The Heart Of Shopping In Balbriggan Member of Balbriggan Chamber of Commerce and Fingal Dublin Chamber Last Minute Back To School Supplies! A new study, based on an analysis of the Property Price Register, shows that transactions in the North County area are up by 17 per cent in the first six months of the year, compared with the same period last year. Dublin transactions are up 13 per per cent over the same period This excellent news is somewhat tempered by the lack of supply, which causes sale levels to drop in some areas. The lack of suitable stock is seen as a major obstacle to further growth in the area. The County Leader spoke to estate agents in the area, and the air of positivity was refreshing. Edel McGuinness of EMG Properties in Balbriggan, confirmed that property is on the move in the area. “There is a big demand for property that is relatively priced. I’ve noticed a definite increase in the enquiries from potential buyers and there’s a definite, positive movement in the market. We recently sold a prop- erty well in excess of 30,000 above the guide price, which is a very positive sign. There’s a big demand, with people bidding against each other. Also, there’s a good selection of houses for sale, but buyers are conservative about what they buy and are always looking for the best bargain,” she said. McGuinness also spoke about the situ- ation facing landlords in letting their proper- ties. “Landlords are faced with additional taxes on their invest- ment properties and are now prepared to sell their investment, rather than hold on to them for letting purposes, which leads to a reduction in stock for letting purposes,” she concluded. Sean Nolan from Property Team Nolan and Fahy in Donabate was very upbeat about the property upsurge. He told the County Leader , “There has been a good level of enquiries from poten- tial buyers, who had been experiencing difficulties with lending institutions.” He continued, “Consequently, there is a stronger number of people viewing properties and some have exceeded the asking price in many cases. We’re now in a situation in the prop- erty market, where anybody who has been watching the market, are now putting their money back into property. Drops of 40-50,000 which previously happened, are now not the case and the risk factor is now eliminated,” he said. He went on in the same positive vein, by adding, “I can see the market now in a strongest position since the decline and I can only see it getting stronger. We’ve had downturns and upturns in the past and I am confi- dent that this one looks like it’s coming to an end,” he concluded. He brought the curtain down on a hugely successful career, when he offi- cially retired last month. Speaking to the County Leader, Pat remi- nisced about some of his career highlights, during his 10 years at the helm at Balbriggan Community College. He said, There was a considerable change in staff profile during this time and I had a hand in selecting most of the present staff, There have been very positive inspec- tion reports and excellent whole school evaluations in 2006. A real highlight for me was the steady improvement in school exam results. Indeed, we had the highest achiever in the entire county in Andrew Kettle, who achieved a maximum 625 points in his Leaving Certificate. This indicates that the school can deliver in terms of results and stan- dard of teaching,” he said proudly. “Another significant trend has been the development of Special Needs provision in my time here, as I have a special affinity in this area. Marie Jan Buckley heads up the Special Needs department in the school. A brand new school is in the design stage at the moment, which will cater for 1,000 students and this will be a very exciting development for the school,” he said. Pat, who has been a teacher at the school for the past 34 years paid tribute to school colleagues who have supported him throughout his career. “I want to thank people like Cáit Shirran, my deputy principal Christine Dunne, Fergal McMahon, Michelle Condra and many others who have worked tirelessly for the school,” he said. He also had kind words for a fellow retiree, John Carton, who has retired as a caretaker at the school. “He was always very popular with students and had a great knowledge of the building. He was always first to arrive in the morning and last out. He will be sadly missed. The corridors of the school are bedecked with collages of pictures he framed.” Pat is a sporting enthusiast, who now has plenty of time to pursue his favourite pastime, cycling. “i am an active member of Swords Cycling Club, where I compete in races and just for leisure. I am also actively involved in the Rás Stage End committee here in Skerries. We’ve been responsible for the Rás coming to Skerries for the past eight years and our committee were awarded as volunteers of the year,” he said. Anger As SundayWorshippersClampedSome Sunday Mass goers in Swords haverecently had a nasty shock when they returnedto their cars after Mass. Their cars had beenclamped, because they had parked in a privatecar park, thinking it was still County Councilproperty. Furious local resident, Joe Harvey contactedthe County Leader about the situation andexplained. “Cars parked beside Swords SeniorCitizens building are now on private property, but there is inadequate signage to let peopleknow. This area, which is across from the StarPub, has always been an overflow car park forMass goers. When you enter the area fromChapel Lane, you cannot see any notices, saying you must pay for parking at all times.”“People assume that this section is st i l lbelonging to the County Council, but you haveto drive deeper into the car park, to see thenotice. If people knew, they would have nodifficulty paying €1 per hour, but they didn’t’know. What irks me most is that they aretargeting Mass goers as easy pickings. Mywife, who was clamped was told by one of theclampers that they were instructed to be thereat Mass time. It’s immoral in my view,” he said.He went on to say, “I came back for 12 o’clockMass and warned two unsuspecting people ofthe problem. They had clamped three cars atthe first Mass and another three at the nextone, a total of €600 - not bad for a Sundaymorning,” he said.Perhaps the most confusing feature is a notice, which asks if you have paid your parking fee. This is the only notice that is visible from this

part of the car park. There are no times ordates on it, and it is attached to an existingCouncil parking notice. “Most people look atthis notice and assume that it belongs to theCouncil , who do not charge for Sundayparking,” he concluded.

Local resident Joe Harvey is pictured here at the car parkbeside Swords Senior Citizens Centre, which is used byMass goers on Sundays.

Disgraceful FingalCemetery Must BeSorted Out

Local Councillor Cian O’Callaghan (NP), ispleading with the County Council to fix up Fingal Cemetery, which has been left in an unsightly state for the past number of months. O’Callaghan said there are a number ofissues around the cemetery that needed tobe addressed including: the removal of thebunkers (some of which are rat infested),and replace them with a bin system, thecutting of the grass vergers, remove alllitter and to restore the grass verges that are full ofovergrowth and weeds. “I am aware of the issues theCounty Council have with lack of staff and funding, but nonetheless, something must be done about thecemetery,” he said. “A concerned resident got in

touch with me about this, and he has been activelytrying to get these issues addressed for the past fewmonths. I met with Council officials to outline theproblems and now we’re just waiting to see what canbe done next. I’ll be continuing to persevere with thisuntil I see some positive changes.”“The bunkers are the main things we need addressedfirst, and then we can focus on their surroundings,”he continued. Another local councillor, Judy Dunne(Lab), feels the same way, and is also important to

have the bunkers sorted out as soon aspossible, due to the fact that they areattracting rats. The concerned resident who got in touchwith O’Callaghan, is local man Michael Fox,who contacted the County Leader originallyto see that the cemetery got sorted out. “Iwas delighted to see that this issue will atlast be brought up with the Council, because the fact is, the cemetery is in adisgraceful state and it absolutely cannot

stay this way,” he said.“Nothing has been done to tryand improve the cemetery asyet and now I want to seeaction,” he concluded.

Cllr. O’Callaghan

Gareth Takes On LifeChanging ChallengeBalbriggan man, Gareth Lee, a state-of-the-art diabetes pump and acommitment to live a full life, made it possible for him to train andrun in a Triathlon, which took place recently. He told the CountyLeader how he managed to overcome his diabetes and take on thisincredible challenge.“I decided to do the Triathlon simply because I have the flexibilityand the freedom to do so. I have Type 1 diabetes since I was threeyears of age and, until now, I could never have dreamt of under-taking such a big challenge,” he explained. This type of diabetesstops your pancreas producing insulin, a hormone that enables youto get energy from food.As a child, Gareth says it was a way of life, rather than a majorproblem. His parents did the worrying and made sure that his

blood-glucose levels were monitored 24 hours a day.“When I hit my teens, it became my problem. I was always

cautious about my blood -glucose levels. If they went too highor too low it could be life threatening. So, no matterwhere I went or who I was with, I had to monitorthem,” Gareth said.“Then about eight years ago, I got an insulin pumpand it changed my life. The pump has a sensorthat measures the amount of blood sugar in thebody to help me deliver the proper amount ofinsulin. It gave me something I never had before –flexibility, and it allowed me to take control of mylife. This is when I decided to do the Triathlon, because I finally could, and also to raise funds forDiabetes Ireland.”“I would have never dreamed I would ever have hadthe chance to compete in such an event, and I wasthrilled when I crossed the finish line,” he concluded.

A The most common chargesin The District Court are

sections 4, 6 & 8 of the PublicOrder Act, 1994

The charges are a by product ofthe weekend drinking culture inIreland and unfortunately, arealmost exclusively as a result ofexcessive alcohol intake.

Section 4 of the Act prohibitsintoxication where the accused isa danger to himself or others. Thecharge, as is commonly thought,is not a charge simply of intoxica-tion. The Garda must prove, byway of specific evidence, that theaccused was in public, and that hewas so intoxicated he was either adanger to himself or others.

This charge is usually issued inconjunction with s.6 below. In fair-ness to the Gardai they are slowto arrest someone for this offencealone, unless the accused wascompletely intoxicated and therewas a worry the accused mightget run over by a car, or might becollapsed on the street.

Section 6 of the Act provides thatyou can be charged for threat-ening, abusive or insulting behav-iour or words with a view tobreaching the peace. The wordingof the Act is problematic. Forinstance, what is insulting? Thesame Act is in the UK and it led toridiculous charges of insulting apoliceman or another person. Somuch so that the law is being, orhas been changed in the UK toremove the word, insulting. Again,in fairness to the Gardai thischarge is reasonably sparinglyused and the behaviour is usuallyof such a nature to justify thecharge. That said, an experiencedcriminal law practitioner wouldcarefully examine the state'sevidence through what is knownas a précis of evidence to see if itbreaches the threshold. Again, theGardai must show the allegedoffence was in public.

Section 8 of the Act gives a Gardapower of arrest and charge forfailing to desist from certainbehaviour (loitering or breachingthe peace) and to leave the area. The Garda must give evidence ofhaving warned the accused inspecific terms. He must specifi-cally advise the accused that if

the accused fails to desist ormove away from the area, theperson could be fined and/orimprisoned. In Court the Gardamust give the detai ls of theexact warning given and if thewarning is not in compliancewith the Act, then the chargeshould be struck out by theCourt. This charge is a l i tt lemore difficult for the state toprosecute and therefore used alittle more sparingly. It is alsoconsidered a little more seriousthan sect ions 4 & 6. Forinstance, it potentially attracts ahigher fine.

All of the charges above attractpotential fines and/or imprison-ment. Naturally, if you are fined,a criminal record will follow. However, t radit ional ly theCourts are far more lenient forfirst time offenders. That said, itshould never be countenancedby an accused not to engage asolicitor. All too often, accusedsenter Court without a solicitorand end up with a cr iminalconviction, which, at the time ofwriting will be with them for therest of their lives. The Courtshave wide powers to leave theaccused without a conviction. However, this result is easiersaid than done and it is essen-tial that you receive good solidexperienced advice from a crim-inal law pract it ioner beforeentering a Court.

Stat ist ics currently show amarked reduction in these typeof charges. I happen to believethat, frankly, this is principallybecause of less disposableincome for 18-25 year olds anddefinitely nothing to do with anyspecif ic act ion of the state. However, because of the markedreduction in charges the Courthas more time to deal with thematters, and the evidence cansometimes be more shocking forthe Courts in times of less preva-lence of the charges. Therefore, another reason to take goodcriminal law advice before goingto the Court.

The off ices of Hennessy andPerrozzi offer an initial free ofcharge consultation. Just ensurethat you bring along with youthe charge sheet or thesummons.

O’Brien Blasts ReillyOver Funding CutsLocal senator, Darragh O’Brien (FF) has described thelack of action from Health Minister James Reilly inresponse to a new round of funding cuts for St.Michael’s House, as “reprehensible.” St Michael’sHouse provides vital services for people with intellectualdiabilities, many of whom are from the North County. O’Brien had informed this newspaper two weeks agoabout impending cuts to funding at St Michael’s Houseand he expressed his disgust that the cuts have nowcome to fruition. He told the County Leader, “This is abridge too far, where the most vulnerable in our societyare being targeted because Minister Reilly is notcapable of running his department.” He expressed his disgust at the fact that the HealthMinister stood “idly by” while vital cuts were made.“Minister Reilly had plenty of warning that serviceswould suffer from the further €1m budget cut to St.Michael’s House. I raised this issue before the cutscame into effect and urged the Minister to intervene toprotect the funding and the much needed services. The fact that Minister Reilly has been utterly silent andstood idly by and allowed this to take place isdisgraceful,” he concluded.

Portrane ResidentsEager For ErosionSolutionResidents of The Burrow in Portrane were devas-tated last year, when they saw up to 20 feet ofprotective sand dunes being washed away in onenight, thanks to stormy weather. They have beenconcerned ever since that more of their coastline is in danger of suffering the same fate,if measures are not put in place, and currently have only a few sandbags strewnaround to protect it. Since then, they have beencampaigning to find a solution to solve the ongoing problem of erosion in the area, and finally, there is to be some progress made on this. A coastal erosion study of the area is to becompleted by consultants appointed by thecouncil in November of this year. Residents havebeen told that interim measures will be takennext spring to tackle the problem, based on theearly findings of that study. It is hoped a more permanent solution to theerosion problem in the area will be deliveredwithin the next five years. Many local residents were invited to the recentmeeting and the general response was that theyleft the meeting feeling “very positive” aboutprogress on the issue. However, they remainedconcerned about how any long-term solutionmight be funded and have asked the Council toset aside money for the task in its next budget. The Council has assured residents that there is“no immediate risk” to property in the area, andagreed to commission a study on coastal erosionin the area, but residents are eager to seepermanent measures put in place to ensure thatno further damage is done.

Pictured are the makeshift sandbags which, up to now,are the only protection that Burrow Beach in Portrane hasfrom the advancing tide.

A World Champion

It’s not very often that the County Leader has thechance to interview a four time world champion, but that’s exactly what Dermot O’Keeffe is. Dermotgraded under a panel of Japanese judges at therecent world championships to successfully passhis 6th Dan, a massive achievement for himself, and his karate club. This will be his fourth time as aWorld Champion. He runs Hokubu Dojo (SwordsKarate Club) in Swords and he is a true master ofhis craft. He sat down with us to tell us more aboutwhy he has devoted his life to such a physicallydemanding art form, and how he’s thrilled to beliving the dream. Dermot has been living in Swordsfor the past 25 years, and his karate club has beenup and running for the past 12 years. His interest inkarate was first sparked as a 16 year old boy, whenhe would watch Bruce Lee on the big screen. “I’vebeen doing this for 35 years, and when I wasstarting, any lad of my age would have beenwatching Bruce Lee so he definitely inspired me towant to start, and many friends of mine too. He wasa remarkable man.” “Compared to when I firststarted, karate as a sport has taken on a new life ofit’s own, and since my classes went full time twoyears ago, I’ve seen any amount of people, from alldifferent age groups and fitnesslevels take part, which as beenfantastic to see.”“It’s important to note, that aswell as a great fitness exercise, karate offers a different outletto local kids who may not beinterested in Gaelic or soccer, but maybe want to pursuesomething more individual,” hecontinued. Dermot trains in andteaches, what’s known as‘Shotokan Karate,’ which origi-nated in Japan in the 1900s.“Shotokan is the most popularform of karate by far, and is atraditional, Japanese art form, and the one thingabout karate in general is that you don’t have tospecialise in one area in particular, it’s foreveryone; different fitness levels, different agegroups. If you’re willing to work hard, anyone cangive it a go,” he explained. He goes on to explainthe hard work and discipline needed to excel atkarate and admits that as a teacher, he pushes hisstudents extremely hard. "What I try to teach allmy students is focus, control and self discipline, which you need to adhere to, in order to train well. There are boundaries and rules that they have torespect, but it's not all hard work; they will have alot of fun as they work." When I ask what mightspur a young child to want to take up karate, hepoints out that it offers a child a different skill set,as opposed to the more traditional activities, andexplains that one of the main reasons a lot of girlsmight want to learn, is for self defence, as karate isa self defence art. He is keen to stress however,

that it's not all about physical contact. "It doesteach people how to fight, but you absolutely don'thave to fight, it's about learning the art and skillsand practising hard over many years." He says thatkarate has many levels of difficulty that the kidscan build up to as they want. "We have a schoolingsystem, which brings students along gradually upthrough the different coloured ranks until theyreach the Blackbelt standard, which is anextremely high level of achievement."Indeed, these local students are extremely lucky tobe taught by Dermot, who is a truly dedicatedmaster of his craft. He trains and teaches every dayof the week and continues to push himself (and hisstudents) to keep achieving. He has been excellingat karate for decades and recently returned from avery successful trip to Japan, where the Swordsgroup represented Ireland in the prestigious J.K.S.World Championships. Dermot, along with three ofhis students, Jennifer O'Keeffe (his daughter),Creona Kealy and Amy McFadden made thejourney. He took the Kata world title with greatdetermination and style and was elated, as thiswas his 4th time to win the honour. No small feat,I'm sure you'll agree! He informs me that Jennifer

and Amy have also been selectedonto the W.K.F National Squadand they are training exception-ally hard for the Junior andCadets World Championships inSpain in November. "I wasthrilled and so proud of thegirls," he said, beaming. "Mystudents work extremely hardand are terrific kids, and to makeit to the championships is amassive accomplishment forthem and the club to be selected. They are so committed, and it'sfantastic to watch them grow andsucceed." The love for karate

clearly runs in the family as Dermot's daughterscurrently train and his wife used to do so yearsago. "My girls love it, and it does make me veryproud that they enjoy it as much as I do. My son ismore sporty," he says, smiling. "We're alwaysopen to new members who might want to join, soanyone can come to a class."He is obviously so passionate and dedicated to hisart form, and he tells me that he's lucky enough tobe living his dream. "As corny as it sounds, I reallyam living out my dream. I get to do what I love andam thrilled when it comes to getting out of bed inthe morning, and I know that not many people cansay that." Dermot says he may retire from profes-sional competitions in the near future - "eventually you have to listen when yourbody is telling you to slow down" - but plans tocontinue teaching. "It's not work to me, it's justwhat I love to do, and I wouldn't have it any otherway," he concluded.

Great Day At SkerriesRaft RaceSkerries RNLI Raft Race 2013 was indeed a day toremember. The organisers worked very hard inrecent months to make sure that the Raft Racewent off smoothly, with no hitches. Thirteen wellturned out rafts lined the shores on the SouthBeach in Skerries as spectators waited witheager anticipation to see if they would make it tothe finish line. All thirteen rafts made it throughthe water stage with Rush Sailing Club made it upthe bank in record time. Each contestant

believed their craft was the winner. Crowds gath-ered and ooh’d and ahh’d over the rafts. Therewas a real holiday atmosphere on the beach.Children were running up and down, in and out ofthe water, dogs were being thrown sticks andthey went splashing into the oncoming tide. Rush Sailing Club Raft came in as worthy winnersThey were like honed athletes as they cutthrough the water on their trusty craft. Well doneto that team. Thanks is given to those whodonated their time, to those who sponsored, andto the organisers, for all their energy, organisa-tion and hard work. Each year in Oldtown, a local resident organisesa charity walk, all in aid of Cappagh Hospital. Byparticipating in the charity walk, former patientsare proudly showing their huge appreciation forthe hospital. The walk is organised every year byBalbriggan resident Leo Halpin, who had his hipreplaced in Cappagh nine years ago. Leo now happily strides out with other locals, eager to raise as much funds as possible afterbeing given a new lease of life by the hospitalstaff. “I was there for a fortnight and I havenever had a pain or ache since,” he told theCounty Leader. “Because I was so uncomfort-

This week, the County Leader paid

a visit to one of our favourite haunts,

Home in Balbriggan. As usual the club

was packed and the atmosphere

electric as everyone let their hair

down and danced the night away.

The DJ was in great form and played

everyone’s favourite tunes, which kept

the dance floor full until the early hours

of the morning. We’re counting down

the days until our next visit.
