Special Example of the Customs Fees shall be

established as follows:

The fee for license of incidental opening of

customs office shall be in accordance with the

followings from April 4, 1949 to April 30, 1949,

excluding the provisions of the Ministerial Or-

dinance concerning Customs Fees (Ministry of

Finance Ordinance No. 18 of 1949):

Ministry of Finance Ordinance No. 25

In accordance with the provisions of Article

19-(2), paragraph 2 and Article 28 of the Closed

Institutions Ordinance (Imperial Ordinance No.

74 of 1947), the Ministerial Ordinance concerning

special exception of the disposition of residual

assets of the Closed Institutions shall be establish-

ed as follows:

Ministerial Ordinance concerning special

exception of the disposition of residual

assets of the Closed Institutions

Article 1. The residual assets of the Closed

Institution, which is the incorporated as-

sociation without invested capital or the

foundational juridical person established in

accordance with the Civil Code (Law No. 89

1896), shall devolve on the persons designated

in the articles of incorporation or the act of

endowment of the said Closed Institution.

2 If no person on whom the residual assets is

to devolve is designated in the articles of

incorporation or the act of endowment of the

Closed Institution prescribed in the preceding

paragraph, the residual assets mentioned above

shall devolve on the National Treasury.

Article 2. The provisions of the preceding Article,

paragraph 1 shall apply mutatis mutandis to

the case of the devolution of the residual

assets of the Closed Institution which is not

a juridical person and has no invested capital

or contribution, or the Closed Institution

which has been established in accordance

with the provisions of special laws or or-

dinances and has no invested capital or con-

tribution.

2 In case there is no special provisions con-

cerning the devolution of the residual assets of

the Closed Institutions prescribed in the preced-

ing paragraph, the Special Liquidator (Tokushu

Seisan-nin) must distribute equally the residual

assets to the persons who were the members

of the said Closed Institutions on the desig-

nated day (provided that, with respect to the

institutions enumerated in the attached list

of the old Ministries of Finance, Foreign

Affairs, Home Affairs and Justice Ordinance

No. 1 of 1945, the day read in accordance

with the provisions of paragraph 6 of Supple-

mentary Provisions of the Ordinance) pre-

scribed in Article 3, paragraph 1 of the

Closed Institutions Ordinance (Imperial Or-

dinance No. 74 of 1947; hereinafter referred

to as the Ordinance).

3 In case the Special Liquidator (Tokushu

Seisan-nin) deems it very unfair to distribute

equally residual assets in accordance with the

provisions of the preceding- paragraph, he .

may distribute residual assets in the different

method from' the method prescribed in the

preceding: paragraph, with the approval of,

the Minister of Finance, notwithstanding the '

provisions of the preceding paragraph.

Article 3. In case the Closed Institution has

been established in accordance with-the pro-

visions of special laws or ordinances and

there are the special provisions concerning

disposition of residual assets in them, the

Special Liquidator (Tokushu Seisan-nin) must

dispose of the residual assets in accordance

with the said provisions, unless otherwise

provided by the Minister of Finance, notwith-

standing the provisions of Article 19-(2),

paragraph 1 of the Ordinance and preceding

Article.

Article 4. In case the Closed Institution iss

1 pf the Commercial Code (Law No. 48 of 1899),

ing the provisions of Article 19-(2), paragraph

1 of the Ordinance.

Supplementary Provision:

This Ministerial Ordinance shall come into

force as from the day of its promulgation.
