Strikers fired

The Department of Water Affairs has terminated the employment of workers who havebeen on an illegal strike at De Hoop Dam after they defied an ultimatum to return towork on 28 June 2012.

The workers have been involved in an illegal, un-protected strike for fiveweeks. The department says its officials have tried unsuccessfully to persuade theworkers to return to work while their grievances were being addressed. On numerousoccasions, the worker representatives would agree to return to work but indicated thatthey had to consult the rest of the labour force. The striking workers continuouslydefied various ultimatums to return to work and to use the established channels todiscuss their grievances in order to find an amicable solution.

The department of Water Affairs says it was left with no option but to terminate thecontracts based on the workers deliberate breach of the provisions of item 6 of theirservice contracts.Consequently, the actions of the workers have not only resulted in

their immediate dismissal but also a forfeiture of all the benefits that were presented tothem in a letter given to them on 22 and 25 June.

The department says it has bent over backward to listen and attend to the workersdemands. The workers have blocked access for the department’s officials to the dam site. They also barred access for the workers who did not wish to be part of the strike.

The department says after all due steps were taken and workers informed, it isassumed therefore that workers were conscious of the possible consequences flowingfrom an illegal strike.

It says management can no longer allow the De Hoop Dam construction site to becontrolled by the workers and have no alternative but to close the site and to dismiss allthe workers at the De Hoop Dam Site. The process of recruitment was due to start thisweek to enable the department to finish the work at hand. Platinum Australia has called in administrators after voluntarilysuspending its shares from trading on the Australian StockExchange (ASX).

Last week, the company launched an “urgent review” into itsSmokey Hills operation near Burgersfort as the mine failed to reachproduction forecasts and operating conditions deteriorated.

The administrator told the ASX “ These issues have beenworsened by decreasing commodity prices. At the same time theCompany has been involved in a costly dispute with a formercontractor. A review of operations has revealed a need to reassessall current projects. It is envisaged that the Company will utilise theAdministration process to restructure its affairs, to consolidate itsposition and to eliminate legacy issues.

The Company has 3 valuable and worthwhile projects and isassessing how best to realise value from them. Further informationon the strategy to restructure and recapitalise the Company will bereleased once negotiations with key stakeholders have beenconcluded. Pitcher Partners have significant expertise andexperience in the Mining Industry and have successfully restructuredand recapitalised more ASX listed Companies using the Voluntarydministration process than any other firm in Australia.

Shareholders are asked not to contact the Company or theAdministrators at this time please. A more detailed informationrelease to the ASX will follow giving indicative timeframes for theAdministration process.”

The South African platinum industry has been facing severepressure, with the government establishing a task team in an effort tosave jobs. Earlier this month, ASX- and JSE-listed Aquarius Platinumplaced its second mine (Everest, between Lydenburg andRoossenekal) on care and maintenance, while Royal BafokengPlatinum deferred R462-million in capital expenditure to preservecash. Eastern Platinum, from Canada, recently suspended funding forthe Maraisburg project and a concentrator plant (Kennedy Vale) nearSteelpoort.

“The Board and management of Aquarius are acutely aware ofthe difficulties facing the industry at present, and aremonitoring the business and financial health of the Companyas closely as we have always done. We believe that themeasures we have outlined today and over the past few weeksonce again demonstrate our commitment to controlling our owndestiny while carefully husbanding our assets on behalf ofshareholders and thereby ensuring the survival of theCompany in these extremely difficult times. Our partnershipwith M&RC has been a long one, but we are agreed that thecontract mining model has become difficult to make work in thecontext of the South African mining environment. We aregrateful to M&RC and to PIP for their assistance in what weexpect to be a smooth transition to Owner Operator.I also note that we seem to be one of the few companies in theplatinum industry that is willing pro-actively to take the requiredtough decisions to close the mines that need to be placed oncare and maintenance. I would hope that the other industryplayers follow suit and cut the unneeded production that isdepressing the industry.” - Stuart Murray, CEO of AquariusPlatinum.

Updating the shareholders and the market on the stae ofthe company the company said the Board of Aquarius isendeavouring to pro-actively manage the business of thecompany to deal effectively and responsibly with the continuingdifficult trading conditions facing the platinum industry in SouthAfrica.

The Board has also recently approved the company’sbudget for the 2013 financial year. In keeping with the policiesof the company, the budget is focused on cash conservationand the preservation of the company’s reserves and resourcesuntil economic circumstances merit their extraction. As a result, several material alterations have been made to the operatingconfiguration of the company to better enable it to endure thecurrent economic environment.

They are summarised as follows:

• Aquarius Platinum (South Africa) (Pty) Ltd (“AQPSA”) andMurray & Roberts Cementation (M&RC) have mutually agreedto terminate their contract mining agreement, and as a resultAQPSA will become an Owner Operator, to ensure maximumfuture cost control and flexibility;• Kroondal, Mimosa and the tailings operations will beoptimised to maximise cash flow generation;• Blue Ridge, Marikana and Everest have been placed on careand maintenance; and• All non-essential capital expenditure will be suspended.

Everest update

The company says the ramp-up at Everest has encounteredchallenges resulting from poor ground conditions and disruptiveindustrial relations, and as a result it is uneconomic in thecurrent low price environment. It has therefore been decided toplace the mine on care and maintenance, ending better prices.During the period that the mine remains on care andmaintenance, some limited drilling and design work willcontinue, in order to facilitate the implementation of the Everestexpansion project into the Buttonshope (Booysendal South)property in due course. The cost of closure is estimated to beapproximately R157 million, and ongoing care andmaintenance costs are estimated to be approximately R23million per quarter.
