What was probably the last straw in the saga around Xstrata Alloys’ Lion plant outsideSteelpoort, was when Greater Tubatse Municipality Mayor, Ralepane Mamekoa’s housewas set alight last week Thursday evening in Eerstegeluk and his vehicle destroyed,presumably by protesters who were shot at with rubber bullets by the Police when theymarched from Eerstegeluk to the Lion plant the previous night (Platinum Gazette of 1April has the article). About 50 protesters were also arrested and two Policemen slightlyinjured.The next day Government decided that talks should be held in Polokwane andthe following statement was issued by the government after the talks: “Talks to deal with violence protests by residents of under Tubatse SteelpoortCommunity in Greater Tubatse Municipality under Sekhukhune District Municipality havejust been concluded today (Friday last week).The meeting was convened by the provincial government in partnership with theSekhukhune District Municipality. In attendance were representatives of Tubatse /Steelpoort Forum, Xstrata Mine management, community representatives, traditionalleaders from the affected villages and other government departments.The talks were initially scheduled to be held at Xstrata Mine in Steelpoort but laterrescheduled to Polokwane due to the tense atmosphere.On the agenda was the memorandum of grievances submitted by the TubatseSteelpoort community three weeks ago.

The community demands the following:

· Employment of local people,· Skills Development Plan,· Procurement Plan,· Appointment of Community Liaison Officer,· Social and Labour Plan Document, and

Communication Model.

In response, government wishes to state the following categorically:

· That mines need to do more regarding empowering local communities throughemployment and other economic spin-offs,

· That Xstrata Alloys, revise its targets and start training locals with the purposeof skilling them and making sure that they are employable,

· That the definition of a local should be located so that it can find clearexpression in the matter between the mine and the communities, (That is thejob the task team)

· That the community representatives and the mine will meet and develop acommon model as per the envisaged Recruitment Agency,

· That Xstrata should understand and comply with government procurementpolicy, and start appointing service providers as per the law of the country,

· That mining houses should embark seriously on developmental initiativesdirected at social responsibility at areas where they mine and deliverables mustserve as evidence,

· That the mine and the affected communities will establish a CommunicationStructure that will develop an all-inclusive communication model, and

· That a government led Task Team be appointed to audit the informationsubmitted by Xstrata Alloys conflicted by the community, with the communityrepresented as observers.

Government wishes to express itself to the acknowledgement that poverty andunemployment are the main causes of frictions within communities and mines, and moreneed to be done.

However, communities are blamed for taking the law into its own hand rather thanengaging on peaceful means of resolving disputes. In addition, government wishes topoint a finger at communities for marching to the mines instead of marching togovernment as voted by them.

In response to concerns by communities that traditional leaders are empoweringthemselves through tenders and jobs for pals in the mines, government advocates formutual understanding and working together with the communities. The ideal situation isfor traditional leaders to serve their people not their personal needs, with communitiesrespecting the role, functions and powers of their traditional leaders.

Police and other law enforcement agencies are called upon to ensure that law andother prevails at the area. And that everybody engaging in acts of violence should beapprehended.

This call follows a three week spate of violence protests which resulted intobarricading of the roads, damage to property, intimidation, burning of cars and threats ofgeneral violence.

On their part, Xstrata Alloys, stated that they are willing to fulfill all their responsibilitiesas demanded by the constitution. However, they request to be given time and appeal fora strong partnership and co-operation with communities in dealing with all challenges.Representatives of communities responded by praising the presentation by Xstrata,however, said it was far from the truth. They say fronting and falsifying citizenship is theorder of the day. They appealed to more visible actions, not false words. Communityanonymously agreed to work with the mine only based on fairness and transparency.

Community leaders pledge to ask people to stop with violent protests and allowall agreed processes to unfold. In conclusion, the Executive of Sekhukhune District Municipality Cllr MogoboDavid Magabe said:

“Government condemns the bombing of the house of the Greater TubatseMunicipal Mayor, Cllr Ralepane Mamekoa on Thursday night. The Mayor’s car wasburned to ashes, parts of his house burnt. We discourage unruliness, riots, actsof intimidation and criminality on the side of the community. We call upon policeand other law enforcement agencies to ensure that criminals are arrested andprosecuted. However, we want to say to the mines, that the concerns of thecommunities are genuine and they must take responsibility of empowering anduplifting the standards of living at communities they operate”, concluded theExecutive Mayor.Both Limpopo Premier Cassel Mathale and MEC Pitso Moloto could not attend themeeting due to other commitments.”

Burgersfort - Tubatse Partnerships, a non-gevernmental organisation, together with theNational Youth Development Agency(NYDA), organised a workshop betweenvarious stakeholders which was alsoattended by representatives of the TubatseHuman Resources Development (HRD)Forum yesterday.

The Tubatse HRD Forum comprises allthe heads of Human ResourcesDevelopment departments of primarily minesin the area. The delegated ModikwaPlatinum Mine HRD Leader, Dr JamesLidderd, as their representative at theworkshop. Dr Lidderd explained to allroleplayers exactly what is neccessary whensomebody wanted to be employed at a mine.He explained that prospective jobseekerswho want learnerships, will be selected asthey need to have passed certain subjects atschool and have the aptitude to completetraining. He said any training or qualificationa candidate have, may not be sufficient,especially if it is not technically inclined. Healso explained to all present at the workshophow a CV should be compiled and what typeof information it must contain to make iteasier for prospective employers to selectcandidates for positions that may becomeavailable.

The workshop was also attended by thelocal HIV/Aids ambassador, Ms HelenMoshoana, representatives from GreaterTubatse Municipality’s Human ResourcesDepartment and the Tubatse Youth Council.

According to Tubatse Partnershipsyesterday’s workshop informed stakeholdersabout various aspects around employment,while an unemployed graduate database isalso in the process of being compiled. Thisdatabase will be forwarded to inter alia theTubatse HRD Forum so that they can use it aa source of possible skills they seek in thearea.

Hawkers to register before 15 AprilHawkers in Burgersfort need to registerfor permits before 15 April whereafterthose who are not in possession ofpermits will not be allowed to trade interms of the By-laws.

This was explaned at a meeting heldWednesday in the old municipal councilchamber in Burgersfort. The meeting ofthe Burgersfort Hawkers Cluster wasalso attended by local LED official, Mrnelso Mokgotho who addressed thehawkers present. According to themanagement structure of the BurgersfortCluster 250 hawkers have already beenissued with permits, while another 265hawkers still need to register and be

issued with permits to trade.The hawkers say they are still,

together with the LED structure at theGreater Tubatse Municipality, busy withnegotiations for funding and erection ofhawkers stalls in the centre of town.Hawkers who do not have permits, willnot qualify for stalls. The next talksaround these stalls will take place nextweek, whille hawkers facilities at theTwin City Centre is also still receivingattention from all relevenat parties.

The next Burgersfort HawkersCluster meeting will take place on 19April when feedback on all these matterswill be given.

talks to GTMOn Wednesday evening the OhrigstadBusiness Forum held a meeting at whichthey tackled concerns regarding the town’sdevelopment.Greater Tubatse Municipality (GTM) CFO, MrLesley Mokwena and GTM RevenueManager, Mr Koos van der Walt attended themeeting to give perspective on the budgetand IDP for the next financial year.Some of the major concerns from theBusiness Forum’s side was what theypercieve a lack of infrastructuredevelopment in the town. Complaints about apossible 10% rates increase, expenditures ofGTM and a perceived lack of communicationwere aired.Mr Mokwena explained that the valuation rollwill play a major roll in the percentage of therates that will be tabled before Council on 19April 2011. Of the 31 Wards in GTM, only fiveare taxpaying. This only constitutes about45% of Council’s income per year. Much ofthe development in the rural areas withinGreater Tubatse are done by stakeholders inthe communities and in conjunction with theSekhukhune District Municipality.Mr Mokwena and Mr van der Walt alsoinvited the Forum members to become moreactively involved in issues decided byCouncil. Every quarter there is an openCouncil meeting at which members of thepublic is welcome. Mokwena suggested thatthe Forum delegate members to attend thesemeetings and provide active input as well asfeedback to the Ohrigstad residents. TheForum was also invited to put their concernsand questions in writing and submit it to therelevant people in time.

One of the complaints were that most of theWard meetings are held at Kgautswane.Some Forum members felt that, as ratepayers to GTM the meetings should be heldin Ohrigstad. The GTM representativespointed out that almost nobody attended theIDP/Budget Public Participation meeting heldtwo weeks ago at Laerskool Ohrigstad.As part of the IDP for the coming financialyear Ohrigstad is due to get 1.8km of tarroad.The Forum enquired how they can give theirinput on which streets in town should betarred and how they can ensure qualityworkmanship. Mr Mokwena promised to helparrange a meeting with the director of theTechnical Department at GTM so that theseconcerns and input can be given to therelevant people. He also pointed out thatevery project should have a SteeringCommittee which includes members of thepublic to help ensure that projects arecompleted satisfactory.The Forum requested that stop streets be putin place and speed humps created inPotgieter Street to help prevent trucks fromspeeding in that area.They also discussed the lack of use of thetaxi rank. It was pointed out that the entranceto the designated taxi area has been washedaway by storm water and the group decidedthat they will from their side approach thelocal Taxi Association to help fix theproblems and better the facilities at the rank.Traffic policing was also mentioned withfeedback from the Police Cluster Meetinggiven that GTM and provincial traffic officerswill more present in the area.

Phoenix Flying Squad is actively involved in fighting crime, not onlyin the mining environment in which they operate, but also throughawareness in communities.The Company has provided security at festivals, awareness daysand even a State of the Municipality address. At such days they’vealso brought along some of the dogs used to sniff out explosivesand track suspected criminals. The dogs are well trained and theevidence they recover is accepted at trails in South African courts.At special days when these dogs show their stuff for an audience,the people are spell bound. Following the commands and move-ments of trainer or handler and dog with concentration.The awareness of the dog’s capabilities is one of the ways in whichcrime is fought. People who are more informed are less likely totake any chances with a canine trained to find criminals. These

educational displays are part of howthey give back to the community.Phoenix Flying Squad often holdsroad blocks to ensure that specifiedareas are kept safe and secure fortheir clients and communitymembers moving through.At such check points dogs can alsobe used.Horseback patrols are communityfriendly and not as invasive asvehicle patrols. These animals cango where vehicles struggle andcommunities know that whenPhoenix Flying Squad patrols onhorse back a criminal will have littlechance of escape. This is truly acompany who cares for theiremployees, clients and the commu-nities in which they operate.

Protection for the consumer, what do you think?The Consumer Protection Act, 68 of 2008came into effect on 1 April 2011, but whatdoes this mean?Many consumers have not even heard of thisAct and don’t know what the implications willbe.One of the major aims of the Act is to providea fair, accessible and sustainablemarketplace for products or services. It willpromote responsible consumer behaviourand help prohibit unfair marketing andbusiness practices.Some of the implications of the act includethat suppliers may not limit access to goodsor services. Suppliers may not excludecertain groups from access to products orservices. E.g. they may not advertise aspecial and say: ‘no hawkers’.Consumers will also have the right to queryinferior quality products.Your right to privacy will further be protected.If you request not to be contacted by directmarketers from a specific company, theymust respect that request.Consumers will also be able to cancel fixed-term contracts at the end of the term withoutpaying a penalty cost.When something breaks and you take it forrepairs, you will only be liable to pay forrepairs you’ve approved before they startedthe work.Consumers are now able to return unsafe ordefective goods to a store within areasonable time. The store will then have toprovide a full refund for the product.You will also be able to demand paying thelower price should two different prices bedisplayed for the same product.These are just some of the implications of theAct. Should you want to complain there areplaces to go.
