als or officialrepresentatives abroad.

Supplementary Provision:

Supplementary Provisions:

1 This Regulation shall come into force as from

the day of its promulgation.

2 Concerning Exports and Receipt of Payment

for Invisible Trade, the provisions before this

amendment shall have validity after the enforce-

ment of this Regulation; provided that foreign

means of payment through Hong Kong-Japan

Open Account is received.

3 Concerning Imports and Payment for Invisible

Trade, the provisions before this amendment

shall have validity after the enforcement of this

Regulation- until September 20, 1951; provided

The Procedure Regulations for Designation,

Release, etc. of Protection Forests and Protection

Facilities Areas shall be established as follows:

Release, etc. of Protection Forest and

Protection Facilities Area

Article 1. Protection forests shall be classifiedinto

the following seventeen types and designated,

according to their object:

(1) Water resources forest;

( 2 ) Sand and stone avalanche prevention forest;

( 3 ) Erosion control forest;

(4) Falling stone prevention forest:

( 5 ) Wind-breakage forest;

( 6 ) Flood control forest;

( 7 ) Tide prevention forest;

( 8 ) Draught prevention forest;

( 9 ) Snow prevention forest;

(10) Mist prevention forest;

(11) Snow avalanche prevention forest;

(12) Falling rocks prevention forest;

(13) Fire prevention forest;

(14) Fish shelter forest;

(15) Navigation target forest;

(16) Recreation forest;

(17) Scenic beauty forest.

Article 2. An application for designation of pro

tection forests to be submitted in accordance Witt

the provisions of Art. 27 of the Forest Law (Law

No. 249 of 1951; hereinafter referred to as " the

Law") or an application for release of protec

tion forests to be forwarded in accordance wit!

the provisions of par. 3 of the same Article shal

be accompanied by the following documents:

(1) Protection forest designation survey shee-

or protection forest release survey sheet;

(2) Protection forest designation survey map oa

(3) Protection forest location map.

Article 3. Notification in accordance with the pro-

visions of Art. 30 of the Law shall be made by-

publication in the prefectural gazette.

Article 4. The governor of To, Do, Fu or pre-

fecture in case where he has made a notification

in accordance with the provision of Art. 30 of

the Law with respect to the protection forests

under Art. 1 items (1) to (3) inclusive, shall

submit a copy thereof to the Minister of Agri-

culture and Forestry without delay.

Article 5. The governor of To, Do, Fu or pre-

fecture, in case where the written opinion relative

to designation or release of protection forest

under Art. 1 items (1) to (3) inclusive in accord-

ance with the provision of Art. 32 par. 1 of the

Law has been submitted to him, shall send it

accompanied by his written opinion to the

Minister of Agriculture and Forestry without

delay.

Article 6. Public notice under Art. 32 par. 3 of

the Law which shall b3 made by the governor

of To, To, Fu or prefecture in accordance with

the provision of the Enforcement1 Ordinance for

Forest Law (Cabinet Order No. 276 of 1951)

shall be made by publication in the prefectural

gazette as well as by posting the sam? at the

entrance of offices of cities, towns or villages

concerned and public hearing meeting hall.

Article 7. The governor of To, Do, Fu or pre-

fecture shall prepare a documant stating impor-

tant mattar3 regarding the progress of the

public hearing meeting.

Article 8. The order under Art. 33 of the Law

shall be issued by sending the written order for

reforestation or the writtan order for rehabilita-

tion.

2 The governor of To, Do, Fu or prefecture in

case where he issued the order under Art. 38 of

the Law, shall report thereof with a document

to the Minister of Agriculture and Forestry.

Article 9. Protection facilities work provided for

in Art. 41 par. 2 of ths Law shall be classified

into six as follows:

Forest devastation rehabilitationwork

Forest devastation prevention work;

Watershed development work;

(4) Seashore sand dune afforestation work;

(5) Disaster prevention forest development

work;

(6) Protection forest improvement work.

Article 10. The governor of To, Do, Fu or pre-

fecture in case where he intends to Apply for

designation by the Minister of Agriculture and

Forestry under Art. 41 of the Law shall submit

a written application accompanied by the follow-

ing documents to the same Minister:

(1) Protection facilities area designation survey

sheet;

(2) Protection facilities area survey map;

(3) Forest within protection facilities area

survey sheet;

(4) Protection facilities area location map.

Article 11. The governor of To, Do, Pu or pre-

fecture, in case where he deems in necessary to

extend the period of validity for designation of

protection facilities area, shall submit a written

application to the Minister of Agriculture and

Forestry not later than four months before the

expiration of that period.

Article 12. The governor of To, Do, Fu or pre-

fecture in case where he completed the protec-

tion facilities work in the protection facilities

area, shall report to that effect to the Minister

of Agriculture and Forestry without delay.

Article 13. The governor of To, Do, Fu or pre-

fecture in case where he intends to discontinue

the protection facilities work, shall report to

th#t effect with a document to the Minister of

Agriculture and Forestry without delay.

Article 14. The governor of To, Do, Fu or pre-

fecture shall prepare the protection forest regis-

tration book and the protection facilities area

registration book and preserve them, keeping them

separated into the section of national forests and

that of private forests.

Article 15. The forms of the following documents

shall be prescribed separately:

(1) Protection forest designation survey sheet,

protection forest release survey sheet, protec-

tion forest designation survey map, and pro-

tection forest release survey map;

(2) Forms of notifications under the provisions

of Articles 30 and 32 of the Law;

(3) Written order for reforestation and writter

order for rehabilitation;

(4) Document mentioned in Art. 8 par. 2;

(5) Protection facilities area designation survey

(6) Written application msntioned in Art. 11;

(7) Document mentioned in Art. 13;

Reason:

The appeal is summarized as follows:

The New East Company applied to the Minister

of International Trade and Industry on June 27,

1951 for a registration as a SPS in compliance

with the Articles 3 and 4 of the Regulation for

Distribution of Designated Daily Necessities (here-

inafter referred to as the Regulation). The appli-

cant was informed on July 10, that the application

was rejected, but is not satisfied because the Com-

pany met qualifications provided for in the Article

5 of the Regulation.

Investigations revealed that:

The applicant declared the capital to be §25,000

on the application, but such declaration was not

backed by any sufficient proof. Besides, seeing

from the balance in the Convertible Account with

Tokyo Bank, the correspondent bark of the appli-

cant, the applicant was recognized net sound

enough in financial abilities.

Therefore, the appeal is recognized to be not

reasonable and decision is made as aforementioned.
