may deliver documents and may even have an acknowledgement of debt signed.What is an acknowledgement of debt?A legal document in terms whereof a party admits his li-ability to another, often coupled with an offer to pay off the debt in monthly installments, and consent to judgment.

THE DEBT COLLECTION INDUSTRY AND THE CONSUMER

It is a reality in the times we live in that most South Africans will probably at some stage be contacted by a debt collector for the payment of an outstanding amount. Whether the demand is for outstanding School fees, Rent and levies, unpaid accounts, TV licenses, medical bills or any other amount, the collection of these amounts if done by any other person than the person to whom the amount is owed in all likelihood falls under the auspices of the Council for Debt Collectors The principles applicable as well as the exceptions to this general rule is set out below.

Once signed such a document may lead to a court order being obtained without further notice to the debtor.Who regulates the debt collector’s actions?The Council monitors the ac-tions of debt collectors ensuring that their actions comply with the code of conduct for debt collectors and further ensuring that they charge only those fees allowed by the Act.What fees may debt collectors charge?The fees are prescribed by law, which include a fee for letters, telephone calls and a collection commission.Fees generally not recoverable are bank charges, and travelling expenses.Typical fees at date of print and con-tained in Schedule B of the Regulations are for example:Necessary Letter R15-00Necessary Phone call R15-00Consultation with debtor\R37-00Other necessary expenses R15-00

A debt collector is not entitled to claim more than R736-00 in fees or the capital amount due whichever amount is the lesser.It then follows that on a debt of R100 the fees charged may never exceed R100.

A debt collector is also allowed 10% fee per instalment received in payment of a debt subject to a maximum of R368-00. Note: Collection commission agreed upon between the debt col-lector and the client cannot be recovered from a debtor.

What should I do if a debt collector contacts me?• Make sure he or she is regis tered. Contact the Council for clarification if necessary.• Listen carefully to what he or she says.• When in doubt obtain legal advice or approach the Council.What rights do debt collectors have?• They have the right to contact you for the payment of a debt• They have the right to charge the prescribed fees for the work done in collecting a debt.

What rights do I have?

• The right to obtain legal advice before signing anything. In the legal world your signature on a document like for instance a acknowledgement of debt can have serious financial consequences.• To be treated with dignity at all times.• The right to confidentiality.• The right not to be contacted before 6 in the morning or after 9 in the evening, or on a Sunday.• The right not to be harassed, humiliated, embarrassed or threatened.• To receive a statement should you request one free of charge once every six months. • To have the account of a debt collector taxed by the clerk of the magistrate court should I dispute the amount for fees charged by the debt collector.• If unhappy with the conduct of a debt collector to report him to the Council for investigation and possible disciplinary steps.

na afloop van die vyfde rondte van die Mtn (Driven by nissan) nasionale halfmarathon bergfietsreeks beklee die jong Cp van Wyk van Makhado (Louis trichardt) tans ‘n algehele tweede plek in die reeks. Die vyfde rondte is op 12 Mei by Diemersfontein (Wellington) beslis, met Cp wat algeheel derde eindig in die 40km halfmarathon. sy tyd was 01:38:59, slegs ‘n sekonde ná die tweedeplekwenner en twee sekondes ná die wenner. nog ‘n jong plaaslike fietsryer en mede-leerling van Hoërskool Louis trichardt, Christiaan roos, eindig algeheel 26ste uit die 326 fietsryers wat die wedren voltooi het, in ‘n tyd van 01:55:34. beide Cp en Christiaan ry vir die psg-span, met nog drie rondtes oor in die reeks. op 27 april het die jaarlikse kompetisie tussen die Makhado Lugmagbasis rolbalklub en Louis trichardt rolbalklub plaasgevind op laasgenoemde se bane om te bepaal wie nou eintlik die Vark van die noorde is. na die dag se spel was die twee klubs gelyk met ses punte elk en is die verskil in skote bereken om die uiteindelike wenner te bepaal, met Louis trichardt wat as oorwinnaars uit die stryd tree. In die foto oorhandig die voorsitter van die basis se rolbalklub, Hannes van der Merwe (regs), die trofee aan die Louis trichardt rolbalklub se president, ben groenewald. Foto verskaf.

Laerskool Louis trichardt se rugbyspanne het verlede Donderdag harde bene gekou in hul eerste ligawedstryde teen oos-skool van polokwane.

Oos-Skool se spanne het in die Super 12-reeks vir laerskole baie goed gevaar en hul ervaring het duidelik gewys in hul wedstryde teen Triegies.

Triegies se 0/9’s verloor 62-0, terwyl die O/10’s 39-5 die onderspit delf. Ook die tweedes val vas en verloor 40-5, terwyl die eerstes 50-3 die knie moes buig. Die enigste Triegie-span wat ‘n mate van suskes behaal het, was die O/11’s wat 12-12 gelykop gespeel het.

Triegies se volgende ligawedstryde is teen Suid-Skool (Polokwane).

Johan uys, oudleerling van beide Laer- en Hoërskool Louis trichardt, is op die ouderdom van 47 jaar steeds aan die presteer op die atletiekveld. Hy het op 4 Mei sy nasionale kleure in atletiek ontvang tydens ‘n plegtigheid in oudtshoorn. buiten vir Wp-kleure, het hy op skool ook Verre-noord en noord-transvaal kleure verwerf. Johan is ‘n lid van die bellville atletiekklub en vir etlike jare werksaam as senior wetenskaplike by die Mediese navorsingsinstituut. sy ouers, Hansie en Corrie uys, is steeds woonagtig in Makhado (Louis trichardt). Dié skuts het op saterdag, 27 april, aan die soutpansberg skietklub in Makhado (Louis trichardt) se skietkompetisie deelgeneem en as wenners uit die stryd getree. this year, the mountain bike race of the ppC Kremetart Cycling race will be hosted in the form of a cross-country olympic event.

Cross-country Olympic (XCO) is a popular mountain bike discipline which is the only form of mountain biking that is an Olympic sport. XCO consists of lap racing around a short circuit containing

various obstacles that must be negotiated. Apart from fitness, XCO also requires serious bike-handling skills.

This year, the Kremetart Mountain Bike XCO will be hosted in the Komatieland Forestry area on 9 June, the day after the big 175km, four-stage road race.

Depending on all the age categories that enter, a total of 12 races will be held

on the course. The goal is to complete the required laps in the fastest time possible.

Pre-entries for the MTB XCO are cur-rently open for those interested and will close on 24 May. There will also be time to enter before the race from 06:30 on the day of the race.

theresa Jooste of the Louis trichardt bowls Club won the prestigious Limpopo Ladies Champion of Champions 2013 competition in polokwane over the past weekend. the competition is a singles competition that is played annually over two days, and Jooste competed against players from all the other clubs in the Limpopo district. she secured good wins against some of the province’s best players to give her the eventual top spot.

Cycling

Die suid-afrikaanse platteland Muurbalkam-pioenskappe, wat vanaf 8 tot 11 Mei deur die Limpopo provinsie in polokwane aangebied is, het vir strawwe kompetisie gesorg.

Altesaam 36 spanne met sowat 150 spelers van regoor Suid-Afrika het in die vier afdelings van die kampioenskap deelgeneem.

In die mans A-afdeling was dit Noord-Wes wat koning kraai. Erik Welman van die Soutpansberg Muurbalklub vorm deel van die Limpopo-span wat vierde eindig in dié afdeling.

Limpopo het meer sukses gehad in die mans B-afdeling en tree as wenners uit die stryd. Die Soutpansberg Muurbalklub spog ook met ‘n speler in dié span, naamlik Dirk du Preez. Limpopo se ander twee manspanne behaal onderskeidelik ‘n 11de en 12de plek, met Soutpansberg se Bertus Guillaume en Theo Schlieben wat deel vorm van hierdie spanne.

Limpopo het geen deelnemers gehad wat in die A-afdeling vir vroue deelgeneem het nie, maar het wel spanne ingeskryf in die B-afdeling, wat spog met ‘n tweede en derde plek. Polisie se vrouespan was die wenners van die B-afdeling.

Muurbalnuus
