ALBERTA ARMING COMMUNITIES TO FIGHT

CLIMATE CHANGE The Municipal Climate Change Action Centre’s efforts to reduce greenhouse gas emissions and support local energy efficiency initiatives are getting a boost from the Alberta government.

The Centre is a one-stop shop that provides tools and resources to help Alberta municipalities through education, technical assistance and expertise, best practices, policy review and rebates to help municipalities retrofit their buildings.

Since 2009, the Action Centre has supported $4.2 million in municipal energy efficiency retrofit projects in 54 buildings throughout the province as part of its Taking Action to Manage Energy (TAME) Buildings Initiative. This will result in a reduction of 2,500 tonnes greenhouse gas emissions per year.

“Municipalities are important leaders and partners in advancing Alberta’s efforts to address climate change. This funding will ensure municipalities can continue to curb greenhouse gases.”

The Alberta government also provided $2 million to help establish the Centre in 2009.

NORELLCO ORDERED TO PAY $185,000 FOR RELEASING CHLORINATED WATER INTO THE STURGEON

RIVER

Norellco Contractors Ltd. was ordered to pay $185,000 in Alberta Provincial Court on November 6, 2014, after pleading guilty to one count of an offence under the Fisheries Act, related to releases of chlorinated water into the Sturgeon River.

On June 26, 2012, Environment Canada received notification that a contractor performing work in St. Albert had broken a high pressure water main. As a result of this break, approximately 18,000 litres of chlorinated water was discharged into local sewer drains. Those drains lead to the Sturgeon River, which is fish-bearing. Environment Canada enforcement officers subsequently opened an investigation into the incident.

On July 2, 2012, the department was notified of a second break by Norellco Contractors Ltd. to the same water main at a point only metres from the location of the first break. An estimated 16,000 litres of chlorinated water was discharged into the river during this second event. Officers determined that the company failed to follow guidelines set out in the Alberta Occupational Health and Safety Code by using a backhoe within one metre of the pipeline. Subsequent sample analyses confirmed that the chlorinated water discharged during the second release was deleterious to fish.

• The company will also participate in the 2015 Northern Construction Safety Officers Conference to inform attendees about the releases, the causes and how preventative measures can avoid future incidents.

• $180,000 of the total penalty will be credited toward the Environmental Damages Fund (EDF) to promote the proper management and protection of fish or fish habitat in Alberta.

• The Sturgeon River is home to a number of fish species, including White Sucker, Northern Pike and Longnose Dace.

RECYCLING COMPANY FINED FOR FISHERIES ACT VIOLATION IN EDMONTON

This week, General Recycling Industries Ltd. (GRI) pleaded guilty in Alberta Provincial Court to one count of an offence under the Fisheries Act, related to the release of a deleterious substance into fish-bearing waters. The company was sentenced to a $75,000 penalty.

On April 28, 2012, Environment Canada received notification that “oily water” was being pumped from GRI property into a storm sewer. An Enforcement Officer attended the site and observed a four inch hose discharging industrial

wastewater into the sewer, which flows into Mill Creek and subsequently the North Saskatchewan River. Both bodies of water are fish-bearing.

Sample analysis confirmed that the wastewater was deleterious to fish. An investigation into the incident was opened and the company was charged in 2013.

$73,000 of the penalty will be allocated to the Environmental Damages Fund.

PROPERTY RIGHTS ALREADY PROTECTED UNDER LAND-USE PLANS,

ALBERTA ENVIRONMENT MINISTER SAYS (Source: Edmonton Journal) EDMONTON - Property rights are already well-protected under regional land-use plans that balance economic opportunity with environmental protection, provincial Environment Minister Kyle Fawcett said Wednesday.

The land-use plans, a sore point for many property rights advocates, are needed to deal with a booming population, fast-growing oil and gas industry and expanding agriculture sector, Fawcett told the annual meeting of the Alberta Municipal Districts and Counties in Edmonton.

“All these regional plans fully respect the property rights of Albertans and the decision-making role of municipalities,” said Fawcett. “Managing the land is a shared responsibility that involves all Albertans.”

To reassure property rights advocates, the Prentice government this week moved to rescind the Land Assembly Project Area Act, which allowed government to freeze property for future public works without compensation.

But property rights advocates also want to see changes to the Alberta Land Stewardship Act, which authorizes new regional land-use plans.

They say the act gives the government powers to rescind or restrict water licences, grazing licences and other government permits that are commercially valuable.

They want adequate compensation, access to the courts and consultation.

Fawcett said those measures are already provided in legislation.

He also said compensating landowners when environmental measures are required could be costly.

“There is definitely a cost to improving environmental protection — whether it is on the land air or water,” Fawcett said in an interview.

“We have to sharpen our approach to the environment. If we want to be leaders in the area, we have to understand that is a cost.’

Fawcett used strong language on the need to reduce carbon emissions and announced a $2-million grant to renew the municipal energy efficiency program.

“No one can dispute the need to reduce our carbon footprint,” said Fawcett, calling it a “a moral and economic imperative.”

The Municipal Climate Change Action Central, opened in 2009, oversaw energy retrofits at arenas and community halls and installation of solar panels on community buildings. Those projects are already saving $400,000 in operating costs annually and have reduced greenhouse gas emissions by 50 tons over 20 years, he said.

SOLAR POWER IN ALBERTA TOPS 5,000 KILOWATTS

(Source: Edmonton Journal) Alberta hit a milestone for solar power on its grid Thursday, and now has 5,001 kilowatts of generating capacity.

“If you’re from Germany or California, you see those numbers and they’re funny because they are so small,” said Rob Harlan, head of the Solar Energy Society of Alberta. “But for us, it’s a big thing. It’s remarkable that it’s changing so fast.”

At this time last year, Alberta had 3,350 kilowatts of generating capacity, meaning the province has seen a 49-per-cent jump in one year.

There are now 1,106 solar systems installed in Alberta and connected to the electrical grid, according to data from Alberta Energy.

The society is hosting a seminar next Wednesday evening with presentations from homeowners on the experience of living with solar. Two farmers will be speaking, as well as two local residents who retrofitted their homes.

Edmonton resident Emanuel Blosser installed $60,000 worth of solar power in October, enough to cancel his $2,000 annual energy bill and also power the electric smart car he hopes to buy this spring.

Raquel Feroe installed solar panels on her home to help reduce the health impacts of burning coal for electricity in Alberta, said Harlan. She convinced the Riverdale Community League to add panels to their building, as well.

U OF A’S ‘GAME-CHANGING’ SENSORS REVOLUTIONIZE METHODS OF

MONITORING CLIMATE SCIENCE DATA EDMONTON - About 300 cellphone-sized sensors installed in the forest north of Peace River are the front lines of a revolution in climate science set in motion by University of Alberta scientists.

From his office on U of A campus, professor Arturo Sanchez can tell whether the forest soil is getting drier, whether spring is early or late, or whether lightning caused a forest fire — all from data streaming dozens of times a minute from the sensors.

“It’s so cool,” says the upbeat professor in the department of earth and atmospheric science and project leader working with a team of Canadian and international scientists. The data is so detailed it can measure how much carbon dioxide the forest is absorbing or emitting, how much sunlight plants are using in photosynthesis, and predict a drought.

The Alberta-developed technology is “a game changer” for researchers and a new tool in the world’s battle to monitor climate change and reduce greenhouse gas emissions, says Sanchez.

It’s also a great new tool to help Alberta policy-makers understand the environmental impacts of oilsands development or forestry companies and how to mitigate the impacts, he says.

Next week, Sanchez will take the system, called Enviro-Net, to a UN climate change conference in Lima, Peru, so the rest of the world can take advantage of this major scientific advance.

The concept of real-time measuring came to Sanchez but the technology wasn’t there. So the U of A team had to built the specialized sensor which records 64 different climate details.

This one records two measurements every second and sends the data to a tower in the forest which relays it to the university.

“The University of Alberta has the capacity when faced with challenges to develop the technology,” Sanchez adds.

The next problem was how to deal with the massive flow of data streaming in every second all day and all night from the censors; how to find the trends and changes.

“In other words, how to move from data to knowledge,” says Sanchez.

That’s where IBM came in with its software capable of handling large data streams — called advanced analytics.

The software provides real-time analysis for 10,000 points of data per second from sensors now placed in Australia, Costa Rica, Brazil and Mexico as well as Alberta.

“You can quickly see a trend line if soil moisture is rising or falling,” he says.

The team chose the Peace River area for a test site about 2-1/2 years ago. The idea was to get baseline data about the health of forests before oilsands development takes off.

“We are finding out what are the conditions of the environment, the health of the forest, before development starts,” Sanchez says.

Over the years, policy-makers can watch in real time the changes and measure them against the baseline data.

This Enviro-Net tool will enhance Alberta’s ability to provide world-class environmental monitoring and keep track of changes due to climate change as well, Sanchez notes.

This technology will benefit many countries and that’s why the U of A is taking the system to the public, he adds.

In Costa Rica, for instance, the sensors revealed that a forest there, under drought conditions, absorbed 40-per-cent less carbon than the year before.

That’s a key piece of information for the country which is trying to become carbon neutral by 2020, says Sanchez, who began working on the system four years ago.

Scientists used to collect data themselves in the forest, then took months to analyze it and report it.

“Now we can basically ‘see’ the forest breathing in real time,” he says.

BC STARTS REVIEW OF REMEDIATION REGIME

(Source: HazMat Magazine) B.C. has released two discussion papers outlining the options the ministry is considering for each of the aspects under review for contaminated sites

The British Columbia government is revisiting the legal regime that surrounds the province’s site remediation processes.

There are two primary concerns from the government’s view: First, B.C. has seen an increase in site remediations over the last decade, but soil relocation applications have actually decreased.

Second, B.C.’s Ministry of Environment has concerns over the provisions for identifying potentially contaminated sites. In terms of the site remediation profile process, the ministry has identified a number of weaknesses and gaps. (See list at bottom of page.)

B.C. has released two discussion papers outlining the options the ministry is considering for each of the aspects under review for contaminated sites. You can read the papers, as well as comment on them, by clicking here. The deadline for comment is Dec. 10, 2014.

In terms of the site remediation profile process, the ministry has identified a number of weaknesses and gaps:

• The multi-step process is confusing and inefficient, with significant administrative burden for al involved

(ministry, local government, and applicant). • Variability in local government bylaws and permitting processes result in uncertainties and inconsistencies

in the system. • Local governments are able to “opt out” of the site profile process, resulting in a patch- work system

across the province – screening of potentially contaminated sites is taking place in some local government districts but not in others.

• Too many triggers initiate the process, often bringing sites to ministry attention at an inappropriate time (for example, minor zoning changes, lot line adjustments, demolition of buildings). This concern led to the development of the “release” process described in the Land Remediation Section Administrative Guidance document 6 (“Site Profile Decisions and Requesting Releases Where Local Government Approvals are Required”).

• Schedule 1 (the site profile form) can be completed by anyone to the best of their knowledge. Applicants are not required to complete historical searches to determine site use, therefore, declarations on the form may not always be accurate.

• Existing site profile exemptions are not always clear and some exemptions are outdated. This creates inconsistency in the implementation of site profile requirements.

• The consequences of submitting a site profile to the ministry are not clear. An applicant must wait for a response from the Director before planning next steps, which can lead to delays in the development process.

• The enforcement of requirements imposed in release letters is difficult and time consuming for ministry.

HARPER GOVERNMENT SUPPORTS NEW ADVANCEMENTS IN ENVIRONMENTAL MONITORING

The Honourable Keith Ashfield, Member of Parliament for Fredericton, on behalf of the Honorable Leona Aglukkaq, Minister of the Environment, Minister of the Canadian Northern Economic Development Agency and Minister for the Arctic Council, announced today the Government of Canada will contribute $280,000 to support work on new innovations in environmental monitoring.

The contribution is being provided to the University of New Brunswick’s Canadian Rivers Institute to support its work on the development of new gene-based environmental monitoring method that is more cost-effective and accurate than other observation techniques.

This method will follow the protocols of the Canadian Aquatic Biomonitoring Network (CABIN) and will focus on the water quality monitoring area of the Joint Oil Sands Monitoring Program. CABIN training and certification will then enable any agency with a mandate in watershed science (i.e. volunteers, First Nations, academics, consultants, industry, provincial/territorial departments) to collect consistent and credible ecosystem health data across Canada.

The benefit to the greater watershed science community will be the development of improved field methods, which could lead to substantial cost savings and reduce the turnaround time for biological data monitoring programs.

advancing watershed sciences and ecological sustainability. • The new method is a world first and was developed as a collaboration between Environment Canada, the

BAT DEATHS AT WIND FARMS NEED MORE STUDY, EXPERT SAYS (Source: Edmonton Journal) EDMONTON - Thousands of bats die on southern Alberta wind farms each year, but it’s unclear what effect that is having on the overall population, says Canada’s foremost bat expert, Robert Barclay.

Most of the bats die because their lungs collapse when they run into low air pressure around the tips of the wind turbines — not because they hit the towers or blades.

With wind farms now coming to north-central Alberta — including two new projects east of Edmonton — the impact on bats migrating from northern forests needs further study, says Barclay, a University of Calgary biology professor.

It’s a serious issue, but with no accurate count of the province’s bat population, “it’s hard to say if turbines are killing too many,” said Barclay.

“We know very little about the abundance and distribution of bats in central to northern Alberta.”

Barclay’s research, begun in 2006, uncovered the surprising fact that migrating bats are much more likely than birds to be killed by wind turbines.

Thanks to their sonar bats can detect solid structures, but they cannot detect the changing air pressure that causes bleeding in their lungs. Birds’ lungs are able to withstand the pressure change.

Barclay’s groundbreaking research took place at Transalta’s Summerview wind farm near Pincher Creek in 2005. When the company noticed bat carcasses under the turbines, it asked Barclay to do a study.

Barclay and his team found 20 to 30 dead bats per turbine. But that number was cut almost in half when Transalta decided not run the turbines when the wind was low and bats are most active, he said.

“This work done at Summerview was one of the first cases in North America where this mitigation was adopted, and has since been recommended in many other regions across Canada,” said Mike Peckford, TransAlta’s senior environmentalist.

The province now requires wind farm companies to do a pre-construction study to determine the level of bat activity around a proposed wind farm site, says Lisa Wilkinson, Alberta Environment bat specialist.

The problem is bats often fly in the same windy corridors preferred by wind farms, she added.

Companies can be required to do a count of dead bats near each turbine. If fatalities are too high, they can be required to take steps to reduce them, Wilkinson said.

Those conditions were recently put on northern Alberta’s largest proposed wind farm after the environment department determined there is a “medium to high risk” of bat fatalities.

That project, the Grizzly Bear Creek wind farm by the German energy giant E. ON Climate and Renewables, will have 50 90-metre turbines. Most of the turbines will be east of Vegreville in Minburn County.

The Bull Creek project by BluEarth Renewables was the first to get approval in north-central Alberta, mostly in Wainwright County. It will have 17 turbines at 80 metres high, scaled back from a proposed 46 turbines.

Bats reproduce at a low rate — with only two young each year — “so you have to be careful with these species,” Barclay said.

Wilkinson noted the hazards will multiply as more wind farms are built.

“There’s a cumulative effect if there are more places where bats can be killed, it could take a bigger toll,” Wilkinson.

“We know there are impacts, so we should be cautious. They are a really important part of the eco-system, not just eating mosquitoes but a lot of agricultural pests.”

In Alberta, three types of migrating bats are vulnerable: the silver-haired, eastern red bats, and the hoary bat that hides in trees in the boreal forest.

Bat populations are under heavy pressure; up to 500,000 migrating bats are killed in North American wind farms. As well, hibernating bats are being decimated by a fungal disease that has not yet arrived in Alberta, said Wilkinson.

Gary Marten, spokesperson for E. On, declined to comment other than to say in an email that the company “will fully comply with Alberta Utility Commission regulations and requirements.”

SEVENSON ENVIRONMENTAL SERVICES INC. AGREES TO PAY $2.72 MILLION TO SETTLE

CLAIMS OF ALLEGED BID-RIGGING AND KICKBACKS WASHINGTON – Sevenson Environmental Services Inc., an environmental remediation firm based in Niagara Falls, New York, has agreed to pay more than $2.72 million to resolve allegations that it violated the False Claims Act and the Anti-Kickback Act by accepting kickbacks, rigging bids and passing inflated charges to the U.S. Environmental Protection Agency (EPA) in connection with work performed at the Federal Creosote Superfund Site in Manville, New Jersey, the Department of Justice announced today. Sevenson was the prime contractor responsible for the cleanup of the Federal Creosote Site, which was funded by the EPA. “The integrity of the public procurement process is severely undermined when federal contractors engage in anticompetitive contracting practices for their own personal gain,” said Acting Deputy Assistant Attorney General August E. Flentje for the Department of Justice’s Civil Division. “The Department of Justice will hold those accountable who abuse their positions at the public’s expense.”

EPA is vigilant to ensure that the type of fraud perpetrated by Sevenson employees at Federal Creosote is not tolerated and that federal funds are recovered,” said EPA Regional Administrator Judith A. Enck.

The settlement announced today resolves allegations that Sevenson solicited and accepted more than $1.6 million in kickbacks from six companies in exchange for the award of subcontracts for work at the Federal Creosote Site. It also resolves allegations that Sevenson conspired with the subcontractors to pass the majority of those kickbacks to the EPA and that it conspired with one subcontractor to pass to the EPA additional inflated charges for soil disposal.

This case was handled by the Civil Division’s Commercial Litigation Branch, with assistance from the New York Field Office of the department’s Antitrust Division, the EPA Region 2, the EPA’s Office of the General Counsel and the Kansas City District of the U.S. Army Corps of Engineers. The claims resolved by this settlement are allegations only, and there has been no determination of liability.

We sampled ecosystems abundant in reindeer lichens to better understand their ecological linkages to vegetation and soil conditions. From these data we identified ecological relationships between lichen abundance and unique soil, groundwater and vegetation conditions. We advanced these inferences to develop and apply novel restoration techniques to recover lichen ecosystems in response to an oil sands exploration program. We will discuss restoration techniques that have the potential to accelerate the recovery of lichens by 30 to 40 years and reclaim low-productivity peat soil ecosystems. Our results could offer the energy and forestry sectors opportunities to reduce their disturbance footprint and impacts to caribou foraging habitats. SPEAKER BIOGRAPHIES:

Jonah Keim is an environmental consultant and research scientist with over 15 years of experience practicing terrestrial ecology. Reporting to the Team Leader your responsibilities may include but are not limited to:

• Understanding the application of occupational health and safety principles and regulations, especially as they relate to hazardous materials and indoor environments.

• Planning and conducting site assessments for hazardous materials including (but not limited to) asbestos, mold, lead, PCBs and mercury.
