Elizabeth, who is now a lieutenant in the Naval Services, told the County Leader about what happened on that eventful day. “Skerries scout group were at Lough Key, along with Balbriggan scouts, when one of the Balbriggan scout leaders, Helen Lynch waded into Lough Key and, as she did, the sands below began to shift. As she couldn’t swim, she lost her footing and fell into the water. The scene was unfolding in front of many young members, who were obviously stricken by the sight of one of their leaders struggling in the water. Elizabeth explained, “Helen was in the lake and thought it was the same as being in the sea, However, a lake is totally different to the sea and she took one step too many, and dropped into deep water. Helen was a practical joker, and we all thought at first that she was just messing, but she disappeared under the water and was actually drowning.” At this point, Elizabeth hurried to Helen’s assistance, but luckily she kept her wits about her and didn’t just jump in. She explained, “ I got into the water, and as I got close to her, she grabbed me and tried to drag me under, as people in this situ- ation will always do. I stayed calm and shouted at her not to pull me down. Luckily, I had trained as a life- guard in Gormanston and our training involved simulation exercises, but this was the real thing. Eventually, we were able to rescue Helen, much to the great relief of all.” Elizabeth’s initial reaction was annoyance at Helen putting herself in danger, not being able to swim. But this soon dissipated and was replaced by a feeling of relief and thanks for being in a position to be able to save a life,” she said. Elizabeth received a bronze medal from the scouting body shortly after the incident happened and she received this award from Eddie Darcy, leader of the Balbriggan Scouts. Indeed it was Eddie who nominated Elizabeth for her Certificate of Bravery, which she received last week. He was the Balbriggan group leader at the time the incident occurred. He told the County Leader, “Soon after the inci- dent, I actually nominated her for an award and she received a Bronze Award for Bravery from Scouting Ireland. I’m delighted she received this award, as it’s very well deserved.” The citation read, “Elizabeth Barrett took control of the situation and after ensuring that the youngsters were safe and calm, she swam the distance into the lake and rescued her colleague, towing her back to the safety of dry land. But for the swift actions of Elizabeth, this event could have resulted in a much more serious outcome. For her efforts, Elizabeth Barrett is awarded a Certificate of Bravery.”. Skerries Woman Rewarded For Bravery The bravery of a local woman has been recognised, when she was presented with an award for bravery, 14 years after the event. The determined actions of a local woman, has resulted in the delivery of a much needed bus shelter in Kinsealy. Local resident, Clodagh Collins is a regular bus user and had become exasperated at the lack of a bus shelter outside Scoil an Dhunninigh in Kinsealy. Single minded Clodagh showed true grit and determination and she made her mind up to do something about it. She decided to contact local TD, Brendan Ryan (Lab) to see if something could be done to have this problem sorted out, once and for all. Clodagh told the County Leader, “This is a very busy bus stop, which serves the Holywell, Kinsealy and Russell Terrace areas, and bus users have had to wait in all weathers for buses. Sometimes, this could be a long time, as this particular area is poorly served by public transport. I took matters into my own hands and decided to conduct a campaign to have a shelter put in place. I contacted Brendan Ryan and the wheels were put in motion,” she said. Ryan said, “We’ve been campaigning with Clodagh since 2010. Planning permis- sion was needed for the project, which was finally granted the green light last February. It was a long road, but we never gave up. This is a very busy bus stop and the need for a shelter is now satisfied and the new shelter makes a huge difference for bus users in the area. I am very impressed with the spirit and deter- mination of Clodagh in seeing this important project coming to pass,” he concluded. Garda Resources Stretched To Limit In BalbrigganExtra gardaí are badlyneeded in Balbriggan asthe shortage of resourcesis now impacting on theGardaí’s ability to policeour communities. This isaccording to localSenator, Darragh O’Brien(FF). He highlighted arecent incident inBalbriggan as an exampleof the stretchedresources. “Last week, one Garda car was avail-able for the entire district. There were fourburglaries that eveningand an individual wasarrested, and theresponse time to calls

that evening was betweentwo and three hours,” hesaid. ”I do not blamegardaí for thisbecause they arenot being givensupport by theMinister or theGovernment todo their job.”“ B a l b r i g g a nstation serves50,000 people. The position on gardaresources is worseningand the gardaí are atbreaking point. Theyneed the support of theGovernment and the

Minister for Justice andthey are not getting it.Our communities need a

stronger gardapresence,” hecontinued. “I have repeat-edly called onMinister Shatterto attend adebate in theSeanad todiscuss his

current policing strategybecause at the moment, his decisions are leadingto less resources andfewer gardaí on the beat,”O’Brien concluded angrily.

one of the groupmembers made thediscovery, when two

people called to his door asking fordonations, but the fundraising hadbeen completed. “We knew thecircumstances were suspiciousbecause our fundraising has beendone, so we reported the incident to

the police.” These bogus collectorswere reportedly going door to door inBroadmeadows, Southbank andother estates around Swords. Thegroup, who have recently undergonemany hard months of fundraising fortwo new playgrounds in Swords, andlocal councillor Darragh Butler (FF) isadvising residents to contact SwordsGarda Station, if they should comeinto contact with them. Mary Lally, River Valley‘The shops put people and parents under pressure with their kids.’

“Do you think we start celebratingChristmas too early here in Ireland?”Q:

Robert Fanning, Swords‘Definitely we have the decorations nearly up before Halloween is

over.’

Olivia Verdon, Swords‘Yes, it’s a money and marketing thing. It’s abit negative as it seems so far away.’

Paul O’Brien, Swords‘Definitely, I think it’s far too early. I think it

takes the goodness out of it. We’re advertising in July for Christmas,do you know what I mean?’

Bernie Dunne, Beaumont‘No, it’s better earlier because you have alonger time to be happy.’

Susan Cullen, River Valley‘Yes the stuff is already in the shops, it puts people under pressure

straight away.’

Joe Keenan, Swords‘Yes, but this year I haven’t heard of it yet. Not this year. I’d preferthey would take their time and just make it a week.’

Isabelle Muenjayi, Swords‘Today is Halloween, and we’ll soon see

everything in the shops for Christmas, youdon’t finish enjoying something and then the next thing starts.’

Teresa Cullen, Swords’Yeah, I’ll tell you why. It’s just that people with the recession are notgetting a chance to get over Halloween and then Christmas comes ontop of it. Everything comes together. What can you do? We’re all kidsat heart. We need something to celebrate.’’

Cadi Murphy, Donabate‘No I don’t think so. Christmas is great, so it should go on as

long as it can.’

Ken Brazal, Swords‘Yeah we do, far too early. We start celebrating before Halloween.

People are more organised now though, and I haven’t startedcelebrating Christmas yet.’

John Harris, River Valley‘Oh yeah I reckon, all the time. I think earlyDecember is time enough to start it. It seems to start earlier everyyear. The minute Halloween is over, it’s all Christmas.’

Paul Cogley, Swords‘Yeah, definitely without a doubt. We start before Halloween don’t we?There’s a lot of pressure on you when you have kids, definitely.’

Mick Davis, Dublin‘Not this year, normally we do. I don’t think this year, for some reason.’

Last week, Iattended aconference inBrussels organised by the EPP Groupwithin the EU Committee of theRegions. Some 64 journalists, broad-casters and columnists drawn fromacross the member states attended. The three days of interactive trainingprovided the opportunity to hear fromMEPs, Commission Spokespersonsand Media consultants. While the meeting was hosted by apolitical grouping, it was not politicalin content. The agenda was toencourage and enable the local press

to report and comment on the work inwhich the Parl iament isengaged. Since direct electionscommenced in 1979 the percent turnout has dropped ateach successive election. The EU Parliament has nowlaunched a campaign with theslogan: Act. React. Impact.Communicating with local andregional voters. This is designed toencourage participation in the elec-tion next year. All political groupingshave agreed that they must nominatetheir candidate for the Presidency ofthe Commission, prior to the election. Also in Brussels last week, RuairiQuinn spoke at the press conference, the Party of European Social ists(PES), at which it was announcementthat the German, Martin Schultz whois the current President of the EUParliament, is their candidate desig-nate for the office of President of the

EU Commission. Most of thePolitical Groupings have either

selected their candidate orare in the process of doingso over the coming weeks. The EPP to which Fine Gaelis affiliated have decided to

hold off their selection untilthe EPP congress which meets

here in Dublin next March. Theirspokesperson told us that theywanted to have the last word on thematter. This will be the first time that theelectorate will be consulted in thefilling of this vital post. Since theadoption of the Lisbon Treaty, it isagreed that the Council of Ministerswill have account of the out turn ofthe election and on that basis make anomination to the newly electedParliament as to who they shouldelect a Commission president. It willbe interesting to see how this processactually will work.

Free legal advice or legal aid- A right or a privilege?

I recently spoke to a Swords residentwho presented to me a very clear, rational and convincing argument to suethe state, further to the alleged negli-gence of the office of the formerFinancial Regulator and other civilservants involved in the management offinance. His argument was impressivehowever his difficulty is his ability tolaunch that action due to his limitedresources. Can the state assist him tosecure access to justice? The only obligation on Ireland to providefree legal advice is in the context of crim-inal hearings. Article 6 (3) of the ECHRprovides;Everyone charged with a criminal offencehas the following minimum rights:(a) to be informed promptly, in alanguage which he understands and indetail, of the nature and cause of theaccusation against him;(b) to have adequate time and the facili-ties for the preparation of his defence;(c) to defend himself in person orthrough legal assistance of his ownchoosing or, if he has not sufficientmeans to pay for legal assistance, to begiven it free when the interests of justiceso require;(d) to examine or have examinedwitnesses against him and to obtain theattendance and examination ofwitnesses on his behalf under the sameconditions as witnesses against him;(e) to have the free assistance of aninterpreter if he cannot understand orspeak the language used in court.Ireland, in my view is in full compliancewith that obligation further to the enact-ment of the ECHR Act, 2003 and theCriminal Legal Aid Act. However, Irelandhas specifically reserved its position notto extend its obligation beyond the fore-going. There has been considerabledebate amongst commentators and caselaw as to whether we are obliged toextend legal aid.In any event, Ireland does provide legalaid in the following circumstances; The Mental Health Legal Aid SchemeThe Coroners Court Legal Aid SchemeRefugee legal Aid SchemeGarda Station Legal Advice SchemeCivil mattersThe Legal Aid Board tends to providelegal aid and legal advice in thefollowing areas mainly:Judicial separation, Divorce,Maintenance, Domestic violence,Custody of and access to children,Problems relating to hire-purchaseagreements, Contract disputes The Board can give legal advice in mostareas. It is prohibited from providinglegal aid in the following categories ofcases:Defamation claims (i.e., where aperson's reputation has been damagedas a result of libel or slander), Landdisputes (i.e., disputes concerning rightsand interests in or over land), Civilmatters covered by the small claimsprocedure, Licensing (publicans'licenses), Conveyancing (i.e., the legaltransfer of a property from one party toanother), Election petitions, Claimsmade in a representative, fiduciary orofficial capacity (see note below), Claimsbrought by a person on behalf of a groupof persons to establish a precedent on aparticular point of law ("test cases"),Any other group or representative action("class actions").The offices near you are;(a) Law Centre, Units 6-8BlanchardstownBusiness Centre, Clonsilla Road, Dublin15. 8640314.Therefore, there is a considerable bodyof law that if, due to financial circum-stances, it is simply not open to thepublic to bring or launch a legal action. The lacuna or the unfairness of this situ-ation has been filled somewhat by thesetting up in 1972 by a group of studentsof Free Legal Advice Centres (FLAC).These have grown to become vitalorganisations in communities. We arelucky enough to have one on ourdoorstep run by Andrew McCann andtheir address is Swords CICUnit 26, The Plaza, Main Street, Swords,Fingal, Co. Dublin Tel: 0761 07 7510 Fax:01 8409714. FLAC have consistently campaigned overthe years to develop access to justice toall especially those in marginalisedcommunities. The situation or injustice isalso somewhat tempered by fair mindedsolicitors who often take cases on thebasis of either “no foal no fee” or indeed“pro bono”. This practice has been, inmy view outrageously criticised byconcerted interests, however but forthese solicitors and indeed FLAC, accessto justice for many would be unattain-able.As for the gentleman with the prospec-tive case against the state, unfortunatelyit appears we are a long way offproviding a circumstance for him tolaunch such an action.I will leave the last word to FLAC;“While the right to civil legal aid is recog-nised in Ireland, there is still much to bedone to realise that right. The currentscheme of civil legal aid is narrowlyfocused, poorly resourced and excludesmany who should be entitled. To beeffective in the vindication of basic rightswhich are guaranteed in law, legal aidprovision must be constructed from theperspective of those people and commu-nities who need it to access justice. If implemented, FLAC’s blueprint woulddeliver civil legal aid in a way whichwould respect and protect the humanrights of those who are otherwise at riskof being denied access to justice. Theelements of the blueprint are practical, possible, and are in line with Irish Stateobligations in national and internationallaw. The right of access to justice and to civillegal aid is often not recognised.Organisations and communitiesconcerned with human rights must bevigilant to ensure that the right isprotected and promoted. FLAC includesamongst these, the Irish government, theLegal Aid Board and non-governmentalorganisations which work in the commu-nity and to advance human rights. FLAC,a human rights organisation which isdedicated to the realisation of equalaccess to justice for all, will work, inconjunction with all other interestedparties,to make the blueprint a reality. What you can do to help:• Seek law reform. The means test mustbe reformed. No area of law should beexcluded.• Press Government for resources so thatan effective legal aid service is available.• Ensure that community groups, groupsworking with vulnerable and margin-alised groups and those working toadvance human rights are aware of theexistence of the Legal Aid Board and theextent of its services.• Lobby for changes in the regulations toensure that financial eligibility is calcu-lated at levels which are realistic.• Tell FLAC – the Free Legal AdviceCentres – of unfairness or hardshipcaused by the denial of civil legal aid, orof inadequacies in the service.”

Best Wishes to Boylan’s Butchersfrom

Nowadays, in a time of unprecedented choicefor shoppers, it is heartening to find that manypeople are beginning to revert to their localarea to do their shopping. Community involve-ment and the all important personal touch andtraditional retailing values are regarded asreasons for this. This is certainly true in the case of Boylan Butchers, who are celebrating their first year in business in Rush, having opened to the public on 19th November 2012.The shop, which is conveniently located on MainStreet, beside Eurospar, has already earned a reputa-tion as the place to go for the finest quality meat ataffordable prices, all served up in a friendly andconvivial atmosphere. Even though Boylan Butchers isonly one year in business, it is clear that they havemade quite an impact on shoppers during this time.Boylan Butchers is under the management ofbrothers, David and Tommy Boylan, who are locals tothe core. They were reared here, at Rogerstown Laneand know the people and the neighbourhood inti-mately. Between them, they have 46 years experiencein the butchery business, having served apprentice-ships and having worked in numerous butchers’outlets along the way. David says, “We are one of theonly butchers who seam bone our own beef. All of ourbeef is Irish and is locally sourced and is 21 day aged.We just hang the beef, because the longer it hangs, the more mature and tender it becomes and theflavour is enhanced, making the taste irresistible. Byhanging the meat on the bone, it matures because itgets black on the outside, which means you knowexactly when it is ready for use. We like to display ourmeat at the counter and the customer can clearly seethe quality of the product on display.”“This is the first shop we have opened and localpeople have been very supportive of us. We have hadgreat feedback, which we appreciate. We also supplylocal businesses with their meat requirements. One ofour customers is the Harbour Bar, which won theaward for Best Traditional Bar Food 2013, so that’s areal boost for our business. We also supply Pasta Pizzain Skerries with beef and chicken, so we’re very happyto be associated with these companies. All of ourpoultry products are supplied by Manor Farm throughDC Poultry and all of our eggs come from just downthe road, in Counties Meath and Louth.

Similarly, our beef, bacon, lamb and pork productsare all supplied by Irishproducers. The meatcomes, literally, from theabattoir to the shop, toensure that ourcustomers have thefreshest meat possible. This is very important tous.Traceability is also veryimportant at BoylanButchers. “We must knowwhere our meat comesfrom, and who killed it”.It’s not just quality steaksthat Boylan Butchersspecialise in. Matt says they are busypreparing for the worldgames, which he says will seemany athletes from around the North Countyparticipate. “The emphasis of the SpecialOlympics in Ireland has always been on the localcommunity,” he explained. “Our vision is to builda programme, so that every person with alearning disability has the opportunity in theirlocal community, to get involved in high qualitysport activities, and I really think that’s whatwe’re building upon year after year. We aim toprovide a sport of choice to those with intellec-tual disabilities within local communities.”And indeed, the local communities around theNorth County have various places that athletescan train in order to participate including: theFingal Gallopers Special Olympics Club inSwords, the Fingal All Stars Special OlympicsClub in Skerries and the Malahide United SpecialOlympics Club, among others. Anyone keen toget involved in training in a specific sport in theSpecial Olympics can approach these clubs orvisit their website for the full details. “What we also love to see, and hope to see more of in

the future is community based clubs developing new sports.” Matt, who lives in Ashbourne and hails originallyfrom Wexford, has been involved with the SpecialOlympics for a number of years; he was ChiefFinancial Officer before he became CEO, and it’sevidently clear that his role is much more than ajob. “First and foremost, I’ve always had a hugelove of sport,” he said. “And when you’re a fan ofsport, the Special Olympics are really quitesomething to behold. It’s incredible to watch allthese dedicated athletics come together andparticipate in such a major sporting event.”Matt’s involvement in the games were spawnedfrom a personal level. “My brother John had anintellectual disability, and I was very aware as hewas growing up, there wasn’t much in Irelandinitially for those with intellectual disability.Thankfully, things have really progressed for thebetter, and when he participated in the games, Isaw how much it meant for him to win, and thepositive affect it had on him.” He goes on to sayhow incredible it is to witness the life changingeffect the games have on the athletes. “We knowthe games profoundly changes their lives andthat of their families. The olympics are a huge

outlet for them in so manyaspects. The games are a veryimportant part of their sociallife as well, as they are gettingout and interacting with somany different people.” “The strength of the SpecialOlympics l ies in what’shappening at community leveland the involvement of localparticipants,” he continued.“And with the amount of excel-lent facil it ies and venuescurrently in the North County,I’ve no doubt that we’ll see

many local athletics taking part in the worldgames next year.” He goes on to mention aparticular highlight of the history of the SpecialOlympics. “For me it was the 2003 WorldGames that were held in Croke Park. It was thefirst time that the games were held outside theUSA, and was a really big deal for us andIreland. You could really see the sense of spiritand how everyone really embraced the games. It changed how Irish people might havedecided to see the event, and they saw theability, rather than the disability, which was fantastic.”In terms of future plans, all eyes are nowgearing towards the world games next year, and as the Special Olympics funding has beendrastically cut by the Government, Matt saysthe challenges they face will be tough, butthey’ll continue to work towards making thegames bigger and better than ever, to ensure itcontinues to bring as much joy as possible toall involved with Special Olympics Ireland.

Rush Residents OutragedOver VandalismLocal residents in Rush were outraged to discover that vandals haddrawn graffiti over the Harbour Park toilets murals painted in the localtown over the bank holiday weekend. A member of Rush Tidy Townscommittee, Majella McHugh and a local artist involved in the paintingof the murals, Laura Colgan got in touch with the County Leader toexplain how distressed members of the community were about theissue. “We were outraged to see the vandalism done to the murals over thebank holiday weekend, we worked hard to get agreement with theCounty Council and felt that they were a welcome addition to thetown,” Majella said. “We hope that by drawing attention to this mind-less and selfish act, people might remember if they saw anything andlet us know and maybe we can catch who did this.” Artist Laura Colgan echoed this sentiment, saying: “I was equallydevastated to find that someone had done graffiti on the mural. Localresidents did the undercoat and I had help with the mural itself fromLyndsey Balfe and Aoife Coyle. Every single bit of it was done volun-tarily, including members of Rush Tidy Towns who sourced the paintand fought very hard for the murals to be allowed in the first place.”“Unfortunately, this has dampened the town spirit,” she continued.“Currently we are looking into getting CCTV footage to find the perpe-trators. Many hours of volunteer work was tarnished by their thought-less, foolish behaviour, the culprits clearly have no respect for theircommunity,” she said angrily.

Local Group Needs Homes For KittensFingal S.P.C.A are an animal rescue charity that have dedicated fiveyears of voluntary service to the North County area, and are looking toplace some of their adorable kittens in local homes. This year has beenparticularly busy for the charity, due to the favourable weather we hadover the summer, as this resulted in more irresponsible people takingoff, leaving the country and abandoning animals unloved and uncaredfor. The consistently warm temperatures also meant that there was anotable rise in the survival rate of these neglected animals. The charityare happy to say that they responded to every single call to rescue andhave been able to keep the breeding of wild cats under control. However, volunteers of the charity have the ongoing task of taming thekittens so they’re ready to be taken into permanent, loving homes. Ifyou’re able to take on the rewarding task of housing one or more ofthese kittens until they find a permanent home, your help would begreatly appreciated. Please call 8436477. Any donations would also bevery welcome.
