Legal Conditions Native Forest Harvesting in accordance with IFOA conditions.

The plantation area in compartment 1 is Authorised as a Timber Plantation, under the Plantations and Reafforestation Act 1999 (Registered Number CH1702P). Authorisation was granted in accordance with the Plantations and Reafforestation (Code) Regulation 2001. In the plantation, the operation must comply with: • Licence Conditions issued by Forests NSW under the Forestry Act (1916). • Forests NSW, Forest Practices Code - Part 1 Timber Harvesting in Forests

NSW Plantations November 2005. (Referred to as FPC). • Forests NSW, Forest Practices Code Part 4 Forest Roads and Fire Trails

(1999). • The Plantations and Reafforestation Act 2001. • Plantations and Reafforestation (Code) Regulation 2001 (referred to as the

PRA Code). • Part 7 (Div. 3) Fisheries Management Act (1994) as amended May 2003.

To implement this plan, you must hold a current Contractors Licence.

Standard Harvest Plan Conditions and Operating Procedures apply.

Area available for harvest is net harvest area less slopes over 30. Expected harvest area is Area available for harvest less inaccessible / pre-merchantable areas/ non-commercial areas. Contractor must ensure timber removed is allocated to the correct compartment when entered into Electronic Delivery Docket.

2. Management Conditions on Boundaries Boundary Conditions

Private Property The northern and north-eastern boundaries of these compartments adjoin private property. These PP boundaries needs to be located and marked by the FT. If the boundary is unclear in the field, contact the harvest planner for neighbour contact details such that agreed boundaries can be determined

Plantation Access Access to the plantation is only by 1.2 Trail off the “Old Pacific Highway” and Bedes Corner Trail to Upper Smiths Creek Road. Other forest trails that join with Upper Smiths Creek Road are not to be used as the adjoining neighbours have not agreed to FCNSW access.

Visual & noise Buffer There is a 25m visual and noise buffer adjacent to the private property dwelling. This buffer extends from the boundary fence and includes the road.

Neighbourhood Noise There are EPA regulations that relate to noise control when operating machinery within 100m from residential establishments.

Boundary Conditions

Dumps 1, 7 and 10 are adjacent to private property and there is potential for noise associated with timber harvest and haulage to affect residential areas that occur within 100m of the active operation.

Restrictions on forest operations will apply per the EPA regulations on neighbourhood noise.

• If working within 100m of a residential establishment, machinery (including chainsaws) operating hours will be limited to between 7am and 8pm Monday to Saturday, and 8am to 8pm on Sundays and Public Holidays.

• Timber haulage trucks may enter or exit the site between 7am and 8pm Monday to Friday, and 8am to 8pm on Weekends and Public Holidays.

The HC will monitor noise and dust resulting from the operation and take the appropriate action to minimise the effect on surrounding property owners.

SMZ / FMZ FMZ 3A – Harvesting Exclusion – Rock, Rainforest & Old Growth.

FMZ 3B – Visual protection – to be treated as FMZ 4,

FMZ 4 - General Management – available for harvest.

FMZ 5 – Hardwood Plantations

Regrowth/Non-regrowth zones

These compartments are entirely within the Regrowth zone. Tree retention conditions under the TSL (see flora & fauna section).

Cultural Heritage Surveys have been conducted and ACHO in consultation with local Aboriginal community representative. If any potential sites identified during harvesting a 20m interim exclusion is to be applied. Notify the Regional ACHO immediately such that final protection measure can be determined.

Modified Harvest Area Modified harvest areas have been located within this planning unit. A total harvest exclusion applies; existing trails and roads can be used for haulage if they traverse through these exclusions. HC to check that these sites are adequately marked immediately prior to harvesting commencing in the vicinity.

4. Haulage Haulage Route Signage and Conditions

Upper Smiths Creek Road – 40km/h speed limit for all log trucks – Road is narrow with limited line of sight – HC to erect 40km/h signage.

Exits onto Old Pacific Highway from Dumps 2, 3 and 14 – HC to erect trucks entering signage on both sides of these access roads.

Haul Route Haulage will be via 2 access routes.

North & East of compartments will be via internal forest roads to Bedes Corner Road to Upper Smiths Creek road and then Pacific Highway.

Western area of compartments is via Bill’s Road Cooperabung Range Rd (gravel) and Cooperabung Drive (bitumen).

Access to highway as per attached Kunderbung to Kempsey map.

School Bus Routes Haulage contractor must apply Rural Road Safety Strategy Communication protocol.

Traffic Control Numerous trails within this unit are used by the general public to gain access into the State Forest. It is the responsibility of the harvesting crew to provide and implement a traffic management plan that will ensure the safety of all road users whilst harvesting within 2 tree lengths of these trails.

5. Community Issue Detail Conditions

Notifications Required Neighbours All relevant notifications have been conducted. A notification list for FCNSW staff is available from the planning folder.

Neighbours Neighbours have been notified during planning. HC should endeavor to contact neighbours (where they occur within 250m of active operations) prior to operations commencing to inform of likely duration of harvest , boundary marking and other general enquiry. Contact Planner for details as required.

Forest Permits Apiary Permitted apiarists have been notified of the planned operation. Any subsequent feedback to the Planner that impacts operations will be advised to the RC and/or HC.

Forest Permits The Tourism & Partnerships team maintain an events calendar, covering all permitted events on State Forest, as well as others that they get notified about, but don’t require a permit. Event details, including contacts are available if you click on the event.

6. Infrastructure Infrastructure Conditions

Boundary Fences If a fence is damaged due to harvesting, then the contractor will repair as soon as possible. No harvesting debris within 5m’s of boundary fences and all roads on boundaries must be left in a drivable condition.

Infrastructure Conditions

Elite/Plus Trees There are elite / plus trees in compartment 1 plantation area and these are to be retained and protected. Harvesting debris should not accumulate within 5 m of Plus trees. Where debris does accumulate, the crew must remove it or flatten to < 1m high.

Gravel Pits No gravel pits within compartments.

Mapped Trails All mapped trails are to be left in a drivable condition post-harvest to facilitate forest maintenance and fire suppression.

The entire native forest areas of net harvest area will be treated with light to medium STS.

The objective is to harvest the merchantable component of the mature aged crop and retain the vigorous younger age class trees. FTs to mark growers for retention where operationally appropriate.

Crew to remove all merchantable stems not marked for retention and ensure mechanical disturbance creates a suitable seed bed for regeneration.

Retain a canopy cover of greater than 50%.

The crew must avoid damage to areas of advanced regeneration/pre-merchantable stems where possible to minimise damage to retained trees.

Pre/Non - merchantable Areas

Throughout the compartment there are pre/non - merchantable areas that will be identified by the FT’s. HC to liaise with FT’s on identifying these areas which will be excluded from harvesting.

Monitoring Planning assumptions have been with respect to current market availability of timber products (e.g. greatly reduced market for wood chip material). As such BA removal has only been planned to reach a maximum of 25 % when measured across the NHA of this compartment (refer IFOA limit table below).

As market conditions may change, the HC must conduct Basal Area monitoring in areas treated with STS Light.

HC is to monitor BA retention during harvesting using BA post-harvest sweeps, randomly located across different stand types to ensure average BA is maintained as per the planned assumptions made in the table below.

Evidence of BA monitoring and the approximate plot location must be documented by HC. Ideally, monitoring of BA should occur prior to leaving each dump to ensure any variance to planned outcomes can be rectified.

Wet Weather Controls Condition 14 of the FPC describes a comprehensive list of wet weather controls that apply to this operation. Hauling is prohibited over any road during wet weather if resulting rutting is likely to be more than 150 millimetres deep for any distance exceeding 20 metre’s (FPC 14.5).

Tracks, Dumps and Roads

Extraction Tracks All extraction tracks must be drained, maintained and managed in accordance with Division 2 of the PRA Code and Conditions 6 and 9 of the FPC:

• Wherever practicable, walkover extraction techniques are to be used in preference to snig track construction.

• Snig track drainage must be located and constructed to ensure that water flow or potential water flow does not occur on snig track or extraction track surfaces for distances exceeding those given in 9.2 of the FPC.

• Constructed snig track cross-banks must have a minimum effective unconsolidated height of 35 cm or consolidated height of 25 cm.

• If downhill snig tracks connect to a dump, tracks must enter the dump from the side, or a drainage cross-bank above where the track enters the dump must be constructed at the end of each day.

Log Dumps All logs dumps must be managed as per Condition 14, 17 of the FPC and 60-61, 64 of the PRA Code. • Field location of log dumps must utilise the most level site available,

consistent with the location indicated on the Operational Map. It is permissible for the Harvesting Coordinator to move the location up to 200m from the indicated position to achieve this provided the new location is within the plantation area.

• Dumps must not be located in any buffer zone. • Runoff from log dumps must not be discharged into drainage features or

extraction tracks and must be dispersed onto stable surfaces. • Dumps must be re-shaped, drained and, where it is considered that

slash/debris cover and natural revegetation will not stabilise the surface, the dump must be enrichment planted or grass seeded.

• Excavators and truck mounted loaders may be used as stationery loaders when there is runoff from log dump surface. All other machinery must remain stationary when there is run-off from the dump surface. This condition does not apply to gravelled dumps (FPC 14.2.4 and PRA 64C)

• Bark and logging debris must not be stacked against retained trees. Following completion of logging on a log dump, bark and logging debris must be stacked 5 metre’s away from the surrounding forest and

separated from other flammable material by mineral soil for a distance of 5 metre’s.

• Pushing bark around the dump with a blade is to be discouraged. Where bark has been pushed with the blade, the excavator must shake the soil out of the bark prior to the bark being added to the bark heap.

• Large amounts of bark should not be accumulated around the dump. Upon completion of each log dump, bark must be re-distributed throughout the surrounding harvest area. Bark piles must not exceed one grapple load or push of the blade (approx. 2 cubic metre’s) and be deposited no closer than two metre’s apart.

• Off cuts must be stacked separately, away from the bark heaps. Roads Roads must be managed as per conditions 18-20 of the FPC. • The HCC must ensure that roads in use are inspected twice weekly to ensure

pavement and drainage is maintained. • Blading off may only occur if it will cause no, or only minimal, damage to the

road surface and soil material must be re-spread as soon as practicable. • A section of road with a non-functioning culvert must be repaired within 72

hrs
