The Medico-Legal Society of Queensland Inc. (MLSQ) has approximately 400 members spanning three professions: doctors, solicitors and barristers. Associate members represent professions working in the medico-legal industry including allied health practitioners, nurses, medical administrators, medical defence organisations, medico-legal reporting agencies and tertiary students of medicine and law. This mix of members provides a unique opportunity for practitioners of these disciplines to meet, share knowledge and exchange views on medico-legal issues and to develop an understanding of how those issues affect each profession.

MLSQ was formed in 1952 to further medico-legal knowledge and to promote understanding and rapport between the medical and legal professions. The then Chief Justice of Queensland, The Honourable Justice Macrossan delivered the inaugural address, Medical and Legal Aspects of Drunkenness in relation to drivers of motor vehicles. After a hiatus during the 1970s, MLSQ was re-formed in the 1980’s and has being going from strength to strength since then. During its 60th Anniversary year, the Society agreed to incorporate, adopting a new constitution and introduced Associate Membership.

Past presidents have included a who’s who of Queensland’s legal and medical fraternities. The MLSQ executive rotates biennially through a doctor, barrister, solicitor sequence.

MLSQ is a very active organisation regularly hosting dinner meetings featuring speakers from a variety of professions. Topics covered at dinners address issues and events of current interest and benefit to all practitioners. MLSQ also hosts an annual conference as well as regular educational workshops.

The MLSQ Expert Witness Directory is another valuable membership benefit. Doctors may register to be included in the directory and lawyers may request access to details of experts in particular areas of specialty, via the Secretariat. View the website for further information.

The conference theme When yes means no focuses on the issue of consent to medical treatment. The complexities confronting medical practitioners in hospitals, at risk of regulatory action or civil suit despite consent apparently being garnered from the patient, will be closely examined. We will provide practical suggestions as how to ensure consent is effectively given, and evidenced, in the unhappy event of later patient complaint of misinformation or coercion.

The keynote address will be delivered by highly regarded orthopaedic surgeon, Professor Ian Harris, University of New South Wales Medical School who is based at Sydney’s Liverpool Hospital. This year, conference sessions will conclude with a debate featuring some of our presenters arguing for and against the topic, Bring back paternalism: Informed consent is a sham.

Suffice it to say it will be both a challenging and informative conference day.

Saturday night’s conference dinner address will be delivered by Professor Roly Sussex OAM, Emeritus Professor of Applied Language Studies at The University of Queensland, Etymologist, and star of ABC radio. He will be speaking about, among other things, the variation in expression of pain and disability across different cultures.

The Marriott Resort’s convenient location, at the northern end of the Gold Coast, puts it close to popular beaches and attractions. Children’s activities are organised on Saturday morning so those with families will have ample time to enjoy the resort’s onsite facilities at this very pleasant time of year.

CONFERENCE PRESENTERSAssociate Professor John Allan graduated from The University of Queensland Medical School in 1973 and became a Fellow of the Royal Australian and New Zealand College of Obstetricians and Gynaecologists in 1984. John is currently the Chief Academic Medical Officer for UnitingCare Health (UCH) and heads its clinical school. He also chairs the UCH human research ethics committee. In addition, John is a board member of Wesley Medical Research, and is a member of The Wesley Hospital’s medical advisory and quality assurance committees.

Janice Crawford holds degrees in nursing and law with post-graduate qualifications in both fields. Janice’s nursing background included many years working in adult mental health both clinically and managerially. Janice was called to the Queensland Bar in 2011. Her main areas of legal interest are criminal law, inquests, professional and medical negligence and personal injuries law. Janice also has a particular interest in children’s legal issues including juvenile justice and the child witness.

Stephanie Gallagher, Special Counsel, Corrs Chambers Westgarth, has more than 20 years’ experience in acting for health industry clients and in the regulation of the health professions. Stephanie has advised in respect of the regulation of the health professions for health care providers, the Boards and Registrants. She was a member of the Nursing Council and Chair of the Queensland Interim Medical Board in Queensland (QMING), the Boards of St Andrew’s War Memorial and QEII Hospitals. Stephanie sat as a member of Institutional Ethics Committees at tertiary hospitals for more than 15 years. She has extensive experience in acting and appearing for health care providers in medical negligence claims, the Coroners Court, QCAT, Inquiries and advising in relation to policy and procedures in relation to health care delivery. Her areas of expertise and interest include clinical risk management.

Ian Harris is Professor of Orthopaedic Surgery at the University of New South Wales. Based at the Liverpool Hospital, Sydney, Professor Harris is an active orthopaedic clinician and researcher. His main areas of research interest relate to the scientific basis for surgery, the scientific quality of surgical research, placebo surgery, the effect of compensation on health, registry science, randomized trials and systematic reviews. Ian is author of the book Surgery, the Ultimate Placebo which explores our overestimation of the effectiveness of surgery.

The University of Queensland Medical Faculty’s Associate Professor Helen Irving is the clinical lead for the Centre for Children’s Health Ethics and Law (CCHEL), a collaborative between Childrens Health Queensland, The University of Queensland and the QUT Australian Centre for Health Law Research. Her clinical role is specialist paediatric and adolescent oncologist and medical lead for the state-wide paediatric haematology, oncology and palliative care network. With additional expertise in clinical trials and palliative care, her interest in bioethics stems from the challenges of care and decision making in paediatrics, particularly associated with the extent of and conflict around care, staff distress, clinical trial access and research ethics.

Dr Kate Lilley is currently a basic trainee of the Royal Australasian College of Physicians, working at the Princess Alexandra Hospital in Brisbane. While working towards specialty training in neurology, she maintains a strong interest in the medical humanities. Her central interest is the intersection between patient and physician narrative and its capacity to effect and affect change in the broader fields of public opinion, medical education and bioethics. Prior to her MBBS, she completed Bachelors degrees in Commerce and Arts (English Literature & Spanish) at The University of Queensland. Her early career was in book publishing at Random House Australia.

Dr Jacinta Powell has been the Director of Medical Services at Logan and Beaudesert Hospitals since 2015 and has been acting in the role of Executive Director, LBHN since late 2016. Prior to these roles she was the medical director of the Metro North Mental Health Service and clinical director at The Prince Charles Hospital. Previously, she was director of Inner North Brisbane Mental Health Service, Herston Mental Health Services, and founder of the Eating Disorders service at Royal Brisbane and Women’s Hospital. Jacinta has experience in working in state wide roles as principal advisor in psychiatry and director of mental health for Queensland. She has a keen interest in health care systems, patient safety and consumer and carer engagement. Dr Powell maintains an active clinical practice working with adults with severe, chronic and complex mental illness including providing a consultation liaison psychiatry service to the renal dialysis unit.

Griffith University Medical School’s Associate Professor Richard Roylance is a Brisbane paediatrician. He holds appointments as chair of the Metro South Human Research Ethics Committee, Eminent Staff Specialist Paediatrician at Logan Hospital, sessional member of the Queensland Civil and Administrative Tribunal (QCAT) and accredited mediator with the Victorian Civil and Administrative Tribunal (VCAT). He has over 25 years’ clinical experience at all levels of the child protection system, with a national and international reputation within the field. Richard’s interest in the protection of children has extended over the past two decades into the broader issue of protecting and supporting vulnerable persons more generally.

The conference dinner address will be delivered by Emeritus Professor Roly Sussex OAM who has had a longstanding love affair with language. He speaks English, Russian, French, Polish and German. A former Professor of Russian at the University of Melbourne, and of Applied Language Studies at The University of Queensland, Roly is spending his ‘retirement’ in research, supervising research students, ABC radio programs on language, writing for the media, and public speaking. He has been explaining language on ABC radio for over 20 years. Roly especially enjoys de-mystifying specialist language from a broad range of professions such as medicine, law, gardening, education, politics, and even the language of pain.

Dr Catherine Yelland is a geriatrician and general physician, working as the Medical Director, Medicine Service Line, at Redcliffe Hospital. She has worked with older people for 30 years, and has been the president of the Australian and New Zealand Society for Geriatric Medicine. She is currently president of the Royal Australasian College of Physicians.

REGISTRATION CANCELLATION POLICY

Registration cancellations must be in writing. Cancellations made before 1 August 2017 will be refunded less a $100 administration fee. No registration refunds will be made after this date. However, your registration may be transferred to another person before 11 August 2017 without penalty. Transfers made on or after 11 August 2017 will incur a $75 processing fee. The conference secretariat must be advised in writing of any cancellation, alteration or transfer.

Drive along the Pacific Motorway (M1), take the Smith Street Connection Exit to Southport.

1. Smith Street turns slightly left and becomes North Street. At the end of North Street, turn right onto the Gold Coast Highway, following the signs to Surfers Paradise.

2. Travel on the Gold Coast Highway for approximately 4 kms. As you enter Surfers Paradise you will see the Marriott Hotel on your right. Note: for southbound traffic there is no right turn into the hotel from the highway.

3. To access the hotel, turn left into Surfers Paradise Boulevard.

4. Turn right into Ocean Ave (first street on the right).

5. Turn right into Gold Coast Highway, heading north back towards Southport. Surfers Paradise Marriott Resort & Spa entry is approximately 600 m on the left.

• Room rates are per room per night and include GST. The rate includes full buffet breakfast in Citrique Restaurant for one adult (single occupancy) or two adults (double occupancy).

• Credit card details or a deposit of at least one night’s tariff must accompany your registration form before your reservation can be processed. Deposits will be deducted by the venue when you settle your account on check-out. A tax invoice/receipt will be issued at that time.

• Alternatively, your credit card authority will be passed to the hotel to secure room reservations. The secretariat will not debit your credit card for your accommodation deposit. The total amount owing will be debited at check-out and a tax invoice/receipt issued.

• Check-in time is 1500 hrs. Check-out time is 1100 hours. Late check-out may be requested but cannot be guaranteed.

• A credit card pre-authorisation of $100 per night will be required at check-in.

CANCELLATION POLICY

• Accommodation cancellations must be made in writing to the secretariat.

• Accommodation deposits will be refunded if a cancellation is notified prior to 4 August 2017 and the room is reallocated to another delegate.

• Between 4 August and 10 August 2017, a cancellation of one night’s deposit applies, unless the room is reallocated to another delegate.

• Rooms cancelled after 10 August 2017 will incur a cancellation fee equal to the tariff for the total number of room nights booked, unless the room is reallocated.

DRESS

Smart casual attire is appropriate for conference sessions. A jacket may be required for air-conditioned session rooms and evening activities. Jacket but no tie is the dress for gentlemen attending the conference dinner. A wrap or jacket is recommended for ladies for cooler evenings.

Under-cover car parking for one vehicle is included in the conference accommodation rate for delegates staying at the resort. For non-resort guests, parking is $15 per day or valet parking is $25 per day.

The Royal Australian and New Zealand College of Psychiatry (RANZCP, Queensland Branch) and the Medico-Legal Society of Queensland Inc. (MLSQ) are co-funding an academic essay prize that will be awarded annually and open to advanced trainees and recent Fellows within all medical and surgical sub-specialities, and lawyers (Barristers and Solicitors) under 5 years admission.

The 2017 MLSQ Conference theme When Yes Means No recognizes that the process of garnering consent involves far more than asking a patient to sign a consent form; hence the inspiration for this year’s essay. Candidates are asked to write a 2000 word essay inspired by the quotation: “Consent has rough edges” from ‘Nutshell’ by Ian McEwan.

The closing date for essay submission is 5.00pm, Monday 17 July 2017. No submissions can be accepted after this date.
