The modern prison systemdates from the 19th centuryand was a largely Britishinvention – for centuriesthere were few gaols becausecapital and corporal punish-ment were the principalpenalties.

Up to about 1800 more than200 crimes, from theft to murder,were punishable by death. Peoplewere executed in public until1868 when the practice wasbanned because of the increasing-ly unruly crowds that gathered towatch.

Throughout the ages imprison-ment was not regarded as a pun-ishment in itself but simply a wayof holding offenders until theywere dealt with.

High-ranking people wereimprisoned for political reasons –in the Tower of London for exam-ple – but the general populationwere handled swiftly. Examplesof everyday justice included the

stocks, pillory and ducking stool.

Sharp-tongued, abusive womensometimes had an iron cage calleda scold’s bridle clamped over theirheads before submitting to thepublic gaze.

There were also debtors’ pris-ons where people were held invarying degrees of comfort untilthey paid back what they owed.

The first modern prisons werein London where enlightenedthinkers such as Jeremy Benthampropagated the idea that prisonsshould reform and rehabilitate aswell as punish. This was a revolu-tionary concept at the time and isthe theory behind prisons preva-lent to this day.

Victorian prison regimes werevery different from those of today,although many gaols from thatperiod are still in use includingLiverpool’s Walton Prison.

This was where one of the lastexecutions took place in 1964 andbefore that prisoners experienced

It was originally a simple struc-ture, similar to the one that can

also still be seen in Everton, untilleading Wavertree resident SirJames Picton used his skills as anarchitect to gentrify the lock-up soit fitted into his picturesque visionfor the area.

Built on what is still commonland, the lock-up also housed sickpeople and homeless migrantsduring its long history.
