(a SC) is one of the Cargo Handlin g agencies app ointed by Airport Authority of Ind ia for carrying out Cargo Handling (CH) at Sardar Vallabhbhai Patel Internat ional Airport, (SVPI) Ahmedabad . / s CSC has been awarded a concession by Gujarat Agro Indust ries Corporation I td.(GAICL) on 04.07.2015 for Operation, Maintenance and Managemen t of Centre for Perishable Cargo(CPGC) as well as General Cargo at SVPIA for its Inte rnat ional Cargo Operations, The Authority vide Order No. 36/2015-16 dated 21.10 .2015 permitted CSC to commence the ir operat ion on ad-hoc basis for CPGC on the ap.l2rov d rates of GSE ltd. Rl1Itl~er , the Authority issued Orde r No. 04/20 16-17 dutec;l 22.04.2016 'apprgvtng the Aa-hoG tariff for the year FY2015-16 to facilitate CSC for Domestic Cargo 'Operat ions tor a per iod of 6 mont hs from the date of issue of order or till the MYI P/ATP for the second cont rol period is determined whichever is earlier. The Authority vide th followi ng Orders allowed AOst!SPs to 'ont inue 'with the existing tariff till the determination of tariffs for S,ec6ncl GOJ'tro] peri d: a) Order No. 50 / 2015-16 dated 31.0:3. 2016. b) Order No. 11 /2016-17 dated 29.09.2016. c) Order NO.19/2016-17 dated 31.03 .2017. c1) Order o. 12/2017-18 dated 29.09.2017. e) Order 0.43/2017-18 dated 28.°3.2018. f) Order o. 21/2018-19 datec128.09.2018.

2. a) M/ ~ CSC submitted their MYTP/ ATP online 011 12.°3.2016 an d submitted the following documents for the consideration of the Authority:

i) Audited balance sheet for FY 2015-16, FY 2016-17 and FY2Q17­18(provisional).

ii) Annual Compliance Statement (ACS) for FY 2015-16 , FY2017-18 (provisional) .

iii) Concession Agreement entered with AAl and GSEC.

iv) Key User Agreements. v) Evidence/minutes of the sta keholde r consultation conducted on

03.03.2 0 16 . vi) Calculations on Aggregate Revenue Requ ired (ARR) for FY2018-19,

FY2019-20 & FY2020-21.

b) i) '[he Autho rity considered the above sub missions made by M/s CSC and 5th issued a Cons ultation Pa per No. 18/ 2018-19 dated October, 20 8

wherein, the Authority proposed that M/ s CSC may be allowed t o charge as per the determined tariff for domestic with an tariff increase of 33% for FY 2018-19, 25% for FY 2019-20 ,and 4% for FY 2020-21. Fu rther, it was proposed no increase in tarifti t'q M/s_CSC. for its International Operations for residual period of Second Gont rolReriod.

ii)The Authority noted the followhlg PAr, ,ineters in the financials as submitted

:38% and for FY 2017-18 is -45%. f

1) Return on Av rag RAB i.e -i6% for FY2016-17 and 213% for FY 2017­8.

2) The t urnover/ loss % in FY 2016-17 is -7% and for Il Y2017-18 is 33%.

iii)The Authority observed that M/ s CSC has incurred losses in FY 2016-17 & FY2017-18 mainly due to cont inuation of ad-hoc tariff approved by AERA and considered the shortfall while calculat ing the Aggregate Revenue Requirement (AruR) for EYf!0 1S -19 ~EY2019-20 and FY2020-21. As detailed in above ment ioned consultation Wl or, the t ariff increase proposed/arrived; biY Mrs esc for domestic and unteunationalfcombined) is 53% in FY 2018-19, 24% in FY2019-20 and 4% in FY2020-21.

c) The Authority sough t evidence based written feedback, comments and suggestions fro m stakeholcl 1'8 on~he above mentioned consultation paper (CP) by 25t h October, 2018. The Authority vide email dated 8th October, 2018, informed the same to all concerned stakeholders on the ir registered mail IDs. In response, no com en t has been received from stakehol ders. Mis CSC also has not offere d any comments on the proposal of the said consultation paper.

ORDER pan carefu l conside rati on of the material available 011 record, the Authority, in

exercise of powers conferred by Section 13(1) (a) of the AERA Act, 2008 hereby orders that:

(ii) The Authority is of the view that 'the Guidelines' need not be followed in a routine manner. Further, even in 'J ight Touch app roach; the Authority examines the margins , the growth of profit and Return on RAB to ensure that extraordinary profits do not accrue to t he serv ice provider and that the ultimate custom r is not burdened with higher tari ffs as the latt er does not have any say in the User Agreements.

(iii) Considering the negative (a) Return on RAB, as well as (b) Profit Margin, as detailed in Consultation Paper and since no stakeholder has comment d on the proposal / tariff increase proposed By," the Authority, t he ta riff increase of 33% for FY2018-19, 25% for foY29 9-.20 ~~ n0 2A,('q £0,1' FY2020-21 is found admissible to Mi s esc for its Domestic Cargo Services.
