    West Kootenay Credit Card FraudTe Salmo RCMP are currently investigating fraudulently

    compromised credit cards from area nancial institutions. Ifyou have had your credit card compromised, report it to thenancial institution and to the local police. Financial institu-tions may alert local police of current issues of fraud but do notdivulge the names of those aff ected to police so it is incumbenton each individual to call local police and provide details.

    Credit card fraud can happen several ways. Your cardcould be lost or stolen and used to purchase goods and

    services. A criminal could obtain your card number andexpiry date and use this information to buy merchandiseby phone or over the Internet. Or criminals could tamperwith payment terminals at retailers to obtain your cardnformation and create a counterfeit credit card.

    Here are some tips to that you can take to protect yourself:

    • Report a lost or stolen card as soon as you notice itis gone. Your card issuer will cancel your card andissue you a new one.

    • Choose a PIN that could not be easily detected ifyour card is lost or stolen – don’t use your birth dateor address, never lend your card or disclose yourPIN to anyone else.

    • Make it a habit to regularly check your transactionsonline or on your monthly statement. If there areany charges that you didn’t make, report them toyour card issuer right away.

    • Never give out your card number over the phoneor Internet unless you know you are dealing with areputable company.

    • Protect your Personal Identication Number (PIN).

    Don’t share it with anyone or write it down, memorize it.• Sometimes scammers will try to trick people intorevealing information about their credit cardseither over the phone or through e-mail.

    • It’s important to know that your credit card companyor bank would never call to ask for personal infor-mation like your credit card number, expiry number,PIN, or the security number on the back of your card.

    Protect your credit card like you protect your cash.Never leave them unattended in your car or at work.

    Getting a pre-nup? It could be tossed outif it’s too unfair. A recent case illustrates:

    Frank and Claudia (names changed)started dating in Calgary in August, 2003.In October, Frank moved to Sicamous,BC, where he bought a house. Next April,Claudia lef  her job and family in Calgaryand moved to Sicamous to live with him.

    Engaged but never married, Frank andClaudia lived together as a common-lawcouple for some eight years. Tey had afairly traditional relationship (no kidsthough), with Frank working and Claudiarunning the household.

    Unfortunately their relationship deterio-rated and they split up in 2012. Tey wentto court over how their property (and debts)should be divided up, and about post-sepa-ration nancial support for Claudia.

    Our Family Law Act   treats common-law couples like Frank and Claudia asspouses (though not officially married),so far as support and property division areconcerned.

    Frank told the court he and Claudiahad agreed on how these things would behandled if they split up. He said they hada written pre-nup type agreement that heand Claudia had signed in December, 2004,early on in their relationship. But Claudiaasked the court to “set aside” (ignore ordisregard) that agreement.

    Te court looked at how the agreementcame about, whether Claudia and Frankreally understood it, and how it worked.

    It turned out the agreement was Frank’s

    idea (written by his sister) and Claudia hadlittle choice but to sign it. She had given upher job in Calgary to move and live withFrank at his request. If she didn’t sign, she’dhave to move back to Calgary and start over,an unattractive option. Claudia didn’t reallyunderstand the document very well (neitherdid Frank).

    With this sort of agreement, courts look atwhether it was fair and appropriate not onlyat the time it was signed but also at the timeof separation, said the court. And the waythis agreement actually worked afer Frankand Claudia broke up was very one-sided.

    One example: the agreement said that ifthey separated, neither Frank nor Claudiawould need to support each other nanciallyaferwards. But Frank had a long-standing,better-paying job as a trucker, which

    continued af

    er he and Claudia split up,while Claudia had given up her work inCalgary to go live with him. Afer they split,she needed support, he didn’t.

    Another example: the agreement saidthat, post-split, they would each keep whatthey’d brought into the relationship. SoFrank alone would get to keep the househe’d bought in Sicamous (including itsincrease in value over the years), eventhough Claudia’s money had also gone

    into it later. And Frank continued to livethere post-split, while Claudia had to rent abasement suite in Calgary.

    Te court set the agreement aside becauseit took advantage of Claudia’s vulnerability,wasn’t adequately understood, and wassignicantly unfair to Claudia.
