Subject: - Hiring of manpower Semi-Skilled & Un-Skilled for Doordarshan Kendra,Patna.

Sir,The undersigned is directed to state that this office is interested in having

contractual arrangement with a suitable placement agency for out sourcing service ofmanpower (Semi-Skilled) for DDK, Patna on monthly contract basis as per the terms &conditions mentioned in Annexure-I.

Interested agencies submit competitive offer along with the bid Security Depositof Rs. 5000/ - (Five Thousand only) by way of account payee Demand Draft from any ofthe Nationalized banks in an acceptable format in favour of DDO, Doordarshan Kendra,Patna payable at Patna addressed to the Station Director, Doordarshan Kendra, Patna-800001,so as to reach on or before 27.07.2016before 1500Hrs.

PROCEDURE FOR SUBMISSION OF SEALEDTENDERS:The tenderer must deposit their tender papers in "tender box" at the gate of DDK,

Patna as required in two parts in separate sealed covers prominently super-scribed asindicating on each of the cover, tender no. and date and time as mentioned above .

./ Cover-I: Following Item should be kept in First envelope.

BID SECURITY (BS): Bid security of Rs. 5000/- (Five thousand) only as mentionedabove shall be placed in cover-I BS furnished by all unsuccessful tenders shall berefunded normally within one week of acceptance of award of work to successfultender er. BS shall not carry any interest. BS by the tender er will be forfeited if thetenderer revokes his tender within the validity period or increases his earlier quotedrates or the tenderer doesn't commence the work within the 15 days after award of theorder. The quotations are liable to be rejected if submitted without exact amount ofEMD/BS at the time of opening the Tech. Bids.

Performance Security Deposit: Shall be furnished by the successful tenderer @ 10% ofthe total value of the Order/Contract in the form of an Account payee Demand Draftonly from a Nationalized Bank in acceptable format in fa~our of DDO, Doordarshan

TECHNICAL BID (TB): All technical details for the scope of work, the complete detailsregarding essential qualification as asked for under qualifying requirements, deviationsif any etc, shall be enclosed in Part-E/Technical Bid along with the copy of tenderspecifications and with other annexure duly signed and stamped as a token oracceptance of tender condition .

./ Cover-Ill: Following items should be kept in Third envelope.

PRICE BID (PB):Tenderer any please note that the prices shall be submitted as per DDPrice Format enclosed (Annexure-Ill).

These three separate covers i.e.: Cover-I, Il & III shall together be enclosed in a fourthenvelope and this sealed cover shall be super-scribed with tender no. due date and timesubmitted to this office.Envelope should have inscription as "Contract for providing required manpower forDDK, Patna, Quotations not received in time with the above are liable to be rejected.Technical Bids shall be opened on in the presence of tenderers who may be present atthat time. Price bids of the eligible bidders shall be opened 28.07.2016 at 1500 Hrs in thepresence of tenderers. Tenders received late will not be considered.

General Terms and Condition:1. Period: Initially for One year, Contract may be extended further for the period of

one year or its parts mutually agreed by DDK, Patna & Contractor, if the servicesof the Contractor are found to be satisfactory.

2. The agency should make available sufficient number of candidates for theirScreening/Interview /Selection out of whom the duly constituted ScreeningCommittee in the 0/0. the Director, Doordarshan Kendra, Patna will select thesuitable candidates for the job. The time, Date and Venues etc. for the screeningwill be intimated later.

3. Security Considerations: The person supplied by the agency should not have anyPolice records/Criminal cases against them. In order to ensure this the agencyshould get the character and antecedents of the persons selected by the ScreeningCommittee verified from the respective police stations.

4. Period within which the manpower is to be supplied. (Within 15 days of Award ofContract).

TERMS & CONDITIONS: As at Annexure-I

1. The tenders will fill up the technical information in Annexure-Il and FinancialInformation in Annexure-Ill. Financial information shall include rates inclusive ofall charges/service tax etc., based on minimum wages payable to Semi Skilled(DEO) and Un-Skilled manpower services under the minimum wages Act asnotified by Govt. of Delhi and revision in the same subsequently shall be applicableas and when the Govt. of Delhi notifies any changes in such rules. It will be theresponsibility of the bidder (in the event of contract being awarded of him/her)that he intimates such changes to The Director, Doordarshan Kendra, Patna fornecessary action. Both the annexure may be put in a separate cover whilesubmitting the proposal to this office.

2. The successful bidder will have to .enter into an agreement with The Director,Doordarshan Kendra, Patna, a copy of which will be made available to thesuccessful tenderer on award of the contract.

3. The decision of The Director, Doordarshan Kendra, Patna to reject/ accept anytender bid shall be final and no grievance will be entertained in this regard.

4. If at any stage of the processing of the bidding/ finalization of the contract, duringthe period implementation of the contract or even after expiry of the terms ortermination of the contract if found that the concerned Agency/bidder has/ hadfurnished false information/ document(s) or with held some vitalinformation/ document(s) or the service of the personnel(s) have not been providedto the utmost satisfaction of this office and as per relevant statutory provisions, thecontract will be cancelled and the concerned authority shall be asked to take liablenecessary penal action against the Agency/Bidder as per relevant/statutoryinstructions/ orders.

5. The tenderer should enclose copies of PAN No, S.Tax No, ESI no, and PF no andother documents along with Tender document /Tech Bid.

6. Doordarshan Kendra, Patna reserves the right to add or modify, delete any portionof this document by issuance of corrigendum which would be published on theDoordarshan Kendra, Patna website, at any time period to deadline for submissionof proposal.

Terms of Payment: Payment will made by this office by Cheque /RTGS /NEFT onmonthly basis on satisfactory completion of work.

No advance payments will be made.

Annexure-I

Scope of Work[ferms and Conditions

DDK, Patna is interested to award contract for 1 year for hiring Semi Skilled manpowerservices required to work in office/ technical area of Doordarshan Kendra, Patna whereelectrical equipments are installed. Tenderer are invited in 2 bid pattern i.e. technical &financial bid separately.

GENERAL:-1.1 Eligibility Condition: Tenderer should have a minimum of two years of experiencein this field of providing at least 200man-day per month.

1.2 The tender er must submit the following documents along with tender, failing whichthe offer will be treated as incomplete and summarily rejected :-

a) A copy of this tender document duly signed by bidder or representatives of bidder ineach page with company stamped at the bottom is to be submitted by the tenderer astoken of acceptance of all the terms and conditions of the tender. Authorization letterin r/o representatives should also be enclosed if documents are signed byrepresentatives.

b) The bidders have to provide documentary proof of providing at least 200 man daysper month, man power for a period of 1 year total man-day during the year should bemore than 2000.

c) Self attested copies of the latest income-tax clearance and service tax registrationcertificates in the performa prescribed by the Government should accompany thetender. The certificates should be in the name of the firm/ individual quoting for thetender.

d) Draft of Rs. 5,000/ - in favour of DDO, Doordarshan Kendra, Patna payable at Patnaas Earnest Money Deposit (EMD),Only draft is acceptable.

e) The offer of the firm shall be signed in ink on each page by the bidder or itsrepresentatives duly authorized.

g) In case of tie, bidder will be judged based on length of experience of service providedto government organization in past lowest quote. The bidder will be decided by adraw of lottery (preferably in presence of tenderers) if tie in experience & quote isfound again.

2. The Semi-Skilled (Data Entry Operator) manpower services will be required to assistOfficeAsstt./Programme Officers for mainly typing jobs of office records, formationof cue sheet, typing of contract forms of Artists, etc. They required to perform duty onround the clock shift basis if required. The normal duty hours shall be for 8 hours andit will called one man day.

3. Deployment will vary as per the requirement of this office.

4. If the firm fails to provide Semi-Skilled manpower services in accordance with thescope of work, DDK, Patna reserves the right to cancel the order and get the workdone on risk & cost of the contractor.

5. Tenderer shall insure their staff personnel deputed for working at DDK, Patna againstall risk and related charges of insurance shall be borne by the firm and no .extrapayment shall be made by DDK,Patna to the firm.

6. All the liabilities relating to staff personnel deputed by tenderers like welfare,compensation during work in shift etc. shall be of the contractor and no extrapayment will be made by the DDK, Patna to the firm. The Contractor shall indemnifyDDK, Patna against all claims and losses under various labour laws, statutes or anycivil or criminal law in connection with employees deployed by him.

7. DDK, Patna shall have right to deduct, from the payment due to the contractor, anysum required or estimate to be required for making good the loss suffered by aworkers by reasons of non-fulfillment of the condition of the contract for the workers,non-payment of wages or of deductions made from his or their wages, which are notjustified by their terms of the contract or non-observance of the regulations.

8. To assess the nature of work, firm may visit site on any working day between 930-1800 Hrs.

9. The manpower on duty will report to the authorized DDK, Patna officer nominatedby the Director, Doordarshan Kendra, Patna to take necessary instructions requiredfor working at DDK, Patna.

10.The liability for any compensation on account of injury sustained by an employee ofthe contractor will be exclusively that of the contractor.

11. The contract shall be valid for a period of 1 year (12 months) after award of workand the Director, Doordarshan Kendra, Patna may extend at his discretion thecontract of manpower for a period of 1 year or its part on the same terms andconditions. The Director, Doordarshan Kendra, Patna reserves the right to terminatethe contract without assigning any reason during the prevalence of contract period bygiving a 30 days notice to the contractor in writing.

12. All disputes arising in connection with the contract shall be settled in mutualconsulation. If no agreement is reached the dispute shall be settle in accordance withthe provisions of the Arbitration and Conciliation Act'1966 and the rules made thereund er. The dispute shall be referred for arbitration to any arbitrator to be appointedby the head of the organization. The award of the arbitrator shall be final andbindings on both the parties. The venue of the Arbitration shall be Patna in India. Theaward to be given by the Arbitration shall be speaking award. All questions, disputes,difference arising under or in connection with this contract shall be to the exclusivejurisdiction of Patna Courts.

13. The Director, Doordarshan Kendra, Patna may dismiss or remove from the site ofwork, any person or persons, provided by contracted service provider, if found to beincompetent or not conduct himself/herself properly and service provider shallforthwith comply with such requirements without any precondition.

14. The Identity Card for carrying out the work shall be provided by the Agency forworking in the office of The Director, Doordarshan Kendra, Patna. These cards are tobe constantly displayed by person engaged by agency to perform work inDoordarshan Kendra, Patna along with photo ID card issued by the Contractor andtheir loss should be reported immediately to the police station and on production ofthe FIRnew Identity Card will be issued as per rules.

15. The Un-Skilled workers are required to perform all such duties expected of amessenger including serving teal coffee/ drinking water etc. to other staff on duty inthe Unit/Branch/Studio where they are deployed.

16. The service provider shall replace immediately any of its personnel if foundunacceptable to the office because of security risk, incompetence, conflict of interestand breach of confidentially or improper conduct upon receiving written notice fromthe officewhere deployed.

17. The office shall not be liable for any loss, damage, theft, burglary or robbery of anypersonal belongings, equipments or vehicles of the personal of the service provider.

18. The service provider's personnel should be polite, cordial, positive, efficient andwear uniform provided by the firm/ agencies while handling the assigned work andtheir action shall promote good will and enhance the image of this office. The serviceprovider shall be responsible for any act of indiscipline on the part of personsdeployed by him.

19. The service provider shall not assign, transfer, pledge or sub contract theperformance of services without the prior written consent of this office.

20. The Service provider's personnel shall not divulge or disclose to any person, anydetail of office, operational process, technical know-how, security arrangements, andadministrative/ organizational matters as all are of confidential/ secret nature.

21. The service providers shall not claim any benefit/ compensation/ absorption/regularization of services with office under the provision of Industrial Dispute Act,1947 or Contract Labour (Regularization & Abolition) Act, 1970. Undertaking fromthe person to this effect will be required to be submitted by the service provider tothis office.

22. The person deployed shall not claim any Master & Servant relationship against thisoffice.

23. The Service provider shall ensure deployment of suitable persons from properbackground after investigation by the local police, collecting proofs of identity likedriving license, bank account details, previous work experience, proof of residence

and recent photograph and withdraw such employees who are not found suitable bythis office for any reason immediately on receipt of such a request.

24. The service provider shall ensure proper conduct of his person in office premises,and enforce prohibition of consumption of alcoholic drinks, chewing paan, smoking,loitering without work.

25. The service provider shall engage the necessary person required by this office fromtime to time. The said persons engaged by the service provider shall be the employeesof the service provider and it shall be duty of the service provider to pay their salaryevery month.

26. The transportation, food, medical and other statutory requirement in respect of eachpersonnel of the service provider will be the responsibility of the service provider.

27. The service provider will submit the bill in the triplicate in the 2nd week ofsucceeding month. Thereafter, the payment will be released by the last week of thefollowing month.

28.The service provider shall provide approved no. of man power during valid contractperiod. Office will not pay any extra amount for over lapping etc. However over staywill be compensated on pro-rate basis.

29. The service provider shall be responsible for contributions towards Provident Fund,Employees State Insurance and other statutory payments/liabilities etc., whereverapplicable.

30. Payments to the service provider would be strictly on the basis of Bio-Metricattendance and certification by the officer, with whom the concerned persons isattached, that his services were satisfactory and attendance as per the bill preferredby the service provider. The Agency's workers will work under the overallsupervision and direction of the authorized Officer of this unit/wing.

31. The service provider shall be contactable at all times and message sent by emailjFax/ Special Messenger from this unit/ wing to the service provider shall beacknowledged immediately on receipt.

32. The agency should be registered as and when required with the concerned Govt.Authorities, i.e. Labour Commissioner. Provident Fund Authorities, Employees StateInsurance Corporation, authority concerned with the Service Tax etc., and a copy ofthe registration should be submitted. The service provider shall be responsible fordeposition of payment of contribution made towards Provident Fund, EmployeeState Insurance, Service Tax etc. and bear all other similar financial and statutoryliabilities as per provisions of EPF Act, ESI Act, Minimum wages Act, ContractLabour (Regulation and Abolition) Act, etc. as and when required, in respect of alloutsourced personnel wherever applicable and provide copies of receipt/ challan ofdeduction/ amount deducted deposited with concerned authorities.

33. Payment of the service provider would be made only after verification or requisitedocuments towards deposition of payment of contribution for EPF, ESI& Service Taxetc.

34: Escalation clause shall not be accepted on any ground during the period the contractis in force except whenever the same is required to be allowed keeping in view therevision of rate of minimum wages ( in compliance with the provision of MinimumWages Act) as notified by the Govt. of Bihar from time to time.

35. The award of the contract will be subject to the fulfillment of the conditions laiddown in Rules 157,158and 160of GFR,2005as amended time to time.

36. Service provider shall have sufficient reserve for man power since DDK, Patna issensitive organization, service provider should rotate service personnel at suitableinterval of 1 to 2 months.

37. Contractor should be financially sound. He should have sufficient resources ofmoney so that it can make payment to its employee in case office fails to makepayment for three months to contractor due to unavoidable reasons.
