Subject: Report of the Special Recognition Committee – Meeting of March 24, 2017

Recommendation: THAT the report of the Special Recognition Committee with respect to its meeting held March 24, 2017 be received for information,

And THAT the recommendation of the GRCA Special Recognition Committee to name a new

seating area at the Guelph Rotary Forest Clare’s Lookout, and name a classroom at the Apps’

Mill Nature Centre The SCJ Nature Education Room, and name the property at the south end of

Main Street in Grand Valley be named Hereward Women’s Institute Park, be approved.

Summary: Not applicable.

Report: The Special Recognition Committee comprised of members of the Grand River Conservation Authority (GRCA) and the Grand River Conservation Foundation (GRCF) met on March 24, 2017 to review and discuss the nominees for Grand River Conservation Foundation Community Conservation Grants.

The Committee recommended that the following applicants receive Grand River Conservation Foundation Community Conservation Grants:

The recommendation for Community Conservation grants was presented to the members of the Grand River Conservation Foundation and approved at its meeting on April 19, 2017. The GRCA Special Recognition Committee also reviewed reports regarding designations and renaming of three items. The Committee recommended that a new seating area at the Guelph Rotary Forest be named Clare’s Lookout, and that a classroom at the Apps’ Mill Nature Centre be named The SCJ Nature Education Room, and that the property at the south end of Main Street in Grand Valley be named Hereward Women’s Institute Park.

Recommendation:

That Report GM-04-17-46 - Chief Administration Officer’s Report be received as information.

Report:

This report provides a brief overview of current activities. It covers programs and activities that are

not included in monthly reports.

1. Queens Park Day: On April 4 Conservation Ontario hosted a reception for Members of Provincial

Parliament (MPPs) at Queens Park. It was an opportunity to provide the MPPs with an overview of

Conservation Authority programs, and highlight the importance of our partnership with the

province. The event was attended by 13 Ministers, 24 MPPs, 28 Conservation Authorities, plus

Conservation Ontario staff, Deputy Ministers, Assistant Deputy Ministers, Environmental

Commissioner staff, Mining and Lands Commissioner staff and Ministers’ staff. Vice-Chair Chris

White, and I attended on behalf of GRCA.

2. Annual Tree Sale: The annual tree sale takes place at the forestry barn at GRCA Head Office.

Typically trees range from eight to 12 inch seedlings, to two or three foot potted trees, to five to

seven foot saplings. In addition to of many species of trees, the sale includes native wildflower mix

and wildflower plugs. Cancelled orders, trees not picked up and nursery overruns are part of this

annual sale. The sale is first come, first served and line ups start early.

3. Grand River Parks: Monday, May 1 at 9 a.m. is the official opening of the 2017 camping and

recreational season at Grand River Parks. Parks Canada is providing free day passes to the

National Parks to celebrate Canada’s 150th Anniversary. These passes are not valid at GRCA parks

and this has caused some confusion with the park patrons. Communications staff are developing a

strategy to spread the message that GRCA Parks are not National Parks, and our normal admission

fees are in effect.

4. Coming events: Spring is a busy time for tree planting and there are several opportunities to

participate in events across the watershed. The GRCA website lists several upcoming events. All

are welcome and board members are encouraged to attend. Full descriptions of the events are

included on the website, but the following list provides an overview:

Rotary Forest Earth Week Tree Planting - Guelph Lake, Saturday, April 22, 2017 - 9:00 a.m. to

2:00 p.m. The GRCA will launch Canada 150 celebrations on Saturday, April 22, Earth Day, at

the Guelph Rotary Forest with the planting of a maple grove that will be shaped like a maple

leaf and will be visible from the sky. This is the 10th anniversary of the Guelph Rotary Forest

planting event at Guelph Lake Park.

6th Annual Brantford Community Tree Planting - Sunday, April 23, 2017 - 10:00 a.m. to 2:00

p.m. In celebration of Canada's 150th anniversary, come and plant a tree for future

generations. With the help of community members, the Brant Tree Coalition has planted over

73,000 trees at events. This year's event is at a new location. Meet at Kraemer's Way

(intersection of Oak Park Road and Hardy Road).

Brant County Community Tree Planting - Saturday, April 29, 2017 - 10:00 a.m. to 1:00 p.m. In

celebration of Canada's 150th anniversary, come and plant a tree for future generations at

Burford Lions Park (78 Maple Ave. N.). The planting is hosted by the CELP class from Paris

District High School.

Cache In Trash Out (CITO) at Pinehurst Lake Park - Sunday, April 30, 2017 - 9:00 a.m. to 2:00

p.m. Cache In Trash Out, also known at CITO, is an ongoing environmental initiative supported

by the worldwide geocaching community. These volunteer events help preserve the beauty of

local natural areas by cleaning them up. Local geocachers are hosting a CITO event at

Pinehurst Lake. Entry into the park is free.

Shimano Take A Kid Fishing Day at Belwood Lake - Saturday, May 6, 2017 - 8:30 a.m. to 4:00

p.m. The Shimano Take a Kid Fishing Day at Belwood Lake Park is designed to get new anglers

(children ages 8-14) involved in fishing, or to improve their skills. There will be a chance to visit

educational stations, learn how to cast, rig lures, tie flies, identify various fish species, try your

hand at the stocked trout pond.

Upper Grand Trailway Tree Plant - Saturday, May 6, 2017 - 10:00 a.m. to 12:00 p.m. Come to

the Grand Valley Trail on Saturday, 10 a.m. to noon, to help plant trees along the Upper Grand

Trailway. Planting starts at the trail entrance along County Road 25 in Grand Valley. Bring your

own shovel. The local Lion's Club will provide hot dogs and beverages after planting.

Dumfries Conservation Area Tree Plant - Saturday, May 6, 2017 - 10:00 a.m. to 12:00 p.m. This

family-friendly event at Dumfries Conservation Area in Cambridge offers participants the

chance to directly support their community in a local reforestation project, 10 a.m. to noon. It

takes place rain or shine and participants are asked to bring their own gardening gloves and a

lot of energy.

Celebrate Canada’s 150th Anniversary at Guelph Lake - Saturday, May 13, 2017 - 10:00 a.m. to

1:00 p.m. Help plant a new 800-tree forest at the future site of the new Guelph Lake Nature

Centre. Stay for an interpretive tour and an opportunity to learn more about the nature centre

that will attract 20,000 students and thousands of visitors each year as they engage in

environmental and active living programs.

5. Water Festivals: Three children’s water festivals are scheduled for the month of May. Each festival

features activity centres, with a focus on five themes: water science, water protection; water

technology; water conservation; and water attitudes. Board members are encouraged to attend.

Brantford-Brant Children's Water Festival is held from May 16-18 at Mohawk Park in

Brantford. The festival is for Grade 4 classes form schools in Brantford, Brant County, and Six

Nations of the Grand River.

Haldimand Children's Water Festival is held from May 24-25 at Taquanyah Conservation

Centre. This festival is for Grade 4 students from schools in Haldimand County, Six Nations of

the Grand River and Mississaugas of the New Credit.

Waterloo-Wellington Children's Groundwater Festival is held on May 26 and from May 29 -

June 1 at the Waterloo Region Museum. The festival is for primary school grade children in the

Region of Waterloo, Wellington County and the City of Guelph.

THAT the Financial Summary for the period ending March 31, 2017 be approved.

Summary:

The Financial Summary includes the 2017 actual income and expenditures. The budget approved at the February 24, 2017 General Meeting is included in the Budget column. The Current Forecast column will indicate an estimate of income and expenditures for the whole year. Any changes between the Current Forecast and the Previous Forecast will be discussed during the meeting. At this time a surplus of $NIL at year-end is anticipated.

Provincial funding for the Source Protection program (SPP) increased by $1,135,000 as a result of approval by the Ministry of Natural Sources (MNR) for the 2017/18 Source Protection Program budget.

Recommendation:

That Report GM-04-17-41 – General Insurance Renewal, 2017-2018, be received for information.

Summary:

Grand River Conservation Authority (GRCA) obtains general insurance as part of a group consisting of 34 Conservation Authorities and Conservation Ontario. The policies run from April 1 to March 31 each year. The policy terms, renewals, loss reviews, and other administrative matters are overseen by the Conservation Ontario General Insurance and Benefits Committee (Insurance Committee), which consists of 10 senior staff from Conservation Authorities (including GRCA) and the General Manager of Conservation Ontario. This committee reports to Conservation Ontario Council and in addition to carrying out a number of ongoing risk management activities, the committee reviews and approves renewal terms annually.

The Insurance Committee conducted a Request for Proposals for insurance brokerage services in 2013, which resulted in a five-year agreement with Marsh Canada Limited. This change resulted in a savings in broker compensation of approximately $500,000 over the five-year period.

The Insurance Committee met with Marsh on February 23, 2017 to review the proposed coverage and premiums for 2017-2018 and the committee approved the April 1, 2017 renewal as recommended by Marsh. A summary of GRCA’s 2017-2018 premiums is attached to this report.

Report:

The Conservation Ontario insurance group was formed in 1986 on the basis that obtaining coverage through a group rather than individually provides better value, allows sharing of administration costs and risk management experience/expertise, as well as helping to offset the impact of significant claims that may arise at one Authority. GRCA was one of the founding members of the group. AON Reed Stenhouse Inc. was the broker from 1986 until 2014. The broker went to market for competitive bids from insurers on a regular basis and a number of different carriers have been used over the years as a result of this marketing.

After Marsh was appointed in 2014, they requested competitive bids from insurers and negotiated a very favourable renewal. Another favourable renewal took place in the second year (2015-2016) with only one carrier changed, to improve the terms of the coverage. This year, due to excellent loss experience for the group, Marsh successfully negotiated renewal of all policies with the incumbent insurers, with no increase in rates.

Following, is a list of the policies, with carriers noted, and a brief description of the coverage provided:

Commercial General Liability (QBE)

The Commercial General Liability (CGL) policy is the first source of coverage for bodily injury and third party property damage. The primary limit is $1 million per occurrence (with no general aggregate) and there is umbrella insurance for settlements that exceed that amount (see below). This policy also covers third party property damage which is the result of Sudden and Accidental Pollution. There is a $5,000 deductible.

Umbrella Liability (QBE)

The umbrella policy provides a limit of $14 million in excess of the primary liability, errors and omissions and automobile coverage. This is a dedicated limit per Authority and there is a $10,000 self-insured retention.

Property (QBE)

The property insurance policy is for all risks including flood and earthquake, subject to the policy exclusions. It also covers first party pollution cleanup of $250,000 (aggregate) per Authority and debris removal (sub-limit of $100,000 with a $25,000 deductible). GRCA’s insured property values are approximately $54 million. There is a $10,000 deductible for most occurrences.

Errors and Omissions (QBE)

This coverage is for damages resulting from negligence in provision of certain professional services, including engineering and the issuance of permits or preparation of maps, plans and surveys. The primary limit under this policy is $1 million per occurrence, with an annual aggregate of $10 million for the group. There is a deductible of $25,000 (indemnity only).

Directors and Officers Liability (Chubb)

This covers Directors and Officers for any claims that may result from wrongful acts while directing the affairs of the Conservation Authority, the Source Protection Authority and the Foundation. At the present time, the Source Protection Committee is also covered under this policy at no additional charge. There is a limit of $3 million per occurrence, with an annual aggregate limit of $5 million per Authority in the group. Defence costs are covered in excess of the limit of liability. There is no deductible.

Automobile (QBE)

This insurance is for all licensed vehicles in the motor pool with a premium of approximately $400-$500 per vehicle (depending on type of vehicle), based on a $1,000 deductible. The limit of liability under this policy is $1 million and the umbrella coverage also applies. GRCA’s actual premium is adjusted during the year based on actual number of vehicles in the fleet.

Equipment Breakdown (QBE)

This policy covers property damage and losses resulting from sudden breakdown of equipment such as boilers, compressors, air conditioning equipment, motors, transformers etc. There is a limit of $25 million per accident, with a range of deductibles depending on the type of damage.

Crime (QBE)

This policy covers such acts as theft, employee dishonesty, counterfeit paper currency etc. with a range of limits between $10,000 and $150,000, depending on the type of crime. The deductible is $500.

Financial implications:

Total General Insurance premiums for the group are approximately $2.8 million (before tax) for the 2017-2018 term. All policies were renewed with the incumbent insurers on an “as is” basis (no change in rates).

Since the policies are purchased at the group level, a number of formulas are used to allocate the premiums to the 34 Conservation Authorities. The formulas are designed to measure the relative exposures at the individual Conservation Authorities. Due to changes in the statistics used (number of visitors, swimming areas, campsites, trails, Nature Centre classes, etc.) the portion allocated to an individual Conservation Authority can vary year-over-year. A major review of the allocation model in 2016 term has resulted in savings of approximately $53,000 for GRCA. In addition, the elimination of insurance on buildings demolished or scheduled for demolition has resulted savings of approximately $12,000. In total, GRCA’s insurance expense will decrease by $65,000 or 17% in the 2017-2018 term. A portion of this savings will be used to purchase new policies for emerging exposures relating to Cyber Extortion (premiums to be finalized in coming months). The need for this project was identified in 2002 in the Water Master Servicing Plan for the Lynden Rural Settlement Area.

The study was completed as a Schedule C Class Environmental Assessment. Consultation was carried out with the public and government review agencies through written correspondence and two Public Information Centres.

The preferred location for the new pumping station and reservoir do not contain any features of interest to the GRCA.

Grand River Conservation Authority

Recommendation: THAT report GM-04-17-42 – Hidden Quarry is received for information.

Summary: The Grand River Conservation Authority (GRCA) General Membership passed the following resolution at the January 27, 2017 meeting:

“THAT GRCA staff review the new application by James Dick Construction Ltd. for the Hidden Quarry including all potential impacts of the proposal on the environment, including ground water flow and source water protection impacts and report back to the Board.”

GRCA staff have reviewed the new application for Hidden Quarry and have concerns with the groundwater modelling that has been completed by the applicant’s consultant. Staff provided comments to the municipality, Ministry of Natural Resources and Forestry (MNRF), and County of Wellington recommending that consideration of the quarry be deferred until additional groundwater analysis and any subsequent ecological impact analysis deemed necessary has been completed.

Report: The proposed quarry is located in the Township of Guelph/Eramosa on a 39.4 hectare property at the northeast corner of 6th Concession Road and Highway 7, two kilometres east of Rockwood and 4.5 kilometres west of Acton. Highway 7 represents the municipal boundary between the Township of Guelph/Eramosa and the Town of Milton. Applications to amend the County of Wellington Official Plan and Township of Guelph/Eramosa Zoning By-law have been submitted in order to designate the property Mineral Aggregate Area to permit the establishment of a mineral aggregate operation (pit/quarry). The area proposed to be extracted is approximately 24.9ha. The owner has also applied to the MNRF for a Class A – Category 2 license for below water table extraction without dewatering. Aggregate license applications are subject to the approval of the MNRF. The County of Wellington and Township of Guelph/Eramosa have requested that the GRCA review these applications in accordance with the GRCA’s Memorandum of Understanding (MOU) with the County of Wellington for Plan Review services. GRCA staff have completed their review and have provided technical review comments to the County in an advisory capacity in

accordance with the MOU. GRCA’s commenting role under the MOU for Plan Review services does not include reviewing and commenting on Source Water Protection, which rests with the municipality; however, as directed by the GRCA General Membership, staff have reviewed the applications under the Source Water Protection policies and offer comments in this report.

GRCA Plan Review Comments - Concerning wetland and watercourse impacts

A Level I and II Hydrogeological Investigation has been prepared by the applicant’s consultants in accordance with the Provincial Standards for aggregate applications. As part of the Hydrogeological Investigation, a groundwater model was developed for the proposed quarry to characterize the groundwater system, analyze the potential for impacts on the groundwater system based on the proposed extraction depth, and then evaluate the effect of the operation on the wetlands and watercourses. The investigation assumes there is little to no connection between the overburden groundwater levels and the bedrock groundwater system in the area for the proposed quarry; this statement leads to the conclusion that the wetlands and watercourses are perched above the bedrock groundwater system and will not be affected by the quarry operations.

Based on the review of new information included in the technical reports with these new applications, staff have several questions concerning the assumptions made in the consultant’s modelling that require a revised groundwater analysis. The revised analysis may lead to a different characterization of the groundwater system or prediction of groundwater impacts. A reassessment of ecological impacts to the wetlands and watercourses would be required in the event that the revised analysis shows a difference from previous assumptions and conclusions.

In light of the above, GRCA staff have requested that the MNRF, County and Township defer consideration of the applications until additional groundwater analysis has been completed by the applicant.

Staff are suggesting that the applicant’s consultant undertake additional groundwater analysis that includes the following steps:

Complete field investigations to evaluate the source of water in the DeGrandis pond/wetland prior to license approval (i.e., overburden or bedrock source)

Revise the groundwater model to include overburden deposits and results of the above field investigation. The overburden has not been included in the consultant’s model and the characterization of the system may be oversimplified.

Calibrate the model to groundwater and surface water base flows. The current model is only calibrated to groundwater levels.

Complete a sensitivity analysis and run the model transiently

Compare the model to the Guelph/Guelph-Eramosa Tier 3 groundwater model to evaluate regional groundwater flow and modelling parameters.

Using the revised model, develop scenarios to evaluate pre-, during, and post-extraction impacts to the wetlands and watercourses.

An updated ecological analysis may be required if the revised modelling results demonstrate potential impacts on the wetlands and watercourses.

Following the above, staff are recommending that the applicant provides an integrated, comprehensive monitoring and contingency plan containing all trigger levels, supporting information and hydrographs. Thus far, the monitoring program and contingencies plans have

not been consolidated and methological details remain outstanding. Staff are also recommending that the surface water monitoring program be enhanced and continuous data collected on stream flow rates, elevations, and temperatures in Tributary B and in the Brydson Spring downstream of Hwy 7.

To assess source water protection impacts and applicable source protection policies, it is necessary to determine if the quarry site is located within a Wellhead Protection Area (WHPA) or Intake Protection Zone (IPZ) developed as part of the Source Protection Program under the Clean Water Act, 2006. In 2006, WHPAs were developed for the Township of Guelph/Eramosa for the purpose of identifying and protecting the municipal wells from groundwater quality related land-use activities. The location of the Hidden Quarry property was compared to the existing quality WHPAs, and as the property is located outside the WHPAs, no source protection policies are applicable to the property. It is important to note that aggregate extraction per se is not considered a drinking water threat under the Source Protection Program.

A Tier 3 Water Budget Study and Local Area Risk Assessment have recently been completed for the City of Guelph and Township of Guelph-Eramosa through the Source Protection Program. The report and study results were presented to the Lake Erie Source Protection Region on April 6, 2017 and are available at www.sourcewater.ca/GGET-Tier3. The Tier 3 study is a major piece of technical work addressing the water quantity component of the Grand River Source Protection Plan. The Tier 3 study will help guide the development of water quantity source protection policies.

Similar to the quality-related WHPAs developed in 2006, the Tier 3 study groundwater model has created quantity-related WHPA-Qs using a groundwater model that encompasses the City of Guelph and Township of Guelph/Eramosa municipal wells. The goal of quantity WHPA-Qs is to identify areas around the municipal wells where other water takings and development activities reducing groundwater recharge may pose a risk to the quantity of the municipal supply. The location of the proposed quarry is outside of any WHPA-Qs.

The Tier 3 study also created a surface water quantity Intake Protection Zone or IPZ-Q, for the catchment area upstream of the surface water intake on the Eramosa River that supplies water to the Arkell Artificial Recharge/Glen Collector system. The next step in the Tier 3 project is to assess the impact of significant water taking and activities that reduce groundwater recharge in the catchment area on the municipal systems. Although the proposed quarry is located within the IPZ-Q, water taking is not proposed with the quarry application.

Precipitation

Precipitation in April has been above average throughout the watershed. Recorded precipitation to date is near or above the totals normally seen by the end of the month. The southern part of the watershed has been a bit drier with the Brantford climate station only recording about 40mm. Most of the precipitation fell during the first week of April, including one day of snow.

March was also a wet month with the entire watershed recording well above the normal precipitation for the month. Precipitation in March was split between rain and snow, but with fluctuating temperatures the snow melted quickly. Overall precipitation over the last six months has been above normal, showing a good recovery from the prolonged dry period in 2016.

Monthly precipitation at the Shand Dam and Brantford climate stations from 2012 to 2017 are shown in Figures 1 and 2. Table 1 includes monthly and recent precipitation trends for watershed climate stations.

Air Temperatures

Temperatures in April to date have been fairly warm. The average air temperature in the first half of April was 6.9 degrees at the Shand Dam climate station, which is about 3.6 degrees warmer than normal for this time of year.

March temperatures were near normal with an average temperature of -2.1 degrees. February also had an average temperature of -2.1 degrees. On the whole, the winter season was warmer than the long term average. With the exception of April last year, average air temperatures have been above the long term average since the summer of 2015.

Figure 3 presents recent mean monthly air temperature departures from normal recorded at Shand Dam.

Lake Erie Conditions

The level of Lake Erie continues to be well above the long term average. The average lake level for the first half of April is approximately 0.3m above the long term average, but it is slightly lower than this time last year. Forecast water levels for Lake Erie from April 1st, show that the lake level may slightly surpass the high levels observed in 2016.

Figure 4 presents current and forecast Lake Erie level from the Canadian Hydrographic Service.

Reservoir Conditions

Water levels in the four large reservoirs are within the normal operating ranges. Shand, Conestogo and Guelph reservoirs are near the upper part of the normal range and water levels are expected to meet the May 1st target on schedule. Water levels in the Luther reservoir are within the normal range for this time of the year. The Woolwich reservoir is also within its normal operating range and many of the smaller reservoirs have been filled to their summer levels.

The reservoirs are operated very carefully at this time of year due to reduced flood storage. Water will continue to be taken into storage over the month of May if it is available. Augmentation of river flows from the reservoirs normally begins in June, but the last few years have been dry during May and augmentation began early.

Reservoir levels for 2017 are shown in Figures 5 and 6 for Shand Dam, Conestogo Dam, Guelph Dam, and Luther Dam.

Long Range Outlook

Environment Canada’s seasonal forecast is predicting above normal temperatures for most of Canada for the next 3 months including April. Their seasonal precipitation forecast is predicting near normal precipitation for Southern Ontario, including the Grand River watershed, for the April to June period.

Flood Operations Centre Activities

There was one flood message issued in April. A Watershed Conditions Statement: Water Safety message was issued on April 6th after a watershed wide rainfall event that resulted in high flows in water courses throughout the watershed. No flooding was observed during this period, although some low lying areas were inundated.

Flood Preparedness

Conditions are being monitored closely. Staff continue to hold weekly Senior Operator meetings as part of overall succession planning initiatives and flood emergency preparedness

Spring inspections of all GRCA owned water control structures have begun and will continue over the next two months.

Luther Dam Operating Curves

Luther Dam primarily provides a flow augmentation function to the upper Grand River and to Shand Dam. While it does provide some benefits from a flood control perspective, these benefits are limited due to the small drainage area regulated by Luther Dam.

The buffers between March 1st and September 30th define the operating range to meet downstream low flow targets. The lower buffer defines the lowest operating range for flow augmentation before reducing downstream flow augmentation targets. The earlier winter (January 1st to March 1st) and late fall (October 1st to December 31st) upper buffer curve is defined from ecologic considerations from the Luther Marsh Master Plan. The upper operating limit defines the maximum operating level from a dam safety perspective.
