The Redbucks

An all-American sextet that formed in Beijing, via London, The Redbucks are probably China’s only regularly performing bluegrass band. Banjo player Luke Boswell and guitarist Chip Rountree, from Washington and Colorado respectively, met South Carolinian Chris Boehner (mandolin) in the capital, where they started out jamming in little bars. After a hiatus that saw one member detour to England, the group reformed last year with additional guitarist Christine Laskowski and fiddler Amy Gardner, whose feminine vocal touch added a new element to the band. The final member, Jackson Garland, was drafted in on double bass - those with a keen eye on the Beijing music scene will note that he is also the keyboardist in alt-rock experimental outfit Random K(e).

Introductions done, the band are about to (at time of print) release their first album, with a launch party at Yugong Yishan on 5 June. The songs are poppy and full, with six stringed instruments and five vocalists contributing to a full sound that is an acutely accurate homage to the deep south. High speed title track, All That Glitters Is Red, Green and Gold, is quintessential bluegrass, with a Bela Fleck-style picked banjo underpinning a galloping male vocal. Tracks like The Wedding Cake Song the other hand, centre around a catchy, folky chorus redolent of softer Grateful Dead songs. Vocal duties alternate track by track, but when a particular singer avoids taking the lead, they back the main vocalist with an array of harmonies and countermelody.

The EP features instrumentals and vocally-led songs, both maintaining the listeners’ interest by virtue of the range and dynamism of the playing. The recording is raw and earthy, like a live show, with the graininess of real acoustic instruments, of horsehair scratching and fingernails plucking steel strings.

The Redbucks are touring China, visiting just six cities (Beijing, Qingdao Shanghai, Guangzhou, Hong Kong and Shenzhen), providing a very rare chance to see this eclectic and unique style of music in China. Find out more at theredbucks.com.

Employing, if we may speak theory here, Ciprian gypsy scales, to make some seriously unpredictable melodies and solo lines, Ma Valise sometimes sound like Manu Chao’s evil twin, though a perpetual

undercurrent of two-chord reggae-style upstrokes give them a bouncy, danceable vibe that will keep revelers entertained.Their determination to break down musical barriers has taken them to France, Germany, Algeria, Morocco, the Netherlands, Bosnia, China, Switzerland and Great Britain. 21 June, Venue: TBC. A huge name in their native France, Zenzile are the next group of world renowned stars brought by French cultural promoters Alliance Française to Shandong Province. WIth 13 years of experience, seven albums, five LPs and appearances all over the world, the eclectic group are credited with an important role in establishing the dub scene in France, and are a notable step forward for international entertainment in Qingdao.

Those thinking that the best gig of last month, energetic turntable duo Beat Torrent, would be an impossible act to follow should reevaluate - this show will be every bit as musically proficient, cutting-edge and incendiary as Atom and Pfel’s set in Paulaner Bar last month.

Citing a menagerie of influences, through post punk, folk and rock to soul and jazz, Zenzile create a unique and varied sound with explorative, ear-catching basslines, ambient guitars, and powerful saxophone lines. Zenzile favour the prog rock stylings of musicians such as ESG, Pink Floyd, Nick Cave and PiL, but make no mistake, this band are dub, and the first dub band to play Qingdao (to our memory, anyway).

Singing sometimes in English, sometimes in French, the themes they address are of social justice, equality and comeraderie, like the words of other dub and hip hop poets before them. For example National Quota, a fine example of songwriting from latest release Pawn Shop, waxes lyrical about cheap labour in the third world. Their leftist lyrical sensibilities make more sense when one considers that the band took their name from Zenzile Miriam Makeba, an anti-apartheid activist from Johannesburg that enjoyed a brief musical career in the US.

“We’ve done some stupid stuff to get here.”

Those are the words of my co-filmmaker, Brendan Madden, from our latest documentary filmed on location in Iraq. I don’t know if I’ve ever heard a person sum up what we do any better than that.

Living in Qingdao and fulltime teachers by day, Madden and I have a side gig: We produce films around the world. And it seems, every year, even though it’s never our intention, we manage to produce enough new films to be worth the effort to show our work at REDSTAR.

Let me just digress for a moment by saying that all of our work is not dumb. At least I hope not. I would argue that in our films we are trying to have serious fun. On occasion, we push ourselves a little further in the hope of telling a story that no one else has told. That’s where the word 'stupid' comes in.

This year we go back to our beginnings and show the three-part debauchumentary in Northeast China that got us noticed and, ultimately, opened the door for us to start producing films professionally. To give you a clue to the plot, Brendan gets seriously injured for the first segment in Harbin, I get injured for the second segment in Yabuli, and in the third segment we may, or may not, get in trouble for attempting to cross into North Korea.

From there, we'll show our newest films. The first explores wild Mongolia, and was recently won a Tripfilms.com 'Trippy' Award for Best Off-the-Beaten-Path Documentary. The second film covers the terrorist attacks in Mumbai, India and whether there exists a connection to Kashmir. But the third is truly special to us - produced for Lonely Planet Television - we show Iraq in a way that, we can guarantee, you’ve never imagined possible.

Each film we produce is short, no longer than 10 minutes. In total, the films amount to approximately 60 minutes, so don’t think the event is meant to slog on for hours.

今年，我们转回到起点，播放3部关于中国东北部的纪录短片。那里是我们梦开始的地方，也为我们打开了作为独立摄影师的大门。我们的经历并非一帆风顺，在哈尔滨拍摄第一节的时候Brendan 受了很严重的伤；在亚布力拍摄第二节的时候我也受伤了；在拍摄第三节的时候，我们可能会面临不知如何能进入朝鲜境内的尴尬。

Hop On, Hop Off

For people wanting to experience many of China's historic and beautiful (but less-frequented) destinations, the idea of joining a standard tour group with matching hats, a screaming guide, and overpriced, pre-ordered meals detract from the potential awesomeness of the experience. Wouldn't it be nice if you could ditch the group whenever you want, experience what you want to see, and come away from the experience thoroughly enriched?

Longtime China resident and Dragon Bus Operations Manager Andrew Papas was in Qingdao earlier this Spring, and told us a little bit about what they do.

How are Dragon Bus tours different from what people normally experience traveling through China? We are the first tour company of its kind in China. Having a Trip Leader allows guests to receive the latest information, as well as the comfort of knowing that someone is there to help whenever necessary. Our guests travel to cities that may not

be on the main tourist trail; especially for those who only have 1-3 weeks to travel around China.

What also sets us apart is the ability for guests to hop on and off our buses in any city that we travel to. If guests get to Qingdao during the Beer Festival for example, they may wish to spend extra time visiting the beaches and hiking around the city. They can hop off the bus, and then hop on the next one that will travel through one week after.

For those that only have a few days, we offer a sector pass. This sector pass allows guests to travel for example between Beijing and Qingdao (5 nights), or Zhengzhou-Xian (5 nights). Each of our routes is broken up in this fashion.

How did you guys uncover and select the destinations?The destinations that we have chosen are key places in terms of Chinese history, culture or beauty but do not have a huge foreign contingent visiting. Places like Luoyang, that has some of the most amazing grottoes one can see, yet is devoid of westerners. Your own Qingdao which, although popular with foreigners living in China, is still relatively unknown by those outside. We want to bring these places into minds of everyone coming to China.

What are your recommendations for independent travelers in Summer '10?Obviously, Qingdao is a great place to spend a summer day. Beaches, mountains, friendly people as well as the chance to see a great mix of how the West has met the East. Nanjing is also a city that people often forget about. The once capital of China has fantastic scenery that is rich with history and culture as well as people who are proud of their city. Finally Shaolin Temple. With the new Karate Kid coming out soon, this place is going to get major recognition around the world. It may be worth going there before everyone else.

Day 2 – Ningbo

Day 3 - ShaoxingShaoxing is famous for its East Lake & Orchid Pavilion, however just as famous for being a city that has produced some of China's most famous artists. The city is also well known for being the home to Chinese "Yellow Wine" or a fortified wine similar to port. Similar in some ways to other canal towns of the region, this city however has a very different feel to it and is a great place for black & white photos.

Days 4 & 5 - Hangzhou

Day 6 - 1000 Island Lake1000 Island Lake (Qiandao) is rich in beauty and generally pollution free, partly in thanks to the forest park which surrounds it. The forest is the largest of its kind in China. The lake itself has water that in places to clear to more than 12 meters. The air and noise pollution in this area has been strictly controlled here in order to protect and maintain this pristine landscape, and it shows. The city has a relaxed pace and great for kicking back or cruising around on a bike around its resort style streets.

Day 7&8 - HuangshanThe mountainous area of Huangshan (Yellow Mountain) is spectacular year round. The hostel is located right in the middle of this amazing old village. Winter will see the mountain peaks covered in a blanket of snow, that makes the jagged rock faces, pine trees amazing. You add swirling mists is it is simply more breathtaking. There are also hot spring pools that are particularly handy during the colder months. Yellow Mountain is subject to

a World Heritage listing for its natural and cultural beauty, so experience this for yourself during your climb of the mountain. The city of Huangshan has also been loved by poets and artists over thousands of years.

Day 9-11 - NanjingThe former capital of the Republic of China, Nanjing is still today now both a very powerful & modern day city. Second only to Shanghai in terms of economic output, it has numerous modern and historic sites, including a 600 year old city wall. Nanjing is full of excellent museums. Dragon Bus provide plenty of options here for you three (3) days and as the city is a great walking city we offer downloadable PDF walking guides. Some consider hiring a boat on the lovely and centrally located Xuanwu Lake and paddling their cares away. Purple Mountain is also a must do as is the Sun Yat Sen Mausoleum.

Day 12 - YangzhouSetting off after breakfast to another ancient & beautiful town in Yangzhou, one that is also off the ‘tourist’ trail. Yangzhou boats sites such as Slender Western Lake & Da Ming temple which is a Nan Dynasty tomb surrounded by some of the most beautiful gardens and canals you will witness. Yangzhou also boasts a worldwide famous rice dish, and has long been considered the best place in China to indulge in a foot massage, and of course we've found one that the groups normally head to after dinner.

Day 13-14 – Suzhou

Day 15 - ShanghaiTo finish off your tour, you have a free day to explore the many sights of this fantastic city. Take a trip to the world highest observation deck at the Shanghai Financial Tower at 474m up, wander down the pedestrian road on Nanjing Lu for some incredible shopping, take a walk along the Bund, or a boat ride on the Huangpu River.

For over twenty years now, the German state of Bavaria and the Chinese province of Shandong have enjoyed a cultural and economic partnership that has helped the people and products of both regions to flourish. The first Bavaria Shandong office first opened in Jinan in 1997, and relocated to

Qingdao in 2004, headed by a chief representative from Bavaria and charged with the task of bringing the regions closer together through student exchanges, joint ventures, trade delegations and more. Since 1 March 2010, the office has been led by Chief Representative Manuel Rimkus.

The ultimate goal of bringing the two regions ever closer together has two major facets. On the one hand, the office provides services to German companies in Shandong free of charge, connecting them with relevant bureaus and potential business partners to help their business flourish in China. At the same time, Mr. Rimkus promotes Bavaria's incredible tourism, education, culture and industry in order to encourage Chinese investment in the region.

There are currently a few projects in the works for the Bavaria Shandong Office. First, Bavaria's Minsiter-President Horst Seehofer was in Qingdao at the end of April to attend the Sino-German Cooperation Qingdao Summit, in a show of support for cooperation in new energy and other emerging industries. Mr. Rimkus hopes that the summit will

Mr. Rimkus thinks of this as coming 'mit Laptop und Lederhosen'; that is, emphasising the terrific high-tech investment and research opportunities, while also remaining firmly grounded in the region's rich cultural tradition.

But there are ongoing cultural endeavours as well. Bayerischer Rundfunk, the state-run television channel, is cooperating with Shandong TV to present an alternative view of China to the standard European focus on pollution and human rights; indeed, they are finding ways to communicate the country's creative side. And a particular passion of Mr. Rimkus is in encouraging cooperation at the level of individual projects and student exchanges, allowing for transfer of knowledge and experience.

南非世界杯巡礼Diego Benning Wang32 teams are competing in 2010 FIFA World Cup South Africa, evenly divided into 8 groups, each group consisting of teams from at least 3 different continents, as a result of FIFA’s new rules applied in the draft of the group divisions.

Group play takes a 'round-robin' format, where each team plays the other three teams in its group, and the two teams with highest scores will qualify for the 'knockout' quarterfinals, and semifinals, where a loss means that the team doesn't proceed to the next round. While every group has more geographical diversity than in the past, the group stage is generally expected to be a little less competitive than what we saw in the last 3 tournaments.

概况2010年南非世界杯共有来自世界各地的32支球队参加，分8个小组进行比赛。据国际足联分组新规则，每组最多2支欧洲球队，其他同一大洲球队不同组。

小组赛采用“单循环”赛制，同组四支队伍捉对厮杀，每组前两名获得出线资格，继续参加第二阶段的淘汰赛----1/8决赛、1/4决赛和半决赛，输的队伍将遭到淘汰。鉴于国际足联的分组新规则，小组赛各支球队来自不同大洲，相较前三届世界杯竞争小组赛出线权的残酷性略有下降。

Underdogs - South AfricaA seed team, thanks to South Africa’s host country status, the Bafana Bafana are actually one of the weakest teams of this World Cup Finals. Two of their three group opponents are former champions, the other one also a world-class team, South Africa aspires about going much further than any outsider could expects. The appointment of coach Carlos Alberto Perreira, whom, as coach, helped Brazil win its 4th World Cup title in 1994, changed this team's prospects.

Yet whether this team is enough to be considered a favorite for champions is still a misty question.

Hopeful Underdogs - Republic of KoreaThis summer, citizens of this country will certainly be cheering for their national team all around the neighbourhoods in Qingdao. But the World Cup Finals are a tough fight for anyone, and East Asian teams have historically struggled.

Great Expectations - EnglandEver since 1966, the Three Lions have voiced their fierce desire for another World Cup trophy. Ridiculous enough, the best result they have achieved since 1966 is a 4th place in 1990. This June, however, qualifying even the semi-finals would not be much of a problem for England.

Hopeful Underdogs - AlgeriaEven though some of France’s greatest players such as Zinedine Zidane, Karim Benzema and Samir Nasri are of Algerian descent, Les Fennecs (the Desert Foxes) are pretty much strangers to the World Cup (only entered twice, both times in the 1980s). Their performance in the African Nations Cup earlier this year only added to the mysteries surrounding this team. They beat Egypt to qualify; maybe they can become a legend in this World Cup.

Hopeful Underdogs - SerbiaThe Serbians’ talents for this sport have always been awed by other Europeans. The 2006 World Cup, however, was quite a pity for the Serbians as they lost all three group matches, including an aching 0 to 6 to Argentina. Dwarfing France in the qualifiers the same way they did to Spain 4 years ago, this time Serbia have more confidence in their group stage, and as luck has it they aren't in a 'group of death' this time around.

Hopeful Underdogs - Japan When Japan’s overly ambitious coach Takeshi Okada repeats his assertive wish to bring Japan to the semi-finals, he seems to have forgotten the fact that Japan has never won a single World Cup match played outside its own territory.

Great Expectations - Paraguay Finising the extremely intense South American qualifiers third place is definitely not an easy deal, as it was something even Argentina and Uruguay could not accomplish. Although Paraguay managed to maintain the consistancy of its performance, they deserve much more than ending up in 1/8 finals from each World Cup.

Hopeful Underdogs - SlovakiaThis is the first time for Slovakia to appear in trans-continental arena after the dissolution of Czechoslovakia in 1992. Although the team are not yet familiar to most fans, its supremacy through the qualification phase over Slovenia, close neighbor Czech Republic, and Eastern European rival Poland will give people some idea of the team’s actual strength.

Great Expectations - Portugal In 2002, the once beloved Golden Generation tragically failed their only World Cup. Their successors, however, ended up qualifying semi-finals in Germany 2006. Portugal nowadays are even stronger than 4 years ago; Cristiano Ronaldo’s leadership vibes, too, are more prevalant for the team.

Hopeful Underdogs - North Korea (DPRK) This is the second time in history that a team from North Korea has advanced to the World Cup Finals, the first being in 1966 when they knocked out favoured Italy before falling to Portugal 5-3 in a quarterfinal match that was hotter than anyone could have hoped. None of the players who participated in the East Asian Games last November will appear in the World Cup, so it's hard to know what to expect.

Hopeful Underdogs - HondurasEven though this Central American nation hasn’t established formal diplomatic relationships with China, the outstanding performance of the 4 Honduran players in China’s Super League has become quite a phenomenon. During the World Cup in South Africa, fans in China will surely be among the team’s warmest supporters.

Charlie's won Best Place to Watch Sports in REDSTAR's 2009

Bar and Nightlife Awards, mostly because they regularly put a

projection screen near the door for football and rugby matches

and everyone was always there. There may be far more places

to choose from this year, but Charlie's is always worth a visit.

This gorgeous beachfront wedding destination is making a

bid for music and sports as well! If there was anything visitors

would rather watch than the downtown skyline over the bay,

or the century-old German villa and beer garden, it's probably

football. Roland boasts a new chef and a newly-remodeled

exterior, so it'll be a great place to watch! Games until

midnight, please call ahead to confirm.

InterContinental has a bar! This smooth Latin-themed joint

promises to carry on the ICH Qingdao tradition of luxury, with

an oversize screen on hand for the games. Special Spanish

tapas and Caribbean cocktails will be heavily promoted during

the games! And rumour has it, Rumba is one of a few places in

town carrying the matches with English commentary.

During the 2006 Championship game, the atmosphere in

'French Bar' was electric as France and Italy battled it out on a

massive screen. Please call ahead to confirm.

Of all the bars in the city, ssLPG has been doing the most

to bring sporting events to the masses this year, piping in

everything from the American Super Bowl and Australian

Football League to F1 and International Cricket. You can bet

that this will be a brilliant place to watch the games, late into

the night, and most likely in English.

Pubs and football were made for each other apparently, and

the authentic British stylings of King's Head make it a great

place to see whether England will finally fulfill their dreams of

World Cup glory.

Capture the spirit of the 2010 FIFA World Cup season at Q Bar

of Shangri-La Hotel, Qingdao. Football fans can watch their

favourite teams play live daily. Enjoy the cool comforts with

the complete range of Tsingtao beers, and imported variety

such as Heineken, Carlsberg and Corona to name a few, as you

cheer your team on.

You know Korona for the grill and ice cream - now go for the

sports! Their upstairs ballroom has a projection screen set up

for the games, and they'll be offering drink specials, hot dogs,

chips and dip, and more. Closing time has been pushed back

for June, to accommodate the game schedule. Games until

midnight, please call ahead to confirm.

Always a hit for Premiership games, certainly the favoured

destination for English football fans living in Qingdao, and

always a great place to get a pint.

Always a cool place to hang out, the rooftop Mamahuhu Cafe

is probably the city's highest place to enjoy the games in the

company of friends! Beers are cheap, dumplings are delicious,

and the football action is guaranteed.

Projection screen in the bar, with cheap drinks, good grub and

other activities available for friends who aren't totally obsessed

with this international event. You can stay up until 2am

watching the game in a great bar, and then crash on a bunk in

the youth hostel for cheap. Make a reservation, though.

Darling Harbour is now open at the Olympic Sailing Center, and one of China's best-loved teppanyaki joints is open for business right near the entrance. This is Qingdao's second Tairyo Teppanyaki (the other one's at Polar Ocean World), very well appointed interior with private dining spaces and more communal tables, and like others in this high-profile all-you-can-eat chain they promise that "you'll stop before we do."

That's quite a claim. 'Teppanyaki' isn't just fun to say; it looks like hard work. As diners all over the world have learned since the cuisine was pioneered in the 1940s, it's practically dinner and a show in one, complete with open flames, knife-throwing and more. These chefs are masterful, and clearly have a good time putting food on the table.

The ingredients at Tairyo are not the cheap thrills like grilled zucchini and 'onion volcanoes' that many Westerners are used to in a teppanyaki experience. This is bone-in flank steak, scallops with sauteed garlic, fillets, lambchops, different kinds of bing, udon... in fact, the experience goes on until you throw in the towel and tell the chef to stop. And with delicious desserts to choose from, as well as free flowing beer and sake, it only costs 150元.

Dishes are available a la carte for light lunchers, starting around 40元 for a plate of meat (other things like noodles cost less). But unless you just really really like those little fillet cubes stir fried with onions, you might as well go for the full experience.

150元 anytime, including beer and sake and juice and anything else, 11:30am-10:30pm. Leave with enough time to go for a stroll, in the mall or on the bar street. Trust me. You'll stop before they do.

No. 27 café and restaurant has taken up residence in the space formerly occupied by HeHe Café. The café has been reimagined as a dimly lit multifunctional space with a screening room and private back room. Owner Andy Yun hopes to lure in a more discerning customer with his focus on the conceptual possibilities of the venue, determined to provide a markedly different experience than what can be found at the coffee shops lining nearby coffee & art street. “They are almost the same style,” he laments, “I don’t like that.” The menu offers a contrastingly less focused variety of Western-style dishes as well as South Asian, Korean and Japanese fare to please the diverse customer base and features the typical mishmash of Chinglish dishes such as the excitingly ambiguous “two stylized pizza.” An Americano costs 18元 and the café offers free refills. All sandwiches come with French fries and in a unique twist on complimentary dishes homemade yogurt is served with every meal. The café holds movie showings every Saturday and Sunday at 3pm, as well as Wednesday night at 7pm.

Customers who spend upwards of 120元 on one meal are able to reserve the screening room for an evening, although the space is used for free movie showings on the weekends open to all. The private back room is available for reservation by individuals or companies and is the perfect spot for parties and meetings with a built-in buffet banquette and intimate seating. Free wifi is available and there is a dedicated computer workstation for the discerning café workhorse. While there are no plans for the stage in the main dining area as this goes to print, Yun is hoping to bring musical acts to the space as soon as possible and is open to individuals and groups reserving the space if interested in performing.

The Diner brand is one of the strongest in Qingdao, with a dedicated following of Westerners, Koreans and Japanese. Looking to capitalize on that popularity, owner George Hu, who began the enterprise by setting up an SPR franchise in the space now occupied by his Coffee Spark almost ten years ago, and chef Leton decided to expand with a new restaurant, The Diner 22. In development since the middle of last year, the restaurant is a beautifully realized space that makes it clear the management wasn’t going for an authentic diner feel – much to the customer’s benefit. A Shanghai-based designer was hired to bring their plans to life, resulting in a modern space that offers a reprieve from the mishmash of poorly conceived imitators. “If you don’t look outside you could be in any country in the whole world,” notes Leton. The design isn’t the only thing setting this location apart from its sister in May 4th Square. The downstairs offers a bar-cum-café with a dedicated cocktail menu that’s impressive in its length, and the same coffee drinks available from Coffee Spark. Leton and Bobby, the bartender, are focusing on developing a bar menu that will be “like tapas, but in an American way.” New dishes are already available at this location and more will be introduced in the coming months. Leton’s mission, and he’s chosen to accept it, is to find and work with the highest quality ingredients available in Qingdao. Most vegetables are organic and imported from Japan, and the best cuts of meat are always used – a fact I can attest to as my Mexican-style steak was marinated to perfection and wonderfully tender. Other new dishes of note include the two-cheese ravioli in a broccoli pesto sauce and pecan-crusted chicken salad, served with blue cheese (blue cheese!) and a house dressing. All sauces and dressings are made in-house, and quality control is Leton’s priority. And, of course, the chocolate soufflé is still available and better than ever. But why twenty-two? Primarily because according to Chinese law, a business name must be at least three characters long, but also for increased recognition. “Numbers are the same in every language,” notes George - a smart thing to recognise for this multinational hotspot.

Meyer’s book, therefore, is akin to the obituary for a dearly departed city. This American lived in one of its old neighborhoods or hutongs. It featured romantic names, e.g. Tree of Heaven Lane. Meyer gamely endured the long walk to the crude toilet and befriended the residents such a former soldier and an old widow. While avoiding a dry history lesson, he recounts Beijing’s amazing past. For instance, in courtly imperial days, the emperor’s bird experts released trained fowl that flew elsewhere to pluck up rice in their beaks and then flapped back so the grain could be cooked. He also reviews the widow’s past as a lens on her urban home,. e.g. she came to Beijing at 15, survived the Japanese invasion, watched the communist triumph and suffered during the cultural revolution. Meyer sadly watches as real estate developers raze the old hutongs, replacing them with high rise office towers, apartment blocks and shopping malls. He quotes a powerful letter that middle school students wrote to the mayor that every city “must have its own culture and history.” Yes, admits Meyer, the living city has seen cycles of decay, loss and renewal before, but he laments that the hutongs – an intangible treasure -- are disappearing forever. Too committed to merely shed tears, Meyer now trains Chinese officials in preserving sites for the UNESCO world heritage list. However, too little is being done to save the neighborhoods. The writing, although rarely deep, reflects the author’s authentic experience and ability to observe, e.g., “The courtyard’s dying light turned a shade of black that terrified my students because it brought out the ghosts.”

is almost too perfect: South Africa's nearly all-white Springboks - hopeless underdogs in the 1995 Rugby World Cup - get unexpected backing from none other than Nelson Mandela (Morgan Freeman), who sees a chance for racial reconcilation.

There's more than a little sports-movie convention here, just with a Nobel Prize-winner as the "coach" spurring his boys to victory. Invictus is more distinctive for its exchanges between Mandela, Springboks captain François Pienaar (Matt Damon), the President's bodyguards, his advisers, Pienaar's family, and so on. They all have their say, but in declamatory, bold-faced words. Mandela in particular ponders and announces every decision, like a man aware of his own semi-mythical status. (It helps that Freeman could recite vacuum cleaner instructions and make it come off naturally.) The characters are recognizably human - one empathises with Mandela and Pienaar's uncertainties - but they're also historical roles in something bigger than Mandela, the Springboks or the film itself. This is more ambitious stuff than The Blind Side.

Eastwood oversells the finale, but it's less about the big game than the give-and-take of nation-building, and weighing little victories against big ones. The film is plainspoken but questions everything, including its own premises. It can play as naiveté or, if you prefer, self-parody, but it's a worked-through naiveté that doesn't take itself for granted.

China’s State Council last year issued the long awaited guidelines on foreign-invested partnerships, under State Council Order [2009] No. 567. The measures, which also apply to companies and individuals from Hong Kong, Macau and Taiwan, permit foreign companies or individuals to establish FIPs in China either by themselves or in partnerships with Chinese nationals, as of March 1, 2010.

The Chinese government is encouraging foreign investment in particular from entities or individuals possessing advanced technology and management experience. Below we detail these new measures.

StructureFIPs may be established by two or more foreign companies or individuals (a wholly foreign-owned FIP) or one or more foreign company or individual may establish a partnership with one or more Chinese company or individual (Sino-foreign FIP). A domestic partnership enterprise may be converted into an FIP through admission of a foreign partner.

Governing lawFIPs will be governed by the Partnership Enterprise Law of 2007 and shall follow pertinent industry investment policies, such as the foreign investment catalogue, administrative regulations, and provisions of the new regulations consistent with foreign investment industrial policies.

Capital contributionsCapital may be contributed by foreign capital injection or legally acquired RMB.

RegistrationForeign companies or individuals may assign an agent to register an FIP at local branches of the State Administration of Industry and Commerce. The FIP shall inform the local SAIC of any subsequent changes to the partnership structure of the FIP.

These measures now open another avenue for foreign direct investment into China, and join the list of applicable business structures. Previously, partnerships were restricted to domestic individuals and entities registered in China. Foreign investors may now consider using FIPs as an investment vehicle into China along with WFOE’s and Sino-foreign joint ventures.

The administration measures for the establishment of foreign-invested partnerships in China were outlined in State Administration of Industry and Commerce Circular [2010] No. 47.

Of note to foreign investors interested in FIPs are the following points.

Likely intentionsThe decree states that the government will encourage overseas companies and individuals to establish FIPs in China possessing “advanced technology” and “management experience.” It remains unclear how this will be determined. In previous cases, technologies are those determined by the Chinese state and are likely to be identified soon,

while “management experience” has in the past been linked to professional qualifications and years of service in a particular industry, supported by a curriculum vitae with additional supporting, original notarized references of work. Interestingly, the decree does state that partners must provide for a certificate of credit worthiness from a recognized financial institution.

This may be indicative that the focal introduction point for FIPs is in technical scientific research and development. The spin-off benefits of obtaining royalties and copyright from an investment into a FIP in terms of publishing research papers, related academic material and patents under an FIP structure would support this theory.

RestrictionsIn terms of restrictions, the decree notes that the current industry restrictions as applicable to foreign direct investment into China also apply to FIPs. The decree also notes that the following types of entities are forbidden to be partners in FIPs:

Publicly listed companies State-owned enterprises Government-sponsored public welfare institutionsOther social organizations involved in public welfare

The decree does not determine any difference between foreign and Chinese companies in the descriptions above, indicating again that private

scientific research and academic bodies are preferred, with the caveat they are not to interfere with, research or comment on aspect of China’s social model or structure.

InvestmentAt present, no specifics have been identified as to required capitalization of FIPs. It remains unclear as to any minimum capital requirements, or the nature of any in-kind contributions such as services, technology know-how, land use rights, IP rights may be classed as part of the investment. However, the decree does acknowledge the financing of FIPs by (freely) convertible foreign currencies or by legitimately obtained RMB (the latter requiring tax paid proof of prior declaration of earnings). This would seem to indicate that the partners themselves could determine the nature of the investment. However, should clarifications be made later to the nature of in-kind contributions, these may well point to the type of investment that FIPs are expected to cater for.

Also of note here is the specification in the decree of “investment focused FIPs,” which may well be of pertinence to financial institutions. The decree does specify that FIPs engaging in the “business of investments” should comply with relevant national regulations. Such a statement is indicative that the government expects some FIPs to be involved in such activities. It also goes on to mention that the Administration of Industry and Commerce at the provincial or city level shall be responsible for such registrations. This is significant as the decree appears to contradict China’s Measures on Foreign Invested Venture Capital Enterprises, issued in 2003, which states that such enterprises must be approved by the Ministry of Commerce and must provide capital to US$10million. Yet the decree makes no such capital specification for FIPs and permits approval by the SAIC instead at a local level. It is unclear whether the decree overrides the 2003 guidelines. If so, research houses for financial institutions may find the introduction of FIPs of significance.

资本认购外国企业或者个人用于出资的货币应当是可自由兑

换的外币，也可以是依法获得的人民币。

注册外国企业或者个人在中国境内设立合伙企业，应当

有全体合伙人指定的代表或者共同委托的代理人向国务院工商行政管理部门授权的地方工商行政管理部门申请设立登记。

按照法令规定，政府将鼓励拥有“先进技术”和“管理经验”的境外企业和个人组建外商投资合伙企业。但尚不清楚将如何规定。依据早前案例，中国政府会对“技术”尽快做出界定；对于“管理经验”在过去被界定为与专业资格和资质悠久的特殊行业服务挂钩，需要提供额外的履历表和原始的工作证明作为参考。有趣的是，法令规定合作伙伴必须提供经由金融机构认证的信用评估证书。

这就暗示了外商投资合伙企业的引进焦点是科学技术研究和发展。对于投资成为外商投资合伙企业的许可费和版权的利益分配将按照出版的研究报告进行，在外商投资合伙企业结构下的相关研究资料和专利权也支持这项理论。

没有规定最低限额限制，或实物出资，例如服务，专有技术，土地使用权，知识产权可能被纳入部分投资。不过，法令承认外商投资合伙企业的筹集资金可为自由兑换的外币或依法获得的人民币（后者需提供先前收入的纳税证明）。这似乎预示着合伙人可自行决定投资的性质。然而，稍后则需要阐明实物出资的性质，以便能够很好的指明外商投资合伙企业所期待的投资类型。

另外，对于“外商投资合伙企业的将投资重点”在法令中有着详细介绍，这很有可能与金融机构的针对性有关。该法令详细说明了外商投资合伙企业从事“商业投资”应符合国家有关规定。该项说法表明，政府期望部分外商投资合伙企业从事相关活动。同样规定中还提及省、市级工商行政部门应对登记的合伙企业负责。值得注意的是，这项法令似乎与中国对外商资本风险投资企业的规定有所违背。在2003年颁布的规定中表明，该类企业必须经过商务部批准且需提供1000万美元的注册资金。然而，该法令对外商投资合伙企业的注册资金没有详细说明，并且通过地方一级的工商管理部门即可进行审批而无需先前国家工商管理总局审批。目前尚不清楚该项法令是否是对2003年规定的重新改写。如果是这样的话，金融研究机构将会发现外商投资合伙企业引进的重大意义。
