dressal Forum, Ahmedabad(Additional), has directedthe state-run OrientalInsur-ance Company to pay ahealth insurance policy-holder Rs 1.17 lakh for ex-penses incurred by him onhis medicaltreatment.

The amount includescompensation of Rs 10,000for his mental agony and Rs2,000 towards the litigationcost, saidthe ConsumerEd-ucation & Research Society(CERS), a co-litigant, in astatement.

Sanghavi, a Crohns dis-ease patient, in 2005 wastreated at a local hospital, but did not make any claimas the company was not li-ableto payany costfortreat-

ment taken during the firstsix months. He had pur-chased the policy just amonthbefore histreatment.

    In August the following

year, Sanghavi renewed thepolicy and in September, heunderwent treatment again.Upon being discharged, he

claimed reimbursement ofRs1,50,299.The insurancecom-pany settled only part of theclaim, i.e. Rs 44,826, sayingthetreatmentdidnot requirehospitalisationand so theen-tire cost wasnotpayable.

When Sanghavi, aided byCERS, approached the fo-rum, the insurer apparentlycitedthe opinionof a doctorfrom a third party agency(TPA) that since no side ef-fects hadbeen noticed whenSanghavi had been treatedforthe first time, hospitalisa-tionwas notrequired duringthesecondtime.

The forum observed thatthe opinion of a doctor treat-ing the patient was more im-portantand orderedtheinsur-

ance company to pay Rs 1.5lakh, Rs 10,000 for mentalagony and Rs 2,000 each tohimand CERStowardsthe lit-igation cost,CERSsaid.
