    A Richfield citizens group opposed to installation of clean fill at the site of a former quarry near Scenic Roadare seeking to intervene a lawsuit between the entityseeking to fill the site and the village of Richfield.

    Scenic Pit LLC sought a temporary restraining orderagainst the village June 5 but it was denied byWashington County Circuit Judge Andrew Gonring.Scenic Pit LLC received state approvals for clean fill tobe placed at the location and has argued that it doesnot need village approvals on any items related to theproject. A motion to address the request for a tempo-rary injunction is scheduled for Sept. 1.

    An organization called Richfield Residents AgainstDump LLC (RRAD) filed an intervenor petition on July24.

    "RRAD, and its members, have a significant interestin maintaining the residential character of the neighbor-hood surrounding the subject property and preventingany nuisance from occurring on the subject property,"Alan Marcuvitz, an attorney for the RRAD, said in the July 24 filing. "Not only would the peaceful enjoymentof the residential use of surrounding property be nega-tively impacted by the presence of a dump, but theproperty values of surrounding land owned by RRADmembers would also decrease.”

    In the filing, Marcuvitz stated the intervention motionwould not delay the resolution of the matter because"this case is at an early stage" and fur ther indicated theRRAD "is prepared to join the village in opposition tothat already-filed motion, but does not request a change

    in the court's schedule.”

    The following police report was takenfrom records at the West Bend PoliceDepartment.

    Eluding• A 19-year-old Town of Jackson man

    was taken into custody for eluding afterpolice stopped a vehicle for speeding inthe 400 block of N. University Drive.During the stop, at 1:15 a.m. Aug. 1, thedriver was asked to exit his vehicle at which

    time he put the vehicle in gear and droveoff at a high rate of speed. The officer fol-lowed the vehicle westbound on W.Washington Street, but eventually terminat-ed the pursuit at Villa Park Drive. TheWashington County Sheriff’s Departmentlocated the vehicle on Highway K near BigCedar Lake at 4:30 a.m. A charge of elud-ing an officer is requested at theWashington County District Attorney’sOffice as well as possession of marijuana

    and drug paraphernalia. Related trafficcitations were also issued for violationsprior to the stop and during the pursuit.

    Operating while intoxicated• A 51-year-old West Bend woman

    was arrested for operating while intoxicat-ed-sixth offense at 8 p.m. Aug. 1 after a cit-izen reported a possible intoxicated driverat Park Avenue and Wildwood Drive. Apolice officer located the described vehicle

    and identified the driver. She wamined to be impaired and chargher 6th offense of OWI.

    • A 31-year-old Slinger marrested for operating while intothird offense at 2:55 a.m. Aug. 3 fa traffic stop in the 1100 block of Street. Police stopped a vehicle aing a lot of a business which wasThe driver was identified and deterbe impaired.

    The Hawks defeated Kewaskum 10-0Aug. 4, their 12th win in a row andimproving their record to 14-2. Hartfordand co-leader Brownsville were to meeton Aug. 7. Hartford will then finish theregular season at Slinger Aug. 9.

    Slinger was in seventh place with an11-4 record following a 9-5 loss toOakfield Aug. 3.

    Rubicon was in third place with a 13-2 record following a 4-3 win overHustisford Aug. 2. Rubicon will finish theregular season at Oakfield at 1:30 p.m.Aug. 9.
