Due to the rain events, the striping should be completed within the next 2 weeks. Once the striping is finished, DOT will reconstruct the shoulders completing this resurfacing map. As I type, the 24 project is underway, beginning with replacing areas of damaged curb and gutter. The completion date for the project is December 15, 2015. 2. 1. As for the report, the consultant is on track to deliver draft report by Monday 10/26/2015. This deliverable will include all findings and recommendations; it is anticipated that finalization of the draft study can be handled within 1-2 weeks, depending on the Town’s review time.

3. Heritage Museum Update – Please find attached letter from Swansboro’s Historic Preservation Commission (SHPC) regarding the Old Town Hall located at 502 Church Street and other near term and long-range requests (Attachment B). As noted in the letter, $14,300 has been allocated from the FY 15-16 budget to make emergency and critical repairs. To date, approximately $1,250 has been spent on emergency electrical repairs in the attic, along with a “very” preliminary environmental/structural analysis of the structure. Office (SHPO) to assist in proper identification of restoration methods related to said structure. Mr. Wood is set to be here on October 14.

Further identified in attached letter from the SHPC, is the SHPC’s support of the Heritage Museum to be located at 502 Church Street. However, prior to the museum’s occupancy of the structure, identified “critical repairs” must be performed. Identified in the FY 15-16 budget is an additional $82,000 that would be used for repairs only resulting from “Swansboro Investors-Big Box Permit Fees.” The SHPC notes “we are grateful for the potential set aside as a result of the “Swansboro Investors-Big Box Permit Fees,” however there are immediate needs for the building that cannot wait.” Please note as well with recent legislation change (160A-414), permit fees collected under the authority set forth shall be used for support of the administration and activities of the inspection department and for no other purpose. The SHPC notes the only true way of stabilizing the structure and reducing/eliminating the threat of mold is replacing the HVAC system and installing the proper insulation, etc. Town staff is in the process of assembling cost estimates for said “critical repairs.” The data is not yet available.

The SHPC further recommends the Town explore all possibilities (ex. One Harbor Church) (Attachment C) for their consideration of using a portion of the building to share in costs of repairs to the structure. The Town should investigate a lease work/arrangement with other entities that would be of benefit in a cooperative manner with the establishment of the Heritage Museum.

On September 30, staff met with One Harbor representatives on usage of the old Town Hall facility. In initial conversation (on site), the church has requested use of the auditorium (Sunday mornings) and 2-3 classrooms and an office. Tentatively, only in conversation, the church has agreed to assist in a donation towards the repairs ($10,000) and provisions for repair work (labor, construction management, contractors, and other needs that may be identified) and appropriate lease agreement (amount, etc TBD). Please keep in mind, that other concerns are at play with consideration, such as parking and long-term lease agreements that would not interfere in the museum’s expansion and function of their day to day activities. On October 1, staff met with museum representatives to share the information retrieved from the September 30 meeting and how the entities could possibly work together. Representatives from the museum believed that the two entities could (if feasible) work together only under certain circumstances. It was recommended by staff, if so desired, that a joint meeting be held between “any” parties considering renting the Old Town Hall for identification of each other’s needs and sharing of space.

Town staff will be seeking direction from the Board of Commissioners on pursuing such interest after “critical repairs” estimates have been received. A suggestion made by staff in meeting (on site) with the Historical Association was the immediate (possible) use of the bicentennial room, storage areas and restrooms upon the Police Department’s vacating of the structure and relocation into the new Public Safety Building (Attachment D). Staff suggested this as a “Phase One” approach to getting the museum off the ground, and the building being identified as the Heritage Museum. Other sections of the building have major work to be performed before it can be occupied as a place of assembly/worship and/or a museum. It was noted that the Museum could occupy the space that was in best condition while the rest of the building was being repaired. Given such repairs, the space being utilized by the museum would allow time for additional funding for not only repairs but advancement and operation of the museum and subsequent expansion into other areas of the building. Before such could occur, a lease agreement (Of note has been drafted) would have to be approved by the Town Board of Commissioners.

4. Onslow County Housing Summit (Attachment E) – On August 31, staff attended an Onslow County hosted Housing Summit at the Commissioner’s Chambers in Jacksonville. The purpose of the meeting was to gather information on the existing Onslow County residential real estate market through a series of presentations to the County Commissioners and the public. Ben Warren, Onslow County Planning and Development Director presented information about existing land use types and the statutory authority of the County as it relates to regulating land use. Other representatives presented data including the City of Jacksonville, Jacksonville Board of Realtors, and Camp Lejeune. The Town of Swansboro is experiencing similar trends in permitting (slow out of the gate in FY 15-16, with recent upticks in residential homes being permitted). SCOPE OF SERVICES

I. TRAFFIC ENGINEERING SERVICES

A. Study Area

A traffic impact analysis has been requested by the Town of Swansboro to determine the impacts associated with the proposed commercial development in located off NC-24. The provided conceptual site plan includes two limited access site driveway connections to NC-24 and one full access site driveway connection to Hammocks Beach Road. Study area intersections include the following:

• NC-24 / Hammocks Beach Road*• NC-24 / Norris Road*• NC-24 / Queens Creek Road*• NC-24 / Swansboro Middle School Driveway*• NC-24 / Site Driveways (1 & 2)• Hammocks Beach Road / Site Driveway (3)

Peak hour (6:00 am – 9:00 am and 2:30 pm – 6:00 pm) turning movement traffic counts will be performed by Timmons Group for the four (4) existing study area intersections* listed above. Summer turning movement traffic counts will be provided to Timmons Group by the Town of Swansboro.

B. Scope of Services

The project involves the tasks and methodology that are outlined below:

Perform peak period (6:00 a.m. – 9:00 a.m. & 2:30 p.m. – 6:00 p.m.) traffic counts at thefour (4) existing study area intersections.

Acquire summer traffic counts from Town of Swansboro. Count data includes:• AM and PM peak hour data for a typical work day (Tuesday – Thursday)• AM and PM peak hour data for Friday• Peak hour data for Saturday

Summer traffic count data will be analyzed to determine the heaviest AM and PM peakhours and these will be used for analysis.

Collect other necessary data relating to the study area and adjacent transportationnetwork.

Review all pertinent information including: land use plans, traffic accident data, anddevelopments or roadway improvements planned in the study area which may impactthis development.

Project and distribute future ambient network volumes based on an area wide growthfactor (to be provided by the NCDOT).

Distribute traffic from other approved traffic impact analyses within the study areaprovided by the Town.

Project (using the latest version (9th Edition) of the Institute of Transportation EngineersTrip Generation Manual) and distribute site-generated traffic to reflect the full build-outof the commercial development.

Conduct a Capacity Analysis for the above mentioned intersections for the followingseven (7) scenarios (AM and PM peak period)

Provide recommendations to improve the level of service (LOS) at any study area intersection that demonstrates a deficient level of service due to the traffic generated by the proposed development.

Complete a conceptual design of offsite roadway recommendations and provide a preliminary construction cost estimate for these improvements.

Produce a Traffic Impact Analysis that documents all findings and recommendations. Attend one meeting with the Town of Swansboro (via Skype, conference call, or

equivalent) to review the project status and provide final project recommendations. COMPENSATION I. TRAFFIC ENGINEERING SERVICES Timmons Group will provide the entire above scope of services described above for the lump sum fee of: $10,000.00 Unless otherwise negotiated, Timmons Group will complete the subject project within five weeks after receiving notice to proceed. Based on our present schedule, Timmons Group can begin work upon receipt of your written authorization. ADDITIONAL SERVICES Any additional services outside of this scope will be billed at an hourly rate of $135.00. Additional services include, but are not limited to: additional intersection traffic counts and/or analyses, additional meetings, deviations from the originally provided scope, traffic signal warrant analyses, phasing of the project, complete offsite roadway improvement designs (to be negotiated separately and payable by lump sum). GENERAL TERMS AND CONDITIONS 1. SCOPE OF SERVICES: The Scope of Services performed under this Agreement shall be as described in TIMMONS GROUP’ proposal or other cover document of which these General Terms and Conditions are made a part. The proposal or other cover document and these General Terms and Conditions are hereinafter referred to as the “Agreement.” Separate Change Orders signed by authorized representatives of TIMMONS GROUP and the Client may, from time to time, describe and incorporate into this Agreement additional or different services to be performed under this Agreement. The General Terms and Conditions shall apply to the Change Orders except to the extent expressly modified by such Change Order. TIMMONS GROUP’ services with regard to the specific properties covered by this Agreement and subsequent Change Orders, if any, shall hereinafter be referred to as the “Project” or “Projects.” 2. STANDARD OF CARE: In providing services under this Agreement, TIMMONS GROUP will endeavor to perform in a manner consistent with the degree of skill and care ordinarily exercised by members of the same profession currently practicing under similar circumstances. It is not the intention of TIMMONS GROUP to provide or offer to provide services inconsistent with or contrary to such practices, nor to make any warranty or guaranty, expressed or implied, nor to have any agreement or contract for services subject to provisions of any Uniform Commercial Code. Moreover, it is not the intention of TIMMONS GROUP to accept any terms and conditions offered by the Client in its purchase order, requisition, or notice of authorization to proceed except as set forth herein or as expressly accepted in writing. Written acknowledgement or receipt of the actual performance of services subsequent to receipt of any such purchase order, requisition or notice of authorization to proceed is specifically deemed not to constitute acceptance of any terms or conditions contrary to those set forth herein. 3. CODE COMPLIANCE: TIMMONS GROUP shall exercise usual and customary professional care in its efforts to comply with all applicable codes, laws, regulations and the policies of regulatory agencies in effect as of the date of the Agreement. Design changes made necessary by newly enacted codes, laws, regulations and the policies of regulatory agencies after the date of this Agreement shall be treated as an Additional Service and TIMMONS GROUP shall be entitled to appropriate additional compensation. The Client understands that different officials charged with the enforcement of such codes, laws, regulations and policies of regulatory agencies may have different or inconsistent interpretations of the requirements of such codes, laws, regulations and policies of regulatory agencies, and that TIMMONS GROUP shall not be liable for any damages arising from conflicting interpretations by different officials. In the event of a conflict between the codes, laws, regulations or policies of regulatory agencies which apply to the Project, TIMMONS GROUP shall notify the client of the nature and impact of such conflict, and the Client agrees to cooperate and work with TIMMONS GROUP in an effort to resolve the conflict. 4. ELECTRONIC FILES: Because of the possibility that information and data delivered in an electric file format may be altered, whether inadvertently or otherwise, TIMMONS GROUP reserves the right to retain the original tapes, disks and other forms of electronic data, and to remove from copies provided to the Client all identification reflecting the involvement of TIMMONS GROUP in their preparation. TIMMONS GROUP also reserves the right to retain hard copy originals of all Project documentation which is delivered to the Client in electronic file format, which originals shall govern in the event of any inconsistency between the two. It is also understood that the automated conversion of information and data from the system and format used by TIMMONS GROUP to an alternate system or format may not be able to be accomplished without the introduction of inaccuracies, errors and anomalies. In the event any Project documentation provided to the Client in electric file format is so converted by the Client, or someone acting on the Client’s behalf, Client agrees to assume all risks associated therewith and, to the fullest extent permitted by law, to hold TIMMONS GROUP harmless and indemnify it from and against any claims, liabilities, damages, losses and costs, including but not limited to attorneys fees, arising therefrom or in connection therewith. 5. GOVERNING LAW: This Agreement shall be governed according to the laws of the State of North Carolina. 6. THIRD PARTY RIGHTS: This Agreement shall not create any rights or benefits to parties other than the Client and TIMMONS GROUP. 7. ASSIGNMENT: This Agreement may not be assigned without the express written consent of the Client and TIMMONS GROUP.

8. PROJECT SITE SAFETY: TIMMONS GROUP’ Project site responsibilities are limited solely to the activities of TIMMONS GROUP and TIMMONS GROUP’ employees on the Project site. These responsibilities shall not be inferred by any party to mean that TIMMONS GROUP has responsibility for Project site safety. The Client and TIMMONS GROUP agree that Project site safety is the sole and exclusive responsibility of the Project Contractor(s). The parties likewise agree that the Project Contractor(s) is solely responsible for Project means, methods, techniques, sequences of operation and procedures, and that TIMMONS GROUP shall have no obligations relating to these Contractor(s) duties. 9. LIMITATION OF LIABILITY: To the fullest extent permitted by law, and notwithstanding any other provision of this Agreement, the total liability, in the aggregate, of TIMMONS GROUP and TIMMONS GROUP’ officers, directors, partners, employees and subconsultants, and any of them, to the Client and anyone claiming by or through the Client, for any and all claims, losses, or damages, including attorneys fees, in any way related to or arising from the Project or the Agreement, shall not exceed the total compensation received by TIMMONS GROUP under this Agreement, or the total amount of $50,000, whichever is greater. 10. INDEMNIFICATION: TIMMONS GROUP agrees, to the fullest extent permitted by law, to indemnify and hold harmless the Client, its officers, directors and employees, against all damages, liabilities or costs, including reasonable attorneys fees and defense costs, to the extent caused solely by TIMMONS GROUP’ negligent performance of professional services under this Agreement and that of its subconsultants or anyone for whom TIMMONS GROUP is legally liable. The Client agrees, to the fullest extent permitted by law, to indemnify and hold harmless TIMMONS GROUP, its officers, directors and employees, against all damages, costs and liabilities, including reasonable attorneys fees, caused solely by the Client’s negligent acts in connection with the Project and that of its Contractor(s), subcontractors or consultants or anyone for whom the Client is legally liable. Neither TIMMONS GROUP nor the Client shall be obligated to indemnify the other party in any manner whatsoever for the other party’s own negligence.

(6) Conduct an educational program with respect to historic properties and districts within the town’s planning jurisdiction.

(7) Cooperate with the state, federal, and local governments in pursuance of the purposes of this ordinance. The Board of Commissioners, or the Commission, when authorized by the Board of Commissioners, may contract with the state, the United States of America, or any agency of either, or with any other organization provided the terms are not inconsistent with state or federal law;

(8) Enter, solely in performance of its official duties and only at reasonable times, upon private lands for examination of survey thereof. However, no member, employee, or agent of the Commission may enter any private building or structure without the express consent of the owner or occupant thereof;

(9) Prepare and recommend the official adoption of a preservation element as part of the municipality’s comprehensive plan;

(10) Review and act upon proposals for alterations, demolitions, or new construction within historic districts, or for the alteration or demolition of designated landmarks, pursuant to this ordinance; and

(11) Negotiate at any time with the owner of a building, structure, site, area or object for its acquisition or its preservation, when such action is reasonably necessary or appropriate.

At our September 1, 2015 Regular Meeting we reviewed a list of suggestions as recommended by our Town Manager in keeping with the prescribed duties of our Commission. We believe these may impact strategic initiatives presently underway or being planned by the Town of Swansboro. Our priorities and subsequent recommendations are listed as follows:

1. One of the initiatives underway includes the reuse of the old Town Hall located at 502 Church Street as a Heritage Museum. It is our understanding that $14,300 has been allocated from the FY 15-16 budget to make emergency and critical repairs to the structure. In addition, potential revenues are noted in the FY 15-16 budget as “Swansboro Investors-Big Box Permit Fees” that would potentially generate $96,000 in revenue whereas $82,000 would be used for repairs.

We are grateful for the potential set aside as a result of the “Swansboro Investors-Big Box Permit Fees,” however there are immediate needs for the building that cannot wait. At the September 1 meeting, Brittany Shipp disclosed with the Commission the repairs planned and underway. We agree with the planned repairs, however once these are made, the building’s climate should be stabilized thus reducing/eliminating the additional presence of mold. The only true way of doing such is replacing the HVAC system and installing the proper insulation, etc. One would estimate the immediate repairs to be close to an additional $30,000 to stabilize the structure. Therefore, the Swansboro Historic Preservation Commission (SHPC) requests the Board of Commissioners allocate now the necessary funds to make the most essential repairs and eliminate further deterioration of the structure.

2. We further understand that other parties have documented interest in leasing a portion or all of the building located at 502 Church Street and would consider sharing or paying for all of the necessary emergency repairs to the building. Therefore, the SHPC would recommend the Town explore all possibilities (ex. One Harbor Church) for their consideration of using a portion of the building to share in costs of repairs to the structure. The Town should investigate a lease work/arrangement with other entities that would be of benefit in a cooperative manner with the establishment of

the Heritage Museum. The SHPC further recommends and provides their documented support for the establishment of the Heritage Museum at 502 Church Street.

3. To further the advancement of the protection of the Old Town Hall building, the SPHC

requests the Old Town Hall at 502 Church Street be included in Swansboro’s Historic District proper. Therefore, the SHPC recommends the Historic District be expanded to include the property located at 502 Church Street.

4. Further protection efforts should be made for the Old Town Hall building located at 502 Church Street. Therefore, the SHPC recommends that the structure be included as a landmark designation and consideration be given in the budget for the hiring of a consultant to assist in the extensive paperwork necessary for filing.

5. The SHPC and the Swansboro Historical Association (SHA) should have a defined relationship and direction be provided between the SHPC and the SHA. Their efforts should be in lock step constantly. The SHPC recommends that a liaison position be created from the SHPC that works and partners with the efforts of the SHA. A representative from the SHA should also be appointed in a liaison capacity and regularly attend meetings of the SHPC.

6. In order to protect the assets of the Historic District and further promote development and enforcement of the Gateway Standards, a code enforcement position should be established full-time dedicated to these efforts and not be a shared responsibility of the Public Works Director. Therefore the SHPC recommends the Town hire a full-time Codes Official that can dedicate their efforts solely for enforcement of the Town’s codes.

7. As a result of providing the additional resources necessary for enforcement of the district, the Town should consider provisions within Article 22 for a Demolition by Neglect Ordinance. Furthermore, stronger code enforcement should be given for all properties located within the Town’s limits and along the Gateway Corridor. Therefore the SHPC recommends the Town provide resources in the form of staff or a consultant to develop and adopt Demolition by Neglect Standards. These standards will give staff enforcement provisions needed to detour deterioration of historic structures located within the district. These provisions can also be benchmarks for other code enforcement activities within the community.

8. Appointees to the SHPC should be residents of the Historic District when all possible. Therefore the SHPC recommends that priority should always be given to applicants that live within the district.

9. The Town should support the preparation of a long-term plan for the district that presents a vision that promotes and develops the district both through the physical assets and through the media. Therefore the SHPC is requesting funding and assistance from the Town, Tourism Development Authority and other identified sources for the development of a website that offers historical facts and photographs/videos of properties located within the district. These efforts can also be used for homeowners within the district and others considering investing in this district of the guidelines associated with being an owner within the district.

We again have the opportunity to change the weights of the criteria used to measure the projects in our

Region and Divisions. The staff from all of our neighboring MPOs and RPOs have met to draft potential

alternatives that we will present for your review.

8. INFORMATION: Modifying Existing Projects

The Down East RPO SPOT 4.0 Subcommittee has met to review the cut projects and existing projects in our

area. We are proposing a number of projects be reworked or segmented into to hopefully boost their score.

We will review this list the modifications we made for your information.

The Down East RPO SPOT 4.0 subcommittee has met to determine what projects need to be resubmitted,

what projects need to be deleted, and what new projects need to be submitted. We will review these
