LOCAL security service provider Eagle EyeProtection Services has disputed claimsthat a court application they filedagainst Stanger Manor Secondary School,after their services were terminated bythe school, was “dismissed with costs infavour of the school” at the Durban HighCourt two weeks ago.

claims that while the case was dismissedthere were “no costs awarded in anyone’sfavour”.

“The case was dismissed due to a dis­pute of facts created by the school.

“We brought to court an applicationto be reinstated as the security serviceprovider, failing which we would claimdamages for the three year contract thatwas terminated.

“When the case was dismissed we

were advised we should go the actionroute in a lower court as opposed to theapplication route.”

Maharaj said the company would betaking the matter on appeal due tomaterial inconsistencies.

“Furthermore, I was in court and therewere no findings by the judge presentduring our appearance. The judge immedi­ately dismissed the case so he did notfind that Eagle Eye misrepresented itself

in tender documents.”MMaharaj also contended that they

did try to amicably resolve the issue atthe school.

“Failing which we exercised our demo­cratic right by going to court.”

Maharaj says that school governingbody chairperson Balan Naidoo acted“unilaterally” in defending the matter.

“We believe he was not mandated todo so by the full school governing body.”

Theschool’sattorney, NarrinePerumal,said the advocate for the school AdrianCollingwood, who was present in court,confirmed that the matter was dismissedwith cost. “This is what we know and fur­ther than that Eagle Eye is free to pursueany avenue they see fit. We do not wantto start a newspaper war,” said Perumal.

ANC provincial secretary, Sihle Zikalalaand MP Maggie Govender attended anunmediated ICW (Indians, colureds,

whites) forum at the KwaDukuza Town Hallon Thursday night.

The ICW committee included ANC region-al chairman Thokozani Msweli, secretaryMuzi Sithole, KwaDukuza mayor, RicardoMthembuaswell as ICWcommitteemembersJeff Kannie, Paul David, RoyNaicker andRiazMeer.

Addressing the largecrowd,Zikalala said itis believed that theANC started as an organi-sation for black people and that it still is.

“This is wrong. It is the principle of theANC that each of our leaders in each epochworked to bring freedom andequality for In-dians, whites, coloureds and Africans. Since1994 what has happened?

“Wedonothavefreedomintotalitybecausetoday we have moved from the struggle of re-sistance against the apartheid government tothe struggle for equality.”

He said each community seems to “careabout their own things”.

“Indians, whites and coloureds believe1994 was largely for the black people.

“Minority groups find that they donot havemuch in common with the ANC because theysee us as a black organisation.

“It is true that the ANC is predominantlyblack but we have had contributions en massfromallpeople inSouthAfricaandweworkforall people.”

Zikalala also spoke about dividing factorssuch as economic orientation,transformationagenda such as affirmative action, service de-livery and factionalism.

He said these factor will have to be ad-dressed to create social cohesion in the coun-try. Speaking about the ICW forum, he said itcomes as an expression of non racialism – afundamental of the ANC.

“Wewant to elicit participation and contri-butions from the Indian, white and colouredcommunities in the ANC structures.

“I admit that there is ahigh level of faction-alism. Election of leadership is based not onthe calibre of the person and the work theycan do but rather on the amount of supportthey bring in.

“Indians, whites and coloureds are left outnot because they do not deserve positions butbecausetheyarenotbringinginsupportersforfactionalism.”

NorthCoastKwaDukuzaRatepayers’Asso-ciationSecretaryFrankduToitsaidtheprovin-cial secretary did all the talking at the event.

“The ‘Indian, white, coloured’ communityhad to listen instead of the ANC listening.

“That left little time for the community toraiseconcerns.Youhavetoaskyourselves,arethey genuinely interested in our concerns orwas it just another vote catching exercise

like the “domesticworkers”meeting recent-ly at the Townsend Park Hall. It is the season,”he said.

KWADUKUZA police areinvestigating a case of mur-der, attempted murder andhouse robbery after a teen-ager was killed on Saturdayin Charlottdale, near Grout-ville.

Acocrding to a policesource, at about 9:30pm afamily was sitting insidetheir home when theyheard a knock at the door.

“Suddenly three armedgunmen barged into thehouse.

“One of the children atthe house managed to runoutside in the ensuing cha-os. The rest of the familywas then robbed of a cell-phone and cash.

“A scuffle then ensuedand the family members

managed to push the sus-pects out of the house andbarricade the door.

“The suspects tried to re-gain entry into the housethrough the door and win-dows, but failed.”

The source said the fam-ily then heard gunshots af-ter which the suspects fled.

“Outside the family dis-covered that the child whohad earlier managed to getout of the house had beenshot and killed.

“Another person in ahouse nearby was also in-jured in the crossfire. Thechild has been identified as14-year-oldSenzeniDerrickMdakane.”

The injured man is re-covering in Stanger Hospi-tal. No arrests have beenmade.

Teenager killed infoiled robbery

THE arrest of five men intent on rob-bing a business in Hulett Street on Fri-daymorning reflected police precision,

KwaDukuza mayor Ricardo Mthembu said.The suspected armed robbers were ar-

rested by the KwaDukuza Cluster Team leadby cluster commander Brigadier Derek Cap-tain-Hastibeer on Friday after Hastibeer re-ceived a tip-off that themenwere planning torob a busy store in the CBD.

The KwaDukuza Cluster Team togetherwith members from the National Interven-tion Unit arrested the suspects as they pulledoff at a petrol station in Hulett Street.

The Toyota Corolla they were travelling inwas reported stolen in Durban.

Three firearms, including a police issuefirearm, were found in their possession.

According to Hastibeer, this is the secondarmed robbery syndicate bust in the space ofthree weeks.

“However, the robberies are not going tostop. There will definitely be another syndi-cate coming into our area. We will not stoparresting these hardcore criminals. If youhave any information on any criminal ele-ments in your area, do not hesitate to contactthe police.”

The men, aged between 20 and 30, havebeen positively linked to more than 10 casesof armed robbery, murder and attemptedmurder.

Ntando Zulu, Siyabonga Ngcobo andThabisoMchunuappearedintheKwaDukuzaMagistrate’s Court on charges of armed rob-bery, house-breaking and possession of unli-censed firearms.

They were not asked to plead.The trio were remanded in custody and

more arrests are expected.The remaining two suspects are yet to ap-

pear.Mthembu said through their different po-

licing expertise, the KwaDukuza ClusterTeam, spearheaded by Brigadier Hastibeerwere able to succeed.

“It should also be emphasised that theofficers were faced with suspects who weredetermined to rob and in the process wouldnot have hesitated to kill our officers or eveninnocent civilians.”

Police were in-vestigating allega-tions of copper ca-ble theft which ledthem to a home-stead at Doringkop.

Speaking to theWeekly after catchingtheman, WisemanMngoma said hewashappy that through informers the sus-pect was apprehended, however, his‘partner in crime’ managed to escape.

“We found the suspect hiding at oneof the houses in Lindelani after one ofthe residents reported that their homehad been burgled.

“The KwaDukuza Correctional Ser-vices centrewas also looking for himbe-cause he ‘ran away’ when they caughthim the first time. This guy is a very fastrunner.”

Mngoma said his company wouldcontinue to work with government forc-es such as Crime Prevention Unit andCorrectional Services to fight crime iniLembe.

“We want to ensure that Lindelaniand other areas in iLembe remain acrime-free zone.

“We ask that the community workswith us.”

He said this is the third suspect theyhave apprehended. KwaDukuza SAPSmedia liaison officer, constable SbusisoKhumalo, commended Inkunzi EbomvuVIP Protection on a job well done.

“If the community can work with thepolice and security companies, manycriminals will be placed behind bars,”said Khumalo.

CLASSES could not continue asnormal for UkukhanyakwezweHigh School pupils

inMaphumulo afterpupilsfromdiffer-ent tribal authorities were involved ina stick fight on Monday last week.

Pupils who feared for their livesrushed home during the stick fightwhile teachers allegedly hid in offices.

KZN Department of Education(DOE)medialiaisonofficer,MuziMahl-ambi who is ‘hopeful’ that the matricpupilswill dowell in their final exams,said this was not only a DOE issue asthe fights also affected all the commu-nity members.

“Thefactionfightshaveaffectedthewhole society.

“Thepupilswhoare inmatric how-ever, have been meeting to study for

their exams regardless of this situa-tion.”

Mahlambi said thedepartmentmetwith the communitymembers and theInduna on Friday who instructed thepupils to return to school on Mondaythis week.

Mahlambi said the school alwaysmaintainsan80percent or abovepassrate each year and is confident thatthey will do the same this year.

“All schools completed the syllabusby31Augustandtheyhavebeenrevis-ing the whole time.”

Exams will resume on 28 Octoberhe said.

According to school principal,Lenard Khuzwayo the fights began ata community event ‘umemulo’ andboysfromdifferenttribalauthoritiesinthe area were involved.

“The fight continued at school on

Monday and pupils who feared fortheir liveswere forced to returnhome.From Tuesday onwards the pupils didnot return to school.”

Khuzwayo said Department ofTransport, Safety and Liasion MECWilliesMchunuwould address the pu-pils and community members thisweek.

Maphumulo SAPSmedia liasion of-ficer lieutenant G Mchunu said therehavebeen faction fights in theareabe-fore which all started during commu-nity events and then went to variousschools.

“As the police we stopped thesefightswhichenduptakingplaceduringclass time and Ukukhanyakwezwe iscurrently the only school facing such aproblem.”

Mchunu said the police arrested afew pupils last week.

AN exercise book containinghandwritten notes penned byAfrica’s firstNobelPeacePrize

Laureate, Chief Albert Luthuli, wasofficiallydonatedtotheLuthuliMuse-um by Pam Didcott, wife of formerConstitutional Court Judge JohnDid-cott recently.

Thediscoveryof thenotebookwasmadebyDidcottshortlyafterherhus-band - a foundingmember of theLib-eral Party and Chancellor of DurbanWestville university - died in 1998.

The book remained in her posses-sion ever since as a treasured me-

mento.Entitled‘MyOutlook’anddated20

June 1957 and signed, the originalTudor exercise book contains hand-writtennotes byLuthuli on anumberof topics such as the ‘Spirit of Serviceto Humanity’ and ‘Why I Championthe Cause of Freedom’.

It documents his education, hismembership and participation inother societies, his banning ordersand notes around his deposition as amember of the Native Representa-tives Council.

It containsrare insightof the influ-enceof the churchandChristianity invarious areas of the life of Luthuli.

“I didnotwant to let it go, but afterDr Reddy convinced me and havingvisited the museum, I know I am do-ing the right thing.

“I am sure it will be looked afterand preserved for many more yearsto come,” said Didcott.

She was accompanied by herfriendsDrJairamReddy,chairpersonof the council of theDurbanUniversi-tyofTechnology,andBettyGovinden,a retired lecturer from the formerUniversity of Durban Westville.

“Weareveryexcitedabout thisdo-nationandwish touse theopportuni-tytocallonothermembersofthepub-lic who directly or indirectly knew or

haddealingswithChiefAlbertLuthulitoconsiderhandingoversuchhistori-cal or official documents or photo-graphs or objects that are linked toChief Luthuli for safekeeping at themuseum,” said Luthuli Museum Di-rector Brian Xaba.

“Further research of the book andits contents will take place for futurehistorical reference. A copy of it willbe placed on our digital online cata-logue that is linked to our website.

“This will enable academics andresearchers from all over the worldaccess to a document that otherwisewould have remained hidden away,”he said.

Dr Reddy also handed over fiveblack and white photographs.

The photographs record an occa-sion in 1993when he - accompaniedby former Chief Justice Pius Langa,United Nations Head of the anti-Apartheid movement Enuga ‘ES’Reddy and formerDurbanMunicipalManagerMichaelSutcliffeandothers- handed over a taped audio copy ofChief Albert Luthuli’s Nobel PeacePrize acceptance speech to MrsNokukhanya Luthuli, affectionatelyknown as ‘MaBhengu’.

They could indicate the first timethatMrsLuthulihadheardthehistor-icspeechmadeinOslo,Norway1961.

To us it seems amazing, but that mandidn't just wake up one morning and de­cide to jump out of a plane.

We can be sure that he has beenstretching himself and trying new thingshis whole life.

Oftentimes, people stay where theyare in life simply because of fear! But doyou know that fear, isn't reality? It's onlya thought in our mind. It's just like thatclassic movie, The wizard of Oz.

When Dorothy arrived at the EmeraldCity, the great Wizard of Oz appeared to beall powerful and mysterious, and he madeeveryone tremble.

He seemed larger than life.But when Dorothy and her friends

pulled back the curtain, the "wizard" wasjust an ordinary man blowing smoke andpushing a lot of buttons.

There's a story about a woman whowas newly divorced, almost penniless,afraid of public places, and trying to raisetwo teenage sons.

After several tragedies in her life, shedeveloped severe agoraphobia (fear of be­

ing in places where there is a risk of havinga panic attack that people may witness),

Because of these fears the suffererwill deliberately avoid places in public. Thiswoman and was afraid to even leave herhouse.

She searched her heart for ways to sup­port herself and her sons.

She loved to cook and all she knew todo for income was to make sandwichesand other simple foods.

With the help of her sons, she foundnew customers and her sons deliveredthe food.

Her business grew quickly beyond thesize of her kitchen, and she now faced adecision.

Would she stand still and stop grow­ing or would she confront her fears andstep out of her comfort zone?

She chose to do the latter. Her busi­ness grew so much that she eventuallyhad her own television show.

Look inside. Think about all the thingsyou've always wanted to do but haven'tbecause of fear.

Whenever you and I are tempted todoubt our ability to start something newand accomplish something, we need torecognise that feeling as a symptom offear ­ it's not a reality.

Like the perception of the great andpowerful Oz, it is merely illusory.

This is as a resultof a long term loantakenby themunici-pality to an amountof two hundred andseventy six millionrands (R276 000000), for the roadsand emergencymasterplan.

This loan wouldbe serviced withsubstantial interestby all ratepayers ofKwaDukuza over along period of time.

By that timemany of us mayhave been longdeadandgoneand the re-paired roads wouldhave become in astate of disrepair,whilst this loan isstill not fully paid.

The ratepayersshould be verymuch aware thathad it not been forthis loan, the ANCcontrolled munici-pality would not inany way be able toengage in these ser-vice deliveries.

The visitors won the toss and elected to bat firstin overcast conditions. The match was reduced to 45­overs due to rain and a slightly damp wicket.

Khalid Shah and Faisal Sahil opened the battingfor the visitors and put on an opening partnership of30 runs before Shah (13) was run out by Yusuf Moollain the 6th over. Sahil (22) was dismissed in the nextover after he was caught at fine leg by Steven Jacobsoff the bowling of Dillon Rautenbach.

Arshad Mahmood and Awais Mohamed took thetally to 53/3 before Mohamed (4) was caught behindby wicket­keeper Yusuf Ismail off the bowling of Aar­on Pillay.

Arshad was involved in yet another 25­runs part­nership with Malik Javid before Javid (11) was clean

bowled by Nadasen in the 17th over. Nazir Zulefir andArshad took the tally to 128/6 before Arshad wascaught at long on by Rautenbach off the bowling ofNadasen. Arshad notched up a brilliant half­century(54) which included five fours and three huge sixes.

Luke was the pick of the Ilembe bowlers claiming3/45 from 9 overs. He received good support from Na­dasen (2/17 from 9 overs) and Rautenbach (2/39from 7 overs).

Chasing 174 runs for victory, the hosts virtuallythrew away their chances of victory after slumpingfrom 39/2 in the 9th over to 94/7 in the 26th over.

Volleyball pundits expected KSST tosuccessfully defend their fourth consec-utive league title after their 2-0 demoli-tion of arch-rivals, Randsons a fortnightago but left the courts red faced after ru-ing their missed opportunities.

Grove End’s league honoursmust beattributed to the return of the “prodigalson” Ronald “Tiger” Ponnsamymidwayinto their league campaign. After the

first two rounds of the competitiveleague, the league title chase looked likea two-horseracebetweenformercham-pionsRandsons anddefending champi-ons KSST.

However, Ponnsamy’s return to com-petitive volleyball, after almost ninemonths, set the courts ablaze and tookGrove End out of the doldrums.

His presence on the courts served asa catalyst to his teammates, who uppedtheir tempo. His constant encourage-ment to “young-bloods” Vinnie SinghandSherwinAdayyapahas givenGroveEnd a new lease on life.

InThursday’s crucial league encoun-ter KSST were in sixes and sevens andwatchedindisbeliefasGroveEndmerci-lessly annihilated them. Ponnsamy and

SatishBhowanibhikcombinedsuperblytoadd to thewoesof the fragileKSSTde-fence.

Singh and Neil Perumal capitalisedon some superb setting by Ponnsamy,putting points on the board with con-summate ease to guide Grove End totheir most comprehensive victory (25-12) against KSST.

The silence in the KSST camp wasdeafening throughout the opening set,but their fans started to find their voicesastheirheroesclawedtheirwaybackin-to contentionwithadramatic26-24winin the second set.

The thirdanddecisive setwas evenlypoisedwithKSSTholdingontoanarrow8-6 lead before Grove End snatched athrilling 15-13 win to reclaim the com-

Syd Kistan summed up his charges per-formance throughout 2013 when hesaid: “We didn’t deserve to win theleague”.

Meanwhile, Warriors Sport notchedup their first league victory in the com-petitive ranks after 15 league appear-ances with a hard fought 16-25; 25-22;16-14winagainstRandsons,whohadtosettle for third spot behind runners-upKSST.
