J U D G M E N T

GOLDSTONE, J : (20)

The five applicants have approached the Court urgently

for relief against the three respondents. The relief relates _

to and arises from events which have occurred in the residen­

tial townships of Kagiso I, Kagiso II and Munsieville in thet

district of Krugersdorp. Allegations have been made concer­

ning the conduct there of members of the South African

Police and the South African Defence Force. The allegations

are of a particularly grave nature and appear from over orte hundred

affidavits filed of record. The papers were served on the

respondents on Thursday. In the time available since then it

would/l

would have been quite impossible for the facts alleged by

the applicants to have been considered, investigated and

answered on oath by the respondents. It has been agreed by

the parties that a period of two weeks from today would be a reason­

able time for that to be done.

Pending the filing of affidavits and the hearing of

this application, Counsel respectively for the Minister of

Law and Order and for the Minister of Defence have been

authorised to give undertakings on their behalf in the

following terms:

' “The Minister of Law and Order has authorised his

Counsel to state the following: The application papers

in this application are voluminous and the application

is brought as a matter of urgency, and it has not been

possible in the short time available to investigate all

the allegations. Those allegations which have been

investigated, appear to be unfounded and are particular­

ly denied. All the allegations are denied and the

undertaking below is given in the urgent circumstances

and without admission of any of the allegations and(20;

reserving all the Minister's rights. The Minister of

Law and Order has taken note of the allegations and

regards them in a serious light. The Minister gives the

undertaking that he will instruct a Senior Police

Officer/s who are not connected with the West Rand

Division of the South African Police to investigate the

allegations and undertakes further that he will instruct

the necessary Senior Police Officers to issue instruc­

tions to all Police in the West Rand Division not to

(30commit unlawful acts."

C1 7 . 3 - JUDGMENT ^

The following is the undertaking which Counsel for the

Minister of Defence is authorised to give:

"The application papers in this application are volumi­

nous and the application is brought as a matter of

urgency and it has not been possible in the short time

available to investigate all the allegations. Those

allegations which have been investigated appear to be

unfounded and are particularly denied. All the allega­

tions are denied and the undertaking below is given in

the urgent circumstances and without admission of any(10)

of the allegations and reserving all the Minister's

rights. It is the Defence Force's policy and instruc­

tions to its members that at all times they must act

with proper discipline, lawfully and with proper consi­

deration of the facts in each case; that they must act

in accordance with good human relationships and with

the minimum- force essential to prevent and combat

unrest. The Minister of Defence undertakes that the

Defence Force will in future act in the same lawful

manner as heretofor, and undertakes to act in the(20)

manner set out in the prayers to the matters of motion."

This matter having been called in open Court, would normally

have the consequence that the papers filed in record are

public documents and available as such. In the present case

the allegations made against the South African Police and

the South African Defence Force are of such a nature that

all parties have agreed that it would be unfair and could

result in irreparable prejudice if they were to be made

public prior to their proper investigation and the respon­

dents being afforded an opportunity of answering them. For(30.

that reason all the parties have agreed that the Court

should place an embargo on the documents filed to date until

the matter again comes before the Court. This is a most

unusual procedure and one not lightly implemented. The fact

that all the parties before the Court, and particularly the

applicants, are in agreement with such procedure makes it possi­

ble to do so.

I would like to express the Court's appreciation to all

Counsel for their co-operation and the responsible manner in

which this application has been handled by them. The underta- (10)

kings are noted by the Court; the application is postponed

to 18 March 1986. Costs of today are reserved.

The documents filed of record are to remain private and

confidential and the press and the parties are ordered to

act accordingly. This confidentiality is to remain in force

until the matter again comes before the Court.

r o a d f r o m the l i q u o r s t o r e .

On F r i d a y the 2 1 s t F e b r u a r y 1 9 8 6 at abo u t

lpm. I left the l i q u o r s t o r e to go to the

m a r k e t to buy v e g e t a b l e s for the said fruit

stor e , a n d s a w two b l a c k p e r s o n s w a l k i n g

a b o u t at the o p p o s i t e e n d of a SA B r e w e r y

t r u c k w h i c h was p a r k e d o u t s i d e the l i q u o r

store, o f f - l o a d i n g l i q u o r .

F r o m the i r b e h a v i o u r it a p p e a r e d to me t h a t

t h e y m i g h t be g u a r d i n g the t r uck, b u t as they

w e r e in p l a i n c l o t h e s , a n d r a t h e r s c r u f f i l y

d r e s s e d , I c o u l d n o t t e l l w h e t h e r t h e y were

p o l i c e m e n or not.

As I w a s a p p r o a c h i n g the e n t r a n c e of the

b o t t l e store, I saw the t w o p e r s o n s I had

p r e v i o u s l y seen a p p e a r i n g to be g u a r d i n g the

SA B r e w e r i e s truck, w a l k i n g a l o n g the v e r a n ­

d a h o u t s i d e the l i q u o r stor e , w i t h a y o u t h

b e t w e e n them, w h o w a s b e i n g h e l d by e a c h of

the men. by his c o llar.

O n e of the men w a s w e a r i n g a s m a l l c a p and

the o t h e r a l u m b e r j a cket.

At t h i s stage I w a s w a l k i n g r i g h t b e h i n d t h e m

a n d as th e y e n t e r e d t h e l i q u o r s t o r e I saw

t h a t e a c h one w a s h o l d i n g a h a n d g u n in his

o t h e r hand. J u s t a f t e r t h e y had e n t e r e d the

shop, the p e r s o n w e a r i n g the c a p l e t go of

t h e y o u t h ' s c o l l a r a n d w h i l s t s h o u t i n g at the

y o u t h in S o t h o t h a t " t h i s n o n s e n s e of you r s

b u r n i n g t h i n g s m u s t e n d " , h i t him w i t h his

o p e n ha n d in the face.

At a b o u t this time I m o v e d a r o u n d to face the

t h r e e of th e m as I w a s c u r i o u s to see if I

k n e w the y o u t h a n d s a w t h a t he w a s c a r r y i n g

two p l a s t i c b a g s and th a t in the o n e bag were

two b o t t l e s w h i c h a p p e a r e d to c o n t a i n petrol

a n d in the o t her, o n e s u c h b o t t l e .

I i m m e d i a t e l y to o k a s t e p or two back.

T h e two p o l i c e m e n t h e n b o t h r a i s e d the i r

h a n d g u n s and p o i n t e d t h e i r g u n s at the o p p o ­

s i t e si d e of the y o u t h ' s jaws.

T h e y w e r e all s t a n d i n g f a c i n g in more or less

the same d i r e c t i o n , the m a n w i t h the l u mber

j a c k e t ( h a v i n g let go of the y o u t h ' s c o l l a r

s t a n d i n g ) on the r i g h t h a n d s i d e of the y o u t h

p o i n t i n g the h a n d g u n w h i c h w a s he l d r i g h t

n e x t to his jaw, at the b a c k o f h i s jaw in

m o r e or le s s the sa m e d i r e c t i o n t h e y were

s t a n d i n g and the o t h e r man, w i t h the cap,

h o l d i n g his h a n d g u n in a s i m i l a r p o s i t i o n and

d i r e c t i o n , b u t p o i n t e d at t h e b a c k o f the

l e f t ha n d side jaw of the y o u t h .

I c o u l d see that the y o u t h w a s b l e e d i n g from

a w o u n d on the le f t h a n d s i d e of his jaw,

w h e r e the h a n d g u n h e l d by the man w e a r i n g the

c a p had be e n p o i n t e d at.

At the time the s h o t w e n t off, I c o u l d not

tell w h o had p u l l e d the t r i g g e r a n d it was

o n l y a f t e r I s a w the b l o o d t h a t I c o n c l u d e d

t h a t it mu s t have b e e n the m a n w e a r i n g the

cap.

I a l s o n o t i c e d th a t t h e g l a s s o f a fridge

doo r , w h i c h w a s just b e h i n d the ti l l a n d in

f r o n t of the t h r e e m e n h a d b e e n s hattered,

a p p a r e n t l y by the s a m e b u l l e t t h a t the y o u t h

h a d be e n sh o t with.

At the time the s h o t w e n t of f , the y o u t h w a s

n o t s t r u g g l i n g in a n y m a n n e r a n d w a s s t a n d i n g

q u i e t l y a n d c a l m l y b e t w e e n t h e two men.

On F r i d a y the 21st F e b r u a r y 1986, a p p r o x i ­

m a t e l y b e t w e e n 3.30 a n d 4pm. I s a w two b l a c k

men, the one w e a r i n g a l u m b e r j a c k e t and the

o t h e r w e a r i n g a c a p e n t e r i n g a l i q u o r store

w i t h a .young man, w h o m t h e y w e r e h o l d i n g by

his c o l l a r . The y o uth, w h o m I jud g e to be

a b o u t 15 or 16 y e a r s old, w a s w a l k i n g b e t w e e n

the two of t h e m in t h i s m a n n e r .

I h a d seen t h e s e two m e n e a r l i e r that m o r n ­

ing, at a b o u t 9 . 3 0 am. w h e n o n e of them, w h o

w a s w e a r i n g a c a p had b o u g h t six b e e r s from

me. I n o t i c e d at the t i m e t h a t the o t h e r

s a i d p e r s o n w e a r i n g the l u m b e r j a c k e t was

w a i t i n g at the d o or, j u s t o u t s i d e the liqu o r

store, for the p e r s o n W i t h the cap.

beers, after w h i c h he a g a i n w e n t outside.

I have read the a f f i d a v i t of L O U I S K A L E K H U T L E

and c o n f i r m his d e s c r i p t i o n of the e v e n t s

t h a t t o o k pla c e a f t e r the two m e n e n t e r e d the

b o t t l e store w i t h the y o u t h as b e i n g c o r r e c t

a n d a c c u r a t e a n d f u r t h e r , s a v e for w h a t is

s t a t e d below, saw and h e a r d e v e r y t h i n g that

he s a y s he saw and h e a r d .

J u s t a f t e r the man w i t h the c a p had a s k e d the

y o u t h w h a t he w a s g o i n g to do w i t h the petrol

b o m b s my a t t e n t i o n w a s d i v e r t e d by a c l i e n t I

had to a t t e n d to a n d w h o h a d a s k e d for some

b e e r s .

In r e s p o n s e thereto, I o p e n e d the frid g e do o r

of the f r idge w h e r e the b e e r s w e r e kept, and

a s I d i d so, I h e a r d a s h o t go o f f and saw

a n d h e a r d the g l a s s of the f r i d g e d o o r I had

j u s t o p e n e d s h atter, a p p a r e n t l y as a r e s u l t

of b e i n g hit a b u l l e t w h i c h m u s t h a v e been

f i r e d w i t h the sh o t t h a t w e n t off.
