Tembe, who took over as the metro police chieflate last year, is also being investigated for al- legedly tampering with the supply chain management processes. He allegedly changed the specifications on the procurement of uniforms for the motorbike unit by changing the linen material to leather. Asaresult,the SA Municipal Workers Union (Samwu) has asked Joburg mayor Herman Mashaba and city manager Dr Ndivhoniswani Lukhwareni to fire Tembe. The union has also written a letter of complaint to Mashaba, Lukhwareni and the MMC for public safety Michael Sun urg- ing them to resuscitate the dis- ciplinar y proceedings against Tembe on charges he allegedly dodged when he resigned from the J MPD in 2011. The charges related to allega- tionsthat Tembedeviated from normal procurement process- es in the payment of R371,725t o a law firm, resulting in the city incurring unauthorised ex- penditure. "Tembe escaped this process through a resignation. It must be investigated whether he made full disclosur es about this misconduct during his in- terview for the post and the hearing into the matter should start in earnest as he is now back in the employ of the city," reads the complaint. But central to Samwu' s com- plaint were recent allegations that Tembe removed members of the Kg unit from the com- mand ofthe tactical directorate to his office and later ordered them to guard his house in Bramley 24hoursa day. This, the union claims, hap- pened without any threat or se- curity analysis conducted by independent bodies legally mandated by the SA constitu- tion suchas SAPS Crime Intel- ligence and the State Security Agency to ascer tain the exis- tenceof such threats. The union said the unit, David Tembe which was launched by Mashaba and Sun, was meant to fight the city's drugs scourge. "The chief of police is not en- titled to any such benefit by rea- son of his contract of employ- ment and as such, his conduct constitutes a gross act of abuse of power ...," wrote Samwu offi- cial Jack Mokalapa. Documents seen by Sunday World show that the Kg unit members started guarding Tembe's house on July 24 2018 until September 28 2018 and he wasther e on day one. Sunda y World hasalsoseena log book filled by the K9 unit members detailing all their op- erations at Tembe's house. The log book shows that the unit had four marked JMPD cars, two dogs trained to detect explosives and one hound that specialised in sniffing out drugs. Four officers, the log book shows, worked day shift andthe same number atnight. It also shows that the highly trained and specialised officers were on several occasions re- quired to open and close the gate for Tembe 'sgardener. It further shows that the offi- cers only left after a violent protest erupted in Westbury on September 28 2018 when they had to join their colleagues to quell the riots. City of Joburg spokesperson Nthatisi Modingoane said: "The city can confirm that a grievance was lodged and the matteris beingattended to. "To ensurethat this is done in a transparent manner, the city and employee representatives agreed that the hearing be con- ducted by an independent chairperson. While the city cannot traverse the full merits ofthe grievance, the pre- sent allegations are to be fur- ther investigated as part of the ongoing process." Tembe said: "I did not in- struct anyone to guard and pa- trol my house. If they say I did that they must show you my in- struction in writing, and if there's nothing like that, then I have nothing to say toyou." Sunda y World has alsolearnt that the chair of the grievance hearing against Tembe with- drew from the process citing that he was not getting support and cooperation from the City. In aletterdated April 23 2019, Sandile July of Werksmans At- torneys informed all the parties involved of his decision to with- draw fromthe hearing.
