SCOPE OF WORK

The scope of the Project is the addition to and renovation of the existing skate park facility located at the Nova Community Park along with a permanent skate park building of 448 square feet and the associated infrastructure more specifically described in schematic design documents as prepared by Misiano Skate Parks, Design & Build identified as Exhibit “A”, the Schematic Site Plan prepared by the City of Ormond Beach dated 07.09.14 identified as Exhibit “B” and the Pro Shop Building schematic design, prepared by Hawkins Hall & Ogle Architects, Inc. dated 8.18.14 identified as Exhibit “C”, all attached to the scope of work and made a part hereof.

The specifications and drawings are an integrated part of the Contract. The

Specifications and Drawings establish minimum standards of quality for this project. They do not purport to cover all details entering into the design and construction of materials or equipment. The Contractor is advised that the equipment arrangements as shown on the drawings may vary with different manufacturers and the Contractor is responsible at no cost to the Owner for making the changes necessary to accommodate the specific equipment installed.

Omission of a specific item or component part of a system obviously necessary for

the proper functioning of the project shall not relieve the Contractor of the responsibility of furnish the item as part of the work at no additional cost to the Owner.

Owner and Contractor have agreed upon the guaranteed maximum price of

$449,541.00 and the contract time for the scope of work provided herein, contractor shall furnish and pay for all management, supervision, financing, labor, subcontracts, materials, tools, fuel, supplies, utilities, equipment and services of every kind and type necessary to diligently, timely and fully perform and complete in a good and workmanlike manner the full scope of the work. Attached as Exhibit “D” is the Contractor’s summary and description of the cost of the work. A. ASSUMPTIONS: 1. In the event of discrepancies between the Contract and these qualifications, the

Contract shall prevail. 2. A line item Contingency in the amount of $10,524 has been included in the estimate

amount. 3. AM Weigel sub-consultant, Hawkins Hall and Ogle Architects, Inc. will provide

signed and sealed Architectural Plans for the proposed building as described in Exhibit C. AM Weigel sub-consultant, Misiano Construction will provide signed and sealed Engineering plans to construct the proposed skate park improvements as described in Exhibit A The City will prepare signed and sealed Civil Engineering plans to construct the proposed skate park site improvements outside the limits of the skate park as described in Exhibit B. AM Weigel is responsible to submit all plan sets for City Building permits.

4. Owner direct purchase shall be pursuant to the general terms and conditions of the Contract section 19.3. It is our intention for the Owner to directly purchase as many items as feasible for the purpose of realizing the benefit of their tax exempt status.

B. EXCLUSIONS: The following items are specifically excluded: 1. All permits or impact fees shall be paid by the City. 2. Permanent utility charges, deposits or meters (gas, power, phone, and water) shall

be paid by the City. 3. Costs associated with relocation, removal or replacement of existing utilities found

on site that conflict with proposed construction. 4. Costs associated with removal or replacement of unsuitable soils or hazardous

materials found on site. C. QUALIFICATIONS BY TRADE: The following items are specifically included: DIVISION 2: Clearing/Site Grading: a. Clearing and proper disposal of existing trees, grass, existing chain link fence and

certain portions of the existing concrete skate park course. b. Import Fill materials as needed to rough grade site c. Building Pad elevation assumed to be approximately 6” above existing grades. d. Includes silt fence and temporary chain link fence around construction area. Chain Link Fence: a. Includes 10’ high galvanized chain link fencing around the perimeter of the skate

park. Rock Excavation: a. Includes 192 Cy @ $59.00/CY = $11,328.00 of rock excavation; a credit will be

provided to the City should a lesser quantity of rock be excavated. Sanitary Sewer: a. Includes PVC sanitary sewer service from building to an existing point of connection. Potable Water: a. Includes PVC SDR-21 piping from building to existing City meter (meter provided by

City of Ormond Beach). Storm Drainage: a. Includes ERCP piping from skate park to an existing point of connection.

Landscaping: a. All areas disturbed by construction activities shall be covered with bahia sod or

grass seed and mulch. b. Includes 6,500 SF @ .50/SF = $3,250.00 of sod; a credit shall be provided to the

City should a lesser quantity of sod be installed. DIVISION 3: Concrete: a. Skate Park includes concrete for the restored area of the existing skate park and

concrete for the new skate park feature elements. b. Building includes reinforced concrete foundations and 4” reinforced concrete slab on

grade. c. Site includes construction of 1,000 SF of 4” thick concrete sidewalk; a credit shall be

provided to the City if a lesser quantity of sidewalk is constructed. DIVISION 4: Masonry: a. Exterior walls shall be reinforced single wythe concrete masonry units consisting of

8” x 8” x 16” load bearing block. b. All concrete masonry units shall be running bond with concave tooled joints on

interior face and flush finish on exterior face to receive stucco. DIVISION 6: Rough Carpentry: a. Pre-engineered wood trusses in 4/12 roof slope with 5’8” CDX plywood sheathing. DIVISION 7: Roofing and Sheet Metal: a. Fully adhered modified bitumen underlayment and 30 year Dimensional Shingle roof

system with off ridge vents. b. Includes aluminum flashings, gutters and downspouts. c. Includes white aluminum roof soffit and fascia. Thermal Insulation: a. Includes 10” thick Batt Insulation installed within the bottom chord of the wood

trusses to provide an R-Value of 30. b. Includes R-11 foam thermal insulation injected into the empty masonry unit cells on

exterior walls.

DIVISION 8: Commercial Grade Doors, Frames & Hardware: a. Includes commercial grade doors, frames and hardware to meet applicable codes. Glass and Glazing: a. Includes two (2) each 4’-0” x 4’-0” Insulated, Vinyl Impact Windows as indicated on

the plans. DIVISION 9: Drywall Partitions: a. Includes 3-5/8” metal studs and gypsum drywall partitions to create unisex restroom

and mechanical/electrical room. b. Drywall finish to be level 4 tape and finish. Acoustical Ceilings: a. Includes 2’ x 2’ acoustical ceilings on 9/16’ white grid throughout. Stucco: a. Includes 3/4” Portland Cement Stucco directly adhered to exterior side of concrete

masonry units with standard vinyl accessories and trim. Floor Coverings: a. Includes Vinyl Composition Tile and resilient base in all rooms. Painting & Joint Sealants: a. Includes prime and two coats of latex semi-gloss on all interior CMU surfaces and

gypsum surfaces. b. Includes prime and two coats of elastomeric paint on all exterior CMU surfaces. c. Includes prime and two coats of DTM paint on all hollow metal doors and frames. d. Includes urethane sealants for all window frames and door frames. DIVISION 10: Toilet Accessories: a. One (1) Tilt Mirror 18” x 30” b. One (1) Toilet Paper Dispenser c. One (1) Paper Towel Dispenser d. One (1) 42” Grab Bar e. One (1) 36” Grab Bar Fire Extinguishers: a. Includes One (1) 10lb ABC extinguisher – wall mounted.

Signage: a. Includes Two (2) each wall mounted identification signs. One at each interior door. DIVISION 15: Plumbing: a. Water piping to polyethylene. b. Sanitary waste and vent to be PVC. c. Plumbing fixtures include an ADA bi-level water cooler, wall hung lavatory and

water closets with flush valves. HVAC: a. One (1) – 2 ton straight cool split system (13 SEER) with electric heat. b. Ductwork to be 1-1/2” ductboard. c. Restroom exhaust included. d. Includes all refrigerant piping and air distribution system. e. Programmable Thermostat Control. DIVISION 16 - ELECTRICAL: a. Building power distribution to accommodate the proposed HVAC equipment and

convenience receptacles per applicable codes. b. Building lighting to be commercial grade fluorescent light fixtures. c. Exit Lighting and battery pack emergency lighting to meet applicable codes. d. Skate Park lighting enhancement includes adding four (4) new mast arms, sixteen

(16) new light fixtures to the existing four (4) concrete light poles and replacing eight (8) lamps in existing light fixtures.

e. Includes security and data system connections to the existing panels within the recreation building.

f. Includes commercial grade switches and receptacles with plastic device plates.

COMPLIANCE WITH FORIDA PUBLIC RECORDS LAW Consultant expressly agrees that it shall comply with the public records law provided in Florida Statutes, Chapter 119, and specifically to: (a) Keep and maintain public records that ordinarily and necessarily would be required by the City in order to perform the contracted service. (b) Provide the public with access to public records on the same terms and conditions that the City would provide the records and at a cost that does not exceed the cost provided in Chapter 119, Florida Statutes, or as otherwise provided by law. (c) Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law. (d) Meet all requirements for retaining public records and transfer, at no cost, to the City all public records in possession of the consultant upon termination of the contract and destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. All records stored electronically must be provided to the City in a format that is compatible with the information technology systems of the City. (e) Failure of the Consultant to comply with Public Records Law as provided by Florida Statutes, Chapter 119, shall subject the Agreement to termination for cause by the City. ACCEPTED: A.M.
